Res. 30939-2026 Sala Constitucional · Sala Constitucional · 13/08/2026
OutcomeResultado
The majority granted the amparo application; in a separate opinion, Justice Garro Vargas proposed that enforcement proceed before the Enforcement Area of the Administrative and Civil Treasury Court.
SummaryResumen
Justice Garro Vargas agrees with the majority that the amparo application should be granted, but dissents on enforcement: she proposes that the Enforcement Area of the Administrative and Civil Treasury Court supervise compliance. She notes that, within six and twelve months, MINAE, the Municipality of Alajuela, and the Ministry of Health must delimit the Ciruelas River protection area, determine whether the protected strip has been affected, and plan a definitive solution to the reported environmental problems. In her view, the enforcement rules in the Administrative Litigation Procedure Code allow the parties to request schedules, impose fines, establish responsibility, and monitor stages of compliance. This proposal is a separate opinion on the operative part; the excerpt does not change the majority’s decision to grant the amparo application.
Key excerptExtracto clave
By contrast, the provisions of the Administrative Litigation Procedure Code on enforcement (Article 155 et seq.) have clear advantages, such as the possibility of requesting schedules, imposing fines, establishing responsibility, and monitoring stages of compliance, among others. Therefore, in accordance with Article 56 of the Constitutional Jurisdiction Act, I consider that the enforcement phase should take place before the Enforcement Area of the Administrative and Civil Treasury Court, under that Code’s judgment-enforcement rules.

X.Dissenting opinion of Justice Garro Vargas regarding the operative part of this judgment. Although I agree with the majority of the Constitutional Chamber (Sala Constitucional) that the amparo application should be granted, I disagree about where the enforcement phase of the matter should be conducted, because the rules governing this constitutional jurisdiction provide no suitable mechanisms for monitoring a judgment that involves technical matters of some complexity. In this case, within six months and twelve months, MINAE, the Municipalidad de Alajuela, and the Ministerio de Salud must first delimit the protection area of the río Ciruelas and determine whether the protected strip defined by the applicable forestry regulations has been affected; second, they must provide a definitive solution to all the environmental problems alleged by the applicants in this amparo. By contrast, the provisions of the Código Procesal Contencioso-Administrativo on enforcement (Article 155 and following) offer clear advantages, such as the possibility of requesting schedules, imposing fines, assigning responsibility, and monitoring stages of compliance.
Therefore, pursuant to Article 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement phase should take place before the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code. (…)
