2026027887. PUBLIC SERVICES. PRIVATE-LAW ENTITY. IT IS ALLEGED THAT THE ASADA EL PROGRESO LA MARAVILLA DE ROXANA, POCOCÍ, SUPPLIES WATER WITH DEFICIENCIES IN QUALITY AND HAS FAILED TO ADOPT THE NECESSARY MEASURES TO ENSURE A SERVICE FIT FOR HUMAN CONSUMPTION. IT IS FOUND THAT THE TECHNICAL REPORT OF THE AYA DEMONSTRATED THE NEED TO IMPLEMENT IMPROVEMENTS IN THE FILTRATION SYSTEM TO ENSURE WATER QUALITY AND PROTECT THE RIGHTS TO HEALTH AND LIFE. THE APPEAL IS GRANTED AND THE PARTIES ARE ORDERED TO CARRY OUT THE TECHNICAL RECOMMENDATIONS WITHIN SIX MONTHS. NQC08/2026.
(…) IV.- On the specific case. After reviewing the reports submitted under oath by the representative of ICAA, as well as the responses provided by the legal representative of the respondent ASADA and the documentary evidence submitted for the resolution of this matter, the Court finds that the appellant (recurrente) is correct in her claim regarding the conditions in which she receives the drinking water service (servicio de agua potable). The record shows that on March 11, 2026, the Technical Visit and Analysis Report of the Filtration System at ASADA Maravilla (Guápiles) was issued, prepared by Eng. Christian Solís Ramírez of the System Optimization Engineering Division of ICAA, in which the following ten recommendations were made to the respondent ASADA:
"1- Take the necessary steps to commission the iron and manganese treatment plant (planta de tratamiento de hierro y manganeso) that has been out of operation for many years. It should be noted that once this system is functioning, it will be possible to achieve the free residual chlorine (cloro residual libre) parameters established in the Regulations for Drinking Water Quality (Reglamento para la Calidad del Agua Potable) 38924-S, which are 0.3 to 0.6 mg/l.
2- Carry out improvements to the conveyance pipeline (tubería de conducción), as it lacks a fastening system to the concrete pedestals and moves freely, which could cause leaks and fractures in the pipe. 3- Carry out aesthetic improvements to the storage tank and the structure that supports it; in addition to painting, it is recommended that the tank be labeled.
4- Install a bulk meter (macro-medidor) in order to maintain more thorough monitoring and thereby obtain more accurate data on the percentage of non-revenue water (agua no contabilizada, ANC).
5- Maintain individual metering (micro-medición) control for the same purpose as point 4, in order to obtain real consumption data and the percentage of ANC, with the aim of detecting leaks or illegally connected users.
6- Apply water quality control measures, such as operational monitoring (control operativo), microbiological testing, and physicochemical testing, which must be submitted semi-annually in the format set out in Annex 3 of the Regulations for Drinking Water Quality 38924-S and its amendment 41499-S, to the Área Rectora de Salud de Pococí. 7- Keep drinking water quality analyses up to date through tests carried out by laboratories accredited by ECA (laboratory and testing).
8- It is suggested to implement operational monitoring, for which it is necessary to acquire equipment for measuring free residual chlorine and turbidity (turbidez), in accordance with Article 8 of the RCAP 38924-S. 9- The importance of proceeding urgently with the rehabilitation of the iron and manganese removal plant (planta de remoción de hierro y manganeso) is emphasized; the various options available on the market may be considered.
10- The ASADA is urged to apply both consumption and connection tariffs as established and to proceed with billing in accordance with RESOLUCIÓN RIA-006-2017 issued by ARESEP." Furthermore, the aforementioned report identifies the following two inconsistencies: 1) The pump-fed water system (sistema de acueducto por bombeo) serves 141 subscribers (abonados), uses 1 drilled well (pozo perforado), and has a raised metal storage tank of 45 m³; it has 100% individual metering and charges a base rate (tarifa base) of ¢4,000 for up to 12 m³ and ¢200 per additional m³; it has force mains (líneas de impulsión) and conveyance lines of 4" in iron and distribution lines of 6" also in iron; it has iron and manganese removal filters that are not in operation and a chlorination system using 12% sodium hypochlorite (hipoclorito de sodio); bulk metering is not carried out, and it has a measured flow rate (caudal aforado) of 3.42 l/s. 2) The water system (acueducto) needs to assess maintenance of the storage tank (painting and labeling) and the commissioning of the treatment plant for the removal of iron and manganese, which affects the performance of the chlorination system, causing this parameter to fall below the level established in the Regulations for Drinking Water Quality 38924-S of 0.3 to 0.6 mg/l.
For this Court, even though said recommendations are grounded in findings from a recently conducted inspection, this does not excuse the ASADA, let alone ICAA, since deficiencies of this nature in the provision of a service that is vital to health and life itself must be anticipated given its critical importance. It is evident that the appellant has repeatedly raised concerns about the quality of the water she receives, which indicates that this is a persistent and ongoing problem, now confirmed by a technical field report. This situation has resulted in a clear and illegitimate failure of service (falta de servicio), contrary to the appellant's constitutional rights to drinking water and to the constitutional principles governing the functioning of public services.
