2026029072. MUNICIPALITY. PUBLIC SERVICES. IT IS ALLEGED THAT THE SUSPENSION AND LOW PRESSURE IN THE DRINKING WATER SUPPLY AFFECT THE LIVING CONDITIONS OF THE INHABITANTS OF TUETAL DE CAFÉ, ALAJUELA. THE CHAMBER CONSIDERS THAT THE EFFECTS ARE DUE TO CLIMATIC FACTORS AND REDUCED AVAILABILITY OF WATER RESOURCES, AND THAT THE MUNICIPALITY HAS ADOPTED OPERATIONAL MEASURES AND IS CARRYING OUT WORKS TO IMPROVE THE SERVICE. THE AMPARO APPLICATION IS DECLARED WITHOUT MERIT. NQC08/2026 (…) IV.- The specific case. To resolve the specific case, it should first be noted that, according to the reiterated criterion of the Constitutional Chamber (Sala Constitucional), the human right to drinking water does not entail a guarantee of uninterrupted supply at all times, but rather the State’s duty to ensure reasonable, safe, sufficient, and healthful access to water resources, taking into account technical and natural limitations (see, in that regard, judgments no. 2025-013762 at 09:15 on 9 May 2025 and no. 2026-010001 at 09:20 on 20 March 2026).

In this regard, in relation to the subject of this proceeding, it has been established that the municipal aqueduct’s optimal performance is affected by the following causes: a) progressive deterioration of the recharge cycle of the springs (nacientes); and b) climatic factors such as the intense and prolonged dry season the country is experiencing.

As for the problem reported by the applicant, contrary to what was alleged, the respondents stated under oath—with the consequences, including criminal ones, provided for in Article 44 of the Ley de la Jurisdicción Constitucional—that there has been no complete interruption in the drinking water system in the areas of Tuetal Norte and Tuetal Sur, but only low pressure in the network. In addition, the established facts show that the respondents have taken operational measures to mitigate the impact on the population (see established fact d).

In light of the foregoing, it has been established that the irregularities in the water supply through the municipal aqueduct stem from events beyond the respondents’ control. For that reason, the respondent municipality is not found to bear any responsibility, since it has implemented the measures needed to prevent a complete interruption of the water service. Accordingly, no violation of fundamental rights is apparent on the terms set out in the initial petition, since the events affecting the normal supply did not result from negligence or arbitrariness on the part of the respondents. It is also verified that they are carrying out short-term improvements and permanent works to improve the water supply (see established fact g).

Consequently, this amparo proceeding must be dismissed.

V.Finally, the applicant maintains that the respondent Municipality does not address the reports he has submitted; however, he gives no specific dates or provides supporting evidence. For that reason, it has not been established that the applicant submitted a report to the Municipality of Alajuela that remains pending resolution. It is therefore ruled out that there has been any failure to act or omission that this Chamber could declare.

Consequently, this amparo proceeding must be dismissed. (…)

2026029072. MUNICIPALIDAD. SERVICIOS PUBLICOS. SE ALEGA QUE LA SUSPENSIÓN Y BAJA PRESIÓN EN EL SUMINISTRO DE AGUA POTABLE AFECTAN LAS CONDICIONES DE VIDA DE LOS HABITANTES DE TUETAL DE CAFÉ, ALAJUELA. LA SALA CONSIDERA QUE LAS AFECTACIONES OBEDECEN A FACTORES CLIMÁTICOS Y A LA DISMINUCIÓN DE LA DISPONIBILIDAD DEL RECURSO HÍDRICO, Y QUE LA MUNICIPALIDAD HA ADOPTADO MEDIDAS OPERATIVAS Y EJECUTA OBRAS PARA MEJORAR EL SERVICIO. SE DECLARA SIN LUGAR EL RECURSO. NQC08/2026 (…) IV.- Sobre el caso concreto. Para la resolución del caso concreto, en primer lugar, conviene señalar que, de acuerdo con el criterio reiterado de la Sala Constitucional, el derecho humano al agua potable no implica la garantía de un suministro ininterrumpido en todo momento, sino el deber del Estado de asegurar un acceso razonable, seguro, suficiente y salubre al recurso hídrico, tomando en cuenta las limitaciones técnicas y naturales (ver en ese sentido las sentencias nro. 2025-013762 de las 09:15 horas del 9 de mayo de 2025 y nro. 2026-010001 de las 09:20 horas del 20 de marzo de 2026).

Ahora bien, en relación con el objeto de este proceso, se tiene por demostrado que el rendimiento óptimo del acueducto municipal se ve afectado por las siguientes causas: a) deterioro progresivo del ciclo de recarga de las nacientes; y b) factores climáticos como la época de verano intensa y prolongada que atraviesa el país.

Sobre la problemática denunciada por el recurrente, se tiene que, contrario a lo alegado, los recurridos informaron bajo la solemnidad del juramento -con las consecuencias, incluso penales, que prevé el numeral 44 de la Ley de la Jurisdicción Constitucional- que en el sistema de agua potable en las zonas de Tuetal Norte y de Tuetal Sur no ha existido una interrupción absoluta, sino únicamente una baja presión en la red. Adicionalmente, del elenco de hechos probados se tiene que los recurridos han efectuado medidas operativas para mitigar el impacto en la población (ver hecho probado d).

En virtud de lo expuesto, se tiene por demostrado que las irregularidades en el suministro de agua a través del acueducto municipal responden a eventos fuera del control de los recurridos, motivo por el cual no se aprecia que el municipio accionado tenga algún tipo de responsabilidad, toda vez que han implementado aquellas medidas necesarias para evitar que se dé una interrupción absoluta en el suministro del servicio de agua. Por lo anterior, al no advertirse violación alguna a los derechos fundamentales en los términos planteados en el memorial inicial, por cuanto los eventos que afectaron el suministro normal no fueron producto de negligencias o arbitrariedad de parte de los recurridos. Además, se verifica que se encuentran ejecutando mejoras a corto plazo y de forma definitiva para mejorar el suministro de agua (ver hecho probado g).

En consecuencia, lo que corresponde es desestimar este proceso de amparo.

V.Finalmente, el recurrente sostiene que la Municipalidad recurrida no atiende los reportes que ha presentado; sin embargo, no menciona fechas concretas ni aporta prueba al respecto, por tal razón no se tiene por demostrado que el recurrente haya presentado un reporte ante la Municipalidad de Alajuela y que esté pendiente de resolución. De ahí que se descarta que exista una inacción u omisión susceptible de ser declarada por esta Sala.

En consecuencia, lo que corresponde es desestimar este proceso de amparo. (…)
