SummaryResumen
The Constitutional Court granted an amparo petition filed by residents of Finca San Juan, Pavas, over chronic raw sewage overflow that since 2019 has contaminated public roads, generated disease vectors, and harmed the community's health and dignity. The Court found that the Municipalidad de San José, the Instituto Costarricense de Acueductos y Alcantarillados (AyA), and the Ministerio de Salud all committed serious omissions, deflecting responsibility among themselves without implementing a definitive solution despite inspections, sanitary orders, fines, and prior rulings. The Court reaffirmed that Article 50 of the Constitution obligates the State to guarantee the right to a healthy environment and that institutional incapacity is no excuse. It ordered all three institutions to coordinate a comprehensive solution within the remaining period from prior sentence No. 2026004335, and condemned the Municipality, the State, and AyA to pay litigation costs, damages, and losses.
Key excerptExtracto clave
Article 50 of the Constitution expressly recognizes the right of all inhabitants of the country to enjoy a healthy and perfectly balanced environment. That right is a fundamental guarantee for the protection of life and public health. In support of this, the Court has resorted to the notion of 'environmental quality' as a parameter of people's quality of life, one that interacts with other elements such as health, food, work, and housing, noting that every person has the right to use the environment for their own development but not without limits, since there is also a duty to protect and preserve the environment for present and future generations—the principle of sustainable development. In consistent jurisprudence the Court has stated that it cannot be accepted that human beings be denied the right to a healthy environment or the right to health due to the incapacity of the corresponding authorities to effectively exercise the powers of oversight and problem-solving granted by law. Indeed, this Court considers that state activity must proceed in a coordinated and effective manner, because it is not simply a matter of identifying the problem and assigning blame to others, as has occurred in this case, nor does it fall to this Court to prescribe for each institution the solutions to be implemented; rather, once the matter is assessed, an integral solution must be provided, for which, under the system of distribution of competences and functions of a State, all those involved must participate, each contributing what ultimately corresponds to it. In accordance with the foregoing, this Court determines that both the Municipalidad de San José, the Instituto Costarricense de Acueductos y Alcantarillados, and the Ministerio de Salud must coordinate a definitive solution to the sanitary problem affecting the Finca San Juan community in Pavas. Consequently, the appropriate course is to declare the petition granted.

2026028821. MUNICIPALITY. EXECUTIVE BRANCH. ENVIRONMENT. THE ALLEGED FAILURE OF A Y A, THE MINISTRY OF HEALTH, AND THE MUNICIPALITY OF SAN JOSÉ TO RESOLVE THE OVERFLOW OF WASTEWATER IN FINCA SAN JUAN, PAVAS. THE COURT FINDS THAT THE VIOLATION OF THE RIGHTS TO HEALTH, A HEALTHY ENVIRONMENT, AND PUBLIC HEALTH PERSISTS, DUE TO NON-COMPLIANCE WITH WHAT WAS ORDERED IN JUDGMENT No. 2026004335. THE WRIT IS GRANTED AND THE AUTHORITIES ARE ORDERED TO IMPLEMENT THE DEFINITIVE SOLUTION WITHIN THE REMAINING DEADLINE SET IN THAT JUDGMENT. NQC08/2026 (…)
IV.On the Specific Case. In the sub lite, the petitioner alleges that since March 2024 there has been an overflow of sewage (aguas negras) at Finca San Juan, Pavas, which flows into the stormwater system (sistema pluvial). The petitioner argues that this situation has produced wastewater (aguas residuales) in public thoroughfares, the infiltration of gases into homes, unbearable odors, and a massive presence of disease vectors, all of which the petitioner considers harmful to the health, safety, and dignity of the residents. The petitioner notes that the Municipality of San José, the Instituto Costarricense de Acueductos y Alcantarillados, and the Ministry of Health are aware of this situation; however, no solution has been obtained. The petitioner requests the intervention of the Court.
In this regard, from the recital of proven facts it emerges that on April 11, 2024, the petitioner filed the following complaint with the mayor's office (alcaldía) of San José: "My name is [Nombre 001], ID # [Valor 002]. On behalf of the residents of Finca San Juan – [...], we have already filed the relevant complaints with the Ministry of Health under case D-0039-2024 related to sewage, which indicates that it is the Municipality of San José that should resolve this public health problem; we also filed a complaint with AYA, which responded via email IN.CS N° 0067 2024 stating that they do not want to take responsibility, claiming that no resources are allocated to this area; however, there are storm drainage networks and sewage pipes here. We the residents, acting in full compliance with our responsibilities, request that the sewage problem be resolved as soon as possible, as very strong odors have begun to appear and people have started to fall ill, this being a public health problem that affects us all." By official communication MSJ-ALCALDIA-AI-782-2024 of April 26, 2024, the municipal authorities replied to the petitioner: "In response to your request, regarding municipal collaboration and the sewage problem at Finca San Juan – Pavas, alameda 156, block 4, in front of store JYL, I enclose official communication No. SCMRP168-2024, which was sent to Dr. Ana Isabel Rodríguez Sánchez, Director of the Pavas Health Area, in which a response to the existing problem at the site is provided." On February 19, 2025, the Ministry of Health served sanitary order (orden sanitaria) No. MS-DRRSCS-DARS-P-OS-006-2025 on the Municipality of San José, requiring it to: "Within a period of no more than 08 calendar months from the date of this notification, carry out the repairs necessary to complete the corresponding sanitary sewer network (red de alcantarillado sanitario) in the area of (alamedas 14, 15, and 16) located in Pavas Finca San Juan, 10 meters east and 5 meters south of Super Alfa, on calle 156 C, so that these areas have an adequate system for the disposal of sewage and wastewater and so that such sewage and wastewater does not obstruct or overflow into public thoroughfares.