Furthermore, the respondent institute is also a co-participant in this violation, as noted above, since pursuant to the Enabling Act of the Instituto Costarricense de Acueductos y Alcantarillados, Law No. 2726 of April 14, 1961, ICAA is responsible for directing and overseeing everything related to the provision of a drinking water service to the inhabitants of the republic. This may be done, in accordance with Article 2, subparagraph g), ibid., even through the delegation, administration, operation, maintenance, and development of water and sewer systems to duly constituted organizations for such purposes (managing associations, asociaciones administradoras); however, the governing body (ente rector) in the matter will continue to be the Institute. This is expressly provided for in Article 3 of the Regulations for Managing Associations of Community Water and Sewerage Systems (Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados comunales), Nº 42582-S-MINAE, which states the following:
"Article 3.- Technical oversight authority (Rectoría técnica): AyA, as the technical governing body in the provision of public water supply, sewerage, and/or wastewater sanitation (saneamiento de las aguas residuales) services, shall carry out all activities related to control, oversight, supervision, evaluation, standardization, and sectoral planning of drinking water and wastewater sanitation services, as well as the direction of the management performed by the ASADAS, since the management of the system is entrusted to the ASADA by delegation from AyA.
The relationship between AyA and the ASADAS shall be governed by the principles of social participation, collaboration, cooperation, adaptability or mutability of services, efficiency and effectiveness, supervision, control, evaluation, standardization, sectoral planning of drinking water and wastewater sanitation services, and direction of the management performed by the ASADAS." In turn, pursuant to the provisions of the aforementioned regulations, the ASADAS have as their sole and specific purposes the provision of drinking water supply and wastewater sanitation services, contributing to the integrated management of water resources (gestión integrada del recurso hídrico), and providing fire hydrant service pursuant to special law. Therefore, pursuant to the Enabling Act of the Instituto Costarricense de Acueductos y Alcantarillados, the exclusive authority (competencia privativa) in the matter of drinking water supply, as well as the construction of water supply systems for that purpose, lies with that institution.
Accordingly, ICAA and the respondent ASADA have breached the principle of proper functioning of public services and the right to drinking water service by failing to promptly carry out the joint actions necessary to guarantee the provision of drinking water to the community under the standards of quality that the applicable regulations themselves prescribe. The foregoing is because it is the obligation of both parties to ensure the continuity, quantity, and timeliness of the service, thereby upholding the right to health and the human right of access to drinking water.
With regard to the subsequent filings submitted by the appellant, she is advised that it is not within this Court's purview to determine whether a water availability certificate (certificación de disponibilidad de agua) should be granted, as this constitutes a matter of ordinary legality (extremo de legalidad ordinaria); it is the ASADA that must determine whether or not its issuance is possible, based on technical considerations that fall outside this constitutional court's jurisdiction.
V.Conclusion. Consequently, the appeal must be granted on grounds of violation of the right to drinking water, and the respondent parties are ordered to carry out the corresponding actions, within their respective areas of competence, to implement improvements to the water system in accordance with the recommendations set forth above. 2026027887. SERVICIOS PÚBLICOS. SUJETO DE DERECHO PRIVADO.SE ALEGA QUE LA ASADA EL PROGRESO LA MARAVILLA DE ROXANA, POCOCÍ, SUMINISTRA AGUA CON DEFICIENCIAS EN SU CALIDAD Y HA OMITIDO ADOPTAR LAS MEDIDAS NECESARIAS PARA GARANTIZAR UN SERVICIO APTO PARA EL CONSUMO HUMANO. SE CONSIDERA QUE EL INFORME TÉCNICO DEL AYA EVIDENCIÓ LA NECESIDAD DE IMPLEMENTAR MEJORAS EN EL SISTEMA DE FILTRACIÓN PARA ASEGURAR LA CALIDAD DEL AGUA Y PROTEGER LOS DERECHOS A LA SALUD Y A LA VIDA. SE DECLARA CON LUGAR EL RECURSO Y SE ORDENA EJECUTAR LAS RECOMENDACIONES TÉCNICAS EN EL PLAZO DE SEIS MESES. NQC08/2026.
(…) IV.- Sobre el caso concreto. Luego de revisados los informes rendidos bajo la solemnidad de juramento por el representante del ICAA, así como las contestaciones brindadas por el personero de la ASADA accionada y la prueba documental aportada para la resolución de este asunto, se estima que lleva razón la recurrente en su reclamo en cuanto a las condiciones que recibe el servicio de agua potable. Consta que el 11 de marzo de 2026 se emitió el informe de la Visita Técnica y Análisis del Sistema de Filtración en Asada Maravilla (Guápiles), realizada por el Ing. Christian Solís Ramírez del Área de Ingeniería de Sistema de Optimización del ICAA, donde se hicieron las siguientes diez recomendaciones a la ASADA recurrida:
“1- Realizar las gestiones necesarias para la puesta en marcha de la planta de tratamiento de hierro y manganeso que tiene tantos años sin trabajar, cabe mencionar que con el funcionamiento de este sistema se podrá alcanzar los parámetros de cloro residual libre que indica el Reglamento para la Calidad del Agua Potable 38924-S de 0.3 a 0.6 mg/l.
