033995-26. PUBLIC SERVICES. IT IS ALLEGED THAT THE COMMUNITY OF ASAYNE IN SANTA TERESITA DE ASERRÍ WENT FIVE DAYS WITHOUT POTABLE WATER AND WITHOUT AN ALTERNATIVE SUPPLY, EVEN THOUGH MINORS, OLDER ADULTS, AND PERSONS WITH DISABILITIES LIVE IN THE AREA. No continuous suspension or abandonment of the service was established, since the rationing was partial, scheduled, and caused by an extreme drought, while the Municipality distributed water by tanker trucks and carried out projects to improve the water system. THE AMPARO APPLICATION IS DECLARED WITHOUT MERIT. VCG09/2026 “(…) III.- REGARDING THE SHORTAGE OF POTABLE WATER DURING THE DRY SEASON. As for this problem, which currently affects many communities throughout the national territory, this Chamber, by Judgment No. 2019-007183 of 9:20 a.m. on 26 April 2019, considered the following:

“(…) III.- THE SPECIFIC CASE. Although it is true that this Court has recognized in repeated rulings that access to potable water is a constitutional right derived from the rights to health, life, a healthy environment, food, and decent housing, among others, it is also true that multiple problems involving shortages of this vital resource currently arise during the dry season (see, to the same effect, judgments No. 2009-12511 of 17:59 on 11 August 2009, No. 2010-015448 of 12:15 on 17 September 2010, No. 2014-004918 of 14:30 on 9 April 2014, No. 2017-006082 of 09:45 on 28 April 2017, and No. 2016-007550 of 09:05 on 3 June 2016). In this regard, the State’s responsibility is to implement the necessary and optimal measures to provide an effective solution to these problems. From this perspective, the record establishes that water cuts have occurred in the area identified by the applicant in recent months, as the respondent authority acknowledges and describes in detail.

However, it was established that the suspensions reported by users of the service did not result from negligence or arbitrariness on the part of the respondent Institute, but rather from a general shortage affecting all systems during the dry season. In this regard, it was established that the respondent authority had announced through various means that water rationing would take place during this season because of the shortfall caused by reduced flows supplying the intake tanks and increased water consumption. Specifically, Zapote belongs to the San José Operations Zone, which is supplied by water stored in the Curridabat Tanks, which receive water from the Tres Ríos System. The record shows that, under normal production conditions, the Curridabat Tanks begin the day at 85% storage capacity; however, current levels have reached 20% of their capacity, making the area prone to shortages.

These occur when population demand exceeds available storage and vary depending on population demand, current production, the level in the storage tank, the service’s topographic elevation, the distance from the service to the distribution point, the elevation of the area, and so forth. Zapote is one of the highest areas, so the impact of the water shortage is greater; this impact occurs only during the dry season and not continuously throughout the year. Shortages normally begin at around 10:00 a.m., and the system begins to recover at around 11:00 p.m. This problem is mitigated by distributing water by tanker trucks to vulnerable population centers. The respondents indicated that they had carried out work to reinforce the system and benefit communities in the highest sectors. They had also made interconnections in the La Pacífica area to transfer that sector to another operations zone and shorten the area covered by the Curridabat Tanks.

The area supplied by the Cipreses Tank was expanded to cover part of San José that had been supplied exclusively by the Curridabat Tanks. As a long-term measure, the respondent institution is promoting projects aimed at controlling unaccounted-for water. As a result, it has worked to develop new sources that are currently in operation for the benefit of the GAM population, and work has been underway on a project intended to increase production benefiting the GAM by up to 2500 liters per second; the project is at the design stage and would be completed in 2025. They also establish that the Palermo, Chigüite, Doña Lela, CNP 9, and CNP 10 wells are currently operating in the GAM. This Court considers that, although the potable-water service shortage in the community where the applicant resides is indeed established, the respondent authorities demonstrated that they acted within their material capabilities to achieve an adequate redistribution.

This Chamber also considers that the shortage occurs only during the dry season, not throughout all months of the year or at all hours of the day, and that the situation is communicated to the public through various means. In addition, the institution has carried out work to reinforce the system and taken corrective and preventive measures, including a study of the development of new sources that are currently in operation, which will benefit the GAM population and are intended to increase production by up to 2500 liters per second. In light of the foregoing, the Chamber rules out that the Administration failed to address the problems with the potable-water service in the affected area; accordingly, the application must be declared without merit, as is hereby done. The foregoing is without prejudice to reminding the respondent institution of its duty to continue carrying out work to reinforce the system and prevent shortages during the dry season (…)” (Emphasis not in the original). IV. THE SPECIFIC CASE

The applicants come before this Chamber and state that they are residents of Asayne, Santa Teresita de Aserrí. They allege that the community has been without potable-water service for five consecutive days, making essential cleaning and personal hygiene activities difficult. They allege that, although this situation was brought to the attention of the Municipality of Aserrí, the problem has not been effectively resolved. They further allege that no alternative potable-water supply service has been provided by tanker truck or other means. They state that minors, older adults, and persons with disabilities live in the community.