The respondent authorities acknowledge that the wastewater situation at Finca San Juan has not been resolved. That being the case, it cannot be overlooked that the problem complained of has already been the subject of judgments by this Court, yet has still not been resolved. In this regard, by judgment No. 2026004335 of 9:20 a.m. on February 6, 2026, a writ of amparo (recurso de amparo) was granted, based on the following grounds.
"WHEREAS:
I.Preliminary matter. Before analyzing the merits of the case—on account of the alleged violation of the right to prompt and effective proceedings—it should be clarified that, pursuant to judgment No. 2008-02545 of 8:55 a.m. on February 22, 2008, this Court has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those matters in which it is disputed whether the public administration has or has not complied with the timeframes established by the Ley General de la Administración Pública (artículos 261 y 325), or by the sector-specific laws governing special administrative procedures, both for issuing a final administrative act (acto final) to conclude an administrative proceeding—whether initiated ex officio or at the request of a party—and for deciding on the applicable administrative appeals. Precisely, this case presents an exceptional scenario, as it involves a complaint filed regarding a water seepage problem that has allegedly not been addressed. Having clarified this point, the Court proceeds to resolve the specific situation raised in this writ of amparo.
The petitioner considers her fundamental rights to have been violated. The petitioner states that since 2024 there has been a continuous overflow of sewage in alamedas 14, 15, and 16 of Finca San Juan, Pavas, a situation that causes contamination, foul odors, the risk of gastrointestinal and skin diseases, and that significantly affects the petitioner's family, minor children, and neighbors. The petitioner asserts that despite having filed the respective complaints with the Ministry of Health, the Instituto Costarricense de Acueductos y Alcantarillados, the Instituto Nacional de Vivienda y Urbanismo, and the Municipality of San José, the problem has not been resolved.
The following facts are considered duly established as relevant to the resolution of this matter:
Between 2019 and 2021, the Instituto Costarricense de Acueductos y Alcantarillados participated in a committee led by the Municipality of San José, in which other institutions also participated (MIVAH, INVU, etc.), to address the wastewater overflow problem in the Finca San Juan, Pavas sector. As part of the work carried out by AyA, the terms of reference for the contracting of preliminary studies, design, and construction of a wastewater treatment plant (planta de tratamiento de aguas residuales) were delivered (see Official Communication DRyT-2021-00147).
On June 6, 2024, the Health Regulatory Area (Área Rectora de Salud) of Pavas received a complaint regarding wastewater overflow and a blocked drain in alamedas 14, 15, and 16 of Finca San Juan, Pavas, directed against the Instituto Costarricense de Acueductos y Alcantarillados. That complaint alleged that the described situation was causing a continuous overflow of sewage and contamination. The respondent health regulatory area processed the complaint and assigned it case number D 091-2024 (see the report submitted and supporting documentation).
On June 18, 2024, the respondent health regulatory area conducted an on-site inspection and confirmed that several sewer drains along the alameda were overflowing. On that occasion, local residents stated that the Municipality of San José and the Instituto Costarricense de Acueductos y Alcantarillados had visited the site; however, neither institution had remedied the reported problem (see the report submitted and supporting documentation).
On June 21, 2024, the respondent health regulatory area prepared technical report No. MS-DRRSCS-DARS-P-IT-0156-2024-JLC, in which it recommended referring the case to the Instituto Costarricense de Acueductos y Alcantarillados for the purpose of conducting a joint inspection visit (see the report submitted and supporting documentation).
On June 21, 2024, the respondent health regulatory area referred case No. D-0091-2024, by means of official communication No. MS-DRRSCS-DARS-P-0269-2024, to the Instituto Costarricense de Acueductos y Alcantarillados (see the report submitted and supporting documentation).
On July 9, 2024, the Instituto Costarricense de Acueductos y Alcantarillados replied to official communication No. MS-DRRSCS-DARS-P-0269-2024 by means of official communication No. DRyT-OMSR-2024-00497, indicating that the Urbanización Finca San Juan had been built by the Instituto Nacional de Vivienda y Urbanismo; however, the project was never completed, which meant that the sanitary sewer network was never transferred to ICAA for proper operation (see the report submitted and supporting documentation).
On July 16, 2024, the respondent health regulatory area replied to the Instituto Costarricense de Acueductos y Alcantarillados regarding official communication No. DRyT-OMSR-2024-00497, by means of official communication No. MS-DRRSCS-DARS-P-0302-2024, requesting the cleaning, maintenance, and unclogging of the sewer network (see the report submitted and supporting documentation).
On August 19, 2024, the respondent health regulatory area received official communication No. DRyT-OMSR-2024-00603 from the Instituto Costarricense de Acueductos y Alcantarillados, indicating that, since the sewer network had not been completed by INVU and had not been transferred to ICAA, it was not appropriate for that institution to allocate resources for its maintenance (see the report submitted and supporting documentation).
On August 19, 2024, the respondent health regulatory area sent official communication No. MS-DRRSCS-DARS-P-0338-2024 to the Instituto Nacional de Vivienda y Urbanismo, requesting information regarding the reported problem (see the report submitted and supporting documentation).
