FAILURE TO ADDRESS CONSTRUCTION WORKS ALLEGEDLY CARRIED OUT IN AN ENVIRONMENTAL PROTECTION AREA IN SAN ANTONIO DE BELÉN IS REPORTED. AMPARO GRANTED IN PART FOR ADMINISTRATIVE DELAY, AND THE MUNICIPALITY OF BELÉN IS ORDERED TO RESOLVE THE COMPLAINT WITHIN ONE MONTH. VCG09/2026 “(…) V.- SPECIFIC CASE. The applicant brings this amparo application before this Constitutional Chamber (Sala Constitucional) and states that she filed a complaint about an environmental and health problem with the Municipality of Belén and the Belén-Flores Health Area, which, she alleges, has not been definitively addressed to date.

She explains, first, that wastewater and sewage are being irregularly discharged from property No. 0047893, located in San Antonio de Belén, into a nearby body of water (a river), thereby causing foul odors, environmental pollution, and a risk to public health.

She alleges that, although various actions have been taken, those actions do not in themselves establish that the irregular wastewater discharge has ceased or that the water resource in question is currently effectively protected.

She maintains that the subsequent approval of a design for infiltration trenches (zanjas de infiltración) amounts only to a documentary assessment of a proposed technical alternative; it does not establish that the solution has been properly implemented or that the previously confirmed pollution has ceased. Therefore, in her view, an on-site physical inspection is essential to determine whether the reported environmental problem has in fact been corrected.

She also states that, from the time the initial complaint was filed, the authorities were informed of possible construction works on the reported property, located near the Río Bermúdez, where environmental restrictions related to the protection of the water resource might apply. The complaint also stated that it was necessary to verify whether the works, earthworks (movimientos de tierra), construction of wastewater treatment systems, and other work carried out on the property complied with the applicable setbacks and alignments under the environmental regulations in force.

She therefore asserts that it is necessary to verify not only the proposed sanitation solution, but also that any work carried out does not affect a protection area or cause further harm to the water resource.

She requests that the amparo be granted and, in essence, that the respondent authorities be ordered to address the situations described above in a timely and specific manner.

Having reviewed the arguments submitted by the applicant, the reports filed by the respondent authorities—after due warning of the consequences provided for in Article 44 of the Ley de la Jurisdicción Constitucional—and all evidence in the record, this Constitutional Court considers that this amparo proceeding should be granted in part, for the reasons set out below.

A. As to the Municipality of Belén and the complaint concerning irregular discharge of wastewater and sewage into the river, the amparo must be denied:

First, it has been established that, from the time this matter was reported, the municipal authorities diligently addressed it. A thorough review of the findings of fact set out in this judgment fully substantiates that conclusion. The complaint in question was filed on 5 March 2026, and the following day the Municipality of Belén authorities inspected the property and conducted dye tests, which confirmed the reported facts and led them to instruct the reported parties to correct the problem. It is also on record that, a few days later, on 13 March 2026, the respondents, accompanied by the environmental manager of the Belén-Flores Health Area of the Ministry of Health, made another site visit. They found that the measures ordered to address and correct the irregular discharge of water into the river had not been complied with. As a result, on 23 March 2026—that is, in the same month the complaint was filed—the respondent municipality’s authorities notified the owner of the reported property of resolution No. DSP-ALS-R-003-2026, requiring improvements to the existing system, including modifications to the septic tank and construction of infiltration trenches.

It has also been verified that the respondent municipal authorities monitored the works proposal submitted in April 2026 by the engineer hired by the reported parties to comply with the order. After several reviews and follow-up actions, the proposal was finally approved on 14 May 2026.

The record likewise shows that, on 3 July 2026, the respondent municipal corporation’s authorities conducted another inspection of the reported property, together with the environmental manager of the Belén-Flores Health Area of the Ministry of Health. During the visit, they found that the required works had not yet been carried out. The Ministry’s authorities therefore issued three health orders concerning the property, with a deadline of 4 August 2026.

It was established that, on 21 and 23 July 2026, before this amparo was notified to the respondents, the municipal engineer responsible for sanitary sewer analysis asked the private engineer hired by the complainant to conduct a technical inspection to verify the completed works. The inspection was ultimately scheduled for 28 July 2026, also before the municipality was notified of this amparo.