In light of the foregoing, they request that the application be granted and that the respondents be ordered to restore potable-water service in the area and provide them with water by alternative means until the problem is resolved.

Upon review of the record, it is established that the applicants are residents of Asayne in Santa Teresita de Aserrí and that potable-water service in that community has not been suspended continuously or without interruption for several days, as alleged. According to the information provided under oath, daily, partial suspensions have occurred at previously announced scheduled rationing times, prompted by an extreme nationwide drought and a severe water deficit in the surface sources supplying the municipal treatment plant. That condition, according to the information provided, reduced pressure in the higher parts of the system; there was no complete cutoff or abandonment of the service.

The record also shows that the following factors contribute to the aforementioned potable-water service suspensions:

“1. Technical Cause and Force Majeure Climate Event. Dependence on surface sources: 95% of the municipal water system’s intake sources are surface waters and rivers, which are highly vulnerable to climate variations and extreme drought.

Severe flow deficit: While demand in the First (Central) and Seventh (Salitrillos) districts peaks at around 100 liters per second (1s), the inflow to the plant during the critical drought phase fell sharply to 30 1/s, creating a structural deficit of 70% (a shortfall of 70 1/s).

Official CNE / IMN Alert: The canton of Aserrí is under a formal Green Alert declared by the National Commission for Risk Prevention and Emergency Response (CNE) due to the consolidation of the 2026 El Niño phenomenon, which has caused the longest and most critical drought recorded since 2018.

Canton topography: The mountainous and irregular topography means that lower areas receive the flow first and consume the little pressure available, preventing water from reaching the higher parts of ASAYNE with sufficient force until consumption at lower elevations decreases.” In response to these suspensions, the respondent Municipality deployed crews and conducted technical verification efforts. Specifically, it took the following actions:

“Leak inspection: A crew was deployed from 07:00 to 20:00 for an entire week in ASAYNE, ruling out breaks or hidden leaks in the area.

Ruling out obstructions: After a main pipe was repaired weeks earlier by the Technical Road Management Unit (UTGV) in María Auxiliadora as part of a sewer replacement, another crew checked for a week to ensure that no sediment or obstructions remained in the transmission line to ASAYN., Pressure tests: By removing water meters in the field, it was confirmed that the service was not reaching users because of a general lack of pressure in the network due to low flow at the intakes, and not because of a breakdown.

Post-rain verification: With the storm that arrived in the middle of last week, increased intake levels at the Treatment Plant immediately restored pressure in all homes in the ASAYNE sector, confirming that the impact was strictly hydraulic and climate-related.” At the same time, it is established that, when these service suspensions occur, the Municipality maintains an ongoing contingency plan to distribute water Monday through Sunday from 7:00 to 20:00 (extending service with institutional vehicles until 21:00 for working people). More than 11,000 liters are distributed daily in Santa Teresita (including the Asayne sector) and nearby areas by tanker trucks contracted through SICOP and institutional pickup trucks fitted with 1200-liter tanks. Specifically, the following measures have been taken:

“3. Contingency Plan and Active Alternative Distribution. Contracting through S1COP: Through ordinary procurement procedure No. 20251D. 000066-0019500001 (Contract with Trasagua S.A., corporate ID number 3-101-635879), tanker-truck services with capacities of 3,000 and 4.000 gallons were contracted.

Daily volumes and hours: 20 priority sectors have been covered, expressly including Santa Teresita and ASAYNE., during the hours of 07:00 to 15:00 and 15:00 to 20:00.

Institutional pickup vehicles: To reach narrow passageways and sectors with difficult road access where tanker trucks cannot maneuver, three (3) pickup trucks with 1,200 L tanks each are used to ensure individualized service.

Valve regulation and communication: Valve-regulation maneuvers are maintained for 16 continuous hours to balance pressure, and rationing schedules are published in a timely manner through institutional social media, the website, and community loudspeaker announcements.” The Municipality of Aserrí also has several financial and technical investments aimed at resolving the aforementioned shortage, namely:

“1. Sectorization through groundwater: With the Lagunilla Well now in operation (already supplying Lourdes abajo and La Planta), the Liceo de Aserrí well, the award of the Plaza de Aserrí Centro Well, and the preparation of tender documents for the Saures and Plaza de Lourdes wells, the lower parts of the canton will be made independent, reserving the Treatment Plant’s flow exclusively for the higher areas (such as Salitrillos and ASAYNE).

2. Modernization of the Treatment Plant: The current plant processes 70 1/s and 40 UNT. Construction and expansion of sedimentation tanks are underway (95% complete as of August 2026), new flocculators have been completed, backup pipes in the Lourdes system are 85% complete, and direct intake at the spring of Quebrada Las Mercedes is 90% complete, eliminating 100 hectares of turbidity runoff.

3. Consumption control and efficiency: The gradual conversion of 75% of fixed water connections to metered service with water meters is underway to prevent waste, along with enforcement against illegal connections.” Having examined the applicants’ grievances, the information provided under oath by the respondent authorities of the Municipality of Aserrí—with due warning of the consequences set out in Article 44 of the Law on Constitutional Jurisdiction—and all the evidence submitted to the record, this Court considers that there are no grounds to grant this amparo proceeding. The reasons are set out below.