On September 4, 2024, the Instituto Nacional de Vivienda y Urbanismo replied to official communication No. MS-DRRSCS-DARS-P-0338-2024 by means of official communication No. DPH-UPH-247-2024, in which the following was stated verbatim: "The parcels generated by IMAS, the lots, public areas, and remaining land, as shown on the site plan (designed by IMAS), were transferred to INVU in November 1995, so that INVU could formalize the transfers of the lots to the prospective beneficiaries of the project and transfer the public areas to the Municipality of San José; therefore, the transfer from IMAS to INVU was intended for INVU to formalize the property deeds—an administrative matter, not a construction one. As noted, the streets, alamedas, park areas, and urban infrastructure works were designed and built by IMAS, as reflected in the plans; therefore, the task of delivering the plans and managing the handover of the pipeline infrastructure to the Instituto Costarricense de Acueductos y Alcantarillados should have been carried out by that entity.
INVU, in April 2008, transferred the streets, avenues, alamedas, parks, and communal areas to the Municipality of San José." (emphasis not in original) On October 11, 2024, the respondent health regulatory area sent a request for support, official communication No. MS-DRRSCS-DARS-P-0408-2024, to the Mayor of San José via email, requesting that the complaint be addressed in accordance with the Mayor's jurisdiction (see the report submitted and supporting documentation).
On September 30, 2024, the respondent health regulatory area received official communication No. CM-PPSD-051-2024 from municipal council member (regidora Municipal) Yorleny Córdoba Moya, requesting support from Ms. Kristel Ramírez Ballesteros of the Instituto Costarricense de Acueductos y Alcantarillados in connection with the complaint (see the report submitted and supporting documentation).
On October 1, 2024, the Instituto Costarricense de Acueductos y Alcantarillados, by means of official communication No. DRyT-OMSR-2024-00738 in response to official communication No. CM-PPSD-051-2024, indicated that the Finca San Juan network was not an asset of that institution, and that resources could therefore not be allocated for its maintenance and operation (see the report submitted and supporting documentation).
On October 23, 2024, a meeting was held between officials of the Municipality of San José and the Ministry of Health. Among the agreements reached, it was decided to forward to the respondent municipality all information contained in complaint No. D-091-2024 up to that point (see the report submitted and supporting documentation).
On February 19, 2025, Sanitary Order No. MS-DRRSCS-DARS-P-OS-006-2025 was served on the Municipality of San José, requiring it to: "Within a period of no more than 8 calendar months from the date of this notification, carry out the repairs necessary to complete the corresponding sanitary sewer network in the area of (alamedas 14, 15, and 16) located in Pavas Finca San Juan, 10 meters east and 5 meters south of Super Alfa, on calle 156 C, so that these areas have an adequate system for the disposal of sewage and wastewater and so that such sewage and wastewater does not obstruct or overflow into public thoroughfares. (see the report submitted and supporting documentation).
On February 26, 2025, the Mayor of San José filed a motion for reconsideration (recurso de revocatoria) with a subsidiary appeal (apelación en subsidio) against Sanitary Order No. MS-DRRSCS-DARS-P-OS-006-2025, stating: "Based on the factual and legal considerations set forth, as well as the legal rules and jurisprudence supporting the Municipality of San José, and given that what is requested in SANITARY ORDER MS-DRRSCS-DARS-P-OS-006-2025 issued by the PAVAS HEALTH REGULATORY AREA is not appropriate, this office respectfully requests that the motion for reconsideration be GRANTED, and, should said motion be denied, that the subsidiary appeal be elevated accordingly." (see the report submitted and supporting documentation).
On April 1, 2025, by means of RESOLUCION-MS-DRRSCS-0662-2025, the motion for reconsideration filed by the Municipality of San José was resolved and denied (see the report submitted and supporting documentation).
On May 20, 2025, the Minister of Health, by means of resolution No. MS-DM-YA-2202-2025, denied the appeal (recurso de apelación) filed by the Mayor of San José (see the report submitted and supporting documentation).
On October 22, 2025, the Ministry of Health sent official communication CARTA-MS-DRRSCS-DARS-P-0602-2025 to the Mayor of San José, requesting a report on the status of compliance with Sanitary Order No. MS-DRRSCS-DARS-P-OS-006-2025 and the actions taken toward that end (see the report submitted and supporting documentation).
On November 18, 2025, the Ministry of Health received official communications MSJ-ALCALDIA-4753-2025 and SCMRP-547-2025 from the Municipality of San José, in which the following was stated: "By official communication No. SCMRP-278-2025, the Services Provision Management Office was informed that what the Ministry of Health is requesting is a matter of sanitary sewerage, and therefore falls neither within the competence nor the functions of this Section; for this reason, resources belonging to the stormwater fee (tasa pluvial) cannot be invested for such purpose, as this would constitute a misappropriation of public funds and would violate the principle of tax legality, the equivalence principle, the transparency principle, and the specific-purpose rule applicable to fees. Likewise, the entity responsible for administering and operating the sanitary sewer system in the Canton of San José is the Instituto Costarricense de Acueductos y Alcantarillados, which is the institution responsible for developing and resolving all matters related to the supply of drinking water, as well as the collection and disposal of sewage and wastewater. In addition, it is important to note that this Section has not been assigned any works related to Sanitary Order No. MS-DRRSCS-DARS-P-OS-006-2025 in the sector known as Finca San Juan." (see the report submitted and supporting documentation).