It was established that, as agreed, on 28 July 2026 the municipal authorities inspected the site to determine whether the problem concerning wastewater management (blackwater and graywater) had been corrected through the completed works. The record shows that they inspected two of the three houses on the property, since no one was present at the third building to authorize entry. After conducting tests, they confirmed that “both the graywater and blackwater generated in the two houses inspected are conveyed to the existing treatment system.” Accordingly, the authorities reported under oath that “no wastewater discharges into the Río Bermúdez were observed; it is therefore concluded that the previously identified discharge was eliminated through the corrective works carried out.” As for the third house, the municipal authorities decided to conduct an inspection together with the Ministry of Health after the deadline in the health orders issued by that institution had passed, in order to verify compliance with the applicable corrective measures.

That being so, it has been shown that, from the time the complaint was filed, the Municipality of Belén authorities took multiple steps to address it, ultimately verifying that the corrective measures they ordered and the reported parties adopted—at least with respect to the discharge of wastewater and sewage into the river—were effective and eliminated the reported problem. It is also important to note that this verification took place several days before the deadline set by the Ministry of Health in its health orders had expired. Thus, although the third house had not been inspected on 28 July 2026, its occupants still had time to carry out the corrections, at least those required by the Ministry of Health, if they had not already done so by then.

Second, the record shows that on 23 March 2026, weeks before this amparo was filed, the municipal authorities notified the applicant of letter No. DSP-ALS-O-034-2026. That letter addressed the complaint, specifically the irregular discharge of water into the river, the inspections conducted, their results, and the measures ordered for the reported parties to correct the problem. It was also established that the municipal corporation’s authorities remained in regular telephone contact with the applicant regarding the improvement design ordered for the reported parties. Indeed, the record shows that in the last week of June 2026, also before this amparo was filed, she was told that the design for infiltration or drainage trenches submitted by the reported party had been approved because it met the applicable requirements.

In addition, although the record does not show that the applicant was notified of the results of the inspection conducted on 28 July 2026, in the circumstances described above that possible omission cannot be considered arbitrary. As noted, at that time the reported parties still had time to comply with the health orders issued by the Ministry of Health.

Accordingly, it has been established that, to date, the protected party has been fully informed of the processing and resolution of the complaint under review. A violation of constitutional Article 41 is therefore ruled out.

B. As to the Municipality of Belén and the complaint concerning construction in a protection area, the amparo must be granted: This is essentially because, after reviewing the record, it has not been established that the municipal authorities addressed or ruled on the applicant’s separate complaint concerning construction allegedly carried out on the property in question within an environmental protection area. By the time this amparo was filed, on 14 July 2026, more than four months had passed since the applicant reported this specific matter on 5 March of the current year. As stated, the record does not show that the municipal corporation addressed it or provided the complainant with a response. This omission does violate the protected party’s fundamental rights. Accordingly, this part of the amparo must be granted, with the consequences set out in the operative section of this judgment.

C. As to the Belén-Flores Health Area and the complaint concerning irregular discharge of wastewater and sewage into the river, the amparo must be denied:

First, when this amparo was filed on 14 July 2026, the authorities in question had received the applicant’s complaint about the situation under review—the irregular discharge of water into the river—formally less than one month earlier, on 25 June 2026. It therefore cannot be maintained that, by the time the matter was brought before the Chamber, an excessive and unreasonable period had passed for the Belén-Flores Health Area authorities to intervene formally and address the reported health problem.

Second, although the complaint was formally filed on 25 June 2026, the record shows that the Ministry of Health authorities had already intervened in the matter before then, in response to a request for assistance from the Municipality of Belén. Specifically, they had done so as early as 13 March 2026, when the relevant environmental manager inspected the reported property together with the municipality.

Third, the health authorities also acted promptly and diligently in response to the complaint, and no arbitrary omission on their part is apparent. In particular, the record shows that before this amparo was filed, they inspected the reported property on 3 July 2026. During that visit they conducted dye tests and confirmed the reported facts, which in turn prompted them to issue and notify the occupants of the three houses on the property of three health orders that same day. Through these administrative acts, the reported parties were given twenty-two business days to carry out the repairs and works required to prevent improper disposal of blackwater and sewage and its discharge into the river’s protection area. The deadline was 4 August 2026.

Fourth, the protected party came before this Chamber on 14 July 2026, when the reported parties still had time to comply with the health orders. Indeed, when the Director of the Belén-Flores Health Area filed his report on 29 July 2026, that office still had time to visit the reported property and verify whether the orders had been complied with.