First, it has been fully established that the potable-water service suspensions in the community where the applicants live (Asayne in Santa Teresita de Aserrí) are not without any basis or support, nor are they properly attributable to arbitrary acts or omissions by the Municipality of Aserrí. On the contrary, it has been established that the suspensions of the service—which, moreover, have not been continuous or uninterrupted for several days as alleged, but have occurred partially—are prompted by the drought affecting the country in connection with the El Niño phenomenon, as well as by the severe water deficit in the surface intake sources supplying the municipal treatment plant and the area’s mountainous and irregular topography, which causes lower areas to receive the flow first and consume the little pressure available, preventing water from reaching the higher parts of Asayne with sufficient force, among other factors. In addition, it is important to note that, in response to the situation, the Municipality conducted inspections in the area, ruling out breaks, leaks, or hidden obstructions as the cause of the reported problem. Accordingly, this Court recognizes that the shortage raised by the applicants is due strictly to hydraulic and climate-related conditions.

Second, according to the information provided under oath, the population has been kept informed of service rationing through various means and, in addition, alternative measures have been taken to provide users with potable water regularly by tanker trucks and pickup trucks (for several hours a day, Monday through Sunday).

Third, the record shows that the authorities of the Municipality of Aserrí have also taken various steps and operational measures to resolve the reported situation. According to the information provided under oath by the respondent Mayor, several financial and technical investments are aimed at resolving the aforementioned shortage, namely: sectorization through groundwater, modernization of the treatment plant (a project that is well advanced to date), and conversion of fixed water connections to metered service with water meters.

* In conjunction with the foregoing, it is important to take into account that this Chamber recently had the opportunity to consider an amparo application brought by residents of the community of María Auxiliadora de Aserrí, in which facts similar to those now presented by the applicants were alleged. By Vote No. 2026-31110 of 09:30 on 13 August 2026, the proceeding was dismissed, based on the following considerations:

“(…) I.- PURPOSE OF THE APPLICATION. The applicant states that, as of the date this application was filed, his household had gone more than four consecutive days without receiving a single drop of potable water, either during the day or at night, making it impossible to meet the most basic needs of daily life. He states that the only measure implemented has been the occasional dispatch of tanker trucks, which is a temporary and insufficient solution. He adds that the Municipality established official water-distribution schedules; however, those schedules are not followed in the Barrio María Auxiliadora sector. He alleges that, despite the residents’ numerous complaints to the Municipality, it has not provided an effective solution and the problem continues to worsen year after year. He considers his fundamental rights to have been violated. (…)

IV. ON THE MERITS

In this case, the applicant states that, as of the date this application was filed, his household had gone more than four consecutive days without receiving a single drop of potable water, either during the day or at night, making it impossible to meet the most basic needs of daily life. He states that the only measure implemented has been the occasional dispatch of tanker trucks, which is a temporary and insufficient solution. He adds that the Municipality established official water-distribution schedules; however, those schedules are not followed in the Barrio María Auxiliadora sector. He alleges that, despite the residents’ numerous complaints to the Municipality, it has not provided an effective solution and the problem continues to worsen year after year. He considers his fundamental rights to have been violated.

The report submitted by the representative of the respondent authority—which is deemed to have been given under oath, with the consequences, including criminal consequences, set out in Article 44 of the Law governing this Jurisdiction—and the evidence establish that, during July 2026, potable-water supply in the Barrio María Auxiliadora sector experienced operational impacts associated with limited water availability caused by the extreme drought season the country faced during the current year. It is also established that there was no continuous suspension of potable-water supply in the Barrio María Auxiliadora sector for four days or more; rather, there were daily, noncontinuous suspensions during set periods. In this regard, the respondent authority formalized and publicized the regulation schedules through institutional social media, the municipal website, and community loudspeaker announcements for the applicant’s sector (Zona Arriba and Salitrillos / Barrio María Auxiliadora).

A baseline supply schedule of 4:30 a.m. to 11:30 a.m. and 5:00 p.m. to 8:30 p.m. was established, with the remaining periods reserved for regulation and pressure recovery in the tanks. Likewise, the historical reading report for water meter No. 00000793 corresponding to the applicant shows the following consumption for March through July 2026: March: 10 m³, April: 8 m³, May: 8 m³, June: 10 m³, and July: 6 m³. It is also established that the respondent Municipality awarded, through the SICOP platform, a contract for tanker trucks under procedures 2025LD-000013-0019500001 / 2025LD-000066-0019500001 to Trasagua S.A., which deploys daily supply routes in two shifts (11:00 a.m. to 3:00 p.m. and 3:00 p.m. to 8:00 p.m.), supplemented by Municipality pickup trucks for areas with difficult access or narrow passageways. In addition, personalized service is provided until 9:00 p.m. for subscribers who arrive home at night and report incidents through the real-time service chats.