On December 4, 2025, the Ministry of Health served on the Mayor of San José sanitary report No. MS-DRRSCS-DARS-0690-2025, imposing a fine of one base salary (salario base), equivalent to the sum of ¢462.200.00, for non-compliance with Sanitary Order No. MS-DRRSCS-DARSP-OS-006-2025 (see the report submitted and supporting documentation).
On December 9, 2025, the Ministry of Health received, at this office, the appeal against sanitary report No. MS-DRRSCS-DARS-0690-2025 filed by the Municipality of San José (see the report submitted and supporting documentation).
IV.On the right to a healthy and ecologically balanced environment. It should be noted, first and foremost, that the fundamental rights to health and to a healthy and ecologically balanced environment (ambiente sano y ecológicamente equilibrado) are constitutionally recognized (Articles 21, 50, 73, and 89 of the Constitución Política), as well as through international norms applicable in Costa Rica. In this regard, in judgment No. 2006-005928 of 3:00 p.m. on May 2, 2006, this Court ruled: "The right to life recognized in Article 21 of the Constitution is the cornerstone upon which all other fundamental rights of the inhabitants of the republic rest. Likewise, the right to health finds its foundation in that same provision of the political charter (carta política), since life is inconceivable if the human person is not guaranteed minimum conditions for an adequate and harmonious psychic, physical, and environmental balance.
Public health and the right to a healthy and ecologically balanced environment are constitutionally recognized in Articles 21, 50, 73, and 89 of the Constitución Política. Specifically, Article 50 of the Constitution expressly recognizes the right of all inhabitants of the country to enjoy a healthy and perfectly balanced environment. That right is a fundamental guarantee for the protection of life and public health. In support of the foregoing, this Court has employed the notion of 'environmental quality' as a parameter, precisely, for the quality of life of individuals, which is combined with other elements such as health, nutrition, work, and housing, and refers to the fact that every person has the right to use the environment for their own development, but not in an unlimited manner, since there also exists a duty to protect and preserve the environment for present and future generations —the principle of sustainable development—." Likewise, Article 50 of the Constitución Política gives rise to the State's obligation to protect the environment.
That provision establishes, to that effect: "The State shall seek the greatest well-being for all inhabitants of the country, organizing and stimulating production and the most equitable distribution of wealth. Every person has the right to a healthy and ecologically balanced environment. For this reason, every person is entitled to report acts that violate that right and to claim reparation for the damage caused. The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding responsibilities and sanctions." This confirms that the various public authorities have the unavoidable duty to preserve, defend, and guarantee every person's fundamental right to health and to a healthy and ecologically balanced environment.
V.On the coordination of public institutions in the comprehensive protection of the environment. There is an obligation on the State—as a whole—to take the necessary measures to protect the environment, in order to prevent levels of contamination, deforestation, extinction of flora and fauna, and excessive or inadequate use of natural resources that would endanger the health of the governed (administrados). For the purposes of this task, the term 'public institution' encompasses the Central Administration (Administración Central)—ministries, such as the Ministry of Environment and Energy and the Ministry of Health—which, by reason of the subject matter, have broad participation and responsibility with respect to the conservation and preservation of the environment, and which generally act through their specialized agencies. Likewise, municipalities bear significant responsibility in this task with respect to their territorial jurisdiction.
Given the diversity of actors that may be involved, one might think that this multiple responsibility would cause chaos in administrative management. Therefore, in order to avoid the simultaneous coexistence of spheres of power of different origins and nature, the duplication of national and local efforts, and the confusion of rights and obligations among the various parties involved, it is necessary to establish a series of coordination relationships between the various agencies of the Executive Branch (Poder Ejecutivo) and decentralized institutions, and between those entities and the municipalities, so that they may carry out the functions entrusted to them. This Court has already addressed the principle of coordination between public agencies and municipalities in the pursuit of common goals, stating in judgment No. 1999-005445 of 2:30 p.m. on July 14, 1999, that: "Coordination is the ordering of the relationships among these various independent activities, which takes charge of their convergence upon a single object or entity in order to make it useful for a comprehensive public plan, without suppressing the mutual independence of the acting parties.
Since there is no hierarchical relationship between the decentralized institutions, nor between the State itself and the municipalities, it is not possible to impose specific conduct upon the latter, which gives rise to the indispensable interinstitutional «concord», in the strict sense, whereby the autonomous and independent centers of action reach agreement on this preventive and comprehensive framework, in which each fulfills a role in view of a mission entrusted to the others. Thus, the relationships between municipalities and other public entities can only take place on an equal footing, resulting in agreed-upon forms of coordination, to the exclusion of any coercive form that would undermine their autonomy, or that would subject the corporate entities to a coordination framework without or against their will; yet this does allow for the necessary subordination of these entities to the State and in the State's interest (through the State's «administrative tutelage» («tutela administrativa»), and specifically, through its function of reviewing legality, with general supervisory powers over the entire sector."
After analyzing the evidentiary elements submitted, this Tribunal finds that, between 2019 and 2021, the Instituto Costarricense de Acueductos y Alcantarillados participated in a commission led by the Municipalidad de San José, in which other institutions also took part (MIVAH, INVU, etc.), to address the problem arising in the Finca San Juan sector of Pavas due to the overflow of wastewater (aguas residuales). As part of the work carried out by the AyA, the terms of reference were delivered for the procurement of preliminary studies, design, and construction of a wastewater treatment plant (planta de tratamiento de aguas residuales). Furthermore, on June 6, 2024, the Área Rectora de Salud de Pavas received a complaint regarding wastewater overflow and a blocked sewer (alcantarilla) in pedestrian walkways (alamedas) 14, 15, and 16 of Finca San Juan, Pavas, against the Instituto Costarricense de Acueductos y Alcantarillados.