Fifth, it was established that, as of 6 July 2026, days before this amparo was filed, the authorities of the health area had informed the applicant of the steps taken on her complaint. Specifically, they told her about the visit, the health orders, and the twenty-two-day compliance period. It was also verified that on 20 July 2026, before the Ministry was notified of this amparo, the applicant was again informed about the inspection and dye test conducted on 3 July 2026. She was also told that the positive dye test had led to the issuance of the corresponding administrative acts, which were attached, and that the health orders were still within the compliance period. Accordingly, no violation of constitutional Article 41 is established here.

D. As to the Belén-Flores Health Area and the complaint concerning construction in a protection area, the amparo must be denied:

This is essentially because it has been established that the applicant filed this specific request with the Ministry of Health on 10 July 2026, just four days before filing this amparo. It therefore cannot be maintained that, by the time the amparo was filed, an excessive and unreasonable period had passed for the request to be addressed. In any event, the record shows that on 20 July 2026, before the health area was notified of this amparo, the applicant was informed that construction permits and the location of the systems mentioned fell within the Municipality’s jurisdiction, not that of the Ministry of Health.

VI. NOTE OF INTEREST

Finally, in light of the arguments set out in the preceding section, the Municipality of Belén authorities are advised that they have a duty, as soon as possible and if they have not already done so, to inspect the third house, which could not be assessed on 28 July 2026, and determine whether its occupants have complied with the measures ordered, in order to definitively resolve the reported health and environmental problem. The municipal authorities are also advised that they have a duty to promptly communicate to the applicant the results of the inspections conducted at the three houses, particularly with respect to the irregular discharge of water.

The Belén-Flores Health Area authorities are also advised that, if they have not already done so, they have a duty to take the necessary steps, promptly visit the three houses mentioned, verify compliance with the health orders issued, and communicate the results to the applicant. They are further advised that, if the health orders have not been complied with, they must immediately order and implement additional measures to prevent further harm to health and the environment. (…)”

031080-26. AMBIENTE. MUNICIPALIDAD. PODER EJECUTIVO. PRONTA RESOLUCIÓN. SE DENUNCIA LA FALTA DE ATENCIÓN DE OBRAS CONSTRUCTIVAS, PRESUNTAMENTE REALIZADAS EN ZONA DE PROTECCIÓN AMBIENTAL EN SAN ANTONIO DE BELÉN. SE DECLARA PARCIALMENTE CON LUGAR, POR MORA ADMINISTRATIVA Y SE ORDENA A LA MUNICIPALIDAD DE BELÉN RESOLVER LA DENUNCIA EN UN MES. VCG09/2026 “(…) V.- CASO CONCRETO. La recurrente acude a esta Sala y señala que denunció un problema ambiental y sanitario ante la Municipalidad de Belén y ante el Área Rectora de Salud Belén-Flores, el cual, a la fecha, según aduce, no ha sido atendido definitivamente.

Explica, en primer término, que en la finca No. 0047893 ubicada en San Antonio de Belén se produce una descarga irregular de aguas residuales y sanitarias en un cuerpo de agua cercano (río) generando con esto malos olores, contaminación ambiental y riesgo para la salud pública.

Alega que, si bien se han realizado diversas actuaciones, estas no acreditan por sí mismas que la descarga irregular de aguas residuales haya cesado ni que el recurso hídrico involucrado cuente actualmente con una protección efectiva.

Sostiene que la aprobación posterior de un diseño de zanjas de infiltración constituye únicamente una valoración documental de una alternativa técnica propuesta, pero no equivale a una constatación de que dicha solución haya sido ejecutada correctamente, ni de que la contaminación previamente comprobada haya cesado. Por ello, en su criterio, resulta indispensable una verificación material en sitio que permita determinar que la problemática ambiental denunciada fue efectivamente corregida.

De otra parte, menciona que, desde la denuncia inicial presentada, también se puso en conocimiento de la administración la existencia de posibles obras constructivas dentro de la propiedad denunciada, ubicada en una zona cercana al Río Bermúdez, respecto de la cual podían existir restricciones ambientales aplicables, relacionadas con la protección del recurso hídrico. Asimismo, se denunció la necesidad de verificar si las obras, movimientos de tierra, construcción de sistemas de tratamiento de aguas residuales y demás intervenciones realizadas en la propiedad respetaban los retiros y alineamientos aplicables conforme a la normativa ambiental vigente.

Afirma, entonces, que corresponde verificar no solamente la solución sanitaria propuesta, sino también que cualquier intervención realizada no comprometa una zona de protección ni genere afectaciones adicionales al recurso hídrico.

Solicita que se declare con lugar el recurso y medularmente que se les ordene a las autoridades recurridas atender puntualmente las referidas situaciones expuestas.