Finally, 95% of the municipal water system’s supply comes from surface sources (rivers and springs); however, the flow of those surface sources decreased sharply by as much as 70%, as the country is facing one of the longest drought seasons recorded in recent years, intensified by climate change and the El Niño phenomenon. This led the National Commission for Risk Prevention and Emergency Response (CNE) to declare a Green Alert for 49 cantons, including the canton of Aserrí.

Accordingly, a violation of the fundamental rights of the amparo applicant is ruled out. This is because the potable-water service suspensions in the area where the applicant lives do not result from negligent or arbitrary conduct by the respondent Municipality, as the provider of the potable-water service, but from a general shortage during the dry season—the canton is even under a Green Alert issued by the CNE—and increased user demand during that period. It is also verified that, in response to the situation, the respondent authority announced the rationing schedules through various means and sought to provide water daily by tanker trucks operating in two distribution shifts, including personalized service until 9:00 p.m. for subscribers who arrive home at night and report incidents through the real-time service chats. Finally, the respondent authority has carried out, and continues to carry out, actions to improve pressure and supply conditions in the canton, including the drilling and commissioning of 4 deep wells; work on automating the current water treatment plant; redesigning and interconnecting the flocculation and sedimentation systems for operation in August 2026; and direct intake at the springs of Quebrada Las Mercedes (90% complete).

Likewise, a gradual replacement of 75% of fixed water connections with consumption meters is planned for 2027, along with control of illegal connections through a regulatory amendment and inspections of housing units. Progress is also being made on the appraisal for purchase of the main property required to build the new Treatment Plant dedicated exclusively to that sector. In light of the foregoing, the application is declared without merit (…)”.

Under these considerations, and in the absence of sufficient grounds in this case to depart from the criterion established in the Chamber’s case law on this type of matter, the present amparo proceeding must be dismissed.

V.Now, without prejudice to the foregoing, it is necessary to inform the respondent authorities that they have a duty to continue making efforts to address the situation raised in this amparo, as well as to provide potable water to residents of the Asayne community by alternative means when service is interrupted for excessive periods. (…)”

NO SE ACREDITÓ UNA SUSPENSIÓN CONTINUA NI EL ABANDONO DEL SERVICIO, PUES LOS RACIONAMIENTOS FUERON PARCIALES, PROGRAMADOS Y CAUSADOS POR UNA SEQUÍA EXTREMA, MIENTRAS LA MUNICIPALIDAD DISTRIBUYÓ AGUA MEDIANTE CISTERNAS Y EJECUTÓ PROYECTOS PARA MEJORAR EL ACUEDUCTO. SE DECLARA SIN LUGAR. VCG09/2026 “(…) III.- EN CUANTO AL DESABASTECIMIENTO DE AGUA POTABLE POR LA ÉPOCA SECA. Respecto a esta problemática que, actualmente, afecta a muchas comunidades del territorio nacional, esta Sala mediante Sentencia No. 2019-007183 de las 9:20 hrs. del 26 de abril de 2019, consideró lo siguiente:

“(…) III.- SOBRE EL CASO CONCRETO. Si bien es cierto, este Tribunal ha reconocido, en reiterada jurisprudencia, que el acceso al agua potable es un derecho constitucional, derivado de los derechos a la salud, la vida, al medio ambiente sano, a la alimentación y la vivienda digna, entre otros, también lo es que en la actualidad, se presentan múltiples problemas de desabastecimiento del líquido vital, generados durante la época seca (en igual sentido véanse las sentencias Nº 2009-12511 de las 17:59 horas del 11 de agosto del 2009, Nº 2010-015448 de las 12:15 hora del 17 de setiembre de 2010, Nº 2014-004918 de las 14:30 horas del 09 de abril de 2014, Nº 2017-006082 de las 09:45 hrs. del 28 de abril de 2017 y Nº 2016-007550 de las 09:05 del 3 de junio de 2016). Al respecto, la responsabilidad del Estado es la de implementar las medidas necesarias y óptimas para dar solución eficaz a estos problemas.

Desde esta perspectiva, se acredita en autos que, en la zona señalada por el recurrente, se han presentado cortes de agua en los últimos meses, lo cual reconoce y detalla la autoridad recurrida. No obstante, se pudo acreditar que las suspensiones reclamadas por los usuarios del servicio no son producto de la negligencia o arbitrariedad de parte del Instituto accionado, sino que estas se deben a una situación de desabastecimiento general de todos los sistemas durante la época seca. En ese sentido se acreditó que, la autoridad accionada ha comunicado a través de diversos medios que durante esta época se producirán racionamientos de agua debido al déficit ocasionado por la reducción de los caudales que abastecen los tanques de captación y por el incremento del consumo de agua. Específicamente, Zapote pertenece a la zona de Operación San José, la cual es abastecida por medio de agua almacenada en los Tanques de Curridabat, los cuales se alimentar de agua proveniente del Sistema de Tres Ríos.

