SummaryResumen
The Constitutional Chamber (Sala Constitucional) explains that Article 50 of the Constitution recognizes everyone’s right to a healthy and ecologically balanced environment and imposes a positive duty on the State to guarantee, defend, and preserve it. Environmental protection includes preventing risks, controlling potentially degrading activities, and ensuring the rational use of natural resources; refraining from authorizing harmful activities is not enough. The text also states that using technological tools to improve administrative oversight of activities with possible environmental impacts expresses the State’s duty to use suitable means to make that right effective. The supplied excerpt does not include the resolution’s operative disposition, so it does not establish the case’s specific outcome or any further legal effects.
Key excerptExtracto clave
Constitutional environmental protection is not limited to preventing harm that has already occurred; it includes the continuing duty to organize State action through public policies, regulatory instruments, and administrative mechanisms that can prevent risks, control potentially degrading activities, and ensure the rational use of natural resources. Constitutional case law has emphasized that environmental protection is a positive obligation of the State, meaning that it must not only refrain from authorizing activities harmful to ecosystems, but also adopt effective measures to progressively strengthen the mechanisms for inspection, control, and monitoring of natural resources. In this context, using technological tools to improve administrative oversight of activities that may generate environmental impacts is an expression of the State’s duty to employ the suitable means available to give effect to the fundamental right recognized in Article 50 of the Constitution.

ARTICLE 50 OF THE POLITICAL CONSTITUTION.
(…)
III.On the fundamental right to a healthy and ecologically balanced environment. Article 50 of the Political Constitution recognizes everyone’s right to enjoy a healthy and ecologically balanced environment and, correspondingly, imposes on the State the legal duty to guarantee, defend, and preserve this constitutional good. For several decades, this Chamber has recognized that the environment is a collective legal good whose protection takes priority within the Social and Democratic State governed by the Rule of Law, given its close connection to human dignity, public health, sustainable development, and the protection of present and future generations. For this very reason, constitutional environmental protection is not limited to preventing damage that has already occurred; it also includes the ongoing duty to organize State action through public policies, regulatory instruments, and administrative mechanisms that make it possible to prevent risks, control potentially harmful activities, and ensure the rational use of natural resources.
Constitutional case law has emphasized that environmental protection is a positive obligation of the State. This means not only refraining from authorizing activities that harm ecosystems, but also adopting effective measures to progressively strengthen the mechanisms for inspection, control, and monitoring of natural resources. In this context, the use of technological tools intended to improve administrative oversight of activities that may generate environmental impact is a manifestation of the State’s duty to employ the suitable means available to give effect to the fundamental right recognized in Article 50 of the Constitution. ARTÍCULO 50 DE LA CONSTITUCIÓN POLÍTICA.