Ahora bien, revisados los argumentos expuestos por la parte accionante, los informes rendidos por las autoridades recurridas –con oportuno apercibimiento de las consecuencias previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional–, así como todas las pruebas aportadas a los autos, este Tribunal Constitucional considera que este proceso de amparo debe ser acogido parcialmente. Esto, por los motivos que se indicarán a continuación.

A. En cuanto a la Municipalidad de Belén y la denuncia por descarga irregular de aguas residuales y sanitarias al río, el amparo se debe desestimar:

Primero, por cuanto se ha demostrado que, desde el momento en que este aspecto fue denunciado, fue diligentemente abordado y atendido por las autoridades municipales. Una lectura exhaustiva realizada al elenco de hechos probados consignado en esta sentencia permite tener plenamente por acreditado dicha afirmación. Nótese que la denuncia en cuestión fue interpuesta el 5 de marzo de 2026 y el día siguiente las autoridades de la Municipalidad de Belén realizaron una inspección y pruebas de coloración en el inmueble en cuestión que confirmaron los hechos acusados y conllevaron al giro de instrucciones a los denunciados para corregir dicha problemática. También, consta que, pocos días después, sea, el 13 de marzo de 2026, los recurridos, en compañía de la gestora ambiental del Área Rectora de Salud Belén-Flores del Ministerio de Salud, realizaron una nueva visita al sitio, mediante la cual se constató el incumplimiento de las medidas giradas de atención y corrección del vertido irregular de aguas al río.

Lo anterior conllevó a que el 23 de marzo de 2026 (sea, el mismo mes de interpuesta la denuncia), las autoridades del municipio recurrido le notificaron a la propietaria de la finca denunciada la resolución No. DSP-ALS-R-003-2026, mediante la cual se requirió la implementación de mejoras al sistema existente, incluyendo adecuaciones al tanque séptico y la construcción de zanjas de infiltración.

Paralelamente, se tiene por verificado que las autoridades municipales recurridas estuvieron al pendiente de la propuesta de obras planteada en abril de 2026 por el ingeniero contratado por los denunciados para atender la orden girada, siendo que, luego de varias revisiones y gestiones realizadas, esta última fue finalmente aprobada el 14 de mayo de 2026.

Igualmente, consta que el 3 de julio de 2026 las autoridades de la corporación municipal recurrida realizaron una nueva inspección en la propiedad denunciada, en conjunto con la gestora ambiental del Área Rectora de Salud Belén-Flores del Ministerio de Salud. Durante la visita se constató que aún no se habían ejecutado las obras requeridas, por lo cual las autoridades del citado ministerio giraron tres órdenes sanitarias vinculadas al citado inmueble con fecha de vencimiento el 4 de agosto de 2026.

Se demostró que, durante los días 21 y 23 de julio de 2026 (antes de notificado este amparo a los recurridos), el ingeniero municipal analista de alcantarillado sanitario le solicitó al ingeniero privado contratado por la parte denunciante la realización de una inspección técnica con el propósito de verificar las obras ejecutadas. Según se acreditó, dicha inspección fue programada finalmente para efectuarse el 28 de julio de 2026 (todo esto, antes también de que este amparo se le notificara a la municipalidad).

Se acreditó que el 28 de julio de 2026, tal y como fue acordado, las autoridades municipales realizaron inspección en el sitio a fin de verificar si la problemática relacionada con la gestión de las aguas residuales (negras y grises) había sido corregida mediante las obras ejecutadas. Consta que en tal ocasión se inspeccionaron dos de las tres viviendas ubicadas en la finca (pues en el tercer inmueble a no habían personas presentes que autorizaran el ingreso) y se comprobó, luego de las pruebas efectuadas, que “tanto las aguas residuales grises como las aguas residuales negras, generadas en las dos viviendas inspeccionadas, son conducidas al sistema de tratamiento existente”. En consecuencia, se informó bajo juramento que “no se evidenció la existencia de descargas de aguas residuales hacia el río Bermúdez, por lo que se concluye que el vertido previamente identificado fue eliminado mediante las obras correctivas ejecutadas”. Finalmente, en cuanto a la tercera vivienda, las autoridades municipales dispusieron realizar una inspección de forma conjunta con el Ministerio de Salud una vez vencido el plazo otorgado mediante las órdenes sanitarias emitidas por esa institución, con el fin de verificar el cumplimiento de las medidas correctivas correspondientes.

