ARTICLE 34 OF THE LAW ON CONSTITUTIONAL JURISDICTION “(…) I.— ON THE JOINDER APPLICATION. Joinder (coadyuvancia) is a form of ancillary intervention that occurs when a person participates in proceedings by supporting the claims of one of the principal parties. Consequently, a person with a direct interest in the outcome of the application has standing to act as an intervening supporter (coadyuvante). However, because that person is not a principal party, the intervening supporter is not directly affected by the judgment; that is, the judgment’s effects cannot reach that person directly and immediately, nor is that person bound by the res judicata effect of the ruling. In amparo matters, however, the effects of the ruling may benefit that person because the jurisprudence and precedents of the constitutional jurisdiction have “erga omnes” effect (Article 13 of the Law on Constitutional Jurisdiction).

ARTÍCULO 34 DE LA LEY DE LA JURISDICCIÓN CONSTITUCIONAL “(…) I.- SOBRE LA COADYUVANCIA PLANTEADA. La coadyuvancia es una forma de intervención adhesiva que se da cuando una persona actúa en un proceso adhiriéndose a las pretensiones de alguna de las partes principales. Como consecuencia, está legitimada para actuar como coadyuvante quien ostente un interés directo en el resultado del recurso, pero al no ser actor principal, el coadyuvante no resultará directamente afectado por la sentencia, es decir, la eficacia de esta no podrá alcanzarle de manera directa e inmediata, ni le afecta la condición de cosa juzgada del pronunciamiento, aunque en materia de amparo pueda favorecerle la eficacia de lo resuelto, debido al carácter de "erga omnes " que tiene la jurisprudencia y precedentes de la jurisdicción constitucional (artículo 13 de la Ley de la Jurisdicción Constitucional).
Aclarado lo anterior, en este caso, la Sala procede a admitir la coadyuvancia activa planteada por Shirley Jara Vásquez, pues tiene un claro interés en el resultado de este proceso, ya que la violación al derecho a un medio ambiente sano constituye una actuación que perjudica a la colectividad.
