032958-26. ENVIRONMENT. EXECUTIVE BRANCH. THE FAILURE TO IMPLEMENT MEASURES AGAINST NOISE POLLUTION CAUSED BY PARTIES AT A TENEMENT AND THE ABSENCE OF POLICE ASSISTANCE ARE CHALLENGED. THE CHAMBER FINDS THAT THE MINISTRY OF HEALTH CONFIRMED EXCESSIVE NOISE AND ISSUED SANITARY ORDERS, BUT FOR MORE THAN EIGHT MONTHS DID NOT USE OTHER LEGAL OPTIONS TO SERVE THEM; NO OMISSION BY THE PUBLIC FORCE WAS ESTABLISHED. THE AMPARO IS PARTIALLY GRANTED, AND THE MINISTRY IS ORDERED TO ANALYZE METHODS OF SERVICE WITHIN FIFTEEN DAYS, MAKE AN ATTEMPT TO SERVE THE ORDERS WITHIN THE FOLLOWING FIFTEEN DAYS, AND INFORM THE COMPLAINANT WITHIN FIVE DAYS. In this case, the applicant states that on 8 August 2025, they filed a complaint with the Ministry of Health (case number 6518-2025) concerning noise pollution. They maintain that they fulfilled the requirements imposed by that authority; however, although its personnel went to the location, they said they had been unable to formally serve the offenders because of their schedules. The applicant states that on 16 and 24 October 2025, they repeatedly called 911 from 22:00 onward, but the police did not arrive. They say that on 7 June 2026, during a conflict, they called 911 “4 to 5 consecutive times” because of the Public Force’s “delayed, ineffective, and nonexistent” response.

From the review of the record, it is established that the petitioner is 48 years old. On 8 August 2025, the applicant filed a complaint with the Ministry of Health (case number 6518-2025) concerning noise pollution. On 12 August 2025, the Heredia Health Area Office received the protected party’s complaint, which reported noise problems caused by their neighbors. By letter CARTA-MS-DRRSCN-DARSH-2594-2025 of 19 August 2025, the Heredia Health Area Office stated: “Dear Sir/Madam: A complaint was received through the digital form on the Ministry of Health’s institutional website, reporting noise-pollution problems caused by neighbors in Heredia, Ulloa, Bella Vista Condominium. To properly address the complaint, it is important to note that the procedure for handling noise-pollution complaints is regulated by Executive Decree 44486-S, ‘Regulations for the Control of Environmental Noise.’ Complaints of this kind must meet the following requirements: 1.

They may not be anonymous or confidential. 2. The affected parties must allow entry to the home to conduct the noise measurement. 3. They must indicate the day and time when the disturbance is most intense. It should also be taken into account that working after 4 p.m. and on non-working days, such as Saturdays and Sundays, requires a special permit. Obtaining that permit takes several days and requires budget availability, so it is not possible to respond immediately when an affected person calls. We therefore await the requested information and confirmation that you are willing to have the noise measurement conducted and to have your name included in the report that must be prepared. You may send the information to: [email protected]. With nothing further, we remain yours sincerely.” The Heredia Health Area Office made several requests of the person seeking legal relief and scheduled the noise measurement for the night of 5 September 2025.

At 22:06 that day, it confirmed that the levels exceeded the limits set by Decree No. 44486-S. On 17 September 2025, the Director of the Heredia Health Area Office issued letter MS-DRRSCN-DARSH-2855-2025, concluding: “1. The requirements of Executive Decree No. 44486-S, Regulations for the Control of Environmental Noise, were met in strict compliance with Chapter XIII, entitled ‘Noise Measurement Procedure,’ Articles 32, 33, 34, 35, 36, and 37. 2. The final result of the noise-measurement procedure for the active source was 61.5 dB(A). 3. The ambient noise (L90), plus the adjustment under Article No. 16, is 41.9 dB(A). 4. The ambient noise together with the noise generated by the source EXCEEDS the levels established in the Regulations for the Control of Environmental Noise, Executive Decree No. 44486-S, as measured in the complainant’s living room during nighttime hours. 5. The measurement establishes that sound levels exceed the applicable standard when sound equipment is used, generating noise pollution and affecting the neighbors’ rest and concentration.