Consta que, durante la producción normal, los Tanques de Curridabat al iniciar el día presentan un volumen de almacenamiento del 85%; no obstante, actualmente los niveles alcanzan un 20% de su capacidad, lo que lleva a que la zona sea propensa a desabastecimientos. Estos se producen cuando la demanda de la población supera el almacenamiento que se tiene y varían dependiendo de la demanda de la población, la producción que se tenga en el momento, el nivel en el tanque de almacenamiento, la cota topográfica del servicio, la distancia del servicio al punto de distribución, la elevación de la zona, etc. Zapote es una de las zonas más altas por lo que el impacto del desabastecimiento de agua será mayor, dicha afectación se da únicamente en la época seca y no de forma constante a lo largo del año. Normalmente, los desabastecimientos inician alrededor de las 10:00 a.m. y el sistema comienza su recuperación alrededor de las 11:00 p.m. se apoya este problema mediante el reparto de agua con camiones cisterna para centros de población vulnerables.

Los accionados indicaron que, han realizado trabajos para reforzar el sistema y beneficiar a las comunidades de los sectores más altos, también, han realizado interconexiones en la zona de La Pacífica para trasladar ese sector a otra zona de operación para acortar el área de cobertura de los tanques de Curridabat, se amplió la operación abastecida por el tanque de Cipreses para abarcar parte de San José que era abastecida exclusivamente por los Tanques de Curridabat. Como medida a largo plazo, la Institución recurrida impulsa proyectos que van enfocados al control del agua no contabilizada. Producto de lo anterior, ha trabajado en explotar nuevas fuentes que se encuentran actualmente en operación para el beneficio de la población del GAM y se ha estado trabajando en la elaboración de un proyecto que pretende aumentar hasta en 2500 litros por segundo la producción que beneficia al GAM, proyecto que se encuentra en la etapa de diseño y se concluiría en el año 2025.

Asimismo, acreditan que, en la actualidad tienen operando en la GAM los pozos de Palermo, Chigüite, Doña Lela, CNP 9 y CNP 10. Este Tribunal considera que, pese a que se comprueba que efectivamente existe el desabastecimiento del servicio de agua potable en la comunidad que reside el recurrente, las autoridades recurridas demostraron que han actuado dentro de sus posibilidades materiales a fin de lograr una adecuada redistribución. Asimismo, considera esta Sala que, el desabastecimiento se da únicamente en época seca y no durante todos los meses del año ni durante todas las horas del día y dicha situación es comunicada a la población por diversos medios. Adicionalmente, se valora que la institución ha realizado trabajos para reforzar el sistema y ha tomado medidas correctivas y preventivas, entre las cuales se encuentra el estudio que realiza para la explotación de nuevas fuentes que se encuentran actualmente en operación, lo que beneficiara la población del GAM y que pretende aumentar hasta en 2500 litros por segundo la producción.

En mérito de lo expuesto, la Sala descarta que la Administración haya sido omisa en la atención de los problemas en el suministro del servicio de agua potable en la zona afectada, por ende, se impone declarar sin lugar el recurso, tal como en efecto se hace. Lo anterior, sin perjuicio de recodarle a la institución recurrida su deber de continuar realizando trabajos para reforzar el sistema y evitar el desabastecimiento durante la época seca (…)” (El destacado no forma parte del original). (ver en similar sentido las Sentencias No. 2019-19080 de las 09:20 hrs. de 04 de octubre de 2019 y No. 2026-22313 de las 09:30 hrs. de 19 de junio de 2026, entre otras).

IV. CASO CONCRETO

Los recurrentes acuden a esta Sala y señalan que son vecinos de Asayne Santa Teresita de Aserrí. Acusan que dicha comunidad permanece sin servicio de agua potable desde hace cinco días consecutivos, lo que dificulta la realización de actividades esenciales de aseo e higiene personal. Alegan que, pese a haberse puesto en conocimiento dicha situación ante la Municipalidad de Aserrí, el problema no ha sido resuelto efectivamente. Aducen que no se les ha proporcionado tampoco un servicio de suministro de agua potable alternativo mediante camiones cisterna u otro mecanismo. Afirman que en la comunidad habitan personas menores de edad, adultas mayores y con discapacidad.

En virtud de lo expuesto, solicitan que se declare con lugar el recurso y se les ordene a los recurridos reestablecer el servicio de agua potable en la zona y proveerles de dicho líquido por medios alternos hasta que se resuelva el problema.

Revisados los autos, se tiene por demostrado que los recurrentes son vecinos de Asayne de Santa Teresita de Aserrí y que en dicha comunidad no se han presentado suspensiones del servicio de agua potable de forma contigua o ininterrumpida por varios días, tal y como se aduce. Según se informó bajo juramento, en dicho sitio se han presentado suspensiones diarias y parciales sujetas a horarios de racionamiento programado y divulgado previamente, motivadas por una condición de sequía extrema nacional y un déficit hídrico severo en las fuentes superficiales de captación que abastecen la planta de tratamiento municipal. Dicha condición, según se informó, redujo la presión en las partes altas del sistema, sin que haya existido un corte absoluto o abandono del servicio.

Consta también que en las referidas suspensiones del servicio de agua potable intervienen los siguientes factores:

“1. Origen Técnico y Fenómeno Climático de Fuerza Mayor. Dependencia de fuentes superficiales: El 95% de las fuentes de captación del acueducto municipal corresponden a aguas superficiales y ríos, las cuales son altamente vulnerables a las variaciones climáticas y a la sequía extrema.