The complaint alleged that the situation described was causing a continuous overflow of sewage (aguas negras) and contamination. The respondent health regulatory area (área rectora de salud) processed the complaint and assigned it case number D 091-2024. On June 18, 2024, the respondent health regulatory area conducted an on-site inspection and confirmed that several sewers along the pedestrian walkways were overflowing. On that occasion, local residents stated that the Municipalidad de San José and the Instituto Costarricense de Acueductos y Alcantarillados had visited the site; however, they had not remedied the reported problem. On June 21, 2024, the respondent health regulatory area prepared technical report N°MS-DRRSCS-DARS-P-IT-0156-2024-JLC, which recommended transferring the case to the Instituto Costarricense de Acueductos y Alcantarillados for the purpose of conducting a joint inspection.
On June 21, 2024, the respondent health regulatory area transferred case N° D-0091-2024 through official communication N° MS-DRRSCS-DARS-P-0269-2024 to the Instituto Costarricense de Acueductos y Alcantarillados. On July 9, 2024, the Instituto Costarricense de Acueductos y Alcantarillados replied to official communication N° MS-DRRSCS-DARS-P-0269-2024 through official communication N° DRyT-OMSR-2024-00497, indicating that the Urbanización Finca San Juan had been built by the Instituto Nacional de Vivienda y Urbanismo; however, the project had not been completed, which resulted in the sanitary sewer network (red de alcantarillado sanitario) not having been transferred to ICAA for proper operation. On July 16, 2024, the respondent health regulatory area replied to the Instituto Costarricense de Acueductos y Alcantarillados regarding official communication Nº DRyT-OMSR-2024-00497 through official communication Nº MS-DRRSCS-DARS-P-0302-2024, requesting the cleaning, maintenance, and unclogging (destaqueo) of the sanitary sewer network.
On August 19, 2024, the respondent health regulatory area received official communication N° DRyT-OMSR-2024-00603 from the Instituto Costarricense de Acueductos y Alcantarillados, indicating that since the sewer network had not been completed by INVU and had not been transferred to ICAA, it was improper for that institution to allocate resources for its maintenance. On August 19, 2024, the respondent health regulatory area sent official communication N° MS-DRRSCS-DARS-P-0338-2024 to the Instituto Nacional de Vivienda y Urbanismo, requesting information related to the problem described. On September 4, 2024, the Instituto Nacional de Vivienda y Urbanismo replied to official communication N° MS-DRRSCS-DARS-P-0338-2024 through official communication N°DPH-UPH-247-2024, which stated verbatim: "The properties generated by the IMAS, lots, public areas, and remainder of the property, according to the site plan (designed by IMAS), were transferred to INVU in November 1995, with the purpose of INVU formalizing the transfer of the lots to the potential beneficiaries of the project and transferring the public areas to the Municipalidad de San José; therefore, the transfer from IMAS to INVU was intended for the formalization of property deeds — an administrative matter, not a construction one.
As mentioned, the streets, pedestrian walkways, park areas, and urban infrastructure works were designed and built by the IMAS, as reflected in the plans; therefore, the responsibility for delivering the plans and managing the pipeline infrastructure to the Instituto Costarricense de Acueductos y Alcantarillados should have been carried out by the aforementioned entity. INVU, in April 2008, transferred the streets, avenues, pedestrian walkways, parks, and communal areas to the Municipalidad de San José." On October 11, 2024, the respondent health regulatory area sent support-request official communication N°MS-DRRSCS-DARS-P-0408-2024 to the mayor (alcalde) of San José by email for the handling of the complaint in accordance with his competencies. On September 30, 2024, the respondent health regulatory area received official communication N°CM-PPSD-051-2024 from municipal council member (regidora) Yorleny Córdoba Moya, requesting support from Ms.
Kristel Ramírez Ballesteros of the Instituto Costarricense de Acueductos y Alcantarillados in connection with the complaint. On October 1, 2024, the Instituto Costarricense de Acueductos y Alcantarillados, through official communication N°DRyT-OMSR-2024-00738 in reply to official communication N°CM-PPSD-051-2024, indicated that the Finca San Juan network was not an asset of that institute and that resources could therefore not be allocated for its maintenance and operation. On October 23, 2024, a meeting was held between officials of the Municipalidad de San José and the Ministerio de Salud. Among the agreements reached, it was determined that the information contained in complaint N° D-091-2024 up to that point would be forwarded to the respondent municipality. On February 19, 2025, Sanitary Order (Orden Sanitaria) N°MS-DRRSCS-DARS-P-OS-006-2025 was served on the Municipalidad de San José, directing it to: "Within a period no longer than 8 calendar months from the date of this notification, carry out the necessary repairs to complete the corresponding sanitary sewer network in the area of (pedestrian walkways 14, 15, and 16) located in Pavas Finca San Juan, 10 meters east and 5 meters south of Super Alfa, on Calle 156 C, so that these areas have an adequate sewage and wastewater disposal system that does not block or overflow onto public thoroughfares.
