Res. 33788-2026 Sala Constitucional · Sala Constitucional · 03/09/2026
OutcomeResultado
The amparo was granted as to the Municipality of Liberia concerning sidewalks and drainage, and as to the Health Area for failing to notify the sanitary report; the claims concerning the Office of the Comptroller General and another case file fell outside the scope of this proceeding.
SummaryResumen
The Constitutional Chamber (Sala Constitucional) granted the amparo against the Municipality of Liberia because it had not definitively resolved, within a reasonable time, the stormwater drainage problems, missing sidewalks along some stretches, and deterioration of other sidewalks near La Victoria School. Although the Municipality had carried out cleaning and clearing work, it had shown neither concrete measures nor a timetable for resolving these risks comprehensively. The Chamber also granted the claim against the Liberia Health Area because it had not notified the complainant of the conclusion of its sanitary inspection. According to the ruling’s heading, the Municipality was ordered to carry out the works within twelve months and the Health Area to notify the sanitary report within three days. The Chamber did not address the merits of the audit attributed to the Office of the Comptroller General of the Republic or the alleged failure to comply with an order in another case file; it stated that those matters should be raised through the appropriate procedures.

Accordingly, with respect to this aspect, the respondent Municipality gives no assurance that the situation will ultimately be addressed and resolved within a reasonable time. It is therefore established that at the site identified by the claimant there is a problem of missing sidewalks in some areas and deterioration of existing structures, which the respondent Municipality has not resolved and for which it has not provided a reasonable timeframe for definitive attention and resolution.

033788-26. MUNICIPALITY. THE LACK OF SAFE SIDEWALKS, DETERIORATION OF PEDESTRIAN INFRASTRUCTURE, AND DRAINAGE PROBLEMS AND STANDING WATER NEAR ESCUELA LA VICTORIA DE LIBERIA ARE REPORTED, AS IS THE FAILURE TO NOTIFY THE RESULT OF A HEALTH COMPLAINT. THE MUNICIPAL MEASURES DID NOT COMPREHENSIVELY ADDRESS THE RISKS TO SAFETY AND PUBLIC HEALTH, AND THE MINISTRY OF HEALTH FAILED TO COMMUNICATE THE CONCLUSION OF ITS INQUIRY. THE AMPARO APPLICATION IS GRANTED, AND THE MUNICIPALITY IS ORDERED TO CARRY OUT THE WORKS WITHIN TWELVE MONTHS AND TO NOTIFY THE HEALTH REPORT WITHIN THREE DAYS. VCG09/2026 “(…) IV.- THE SPECIFIC CASE. In this case, the claimant alleges omissions by the respondent authorities concerning the pedestrian infrastructure in the La Victoria neighborhood of Liberia. In that regard, he states: “The central purpose of this instrument is to establish before this Court the continuing existence of an absolute omission to provide a technical and material solution in Barrio La Victoria de Liberia (specifically, in the area bounded by the local school, Calle 11, and Avenidas 6, 8, and 10).” He details that there are stormwater infrastructure problems, collapsed drainage outlets, and a complete lack of safe sidewalks at that location, particularly near Escuela La Victoria.
He argues that the stormwater system receives flows from various businesses, causing water to overflow right at the school rather than follow its natural drainage route. He notes that the corners of Avenidas 8 and 10 and Calle 11 are subject to constant runoff accumulation, and that the standing water causes foul odors, creating a permanent source of contamination and a breeding ground for vectors that put the population at risk, especially the students at the school in question. He adds that for approximately 100 meters along the right side of Calle 11 (heading south), there are no sidewalks or curbs with gutters, and that on the left side the infrastructure is in ruins (with holes, cracks, and physical obstructions), also making access difficult as required by Law 7600. He explains that this situation forces students and people passing through the area to walk in the roadway, putting them at risk.
The case file establishes that the problems involving pedestrian infrastructure in “the area bounded by the local school, Calle 11, and Avenidas 6, 8, and 10” had been reported by the claimant at least since 2025. In January, February, and May 2026, the respondent municipality carried out sidewalk-cleaning work, removed invasive vegetation, cut down trees, and cleared areas that interfered with pedestrian traffic and surface water flow. Regarding the stormwater system, the respondent municipality states that “the conditions observed at some points in the area are associated mainly with external factors, such as the improper discharge of wastewater into the stormwater system and the accumulation of solid waste and sediment that affect its operation.” An integrated project to manage stormwater in the “Barrios del Sur de Liberia” was also initiated; however, work has not yet begun in Barrio La Victoria.
In official letter no. 0358-03-2026 of 23 March 2026, the Technical Road Management Unit of the respondent local government stated: “(…) regarding the partial absence of pedestrian and stormwater infrastructure along some sections of Calle 11 and Avenida 10, it is reiterated that Article 84 of the Municipal Code establishes that registered property owners have the primary obligation to build and maintain the sidewalks in front of their properties. Under that provision, the Municipality is responsible for inspecting and notifying the obligated owners and, if an omission is confirmed, considering the subsidiary execution of the necessary works, and subsequently recovering the cost by means of a fee or special contribution (…) In areas where there are no sidewalks, the cited Article 84 of the Municipal Code continues to place direct responsibility on property owners to build them in front of their properties.
