THE COURT HOLDS THAT THE FUNDAMENTAL RIGHT TO WATER DOES NOT REQUIRE AUTOMATIC GRANTING OF THE SERVICE WHEN TECHNICAL IMPEDIMENTS EXIST, BECAUSE THE PROPERTY IS OUTSIDE THE COVERAGE AREA OF AN AUTHORIZED OPERATOR, THE NEARBY PIPE IS A CONVEYANCE PIPELINE AND CANNOT FEASIBLY PROVIDE PERMANENT CONNECTIONS, AND LIMITATIONS ON WATER AVAILABILITY AND THE DISTRIBUTION NETWORK REMAIN. SE DECLARA SIN LUGAR EL RECURSO. RGS09/2026 “(…) no cuenta con servicio de suministro de agua potable, pese a que lo ha solicitado a la ASADA de Rivas. Cualquier discusión al respecto debe ser expuesta y resuelta sea ante la propia ASADA, el ICAA, o bien en la sede jurisdiccional de legalidad ordinaria que corresponda. (…)” “(…) Conclusión.
