(…) VII.- NOTE BY JUSTICE SALAZAR ALVARADO. In environmental matters, it is my view that, if the Public Administration has already intervened, the matter falls within the jurisdiction of the administrative-litigation jurisdiction. Nevertheless, I do address the merits when other rights of the people affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy environment free from contamination (Article 50 of the Political Constitution). That is the case here: the applicant alleges that the Municipalidad de Pococí and the Ministerio de Salud have not effectively addressed repeated complaints about the persistent accumulation of rainwater and wastewater in barrio Coopevigua 2 in Guápiles. According to the allegations, this situation causes foul odors, the proliferation of mosquitoes, flies, and other insects, and exposes community residents to the risk of contracting diseases, thereby endangering public health; for that reason, they have come before this Chamber. The situation described is an exception to my general position on this matter. I therefore consider it necessary for this Constitutional Court to examine the merits in order to verify or dismiss the applicant’s allegations. (…) NQC08/2026

En asuntos ambientales, es criterio del suscrito, que, si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente alega que la Municipalidad de Pococí y el Ministerio de Salud no han atendido eficazmente reiteradas denuncias presentadas por la persistente acumulación de aguas pluviales y residuales en barrio Coopevigua 2 de Guápiles, situación que, según alegan, provoca malos olores, proliferación de zancudos, moscas y otros insectos, y expone a los habitantes de la comunidad al riesgo de contraer enfermedades, con riesgo a la salud pública, motivo por el cual acuden ante esta Sala. La situación descrita constituye una excepción a mi posición general en esta materia, por lo que estimo necesario que este Tribunal Constitucional analizara por el fondo el asunto, con el fin de verificar o descartar los alegatos de la parte recurrente.