In accordance with what was stated in the previous official letters, and in response to requests for reviews or additional studies at other points in the area, the Municipality will again issue the corresponding notices when new instances of noncompliance are identified. If noncompliance persists, and subject to budget availability, the necessary works may be carried out in accordance with the municipal budget for 2026 or scheduled in subsequent budgets (…)”. In official letter no. PUTGV-0860-06-2025, dated 22 June 2026, the Technical Road Management Unit of the respondent municipality stated: “the alleged absence of pedestrian infrastructure in front of Escuela La Victoria is asserted, when in fact the main frontage of that school is located at the intersection of Avenida 10 and Calle 15, an area with pedestrian infrastructure intended for students, teaching staff, and users generally. Likewise, although some sidewalk sections in nearby areas show varying degrees of deterioration and require maintenance, rehabilitation, or reconstruction, this does not mean that pedestrian infrastructure is entirely absent (…)”.
In official letter no. PUTGV-0860-06-2025, dated 22 June 2026, the Technical Road Management Unit of the respondent municipality detailed the following follow-up actions to be carried out: “1. Periodic maintenance of the stormwater system, including cleaning curbs and gutters, removing sediment, eliminating waste, and clearing drainage elements in the areas identified as priorities. 2. Technical follow-up inspections to verify the operation of the existing stormwater infrastructure and determine whether additional interventions are needed when technically appropriate. 3. Continued improvements to pedestrian infrastructure in accordance with the maintenance, rehabilitation, and reconstruction programs established in institutional planning and the current prioritization criteria. 4. Progressive implementation of the Integrated Stormwater Sanitation Project for Barrios del Sur, developed on the basis of technical studies commissioned by the Municipality and scheduled in stages according to budget availability and the construction sequence established in the project design. 5.
Interinstitutional coordination with the Ministry of Health, the Instituto Costarricense de Acueductos y Alcantarillados (AyA), and other competent entities to identify and address irregular discharges of wastewater and other situations that may affect the proper operation of stormwater systems. 6. Inspection of situations attributable to third parties, including improper disposal of solid waste and improper connections to the stormwater system, through the applicable administrative procedures.” On 24 March 2026, the claimant filed a complaint with the Liberia Health Area, concerning problems related to “water disposal (…) safety and hygiene conditions,” specifically “FROM ESCUELA VICTORIA, LOCATED IN FRONT OF AVENIDA 10, APPROXIMATELY 6 TO 8 METERS WEST, FROM THAT POINT DOWN SOUTH ALONG THE LEFT SIDE OF CALLE 11.” The Liberia Health Area issued health orders nos. 018-2026, 019-2026, 021-2026, 022-2026, 024-2026, and 025-2026 against the owners of several homes in the area.
Those orders provided: “Ensure the sanitary disposal of wastewater produced at the residence or establishment within the boundaries of the property, in order to prevent soil contamination, the creation of vector breeding grounds and disease, and air pollution through conditions that compromise its purity or quality.” The Liberia Health Area was notified of the order commencing this proceeding on 18 June 2026. On 19 June 2026, the Liberia Health Area conducted a follow-up inspection of the health orders issued, and report no. MS-DRRSCH-DARSL-ER-IT-0082-2026 of 22 June 2026 stated: “an on-site inspection confirmed that the wastewater and the respective treatment systems had been properly managed (…)”.
First, with respect to the Municipality of Liberia, intervention by this constitutional jurisdiction is necessary.
In this regard, although the respondent local government has carried out some work to address the problem reported by the person seeking protection (for example, cleaning sidewalks, removing invasive vegetation, cutting down trees, and clearing areas that interfered with pedestrian traffic and surface water flow), there is no evidence that the situation at issue has been resolved definitively and comprehensively.
In this regard, one of the reported problems in the area (“Barrio La Victoria de Liberia (specifically, in the area bounded by the local school, Calle 11, and Avenidas 6, 8, and 10)”) concerns the stormwater system, which, according to the claimant, causes water to overflow and accumulate at certain sites, resulting in contamination and risks to people. In that regard, the respondent authority does not deny that such conditions exist, since it reports: “the conditions observed at some points in the area are associated mainly with external factors, such as the improper discharge of wastewater into the stormwater system and the accumulation of solid waste and sediment that affect its operation.” It also explained that an integrated project to manage stormwater must be carried out. That project has already begun in other areas of the southern neighborhoods of Liberia, but not yet in Barrio La Victoria.
Accordingly, as regards this matter, the respondent municipality does not guarantee that the situation will ultimately be addressed and resolved within a reasonable period.
