SummaryResumen
The Constitutional Chamber (Sala Constitucional) considered a claim concerning wastewater discharged from several homes and inadequate infrastructure to carry stormwater from the La Pavilla sector of Cipreses de Oreamuno, across route N.°30703 and into private property, creating flood and health risks. It considered that inspections confirmed the problem and that CONAVI and the Ministry of Health had not timely adopted the necessary measures. The Chamber partially granted the amparo application and ordered the immediate issuance of health orders and adoption, within six months, of a plan to channel and convey the water. Justice Garro Vargas dissented only on enforcement: she proposed placing it before the Enforcement Area of the Administrative Litigation and Civil Treasury Tribunal, citing the technical complexity of the orders and the monitoring tools available in that jurisdiction. Her proposal is dissenting and does not change the majority disposition described.

034735-26. FAILURE TO ADDRESS THE DISCHARGE OF WASTEWATER AND STORMWATER FROM THE LA PAVILLA SECTOR OF CIPRESES DE OREAMUNO IS ALLEGED. THE WATER CROSSES TRAVESÍA ROUTE NO. 30703 AND FLOWS INTO PRIVATE PROPERTY, CREATING A RISK OF FLOODING AND HARM TO PUBLIC HEALTH. IT IS FOUND THAT INSPECTIONS CONFIRMED THE DISCHARGE OF WASTEWATER FROM SEVERAL HOMES AND THE LACK OF ADEQUATE STORMWATER INFRASTRUCTURE, AND THAT CONAVI AND THE MINISTRY OF HEALTH DID NOT TIMELY ADOPT THE MEASURES NEEDED TO RESOLVE THE PROBLEM. THE AMPARO APPLICATION IS DECLARED PARTIALLY GRANTED. IT IS ORDERED THAT HEALTH ORDERS BE ISSUED IMMEDIATELY AND THAT A PLAN FOR CHANNELING AND CONVEYING THE WATER BE ADOPTED WITHIN SIX MONTHS. RGS09/2026 “(..:) Dissenting opinion of Justice Garro Vargas regarding enforcement of the judgment.
I dissent with respect to enforcement of the judgment, so that, pursuant to Art. 56 of the Law on Constitutional Jurisdiction (LJC), enforcement be assigned to the Enforcement Area of the Administrative Litigation and Civil Treasury Court.
Enforcement of the orders issued by the Constitutional Chamber (Sala Constitucional) is, in principle, to be supervised by that same jurisdiction. However, that provision establishes exceptions under which, as determined by this Court, enforcement of the judgment may be assigned to the administrative-litigation jurisdiction:
“Art. 56. Enforcement of judgments is the responsibility of the Constitutional Chamber, except with respect to the calculation and payment of compensation and pecuniary liabilities, or in other matters that the Chamber considers appropriate, in which case it shall be carried out through the administrative-litigation procedure for enforcement of judgments provided for in the law governing that jurisdiction.” (Emphasis not in the original.)
Recall that the draft law under consideration for the LJC originally provided as follows:
“Art. 56. Judgments favorable to the applicant shall be enforced through the administrative-litigation procedure for enforcement of judgments provided for in the law governing that jurisdiction.” (Emphasis not in the original.)
However, the text was amended by motion so that the provision would be consistent with the regulations in Art. 153 of the Political Constitution, but the following explanation was given:
“THE SECRETARY:
Motion No. 68 (32-19) by Deputy Chacón Jiménez:
“Article 57 (formerly 56): so that the text reads as follows: ‘enforcement of judgments is the responsibility of the Constitutional Chamber, except with respect to the calculation and payment of compensation or pecuniary liabilities, in other matters that the Chamber considers appropriate, in which case it shall be carried out through the administrative-litigation procedure for enforcement of judgments provided for in the law governing that jurisdiction.’ THE PRESIDENT:
Is the motion just read under discussion?
Doctor Piza Escalante:
There was a contradiction here with the general principle that it is the Courts that enforce their own judgments, and it sent all enforcement to the Administrative Litigation Jurisdiction; then the other articles that allowed the Chamber to enforce them were left up in the air.
Deputy Corrales Bolaños:
In that part it says: ‘or in other matters that the Chamber considers appropriate…,’ what is it referring to?
Doctor Piza Escalante:
The idea is that the Chamber, in the judgment-enforcement procedure, resolves what it considers to be within its remit. The rest is sent to the Administrative Litigation Jurisdiction.
THE SECRETARY:
Is the motion sufficiently discussed?
THE PRESIDENT:
Discussed. Approved (unanimously, five deputies present).” (sic). See the minutes approving the LJC. Emphasis not in the original.)
On the basis of the foregoing, it is clear that the LJC itself authorizes this Chamber to assess and decide whether it is necessary to refer all or some aspects relating to enforcement of the judgment to the administrative-litigation jurisdiction.
In this specific case, given the nature of the orders being issued by this Court, I consider it appropriate to assign the enforcement phase of the matter to the administrative-litigation jurisdiction. This is because the regulations governing this constitutional jurisdiction provide no suitable mechanisms for following up on the orders set out in this judgment, which involve highly complex technical matters.
By contrast, the provisions of the Administrative Litigation Procedure Code concerning enforcement (Art. 155 et seq.) offer clear advantages, such as the possibility of requesting schedules, imposing fines, establishing liability, supervising stages of compliance, etc. Therefore, pursuant to Art. 56 of the LJC, I consider that the enforcement phase should take place before the Enforcement Area of the Administrative Litigation and Civil Treasury Court, under the judgment enforcement rules of that Code.(…)”
