V.The specific case. It is clear from the established facts that the problem reported by the applicants is not merely hypothetical nor based solely on subjective assessments. On the contrary, it was confirmed by the respondent authorities themselves.
On 7 July 2026, the Municipality of Pococí found that the drainage system was obstructed and that this prevented stormwater from flowing properly, causing it to stagnate in the roadside ditch and on the public road. The Ministry of Health, for its part, verified the presence of stagnant wastewater, grease residue, foul odors, flies, and inadequate wastewater disposal systems.
It is also established that the authorities knew about the situation before this proceeding was filed. The Municipal Council had considered requests concerning drainage problems since 2021, and the Municipal Environmental Control Process had referred the case to the Ministry of Health in February 2025. In turn, the Área Rectora de Salud received a complaint in December 2025 and, in January 2026, confirmed that the wastewater treatment system at the commercial establishment had failed.
Despite this, the Municipality conducted the new inspection and cleaned the drainage system only after this amparo application had been admitted for processing. Although these actions are positive and are aimed at remedying part of the problem, they do not negate the prior omission or establish that a definitive solution has been provided, particularly because the accumulation of water was also caused by wastewater discharges from private properties.
As for the Ministry of Health, although it issued health order No. MS-DRRSHC-ARSP-05-2026 in January 2026, compliance was not verified until 15 July of that year, by which time the deadline granted had long since passed and the amparo was already under consideration. That inspection confirmed that, despite the work carried out, wastewater continued to surface. In addition, tests intended to identify other sources of irregular discharge were likewise conducted only after the amparo had been admitted for processing, and, when the report was submitted, issuance or service of a health order concerning one of the properties was still pending.
Thus, the administrative actions themselves establish that the intervention before this proceeding was insufficient to effectively protect the rights of community residents. It is not enough to receive complaints, conduct inspections, or issue health orders; their compliance must be verified in a timely manner and, if the irregularities persist, the measures provided for in the legal system must be implemented to stop them.
On the other hand, this jurisdiction may not substitute its judgment for the technical assessment of the health authorities or specifically order the constant fumigation sought by the applicants, since the technical report explains that this measure is not necessarily the most effective way to address the cause of the proliferation of vectors. It is for the Ministry of Health to determine, in accordance with science and technology, which control measures are appropriate. Nor is it for this Chamber to automatically order that the street be paved or that a public works project with specified characteristics be built. What the Constitution requires is that the Municipality adopt, within a reasonable period, the technical measures necessary to ensure proper drainage and prevent water from accumulating on the public road.
Consequently, there has been a violation of the rights protected by Articles 21 and 50 of the Political Constitution, because, when the amparo was filed, a known public health and environmental problem persisted without the authorities having provided a comprehensive, timely, and effective response.
VI.Actions taken during the processing of the amparo. This Court does not overlook that, after the amparo was filed, the Municipality cleaned the drainage system and the Ministry of Health conducted further inspections, fluorescein tests, vector-control work, and issued several health orders.
However, these actions are insufficient to provide an effective and comprehensive solution to the problem raised. Moreover, in this case there is no certainty that the harm has ceased completely, since, when the reports were submitted, verification of several health orders, service of another administrative act, and adoption of a comprehensive solution for managing stormwater and wastewater remained pending. For that reason, the amparo must be granted against both respondent authorities, on the terms set out in the operative part of this judgment. (…)

V.Sobre el caso concreto. Del elenco de hechos probados se desprende que la problemática denunciada por los recurrentes no es meramente hipotética ni se encuentra sustentada únicamente en apreciaciones subjetivas. Por el contrario, fue comprobada por las propias autoridades recurridas.
La Municipalidad de Pococí constató el siete de julio de dos mil veintiséis que el sistema de drenaje se encontraba obstruido y que esa condición impedía el adecuado discurrir de las aguas pluviales, lo cual ocasionaba su estancamiento en la cuneta y en la vía pública. El Ministerio de Salud, por su parte, verificó la existencia de aguas residuales estancadas, restos de grasa, malos olores, moscas y sistemas inadecuados de disposición de aguas servidas.