Legal Basis: Articles 1, 2, 4, 7, 147 subsection c), 275, 285, 288, 289 of Ley Nº 5395, Ley General de Salud. Article 6 subsection e) of the Reglamento Sectorial para la Regulación de los Servicios de Acueducto y Alcantarillado Sanitario No 30413-MP-MINAE-S-MEIC." On February 26, 2025, the mayor of San José filed a motion for reconsideration (recurso de revocatoria) with a subsidiary appeal (apelación en subsidio) against Sanitary Order N°MS-DRRSCS-DARS-P-OS-006-2025, stating: "Based on the factual and legal considerations set forth, as well as the legal rules and case law that protect the Municipalidad de San José, and given that what is requested in SANITARY ORDER MS-DRRSCS-DARS-P-OS-006-2025 issued by the ÁREA RECTORA DE SALUD DE PAVAS is not appropriate, it is respectfully requested that the motion for reconsideration be GRANTED, and should said motion be denied, that the appeal be elevated on a subsidiary basis." On April 1, 2025, through RESOLUCION-MS-DRRSCS-0662-2025, the motion for reconsideration filed by the Municipalidad de San José was resolved and declared without merit.
In addition, on May 20, 2025, the Minister of Health, through Resolution N°MS-DM-YA-2202-2025, declared the appeal filed by the mayor of San José without merit. Likewise, on October 22, 2025, the Ministerio de Salud sent official communication CARTA-MS-DRRSCS-DARS-P-0602-2025 to the mayor of San José, requesting a report on the status of compliance with Sanitary Order N°MS-DRRSCS-DARS-P-OS-006-2025 and the actions taken toward that end. On November 18, 2025, the Ministerio de Salud received official communications MSJ-ALCALDIA-4753-2025 and SCMRP-547-2025 from the Municipalidad de San José, which stated the following: "Through official communication No. SCMRP-278-2025, the Services Provision Management was informed that the matter requested by the Ministerio de Salud concerns sanitary sewerage and is therefore neither within the competence of this Section nor among its functions; for this reason, resources belonging to the stormwater fee (tasa pluvial) cannot be invested for that purpose, as doing so would constitute a misappropriation of public funds and would violate the principle of tax legality, the equivalence principle, the transparency principle, and the specific-purpose principle governing fees.
Furthermore, the entity responsible for administering and operating the sanitary sewerage system in the Canton of San José is the Instituto Costarricense de Acueductos y Alcantarillados, the institution responsible for developing and resolving all matters related to the supply of drinking water as well as the collection and evacuation of sewage and wastewater. In addition to the foregoing, it is important to note that this Section has not been assigned any works related to Sanitary Order No. MS-DRRSCS-DARS-P-OS-006-2025 in the sector known as Finca San Juan." On December 4, 2025, the Ministerio de Salud notified the mayor of San José of sanitary report N°MS-DRRSCS-DARS-0690-2025, which imposed a fine of one base salary (salario base) in the amount of ¢462.200.00 for non-compliance with Sanitary Order No. MS-DRRSCS-DARSP-OS-006-2025. Finally, it follows that on December 9, 2025, the Ministerio de Salud received before this body an appeal of sanitary report N°MS-DRRSCS-DARS-0690-2025 filed by the Municipalidad de San José.
A. Regarding the Municipalidad de San José, it is established that these authorities have been aware of the problem under study since 2021 and that, despite the several years that have elapsed, they have not carried out clear and decisive actions aimed at definitively resolving it. It should be noted that, according to the proven facts (hechos probados) section of this amparo proceeding (amparo), the municipal corporation has participated in committees together with other institutions in order to find a solution to the problem affecting the Finca San Juan sector of Pavas; however, the wastewater overflow problem persists without a real solution. In addition to the foregoing, it should be noted that the respondent municipal entity has been subject to a sanitary order since February 19, 2025, without having complied with the directives of the Ministerio de Salud as of this date; in the reports submitted to that ministerial body providing updates on the actions taken in this regard, what is pleaded is a lack of competence that is used to justify non-compliance.
In these circumstances, this Constitutional Chamber has no doubt that the authorities of the respondent municipality have committed serious omissions that have contributed to the persistence of the public health and environmental problem under study.
B. With respect to the Ministerio de Salud, it is established that these authorities have been aware of the problem under study since 2024 and that, since then, they have also conducted on-site inspections and, upon confirming the reported facts, have been coordinating with different institutions to address it. In this regard, it should be noted that on June 21, 2024, the respondent health regulatory area transferred case N° D-0091-2024 through official communication N° MS-DRRSCS-DARS-P-0269-2024 to the Instituto Costarricense de Acueductos y Alcantarillados; however, on July 9, 2024, the Instituto Costarricense de Acueductos y Alcantarillados replied to the communication indicating that the Urbanización Finca San Juan had been built by the Instituto Nacional de Vivienda y Urbanismo, and stating that the project had not been transferred to that institution for proper operation. Moreover, despite the health regulatory area having requested the cleaning, maintenance, and unclogging of the sewer network, it received a refusal from ICAA, which stated that since the sewer network had not been completed by INVU and had not been transferred to ICAA, it was improper for that institution to allocate resources for its maintenance.
It is evident that, faced with this situation, the authorities of the Ministerio de Salud turned to the Instituto Nacional de Vivienda y Urbanismo to obtain information about the situation in the sector known as Finca San Juan, Pavas, and established that: "INVU, in April 2008, transferred the streets, avenues, pedestrian walkways, parks, and communal areas to the Municipalidad de San José." (sic). For this reason, after several approaches to the Municipalidad de San José in order to find a solution to the problem, on February 19, 2025, the Ministerio de Salud finally served Sanitary Order N°MS-DRRSCS-DARS-P-OS-006-2025 on the respondent municipal corporation, which as of this date remains pending compliance.