Accordingly, a sanitary order is being issued to the tenants and owners of the property directing them to refrain from this practice, especially at night, in accordance with the Regulations for the Control of Environmental Noise, Executive Decree 44486-S, which states verbatim: ‘... Article 9. No natural or legal person shall cause or permit the production or emission of artificial or anthropogenic noise that exceeds the levels established in these regulations ...’ 6. If it is confirmed that noise pollution in the area continues, the fine established in Articles 378 and 378 bis of the General Health Law, as amended by Law No. 9837 of 4 April 2020, and its Regulations (Executive Decree No. 42293-S of 10 April 2020), will be imposed. Those provisions establish that, when noncompliance with a sanitary order is duly confirmed by the Health Authority, it will serve a sanitary report on the person who has failed to comply.

The report will contain a statement of facts and imposition of the fine, and will grant the offender twenty (20) business days to pay the fine of ONE BASE SALARY, corresponding to four hundred sixty-two thousand two hundred colones (462,200.00), for failure to comply with special or general orders or measures issued by the health authorities. The fine will be collected through the vehicle registration sticker, if the person owns a vehicle, or deducted from their salary through the Ministry of Finance.” On 18 September 2025, the Heredia Health Area Office issued sanitary orders MS-DRRSCN-DARSH-232-2025 and MS-DRRSCN-DARSH-233-2025. On 7 June 2026, the Public Force responded to two reports from the address identified by the petitioner, which were received at 2:40 and 3:26. In letter MSP-DM-DVURFP-DGFP-DRCH-DPH-D49-D49/3-114-2026 of 29 June 2026, the head of the Ulloa District Delegation of the Heredia Public Force stated: “Upon reviewing the records and duty logs of the Ulloa District Subdelegation, only one incident related to the address indicated in the amparo application was located.

It occurred on 7 June 2026 and records two reports received by radio dispatch, at 02:40 and 03:26, both classified as domestic violence. As supporting documentation, a certified copy of folio 440 of the Ulloa District Subdelegation Duty Log is attached, showing the response provided.” In her report MS-DRRSCN-AJ-J-105-2026 of 30 June 2026, the Director of the Heredia Health Area Office recorded: “3. The sanitary orders were issued as follows: MS-DRRSCN-DARSH-232-2025 to [Nombre 008], cédula: [Valor 004], [Nombre 009], cédula: [Valor 005], location: [...]. Cadastral plan H-0718002-2001, property 185763 (owners); and order MS-DRRSCN-DARSH-233-2025 to [Nombre 003], cédula: [Valor 003], [Nombre 007], cédula: [Valor 002] (tenants). Visits were made to the homes to serve the sanitary orders issued; however, no one received the health authority on any of the visits. The visits were made at different times, but neither tenants nor owners received the visitors, so effective service could not be achieved.

During one visit, neighbors even stated that the people living in the apartments had moved. 4. Visits to the site were made on 29 September 2025 at 10:47 a.m.; 17 October 2025 at 2 p.m.; 24 October 2025 at 2:30; 31 October 2025 at 11:30 a.m.; 7 November 2025 at 2 p.m.; 14 November 2025 at 10 a.m.; 20 February 2026 at 10 a.m.; 27 March 2026 at 2:30 p.m.; and 6 May 2026 at 9:30 a.m. Effective service could not be achieved despite the health authority’s multiple attempts.” In light of the foregoing, under the terms set out in the application, the amparo should be partially granted solely against the Ministry of Health.

In this regard, although the Heredia Health Area Office promptly addressed the applicant’s complaint, conducting the noise measurement and issuing the sanitary orders in less than two months, it remains true that, as of the filing of this amparo, the orders had still not been served. It should be noted that the last attempt took place on 6 May 2026. Since a problem requiring the Ministry of Health’s intervention has been confirmed, that body must take the actions authorized by the legal system to serve the sanitary orders it issued; its failure to communicate them after more than eight months cannot be accepted. In this regard, the Heredia Health Area Office itself acknowledged in a letter that working outside regular hours or on non-working days required a special permit. It may therefore consider whether that option is feasible, or consider another option that would allow the orders to be communicated to their intended recipients. Accordingly, this part of the amparo is granted, on the terms to be set out in the operative section of this judgment.