Moreover, concerning the lack of sidewalks and the infrastructure problems at the site in question, there is likewise no indication that the respondent municipality has taken steps to resolve the matter swiftly and effectively. First, note that, by official letter no. 0358-03-2026 of 23 March 2026, the Technical Road Management Unit of the respondent local government did not dispute the problem at issue, but merely stated: “regarding the partial absence of pedestrian and stormwater infrastructure along some sections of Calle 11 and Avenida 10, it is reiterated that Article 84 of the Municipal Code establishes that registered property owners have the primary obligation to build and maintain the sidewalks in front of their properties.
However, there is no evidence of concrete action either to inspect the property owners’ construction of sidewalks or to carry out the works in question directly.
Now, although later, in official letter no. PUTGV-0860-06-2025 of 22 June 2026, the Technical Road Management Unit of the respondent municipality stated that there is pedestrian infrastructure in front of Escuela La Victoria, it also acknowledged that “some sidewalk sections in nearby areas show varying degrees of deterioration and require maintenance, rehabilitation, or reconstruction.” Furthermore, no possible dates for a future intervention were specified.
Thus, it is established that at the site identified by the person seeking protection there is a problem involving a lack of sidewalks in some areas and deterioration of existing structures, which the respondent municipality has not resolved and for which it has not guaranteed a reasonable timeframe for definitive attention and resolution.
Accordingly, the amparo application is granted with respect to these matters and the Municipality of Liberia, on the terms set out in the operative part of this ruling.
V.On the other hand, concerning the Liberia Health Area, the Court finds that the complaint filed by the person seeking protection on 24 March 2026 was initially addressed; indeed, various health orders were issued against property owners in order to “Ensure the sanitary disposal of wastewater produced at the residence or establishment within the boundaries of the property, in order to prevent soil contamination, the creation of vector breeding grounds and disease, and air pollution through conditions that compromise its purity or quality.”
However, it was only in connection with the processing of this amparo proceeding that, on 19 June 2026, the respondent authority conducted an inspection to verify compliance with those orders and issued report no. DRRSCH-DARSL-ER-IT-0082-2026 of 22 June 2026, which specifically determined that the requirements had been met.
Now, although this Chamber is not responsible for reviewing the merits of the respondent authority’s decision or determining whether the administrative acts were ultimately complied with, this Chamber may intervene to guarantee minimum procedural requirements, such as effective notification to the amparo applicant of the conclusion reached in the summary inquiry. In that regard, the case file does not show that report no. DRRSCH-DARSL-ER-IT-0082-2026 of 22 June 2026 was formally notified to the person seeking protection in his capacity as complainant, so that he would be fully informed of the respondent authority’s conclusion regarding the matter at issue.
In light of the foregoing, this part of the amparo application is granted with respect to the Liberia Health Area, on the terms set out in the operative part of this ruling.
VI.In subsequent submissions, the person seeking protection also complains that the Contraloría General de la República (CGR) was not brought into the proceeding, since in his view there were “oversight omissions” due to alleged inaction in an external audit of the municipality. However, given the principal subject of this matter (the reported road infrastructure and health problem), the order commencing this proceeding requested reports only from the Municipality of Liberia and the Ministry of Health, as they are the bodies directly responsible for addressing this specific situation. If the person seeking protection considers that there has been any irregularity in an audit or oversight process by the CGR, he should go to the competent ordinary administrative or judicial forums, since that situation constitutes a dispute concerning ordinary legality which, as a general rule, falls outside the summary nature of this amparo proceeding.
On the other hand, the claimant refers to alleged noncompliance by the municipality with what was ordered in case file no. 23-024765-0007-CO; however, that matter concerns a dispute unrelated to the specific subject of this case. Therefore, if the person seeking protection so wishes, he must raise that particular allegation in case file no. 23-024765-0007-CO itself, so that the matter may be resolved through that enforcement process. 033788-26. MUNICIPALIDAD. SE DENUNCIA LA FALTA DE ACERAS SEGURAS, EL DETERIORO DE LA INFRAESTRUCTURA PEATONAL Y LOS PROBLEMAS DE DRENAJE Y AGUAS ESTANCADAS EN LAS INMEDIACIONES DE LA ESCUELA LA VICTORIA DE LIBERIA, ASÍ COMO LA FALTA DE NOTIFICACIÓN DEL RESULTADO DE UNA DENUNCIA SANITARIA. LAS MEDIDAS MUNICIPALES NO SOLUCIONARON INTEGRALMENTE LOS RIESGOS PARA LA SEGURIDAD Y SALUBRIDAD, Y EL MINISTERIO DE SALUD OMITIÓ COMUNICAR LA CONCLUSIÓN DE SUS DILIGENCIAS. SE DECLARA CON LUGAR Y SE ORDENA EJECUTAR LAS OBRAS EN DOCE MESES Y NOTIFICAR EL INFORME SANITARIO EN TRES DÍAS. VCG09/2026 “(…)