At this juncture, it is important to remind the authorities of the Ministerio de Salud that having issued the aforementioned sanitary order and having requested compliance reports — including imposing penalties in that regard — does not relieve or exempt it from continuing to address the matter and providing appropriate follow-up through the issuance and execution of all pertinent acts, in accordance with the provisions of the Ley General de Salud and its regulations. In this regard, this court, in Voto No. 2016-6368 of 09:30 a.m. of May 13, 2016, stated the following:
"(…) V. ON THE AMPARO AGAINST THE MINISTERIO DE SALUD. ON THE MERITS: From the foregoing facts, it follows that the Ministerio de Salud, while it acted in a timely manner and issued sanitary orders and even filed criminal complaints, the truth is that the public health problem persists, as its representative states in the report submitted under oath. The Chamber does not observe that the Ministerio adopted extraordinary measures, such as the closure of the site, the collaboration of the Public Force for the security of the site, or even the eventual eviction of the residential complex, or any other effective measures. The provision of a public service such as that entrusted to the Ministerio de Salud demands an efficiency and diligence that may exceed what is required of other public bodies, by reason of the fundamental rights to health and to a healthy environment, as they pertain to its competencies.
The Chamber considers that the actions taken by the Ministerio de Salud have been insufficient and violate the fundamental right to health and to a healthy environment of the petitioner, and therefore the petition must be granted against it and the Ministerio must be ordered to adopt all necessary measures, including radical ones, and to make the relevant decisions in order to eliminate the existing public health problem at the boundary between Condominio Camino de Luna, Río Liberia, and Residencial El Río, within a period of two months from the notification of the judgment. (…)" (Emphasis not part of the original.)
Likewise, in Sentencia No. 2022-10613 of 09:40 a.m. of May 13, 2022, this Chamber stated:
"(…) IV.- ON THE SPECIFIC CASE.- After analyzing the evidentiary elements submitted, this Tribunal finds that a violation of fundamental rights by the respondent authorities has occurred. This is because, in the report submitted by the representative of said authority — which is deemed given under oath with the consequences, including criminal ones, provided for in article 44 of the Law governing this Court — and the evidence submitted for the resolution of the matter, it has been duly established that on August 16, 2021, the respondent received the complaint filed by the petitioner against his neighbors for the discharge of grey water (aguas servidas) onto his property by the reported neighbors. On August 27, 2021, the Environmental Manager of the Área Rectora de Salud Alajuela 1 conducted an on-site inspection, at which the health authority determined the discharge of stormwater (aguas pluviales) and wastewater (sewage and grey water) onto the petitioner's property, causing foul odors and the risk of proliferation of insects and rodents that could affect the health of the persons living in the home.
On September 3, 2021, the respondent issued and served Sanitary Order N° 0188, ordering José Arístides Morera Jiménez to correct the problem found and, within two months, to properly and hygienically dispose of the stormwater, wastewater, and sewage that are not properly channeled in the property under his ownership. On November 10, 2021, the respondent conducted a verification visit to assess compliance with the aforementioned sanitary order, confirming that the stormwater and wastewater were still being discharged onto the protected party's property, thereby establishing non-compliance with the order. Through official communication MS-DRRSCN-DARSA1-3001-2021, the respondent filed a complaint with the Deputy Prosecutor's Office (Fiscalía Adjunta) of Alajuela against José Arístides Morera Jiménez for the crime of disobedience to authority, without any decision having been issued to date.
On December 9, 2021, the petitioner filed a complaint against Mr. Aiut Avalos, indicating that the respondent channels his stormwater and grey water onto the petitioner's property and requesting that the neighbor be asked to channel those waters in an appropriate manner. On January 6, 2022, the respondent conducted an inspection visit and, despite no one being present at the respondent's property, confirmed that the stormwater and grey water are directed to the petitioner's property; Sanitary Order 0030 was therefore drawn up, ordering Mr. Aiut Avalos to properly and hygienically dispose of the stormwater that is not properly channeled at his residence; however, it has not been possible to serve notice, as no one has been found at the premises.
In these circumstances, this Chamber finds that while the respondent argues that it has taken actions aimed at resolving the situation affecting the protected party, the truth is that it has not been able to resolve it definitively, since merely filing a criminal complaint for non-compliance with a sanitary order and pleading the inability to serve notice of the other sanitary order is not sufficient for this Chamber, bearing in mind that a serious and proven problem of improperly managed stormwater and wastewater exists — all of which flows onto the petitioner's property due to the lack of drainage works by the neighbors — causing serious flooding and contamination problems that have persisted for a long time without being resolved. It should be noted that the Ministerio de Salud has broad powers to act in accordance with the Ley General de Salud and its corresponding regulations, as the governing body responsible for health surveillance and control, including: special sanitary measures for the eviction of dwellings (article 1 subsection c of the Regulations), declarations of uninhabitability, demolition, as well as fines, since it is clear that in accordance with articles 39 and 286 of the Ley General de Salud it is the duty of every owner and person in charge of movable and immovable property to avoid nuisances and harm to health as well as contamination or infection focal points, and to carry out drainage works — with the administration even being empowered to carry them out at the expense of the non-compliant party in cases of refusal — all while safeguarding due process. Therefore, it is appropriate to grant the petition, with the consequences to be set forth in the operative part. (…)" (Emphasis not part of the original.)