Severo déficit de caudal: Mientras la demanda de los distritos Primero (Central) y Séptimo (Salitrillos) ronda un pico de 100 litros por segundo (1s), el caudal de ingreso a la planta durante la fase crítica de sequía cayó drásticamente a 30 1/s, generando un déficit estructural del 70% (70 1/s de faltante).

Alerta Oficial CNE / IMN: El cantón de Aserrí se encuentra bajo declaratoria formal de Alerta Verde por la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE) debido a la consolidación del fenómeno de El Niño 2026. el cual ha provocado la sequía más prolongada y crítica registrada desde el año 2018.

Topografía del Cantón: La topografía montañosa e irregular provoca que las partes bajas reciban primero el caudal y consuman la poca presión existente, impidiendo que el agua suba con fuerza a las partes altas de ASAYNE hasta que disminuye el consumo en las cotas inferiores”.

Ante dichas suspensiones, la municipalidad recurrida ha realizado un despliegue de cuadrillas y efectuado gestiones de comprobación técnica. Concretamente, se han realizado las siguientes actuaciones:

“Inspección de fugas: Se desplegó una cuadrilla de 07:00 a 20:00 horas durante una semana completa en ASAYNE, descartando la existencia de rupturas o fugas no visibles en la zona.

Descarte de obstrucciones: Tras |a reparación de una tubería madre efectuada semanas atrás por la Unidad Técnica de Gestión Vial (UTGV) en María Auxiliadora por sustitución de alcantarillado, otra cuadrilla verificó durante una semana que no quedaran sedimentos u obstrucciones en la línea de conducción hacia ASAYN., Pruebas de presión: Al desmontar hidrómetros en campo, se comprobó que el servicio no llegaba por la falta generalizada de presión en la red debido al escaso caudal en las tomas y no por avería.

Constatación post-lluvias: Con el temporal que ingresó a mediados de la semana pasada, el aumento en los niveles de captación de la Planta de Tratamiento restableció de inmediato la presión en todas las viviendas del sector de ASAYNE, confirmando que la afectación era estrictamente hidráulico-climática”.

Concomitantemente, se tiene por demostrado que, cuando se presentan tales suspensiones del servicio, el municipio mantiene un plan de contingencia continuo para distribuir agua de lunes a domingo de 7:00 a 20:00 (extendiéndose con vehículos institucionales hasta las 21:00 hrs. para personas trabajadoras), repartiéndose más de 11.000 litros diarios en Santa Teresita (incluido el sector de Asayne) y zonas aledañas, mediante camiones cisterna contratados vía SICOP y pick ups institucionales adaptados con tanques de 1200 litros. Específicamente, se han tomado las siguientes medidas:

“3. Plan de Contingencia y Distribución Alternativa Activa. Contratación Vía S1COP: Mediante el procedimiento licitatorio ordinario No 20251D. 000066-0019500001 (Contrato Trasagua S.A.. cédula jurídica 3-101-635879), se contrató el servicio de camiones cisterna con capacidades de 3,000 y 4.000 galones.

Volúmenes y Horarios Diarios: Se han cubierto 20 sectores prioritarios, incluyendo expresamente a Santa Teresita y ASAYNE., en horarios de 07:00 a 15:00 horas y de 15:00 a 20:00 horas.

Vehículos Pick-Up Institucionales: Para ingresar a pasajes estrechos y sectores de difícil acceso vial donde los camiones cisterna no pueden maniobrar, se utilizan tres (3) pick-ups con tanques de 1,200 L cada uno, asegurando atención personalizada.

Regulación de Válvulas y Comunicación: Se mantienen maniobras de regulación de válvulas durante 16 horas continuas para balancear presiones, publicando oportunamente los calendarios de racionamiento mediante redes sociales institucionales, página web y perifoneo comunal”.

La Municipalidad de Aserrí igualmente cuenta con varias inversiones financieras y técnicas orientadas a solucionar el problema de desabastecimiento referido, a saber:

“1. Sectorización mediante Aguas Subterráneas: Con la puesta en operación del Pozo Lagunilla (que ya abastece Lourdes abajo y La Planta), el pozo del Liceo de Aserrí, la adjudicación del Pozo de la Plaza de Aserri Centro, y la formulación de carteles para los pozos de Saures y Plaza de Lourdes, se independizarán las partes bajas del cantón reservando el caudal de la Planta de Tratamiento exclusivamente para las partes altas (como Salitrillos y ASAYNE).

2. Modernización de la Planta de Tratamiento: La planta actual procesa 70 1/s y 40 UNT, Se ejecuta la construcción y ampliación de sedimentadores (al 95% de avance a agosto 2026), nuevos floculadores (concluidos), tuberías de respaldo en el sistema Lourdes (85% de avance), e integración de la captación directa en la naciente de la Quebrada Las Mercedes (90% de avance, eliminando 100 hectáreas de arrastre de turbiedad) 3. Control del Consumo y Eficiencia: Se ejecuta la migración paulatina del 75% de las pajas de agua fijas a micromedición con hidrómetros para evitar el dispendio del recurso, sumado a la persecución de conexiones ilícitas”.

