(…) V.- NOTE OF JUSTICE SALAZAR ALVARADO In environmental matters, it is also my view that, if there has already been intervention by the Public Administration, consideration and resolution of the matter fall within the administrative-litigation jurisdiction. Nevertheless, I do consider the merits when other rights of the people affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy an environment that is healthy and free from contamination (Article 50 of the Political Constitution), as in this case, in which the applicant alleges that, since January 2026, the respondent municipality has been carrying out a series of works in the Playa Hermosa area, in front of the Bowies Point Bar and Vida Hermosa Beach Bar and Restaurant. The applicant complains that, despite the foregoing, the works involve felling and clearing trees, removing topsoil, clearing debris, cutting and filling with earth, among other things, on a parcel located along the Costanera Sur highway, where a wide variety of flora and fauna are found. The applicant alleges that, for this purpose, the municipality lacks the permits required to carry out those works, causing environmental harm and harm to the community of Garabito, to the detriment of a healthy and ecologically balanced environment and a dignified quality of life. (…) V.- NOTA DEL MAGISTRADO SALAZAR ALVARADO. En asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente acusa que la municipalidad accionada realiza desde el mes de enero de 2026 una serie de trabajos en la zona de Playa Hermosa, frente a los restaurantes Bowies Point Bar, Vida Hermosa Beach Bar y Restaurant. Reclama que, pese a lo anterior, los trabajos involucran la tala y desmonte de árboles, despalmar, retirar escombros, cortar y rellenar con tierra, entre otros, en un terreno que se ubica sobre la ruta Costanera Sur, en el que se encuentra gran variedad de flora y fauna.
Alega que, para tal efecto, el municipio no cuenta con los permisos respectivos para ejecutar dichos trabajos, lo que ocasiona daño ambiental y a la comunidad de Garabito, en detrimento de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida. (…) NQC08/2026