As for the Public Force, no violation that may be declared in this jurisdiction is apparent. With respect to 16 and 24 October 2025, the applicant did not specify the times of the calls or explain in detail the type of report allegedly made, so as to allow an assessment of whether there was an omission of constitutional significance. The record also shows that on 7 June 2026 (the same day this amparo was filed), the Public Force did respond to a reported conflict on two occasions. However, the petitioner likewise did not state the times of the calls or the specific circumstances reported in each one. Therefore, the amparo is denied with respect to the Ministry of Public Security.

Finally, this Court is not an office for processing requests. The applicant may, if they so wish, submit requests for information to the relevant offices so that they may assess the matter and decide as appropriate. (…)”

032958-26. AMBIENTE. PODER EJECUTIVO. SE RECLAMA LA FALTA DE EJECUCIÓN DE MEDIDAS CONTRA LA CONTAMINACIÓN SÓNICA PRODUCIDA POR FIESTAS EN UNA CUARTERÍA Y LA AUSENCIA DE AUXILIO POLICIAL. LA SALA DETERMINA QUE EL MINISTERIO DE SALUD COMPROBÓ EL EXCESO DE RUIDO Y EMITIÓ ÓRDENES SANITARIAS, PERO DURANTE MÁS DE OCHO MESES NO UTILIZÓ OTRAS OPCIONES LEGALES PARA NOTIFICARLAS; NO SE ACREDITÓ OMISIÓN DE LA FUERZA PÚBLICA. SE DECLARA PARCIALMENTE CON LUGAR Y SE ORDENA ANALIZAR LOS MEDIOS DE NOTIFICACIÓN EN QUINCE DÍAS, PROCURARLA EN LOS QUINCE DÍAS SIGUIENTES E INFORMAR AL DENUNCIANTE EN CINCO DÍAS. VCG09/2026 “(…) IV.- Sobre el caso concreto. En el sub lite, el accionante indica que el 8 de agosto de 2025 interpuso una denuncia ante el Ministerio de Salud (número de trámite 6518-2025) por contaminación sónica. Sostiene que cumplió los requerimientos que le hizo tal autoridad; sin embargo, pese a que se presentaron al lugar, adujeron no haber podido notificar formalmente a los infractores debido a sus horarios. Señala que los días 16 y 24 de octubre de 2025 se llamó de forma reiterada al 911 a partir de las 22:00 horas, pero la policía no llegó. Menciona que el 7 de junio de 2026, con ocasión de una situación de conflicto, llamó al 911 de “4 a 5 ocasiones consecutivas” debido a la “tardía, ineficaz e inexistente” respuesta de la Fuerza Pública.

Del estudio de los autos se tiene por demostrado, que el recurrente tiene 48 años. El 8 de agosto de 2025, el accionante interpuso una denuncia ante el Ministerio de Salud (número de trámite 6518-2025) por contaminación sónica. El 12 de agosto de 2025, el Área Rectora de Salud de Heredia recibió la denuncia del tutelado, en la que señaló problemas de ruido por parte de sus vecinos. El Área Rectora de Salud de Heredia, mediante oficio CARTA-MS-DRRSCN-DARSH-2594-2025 de 19 de agosto de 2025, indicó: “Estimado (a) Señor (a) Se recibió denuncia por medio del formulario digital de la página web institucional del Ministerio de Salud, en donde se denuncia problemas de contaminación sónica, que generan vecinos, en el sector de Heredia, Ulloa, Condominio Bella Vista. Para poder dar una adecuada atención a la denuncia formulada, es importante mencionar que la atención a las denuncias por contaminación sónica, tienen normado el procedimiento en el Decreto Ejecutivo 44486-S, "Reglamento Para El Control Del Ruido Ambiental", por lo que las denuncias de este tipo deben cumplir con los siguientes requisitos: 1.

No pueden ser anónimas ni confidenciales. 2. Los afectados deben permitir el ingreso a la vivienda para realizar la medición sónica. 3. Debe indicar el día y la hora en que se presenta con mayor intensidad la molestia. Se debe tomar en cuenta, además, que, para laborar después de las 4 pm y días no hábiles como sábados y domingos, se requiere de un permiso especial, trámite que lleva algunos días y disposición de presupuesto, por lo que no es posible presentarse a atender la denuncia ante el llamado inmediato por parte del afectado. Por lo que quedamos atentos a que nos aporte la información solicitada y nos indique si esta (sic) dispuesto que se realice la medición sónica y de que se mencione su nombre en el informe que obligatoriamente se debe confeccionar. La información la puede remitir al suscriben”. El Área Rectora de Salud de Heredia llevó a cabo varios requerimientos al justiciable y programó la medición sónica para el 5 de setiembre de 2025 en la noche.