También se encuentra demostrado que las autoridades conocían la situación desde antes de interponerse este proceso. El Concejo Municipal había conocido gestiones relacionadas con los problemas de drenaje desde el año dos mil veintiuno y el Proceso de Control Ambiental Municipal había remitido el caso al Ministerio de Salud desde febrero de dos mil veinticinco. A su vez, el Área Rectora de Salud recibió una denuncia en diciembre de dos mil veinticinco y, en enero de dos mil veintiséis, comprobó que el sistema de tratamiento de aguas residuales del establecimiento comercial se encontraba colapsado.
Pese a ello, la Municipalidad efectuó la nueva inspección y la limpieza del sistema de drenaje únicamente después de cursado este recurso. Si bien tales actuaciones son positivas y se encuentran dirigidas a remediar parte de la problemática, no desvirtúan la omisión precedente ni acreditan una solución definitiva, particularmente porque la acumulación de aguas obedecía también a descargas residuales procedentes de inmuebles privados.
En cuanto al Ministerio de Salud, aunque emitió la orden sanitaria N° MS-DRRSHC-ARSP-05-2026 en enero de dos mil veintiséis, su cumplimiento fue verificado hasta el quince de julio siguiente, cuando ya había transcurrido ampliamente el plazo concedido y el recurso se encontraba en trámite. Esa inspección permitió comprobar que, pese a las labores ejecutadas, el afloramiento de aguas residuales continuaba. Además, las pruebas dirigidas a identificar otras fuentes de descarga irregular se practicaron igualmente después de cursado el amparo y, al momento de rendirse el informe, todavía se encontraba pendiente emitir o notificar una orden sanitaria respecto de uno de los inmuebles.
De ese modo, las propias actuaciones administrativas acreditan que la intervención anterior a este proceso fue insuficiente para proteger de manera efectiva los derechos de los habitantes de la comunidad. No basta con recibir denuncias, efectuar inspecciones o dictar órdenes sanitarias; es indispensable verificar oportunamente su cumplimiento y, de persistir las irregularidades, ejecutar las medidas previstas en el ordenamiento jurídico para hacerlas cesar.
Por otra parte, no corresponde a esta jurisdicción sustituir el criterio técnico de las autoridades sanitarias ni ordenar específicamente la fumigación constante pretendida por los recurrentes, pues el informe técnico explica que esa medida no constituye necesariamente la alternativa más eficaz para tratar el origen de la proliferación de vectores. Corresponde al Ministerio de Salud determinar, conforme a la ciencia y la técnica, cuáles acciones de control resultan adecuadas. Tampoco compete a esta Sala ordenar, de manera automática, el asfaltado de la calle o la construcción de una obra pública con características determinadas. Lo constitucionalmente exigible es que la Municipalidad adopte, dentro de un plazo razonable, las medidas técnicas necesarias para asegurar el adecuado drenaje de las aguas y evitar su acumulación en la vía pública.
En consecuencia, se acredita una lesión de los derechos protegidos en los artículos 21 y 50, de la Constitución Política, pues al momento de interponerse el recurso persistía una problemática sanitaria y ambiental conocida por las autoridades, sin que se hubiera brindado una respuesta integral, oportuna y efectiva.
VI.Sobre las actuaciones realizadas durante la tramitación del recurso. No desconoce este Tribunal que, después de interpuesto el amparo, la Municipalidad limpió el sistema de drenaje y el Ministerio de Salud realizó nuevas inspecciones, pruebas con fluoresceína, labores de control vectorial y emitió varias órdenes sanitarias.
Sin embargo, tales actuaciones no resultan suficientes para ofrecer una solución efectiva e integral al problema planteado. En el caso concreto, además, no existe certeza de que la afectación haya cesado completamente, pues al rendirse los informes continuaban pendientes la verificación de varias órdenes sanitarias, la notificación de otro acto administrativo y la adopción de una solución integral para el manejo de las aguas pluviales y residuales. Por ello, el recurso debe declararse con lugar contra ambas autoridades recurridas, en los términos que se indican en la parte dispositiva de esta sentencia. (…)
