OutcomeResultado
The Constitutional Chamber established the standard of review applicable to modifications of environmental protection instruments: courts must determine whether the measure produces an unjustified reduction in the existing level of protection, recognizing that the non-regression principle is not absolute but requires objective, technical, and constitutionally reasonable justification compatible with Article 50.La Sala Constitucional fijó el estándar de revisión aplicable a modificaciones de instrumentos de protección ambiental: se debe verificar si la medida produce una disminución injustificada del nivel de protección existente, reconociendo que el principio de no regresión no es absoluto pero exige justificación objetiva, técnica y constitucionalmente razonable compatible con el artículo 50.
SummaryResumen
The Constitutional Chamber develops the four cardinal principles of Costa Rican constitutional environmental law under Article 50 of the Constitution: prevention, precaution, progressivity, and non-regression. Prevention requires the State to act when sufficient knowledge of risk exists; the precautionary principle authorizes and even demands state intervention when scientific uncertainty remains about serious or irreversible harm. Progressivity obliges the State to gradually strengthen achieved protection levels. Non-regression prohibits unjustified reductions of those levels, though the Chamber clarifies it is not absolute: the Administration retains regulatory discretion to modify protection instruments if it demonstrates objective and technically verifiable grounds. Constitutional review of any environmental regulatory modification must determine whether the measure produces an unjustified reduction in the existing level of protection or instead reflects a reasonable technical redefinition that maintains or even strengthens the effectiveness of the environmental protection system.

Nevertheless, the Chamber has also recognized that the principle of non-regression does not have an absolute character. The Administration retains a margin of regulatory discretion to modify public policies, reorganize regulatory instruments, or replace administrative mechanisms, provided that such decisions are grounded in objective, technically demonstrable reasons compatible with the constitutional duty of environmental protection. Not every regulatory modification therefore constitutes in itself a constitutionally prohibited regression. The determining factor is whether the challenged measure effectively produces an unjustified reduction in the existing level of protection or whether, on the contrary, it reflects a reasonable technical redefinition that maintains — or even strengthens — the effectiveness of the environmental protection system. Consequently, when a constitutional challenge is brought against an administrative decision modifying a previously established environmental protection instrument, the examination of this jurisdiction must be directed at determining whether the Administration demonstrated, through objective and verifiable grounds, that the modification is compatible with the reinforced duty of protection imposed by Article 50 of the Constitution.

ARTICLE 50 OF THE POLITICAL CONSTITUTION.
(…) IV.- On the principles of prevention, precaution, progressivity, and environmental non-regression. The evolution of Environmental Law (Derecho Ambiental) has led to the recognition that effective protection of the environment requires the State to act in advance in the face of risks that could compromise the balance of ecosystems. For this reason, this Sala has consistently incorporated the prevention principle (principio de prevención) and the precautionary principle (principio precautorio) as interpretive parameters of Article 50 of the Constitution. The prevention principle obliges public authorities to adopt measures aimed at preventing the occurrence of harm when there is sufficient knowledge about the risks associated with a given activity. For its part, the precautionary principle authorizes and even requires State intervention when, even in the presence of scientific uncertainty, serious or irreversible harm to the environment may occur.
To these principles are added those of progressivity (progresividad) and environmental non-regression (no regresión ambiental), extensively developed by both International Human Rights Law (Derecho Internacional de los Derechos Humanos) and Costa Rican constitutional jurisprudence (jurisprudencia constitucional costarricense). The Sala has indicated that the progressivity principle imposes on the State a duty to gradually strengthen the levels of environmental protection achieved, through the constant improvement of the legal, administrative, and technical instruments designed to guarantee the effective enjoyment of the fundamental right to a healthy environment. As a complementary expression of that principle, the prohibition of environmental non-regression prevents public authorities from reducing, without objective, sufficient, and constitutionally reasonable justification, the degree of protection previously achieved.
Nevertheless, the Sala has also recognized that the non-regression principle does not have an absolute character. The Administration retains a margin of regulatory discretion (configuración normativa) to modify public policies, reorganize regulatory instruments, or replace administrative mechanisms, provided that such decisions are grounded in objective, technically demonstrable reasons that are compatible with the constitutional duty of environmental protection. Therefore, not every regulatory modification constitutes in itself a constitutionally prohibited regression. What is determinative is verifying whether the challenged measure effectively produces an unjustified reduction in the existing level of protection, or whether, on the contrary, it reflects a reasonable technical redefinition that maintains—or even strengthens—the effectiveness of the environmental protection system (tutela ambiental). Consequently, when a constitutional challenge is raised against an administrative decision that modifies a previously established environmental protection instrument, the review conducted by this jurisdiction must be directed at determining whether the Administration demonstrated, through objective and verifiable grounds, that the modification is compatible with the heightened duty of protection imposed by Article 50 of the Political Constitution. ARTÍCULO 50 DE LA CONSTITUCIÓN POLÍTICA.