Tal día a las 22:06 horas comprobó que se sobrepasaban los parámetros establecidos en el decreto nro. 44486-S. El 17 de setiembre de 2025, la Dirección del Área Rectora de Salud de Heredia emitió el oficio MS-DRRSCN-DARSH-2855-2025, en el que se concluyó: “1. Se cumplió con lo establecido el en Decreto Ejecutivo N°44486-S Reglamento para el Control del Ruido Ambiental, en estricto cumplimiento con lo dictado en le (sic) Capítulo XIII denominado Procedimiento para la medición de ruido, artículos 32, 33, 34, 35, 36 y 37. 2. El resultado final del procedimiento de medición de ruido obtenido para la fuente generadora activa fue en 61.5 dB(A). 3. El ruido ambiente (L90), más ajuste del articulo N°16 es de 41.9 dB(A). 4. El ruido ambiente más el generado por la fuente, SUPERA lo establecido en el Reglamento para el Control del Ruido Ambiental, Decreto Ejecutivo N° 44486-S, medidos sala de estar del denunciante, para horario nocturno. 5.

Como resultado de la medición se puede asegurar que los niveles de sonido cuando utilizan el equipo de sonido sobrepasan la norma establecida, generando contaminación sónica, afectando el descanso, concentración de los vecinos, por lo que se procede a emitir orden sanitaria a los inquilinos y propietarios del inmueble para que se abstengan de realizar esta práctica, especialmente en horas de la noche, de acuerdo con lo que establece el Reglamento para el Control de Ruido Ambiental, Decreto Ejecutivo 44486-S, que cita textualmente: " ... Artículo 9. - Ninguna persona física o jurídica, causará o permitirá la producción o emisión de ruidos artificiales o de origen antrópico, que sobrepase los niveles establecidos en este reglamento ... " 6. En caso comprobarse de que se continúa contaminando con ruido la zona se procederá a imponer multa establecida en la Ley General de Salud, artículos 378 y 378 bis de la Ley General de Salud, reformada por Ley No. 9837 de 4 de abril de 2020 y su Reglamento (Decreto Ejecutivo No. 42293-S de 10 de abril de 2020), que establece que cuando exista incumplimiento a una orden sanitaria, debidamente acreditado por la Autoridad de Salud, esta notificará un informe sanitario a la persona que incumple, el cual contendrá una relación de hechos y la imposición de la multa, otorgándole al infractor un plazo de veinte (20) días hábiles para la cancelación de la multa, de UN SALARIO BASE que corresponde a la suma de cuatrocientos sesenta y dos mil doscientos colones (462,200.00), por ser omiso en el cumplimiento de órdenes o medidas especiales o generales dictadas por las autoridades de salud.

El cobro de la multa se realizará con el marchamo, si cuenta con vehículo o rebajo del salario por medio del Ministerio de Hacienda”. El 18 de setiembre de 2025, el Área Rectora de Salud de Heredia emitió las órdenes sanitarias MS-DRRSCN-DARSH-232-2025 y MS-DRRSCN-DARSH-233-2025. El 7 de junio de 2026, la Fuerza Pública atendió dos reportes en la dirección aludida por el recurrente, los cuales ingresaron a las 2:40 horas y a las 3:26 horas. El jefe de la Delegación Distrital Ulloa de Heredia de la Fuerza Pública, en el oficio MSP-DM-DVURFP-DGFP-DRCH-DPH-D49-D49/3-114-2026 de 29 de junio de 2026, expuso: “Realizada la revisión de los registros y libros de guardia de la Subdelegación Distrital de Ulloa, únicamente se logró ubicar un incidente relacionado con la dirección indicada en el recurso de amparo, correspondiente al día 7 de junio de 2026, el cual registra dos ingresos reportados por cabina de radio, a las 02:40 horas y 03:26 horas, ambos clasificados como violencia intrafamiliar.