Dicho esto, se demuestra que las autoridades de la Municipalidad de Belén, desde el momento de presentada la denuncia, han realizado múltiples gestiones para atenderla, hasta finalmente verificar que las medidas de corrección giradas y adoptadas (al menos en lo tocante al vertido de aguas residuales y sanitarias en el río) han sido efectivas, eliminándose la problemática acusada. Además, es importante señalar que la verificación de este último estado de cosas se llevó a cabo días antes, incluso, de que venciera el plazo dispuesto al efecto por el Ministerio de Salud en las órdenes sanitarias giradas. De ahí que, aunque la tercera vivienda no hubiera sido inspeccionada el 28 de julio de 2026, lo cierto es que los habitantes de ese inmueble contaban aun con plazo para atender las correcciones (al menos las giradas por el ministerio de salud), en caso –solo eventualmente–, que no lo hubieran hecho para entonces.

Segundo, dado que, consta que el 23 de marzo de 2026 (semanas antes desde antes de formulado este amparo), las autoridades municipales le notificaron a la recurrente el oficio No. DSP-ALS-O-034-2026, a través del cual se hizo referencia a la denuncia planteada (concretamente en cuanto al vertido irregular de aguas en el río), a las inspecciones realizadas, a los resultados obtenidos y las medidas giradas a la parte denunciada para la corrección de la problemática. También, se demostró que las autoridades de la citada corporación municipal han mantenido constante comunicación con la recurrente vía telefónica, respecto al diseño de mejoras girado a la parte denunciada. Incluso, consta que en la última semana de junio de 2026 (antes también de formulado este amparo), se le explicó que la aprobación del diseño aportado por la denunciada de zanjas de infiltración o drenaje se había emitido por cumplirse los requerimientos establecidos al efecto.

Adicionalmente, cabe señalar que, si bien no consta que se le haya notificado a la recurrente una respuesta tocante a los resultados de la inspección efectuada el 28 de julio 2026, dicha eventual omisión, partiendo de las circunstancias supra descritas, no podría tenerse como arbitraria, en el tanto, se reitera, los denunciados, para entonces, aún contaban con plazo para cumplir las órdenes sanitarias también giradas por el Ministerio de Salud.

Bajo dicha inteligencia, se ha demostrado que la tutelada, en lo que corresponde hasta el momento, se ha mantenido plenamente informada del trámite y resolución de la denuncia bajo estudio, descartándose con esto una violación al numeral 41 constitucional.

B. En cuanto a la Municipalidad de Belén y la denuncia por construcciones realizadas en zona de protección, el amparo se debe acoger: Esto, medularmente, en el tanto, luego del estudio de los autos no se ha demostrado que las referidas autoridades municipales se hayan pronunciado y hayan atendido propiamente la denuncia también formulada por la recurrente relacionada con construcciones presuntamente realizadas en el inmueble en cuestión en zona de protección ambiental. Para la fecha de formulado este amparo, sea, el 14 de julio de 2026, había trascurrido un plazo excesivo de más de cuatro meses desde que este aspecto en concreto se denunció por la recurrente el 5 de marzo del año en curso y, como se dijo, no consta que haya sido abordado y atendido por la corporación municipal; tampoco, que una respuesta sobre el particular se le haya brindado a la denunciante. Dicha omisión sí representa una violación a los derechos fundamentales de la tutelada. Por ende, este este extremo del amparo se debe estimar, con las consecuencias que se dirán en la parte dispositiva de la presente sentencia.

C. En cuanto al Área Rectora de Salud Belén-Flores y la denuncia por descarga irregular de aguas residuales y sanitarias al río, el amparo se debe desestimar:

Primero, habida cuenta que, cuando se interpuso este amparo (14 de julio de 2026), las referidas autoridades tenían poco menos de un mes de haber recibido formalmente (el 25 de junio de 2026) la denuncia planteada por la recurrente para atender la situación bajo estudio (vertido irregular de aguas en el río). De ahí que, no pueda sostenerse que, al momento en que se acudió a la Sala, había trascurrido un plazo excesivo e irrazonable a efecto que las autoridades del Área Rectora de Salud Belén-Flores, hubieran intervenido formalmente y atendido la problemática sanitaria expuesta.

Segundo, dado que, en todo caso, aun cuando formalmente la denuncia se planteó el 25 de junio de 2026, consta que las autoridades del Ministerio de Salud, de previo y, en atención a colaboración requerida por la Municipalidad de Belén, ya habían intervenido en el caso bajo estudio, específicamente, desde el 13 de marzo de 2026. Ocasión última en la que la respectiva gestora ambiental realizó una inspección en conjunto con el municipio en la finca denunciada.