More recently, in Voto No. 2025-583 of 09:20 a.m. of January 10, 2025, this constitutional body stated:
"(…) On the Ministerio de Salud. While the reports submitted and the evidence on record establish that the respondent authorities of the Ministerio de Salud — Área Rectora de Salud de Puntarenas – Chacarita — have undertaken steps to comply with the orders previously issued by this Tribunal, as reflected in the proven facts of this judgment, and that, faced with non-compliance with Sanitary Order 0112-REG-2024 by the Municipalidad de Puntarenas, on December 4, 2024, a criminal complaint was filed against the Municipalidad de Puntarenas for the alleged crime of Disobedience to Authority before the Deputy Prosecutor's Office of the Public Prosecutor's Office in Puntarenas; the truth of the matter is that, for this Chamber, its performance has been insufficient, since said ministry demands observance as well as ensuring the protection of the health of the population and the environment (…)" (Emphasis not part of the original.)
In light of this panorama, it is clear that the respondent authorities of the Ministerio de Salud have also failed to adequately address the serious environmental situation facing the Finca San Juan community in Pavas.
C. Finally, regarding the Instituto Costarricense de Acueductos y Alcantarillados, it has been reported and established from the evidence submitted that the Urbanización Finca San Juan was initially built by the Instituto Mixto de Ayuda Social and that, because the project was not properly completed, its transfer to ICAA was frustrated. In the report submitted to this Chamber, ICAA clearly explained the following:
"(…) It is important to note that an incomplete sanitary sewer network exists at the site, which has no treatment system and is not an asset of AyA; therefore, the Institution does not provide maintenance services for said network and does not charge for the sanitary sewerage service. According to the information available, this network is the property of INVU. (…)." Now, while the objective reasons explained by the ICAA authorities for not assuming the problem with public funds are understandable, the truth is that this state of affairs should not and cannot exempt it from cooperating with the other respondent authorities in order to find a solution to the proven environmental and public health problem. In view of the gravity of the established facts, this Constitutional Tribunal considers that ICAA must indeed intervene — by virtue of the clear and extensive expertise it possesses in the matter — and carry out the necessary coordination with the Municipalidad de San José and the Ministerio de Salud in order to jointly produce a response and address the situation under study. While, as stated, ICAA is not compelled to invest public funds in the solution of the problem, it can cooperate and coordinate with the other cited public bodies in the terms indicated. However, this last task is conspicuously absent in the present matter.
VII.Conclusion. In consistent case law this Chamber has held that it cannot be accepted that human beings are denied the right to a healthy environment or the right to health due to the inability of the relevant authorities to effectively exercise the supervisory powers and problem-solving tools granted to them by law. Indeed, this Tribunal considers that state action must be coordinated and effective, since it is not simply a matter of identifying the problem and attributing responsibility to others, as has occurred in this case, nor is it for this Chamber to assign to each entity the solutions it must implement; rather, once the matter has been assessed, a comprehensive solution must be provided, for which, under the system for the distribution of competencies and functions of a State, all parties involved must participate, each contributing what ultimately falls within its purview. In accordance with the foregoing, this Chamber determines that the Municipalidad de San José, the Instituto Costarricense de Acueductos y Alcantarillados, and the Ministerio de Salud must all coordinate a definitive solution to the public health problem affecting the Finca San Juan community in Pavas. Consequently, it is appropriate to grant the petition.
I have supported the position of this Tribunal that when a party alleges a violation of the right to prompt and effective justice in administrative proceedings, it is the Tribunales de lo Contencioso-Administrativo and not this Chamber that must hear the legal dispute. Now, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is amenable to judicial protection by means of the amparo petition established by article 32 of the Ley de la Jurisdicción Constitucional, in relation to article 27 of the Constitution of the Republic of Costa Rica, in those cases where the petitioner considers that the factual actions of the Administration, its administrative acts, or its response are affecting fundamental rights. In my view, the recently enacted legislation does not imply that this Tribunal must modify its case law, since, pursuant to article 7 of its Law, it is exclusively responsible for defining its own jurisdiction.
Therefore, except for those legal and constitutional disputes that have been recognized by this same Chamber as exceptional cases that may properly be heard in this court through the constitutional amparo proceeding, in all other cases, and for the reasons given by this Tribunal (Sentencia N° 2008-02545 of 8:55 a.m. of February 22, 2008), jurisdiction lies with the judges of the administrative courts, all of which is consistent with article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and teleological interpretation of the legal order.

2026028821. MUNICIPALIDAD. PODER EJECUTIVO. AMBIENTE. SE ALEGA LA OMISIÓN DEL A Y A, EL MINISTERIO DE SALUD Y LA MUNICIPALIDAD DE SAN JOSÉ DE SOLUCIONAR EL DESBORDAMIENTO DE AGUAS RESIDUALES EN FINCA SAN JUAN, PAVAS. LA SALA ESTIMA QUE PERSISTE LA AFECTACIÓN A LOS DERECHOS A LA SALUD, AL AMBIENTE SANO Y A LA SALUBRIDAD PÚBLICA, POR INCUMPLIMIENTO DE LO ORDENADO EN LA SENTENCIA No. 2026004335. SE DECLARA CON LUGAR EL RECURSO Y SE ORDENA CUMPLIR LA SOLUCIÓN DEFINITIVA DENTRO DEL PLAZO PENDIENTE FIJADO EN ESA SENTENCIA. NQC08/2026 (…)
“CONSIDERANDO:
I.De previo.