Ahora bien, analizados los agravios planteados por los recurrentes, lo informado bajo juramento por las autoridades recurridas de la Municipalidad de Aserrí –con oportuno apercibimiento de las consecuencias previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional–, así como todas las pruebas aportadas a los autos, este Tribunal considera que no existe mérito para acoger este proceso de amparo. Esto, por los motivos que se dirán a continuación.

Primero, por cuanto se ha demostrado plenamente que las suspensiones del servicio de agua potable en la comunidad donde habitan los recurrentes (Asayne de Santa Teresita de Aserrí) no carecen de fundamento o sustento alguno, ni se deben propiamente a actuaciones u omisiones arbitrarias atribuibles plenamente a la Municipalidad de Aserrí. Por el contrario, se ha acreditado que las suspensiones de dicho servicio (las cuales, además, no han sido contiguas o ininterrumpidas por varios días tal y como se alega, sino que se han presentado de forma parcial), se motivan en la condición de sequía que afecta al país aparejada al Fenómeno del Niño, así como al déficit hídrico severo que sufren las fuentes superficiales de captación que abastecen la planta de tratamiento municipal y a la topografía montañosa e irregular propia de la zona que provoca que las partes bajas reciban primero el caudal y consuman la poca presión existente, impidiendo que el agua suba con fuerza a las partes altas de Asayne, entre otros aspectos.

Adicionalmente, es importante destacar que, ante dicha situación, el municipio ha realizado inspecciones en la zona, descartándose que la problemática expuesta se encuentre aparejada a la existencia de rupturas, fugas u obstrucciones no visibles en la zona. Así las cosas, este Tribunal reconoce que el problema de desabastecimiento de agua planteado por los tutelados obedece estrictamente a condiciones hidráulicas- climáticas.

Segundo, habida cuenta que, según se informó bajo juramento, la población se ha mantenido informada de los racionamientos del servicio (a través de diversos medios) y, además, se han tomado medidas alternas para proveer de agua potable a los usuarios de forma regular a través de camiones cisterna y pick ups (de lunes a domingo por varias horas).

Tercero, dado que, consta que las autoridades de la Municipalidad de Aserrí, concomitantemente, han realizado diversas gestiones y tomado medidas operativas tendentes a solventar la situación reclamada. Según informó bajo juramento la Alcaldesa recurrida, se cuenta con varias inversiones financieras y técnicas orientadas a solucionar el problema de desabastecimiento referido, a saber: la sectorización mediante aguas subterráneas, la modernización de la planta de tratamiento (proyecto que tiene un gran avance a la fecha) y la migración de las aguas de agua fijas a micromedición con hidrómetros.

* En consuno con lo anterior es importante tomar en cuenta que esta Sala recientemente tuvo la oportunidad de conocer un recurso de amparo formulado por los vecinos de la comunidad de María Auxiliadora de Aserrí, en el cual se adujeron hechos similares a los ahora expuestos por los recurrentes. Mediante el Voto No. 2026-31110 de las 09:30 hrs. de 13 de agosto de 2026 el proceso fue desestimado, bajo el siguiente orden de consideraciones:

“(…) I.- OBJETO DEL RECURSO. - Manifiesta el recurrente que, a la fecha de interposición de este recurso, su núcleo familiar tenía más de cuatro días consecutivos sin recibir una sola gota de agua potable, tanto durante el día como durante la noche, situación que impide satisfacer las necesidades más elementales de la vida diaria. Señala que, se ha implementado como única medida el envío ocasional de camiones cisterna, lo que constituye una solución temporal e insuficiente. Además, agrega que la Municipalidad estableció horarios oficiales de distribución de agua; sin embargo, en el sector de Barrio María Auxiliadora dichos horarios no se cumplen. Reclama que, a pesar de las múltiples quejas formuladas por los vecinos ante la Municipalidad, ésta no ha dado una solución efectiva y la problemática continúa agravándose año tras año. Estima lesionados sus derechos fundamentales. (…)

IV. SOBRE EL FONDO

– En el sub lite, el recurrente manifiesta que a la fecha de interposición de este recurso, su núcleo familiar tenía más de cuatro días consecutivos sin recibir una sola gota de agua potable, tanto durante el día como durante la noche, situación que impide satisfacer las necesidades más elementales de la vida diaria. Señala que, se ha implementado como única medida el envío ocasional de camiones cisterna, lo que constituye una solución temporal e insuficiente. Además, agrega que la Municipalidad estableció horarios oficiales de distribución de agua; sin embargo, en el sector de Barrio María Auxiliadora dichos horarios no se cumplen. Reclama que, a pesar de las múltiples quejas formuladas por los vecinos ante la Municipalidad, ésta no ha dado una solución efectiva y la problemática continúa agravándose año tras. Estima lesionados sus derechos fundamentales.

