FAILURE TO ADDRESS THE DISCHARGE OF WASTEWATER AND STORMWATER ALLEGED It is alleged that no solution has been provided for the discharge of wastewater and stormwater from the La Pavilla sector of Cipreses de Oreamuno. The water crosses Travesía Route No. 30703 and empties onto private property, posing a risk of flooding and harm to public health. Inspections are considered to have confirmed the discharge of wastewater from several homes and the lack of adequate stormwater infrastructure, without CONAVI and the Ministry of Health having taken the necessary measures in a timely manner to resolve the problem. The amparo proceeding is partially granted. The authorities are ordered to issue sanitary orders immediately and adopt a plan for channeling and conveying the water within six months. RGS09/2026 “(…) The applicant states that they submitted a request to the respondent authorities to eliminate the drains from the property of [Name 006]., located on Travesía Route No. 30703 in Cipreses de Oreamuno, because they cause damage to the land and the residential development located south of the property, as a result of the wastewater and stormwater that pass through that property.

However, the applicant complains that CONAVI told them the request could not be granted because the legal framework requires adjacent landowners to receive and allow water from the road to flow through their properties and to keep the drains in perfect condition and free of obstructions, compounded by the fact that the other authorities continue not to cooperate in resolving the problem described. (…)” “(…) this Chamber determines that the authorities of CONAVI and the Oreamuno Health Area have failed to take the actions and conduct the proceedings aimed at carrying out the appropriate works to channel and convey the stormwater and wastewater, so that it does not flow through the area identified by the applicant. In the opinion of this Constitutional Tribunal, regardless of the actions that fall to each authority in this matter under its respective powers, the fact remains that, in the case under review, their inertia and lack of efficiency in promptly addressing the reported situation are evident. This constitutes a violation of the right to a prompt and duly completed procedure and creates a risk for the residents of the sector affected by the water discharge.

In view of the foregoing, the proper course is to grant the amparo proceeding only against these authorities, on the terms set out in the operative part of this judgment.

VII.Finally, with respect to the authorities of the Municipality of Oreamuno, the proper course is to dismiss the amparo proceeding, since, before it was filed, they forwarded the complaint concerning the alleged problem to the authority competent to resolve it, namely CONAVI, because the route is a national road. (…)”

SE ALEGA FALTA DE SOLUCIÓN A LA DESCARGA DE AGUAS RESIDUALES Y PLUVIALES PROVENIENTES DEL SECTOR LA PAVILLA DE CIPRESES DE OREAMUNO, QUE ATRAVIESAN LA RUTA DE TRAVESÍA N.°30703 Y DESEMBOCAN EN UNA PROPIEDAD PRIVADA, CON RIESGO DE INUNDACIÓN Y AFECTACIÓN SANITARIA. SE CONSIDERA QUE LAS INSPECCIONES CONFIRMARON LA DESCARGA DE AGUAS RESIDUALES DE VARIAS VIVIENDAS Y LA INEXISTENCIA DE INFRAESTRUCTURA PLUVIAL ADECUADA, SIN QUE EL CONAVI Y EL MINISTERIO DE SALUD HUBIERAN ADOPTADO OPORTUNAMENTE LAS MEDIDAS NECESARIAS PARA SOLUCIONAR LA PROBLEMÁTICA. SE DECLARA PARCIALMENTE CON LUGAR EL RECURSO. SE ORDENA EMITIR DE FORMA INMEDIATA LAS ÓRDENES SANITARIAS Y ADOPTAR UN PLAN DE CANALIZACIÓN Y CONDUCCIÓN DE LAS AGUAS, EN UN PLAZO DE SEIS MESES. RGS09/2026 “(…) La parte recurrente manifiesta que presentó ante las autoridades accionadas una solicitud para eliminar los desagües de la propiedad de [Nombre 006]., ubicada en la ruta de Travesía nro. 30703 en Cipreses de Oreamuno, debido a que provocan daños a los terrenos y el residencial, ubicado al costado sur de la propiedad, por las aguas residuales y pluviales que pasan a través de dicha finca; sin embargo, reclama que el CONAVI le indicó que la solicitud no resultaba atendible debido a que el marco legal obliga a los colindantes a recibir y dejar discurrir las aguas del camino y a mantener los desagües en perfecto estado y libres de obstáculos, con el agravante de que las otras autoridades siguen sin colaborar para la resolución de la problemática expuesta.

VII.Finalmente, en cuanto a las autoridades de la Municipalidad de Oreamuno lo procedente es desestimar el recurso, toda vez que, de previo a la interposición de este recurso, remitieron la denuncia formulada ante la autoridad competente para resolver la problemática alegada ante el CONAVI al tratarse de una ruta nacional. (…)”