Tercero, ya que, se demostró que, con motivo de dicha denuncia, igualmente, las autoridades en salud actuaron oportuna y diligentemente, sin que se advierta alguna arbitraria omisión de su parte. Particularmente, consta que, antes de formulado este amparo, realizaron una inspección el 3 de julio de 2026 en la propiedad denunciada; ocasión en la cual se ejecutaron pruebas de coloración y se comprobaron los hechos denunciados, lo cual, a su vez, motivó al dictado y notificación, ese mismo día, de tres órdenes sanitarias a los habitantes de las tres viviendas halladas en el inmueble. Actos administrativos mediante los cuales, a su vez, se les otorgó a los denunciados veintidós días hábiles para realizar las reparaciones y obras requeridas para evitar la inadecuada disposición de aguas negras y servidas y su vertido en la zona de protección del río (concretamente, con fecha de vencimiento el 4 de agosto de 2026).

Cuarto, en el tanto, la tutelada acudió a esta Sala el 14 de julio de 2026, cuando, para entonces, las personas denunciadas aún contaban con plazo para cumplir lo dispuesto en las referidas órdenes sanitarias giradas. Incluso, nótese que, al momento de rendido el informe por el Director del Área Rectora de Salud de Belén-Flores, sea, el 29 de julio de 2026, dicha instancia contaba con plazo para acudir al inmueble denunciado y verificar que lo ordenado hubiera sido efectivamente cumplido.

Quinto, por cuanto se demostró que, desde el 6 de julio de 2026 (días antes de formulado este amparo), las autoridades de la citada área rectora de salud le informaron a la recurrente el trámite llevado a cabo respecto a su denuncia. Específicamente, se le informó sobre la visita realizada, el de órdenes sanitarias y el plazo otorgado de veintidós días para su cumplimiento. Concomitantemente, se verificó que el 20 de julio de 2026 (antes de notificado este amparo al citado ministerio), se le informó a la recurrente nuevamente sobre la inspección y prueba de coloración el 3 de julio de 2026. Se le aclaró también que, al tener la prueba de coloración positiva, se giraron los actos administrativos correspondientes (los cuales se le adjuntaron) y se le indicó, además, que las órdenes sanitarias aún se encontraban en plazo. Por ende, una violación al artículo 41 constitucional no se tiene configurada en la especie.

D. En cuanto al Área Rectora de Salud Belén-Flores y la denuncia por construcciones realizadas en zona de protección, el amparo se debe desestimar:

Esto medularmente, en el tanto se ha demostrado que esta precisa gestión la formuló la recurrente ante el Ministerio de Salud el día 10 de julio de 2026, sea, cuatro días antes de formulado este amparo. De ahí que, no se podría sostener que, al momento de interpuesto este amparo, había trascurrido un plazo excesivo e irrazonable para su atención al momento. En todo caso, consta que el 20 de julio de 2026 (antes de notificado este amparo al área rectora), se le informó a la recurrente que lo tocante al permiso de construcción y la ubicación de los sistemas señalados era competencia de la Municipalidad y no del Ministerio de Salud.

VI. NOTA DE INTERÉS

Finalmente, en virtud de los argumentos expuestos en el considerando anterior, resulta menester señalares a las autoridades de la Municipalidad de Belén que es su deber realizar lo antes posible (en caso de no haberla realizado antes) una inspección en la tercera vivienda que no pudo ser valorada el pasado 28 de julio de 2026 y determinar si las medidas giradas a sus habitantes han sido o no cumplidas en aras de solventar de manera definitiva el problema sanitaria y ambiental denunciado. Igualmente, se les indica a las autoridades municipales que es su deber comunicar prontamente el resultado de las inspecciones realizadas a las referidas tres viviendas a la parte recurrente (en particular, lo tocante al tema del vertido irregular de aguas).

Adicionalmente, se les indica a las autoridades del Área Rectora de Salud de Belén-Flores que es su deber (en caso de no haberlo hecho antes), gestionar lo pertinente y, de forma pronta, acudir a las tres viviendas citadas, verificar el cumplimiento de las órdenes sanitarias giradas y comunicar su resultado a la recurrente. Asimismo, se les señala que, en caso que lo dispuesto en las referidas órdenes sanitarias no se haya cumplido, deberán disponer y ejecutar inmediatamente medidas adicionales para evitar que no se continúe dañando la salud y el ambiente. (…)”