Del informe rendido por la representante de la autoridad recurrida -que se tiene dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y del elenco probatorio, se tiene por acreditado que durante el mes de julio de 2026, el suministro de agua potable en el sector de Barrio María Auxiliadora ha presentado afectaciones operativas asociadas a la limitada disponibilidad hídrica provocada por la temporada de sequía extrema que ha enfrentado el país durante el presente año. Asimismo, se tiene que, en el sector de Barrio María Auxiliadora, no se ha presentado una suspensión continua del suministro de agua potable por cuatro días o más, lo que se ha registrado son suspensiones diarias, no continuas, en lapsos determinados. En ese sentido, se tiene que, la autoridad recurrida oficializó y difundió los horarios de regulación mediante las redes sociales institucionales, el sitio web municipal y perifoneo, para el sector del recurrente (Zona Arriba y Salitrillos / Barrio María Auxiliadora), se estableció un horario base de suministro de 4:30 a. m. a 11:30 a. m. y de 5:00 p. m. a 8:30 p. m., reservando los bloques restantes para regulación y recuperación de presiones en tanques.

De igual forma, se tiene que, según el reporte histórico de lecturas del hidrómetro N.° 00000793 correspondiente al recurrente, durante el periodo de marzo a julio de 2026, se reflejaron los siguientes consumos: marzo: 10 m³, abril: 8 m³, mayo: 8 m³, junio: 10 m³ y julio: 6 m³. Por otra parte, se tiene que, el municipio recurrido adjudicó mediante la plataforma SICOP la contratación de camiones cisterna bajo el procedimiento 2025LD-000013-0019500001 / 2025LD-000066-0019500001 a la empresa Trasagua S.A., la cual, despliega rutas diarias de abastecimiento en dos turnos (11:00 a. m. a 3:00 p. m. y 3:00 p. m. a 8:00 p. m.), complementadas con vehículos pick-up de la Municipalidad para los sectores de difícil acceso o pasajes estrechos. Asimismo, se brinda un servicio personalizado hasta las 9:00 p. m. para aquellos abonados que ingresan a sus viviendas en horas de la noche y reportan eventualidades en los chats de atención en tiempo real.

Finalmente, se tiene que, el 95% del suministro del acueducto municipal proviene de fuentes superficiales (ríos y nacientes); sin embargo, las fuentes superficiales sufrieron una disminución drástica de hasta un 70% en sus caudales, dado que el país enfrenta una de las épocas de sequía más extensas registradas en los últimos años, acentuada por el cambio climático y el Fenómeno del Niño, situación que conllevó a la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE) declarar Alerta Verde para 49 cantones, incluyendo el cantón de Aserrí.

Así las cosas, se descarta la lesión a los derechos fundamentales del amparado. Lo anterior, por cuanto se determina que, las suspensiones del servicio de agua potable en la zona donde reside el recurrente no obedecen a una actuación negligente o arbitraria de la Municipalidad recurrida -como prestataria del servicio de agua potable-, sino que se produce por un desabastecimiento general durante la época seca -incluso el cantón se encuentra con alerta verde emitida por la CNE- y por la mayor demanda de los usuarios durante ese periodo. Igualmente, se verifica que, ante tal situación, la autoridad recurrida ha comunicado por diversos medios los horarios de racionamiento del servicio y también ha procurado el suministro del agua de manera diaria a través de camiones cisterna con dos turnos de reparto, disponiendo incluso de un servicio personalizado hasta las 9:00 p. m. para aquellos abonados que ingresan a sus viviendas en horas de la noche y reportan eventualidades en los chats de atención en tiempo real.

Finalmente, se observa que la autoridad recurrida ha realizado y se mantiene realizando, acciones para mejorar las condiciones de presión y abastecimiento en el cantón, incluyendo el sector de Barrio María Auxiliadora, como lo son la perforación y habilitación de 4 pozos profundos, se trabaja en la automatización de la planta actual de tratamiento de aguas, rediseño e interconexión de sistemas de floculación y sedimentación para entrar en funciones en agosto de 2026 y captación directa en las nacientes de la Quebrada Las Mercedes (avance del 90%). Asimismo, se proyecta para el año 2027 una sustitución paulatina del 75% de las pajas fijas por hidrómetros de consumo medido, control de conexiones ilegales mediante reforma reglamentaria y fiscalización de unidades habitacionales y se avanza en el avalúo para la compra de la finca principal requerida para la construcción de la nueva Planta de Tratamiento dedicada exclusivamente a dicho sector. En virtud de lo expuesto, se declara sin lugar el recurso (…)”.

Bajo tal orden de consideraciones y, al no existir, en la especie, razones suficientes que hagan variar el criterio establecido por la Sala en su jurisprudencia para este tipo de temas, lo procedente es desestimar el presente proceso de amparo.

V.Ahora bien, sin demérito de lo consignado supra, resulta menester indicarles a las autoridades recurridas que es su deber continuar realizando esfuerzos para atender la situación reclamada en este amparo, así como brindar el servicio de agua potable a los vecinos de la comunidad de Asayne a través de medios alternativos, cuando este se interrumpa por plazos excesivos. (…)”