Como respaldo de lo anterior, se adjunta copia certificada del folio 440 del Libro de Guardia de la Subdelegación Distrital de Ulloa, donde consta el registro de la atención brindada”. La directora del Área Rectora de Salud de Heredia, en el informe MS-DRRSCN-AJ-J-105-2026 de 30 de junio de 2026, consignó: “3. Las Ordenes sanitarias fueron emitidas: MS-DRRSCN-DARSH-232-2025 a [Nombre 008], cedula: [Valor 004], [Nombre 009] Cedula: [Valor 005] Ubicación: [...]. Plano catastro H-0718002-2001, finca 185763 (propietarios) y orden MS-DRRSCN-DARSH-233-2025 a [Nombre 003], Cedula: [Valor 003] [Nombre 007] Cedula: [Valor 002] (Inquilinos). Se procedió a visitar las viviendas para notificar las ordenes sanitaria emitidas, sin embargo, en ninguna de las visitas efectuadas, se atendió a la autoridad sanitaria. Las visitas se realizaron a diferentes horas, no obstante, tanto inquilinos como propietarios no atendieron la visita, de tal manera que no se logró una notificación efectiva, incluso en una de las visitas vecinos manifestaron que las personas que vivían en los apartamentos se trasladaron de vivienda. 4.

Se realizaron visitas al sitio los días 29 de setiembre de 2025 a las 10:47 am, 17 de octubre de 2025 a las 2 de a (sic) tarde, el 24 de octubre de 2025 a las 2:30, 31 de octubre de 2025 a las 11:30 am, 07 de noviembre de 2025 a las 2 de la tarde, 14 de noviembre de 2025 a las 10 de la mañana, 20 de febrero de 2026 a las 10 de la mañana, 27 de marzo de 2026 a las 2:30 de la tarde, 06 de mayo de 2026 a las 9:30 am., sin que se pudiera realizar la no se logró la notificación efectiva, pese a los múltiples intentos realizados por la autoridad sanitaria”.

Desde este panorama, en los términos planteados en el escrito de interposición, procede declarar parcialmente con lugar el recurso solo en contra del Ministerio de Salud.

Sobre el particular, si bien el Área Rectora de Salud de Heredia atendió la denuncia formulada por el accionante de forma célere, por cuanto en menos de dos meses llevó a cabo la medición sonora y dictó las órdenes sanitarias, no menos cierto es que, a la fecha de interposición de este recurso, todavía no las habían podido notificar. Nótese que el último intento se llevó a cabo el 6 de mayo de 2026. Justamente, al haberse comprobado la existencia de un problema que amerita la intervención del Ministerio de Salud, este órgano debe llevar a cabo las actuaciones que le faculta el ordenamiento jurídico para notificar las órdenes sanitarias que emitió, sin que sea atendible su falta de comunicación luego de más de ocho meses. En ese sentido, la propia Área Rectora de Salud de Heredia reconoció en un oficio que para laborar fuera de horario o en días no hábiles requerían un permiso especial, por lo que, a los efectos de procurar la notificación de las órdenes, pueden analizar la viabilidad de tal supuesto, o bien, de alguno otro que permita comunicarlas a las personas destinatarias. En consecuencia, se declara con lugar este extremo, en los términos que se dictarán en la parte dispositiva de esta sentencia.

Por otra parte, en cuanto a la Fuerza Pública, no se observa alguna transgresión susceptible de ser declarada en esta jurisdicción. Al respecto, en relación con los días 16 y 24 de octubre de 2025, el accionante no precisó las horas de las llamadas ni explicó de forma detallada el tipo de reporte que presuntamente hizo, a fin de analizar si hubo o no alguna omisión de relevancia constitucional. Asimismo, consta en el expediente que, el 7 de junio de 2026 (mismo día de la interposición de este recurso), la Fuerza Pública sí atendió un conflicto que le fue reportado en dos ocasiones; sin embargo, en el mismo sentido, el recurrente no expuso las horas de las llamadas ni tampoco la situación específicamente denunciada en cada una de ellas. Ergo, se declara sin lugar el recurso en lo que atañe al Ministerio de Seguridad Pública.

Finalmente, este Tribunal no es una instancia tramitadora de gestiones, por lo que, si a bien lo tiene, puede gestionar las solicitudes de información que estime pertinentes ante las dependencias correspondientes, a fin de que valoren lo pretendido y resuelvan lo que resulte procedente. (…)”