2- Efectuar las mejoras en la tubería de conducción ya que la misma no cuenta con un sistema de fijación a los pedestales de concreto y su movimiento queda libre, esto podría provocar fugas y fractura de esta. 3- Mejoramiento estético del tanque de almacenamiento y la estructura que lo soporta, además de la pintura se recomienda rotulación de este.
4- Instalación de un macro-medidor con la finalidad de poder llevar un control más exhaustivo y así tener un dato más exacto del % de ANC (agua no contabilizada).
5- Llevar el control de la micro-medición con el mismo objetivo del punto 4, poder tener un dato real de consumo y el % de ANC, esto con el propósito de detectar fugas o personas conectadas de manera ilegal.
6- Aplicar del control en calidad del agua, como lo es el control operativo, exámenes microbiológicos y físico químicos, los cuales deber ser presentados semestralmente según el formato del anexo 3 del Reglamento para la Calidad del Agua Potable 38924-S y su reforma 41499-S, esto ante el Área Rectora de Salud de Pococí. 7- Mantener actualizados los análisis de calidad del agua potable mediante ensayos realizados por laboratorios que estén acreditados por el ECA (laboratorio y ensayos) 8- Se sugiere implementar el control operativo para lo cual es necesario adquirir los equipos de medición de cloro residual libre y turbidez, según el Artículo 8 del RCAP 38924-S. 9- Se recalca la importancia de proceder de manera apremiante con la rehabilitación de la planta de remoción de hierro y manganeso, para la cual pueden optar por las diferentes opciones del mercado.
10-Se insta a la ASADA aplicar las tarifas tanto de consumo como de instalaciones de previstas y poder así realizar el cobro según lo establecido en la RESOLUCIÓN RIA-006-2017 emitida por ARESEP”.
Además, del citado informe se denota que, entre las inconsistencias se señalan las siguientes dos: 1) El sistema de acueducto por bombeo abastece a 141 abonados, utilizan 1 pozo perforado y su tanque de almacenamiento es metálico y elevado de 45 m³, tienen 100% micro-medicion y cobran una tarifa base de ¢4000 de hasta 12 m³ y ¢200 m³ el adicional, líneas de impulsión y conducción de 4” en hierro y distribución de 6” también en hierro, poseen filtros para la remoción de hierro y manganeso que no están en operación y un sistema de cloración con hipoclorito de sodio al 12%, no realizan macro-medición y además tienen un caudal aforado de 3,42 l/s. 2) El acueducto requiere valorar el mantenimiento del tanque (pintura y rotulación) y la puesta en marcha de la planta de tratamiento para la remoción de hierro y manganeso que afecta el desempeño de la cloración en el sistema, dejando este parámetro por debajo de lo establecido en el Reglamento para la Calidad del Agua Potable 38924-S de 0.3 a 0.6 mg/l.
Para esta Sala, si bien dichas recomendaciones tienen sustento en lo corroborado en una inspección realizada en fecha reciente, no por ello es posible excusar a la ASADA ni mucho menos al ICAA, pues más bien deficiencias así en la prestación de un servicio vital para la salud y la vida misma se deben prever por su valiosa importancia. Véase que la recurrente es reiterativa en sus manifestaciones sobre la calidad del agua que recibe. Lo que denota que es una problemática consistente en el tiempo y que ahora se confirma con base en un informe técnico de campo. Esa situación se ha traducido en una evidente e ilegítima falta de servicio, contraria a los derechos constitucionales de la recurrente al agua potable y a los principios constitucionales que rigen el funcionamiento de los servicios públicos.
Por otra parte, el instituto recurrido también es coparticipe de dicha lesión, como se indicó, ya que de conformidad con la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, Ley No. 2726 de 14 de abril de 1961, le corresponde dirigir y vigilar todo lo concerniente para proveer a los habitantes de la república de un servicio de agua potable y esto lo puede hacer, de conformidad con el artículo 2, inciso g), Ibidem, incluso, mediante la delegación, administración, operación, mantenimiento y desarrollo de los acueductos y alcantarillado, en organizaciones debidamente constituidas para tales efectos (asociaciones administradoras); sin embargo, el ente rector en la materia seguirá siendo el Instituto. Así lo dispone, expresamente, el artículo 3, del Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados comunales, Nº 42582-S-MINAE, que señala lo siguiente:
“Artículo 3.- Rectoría técnica: El AyA como ente rector técnico en la prestación de los servicios públicos de acueducto, alcantarillado y/o saneamiento de las aguas residuales, ejercerá todas las actividades propias del control, vigilancia, fiscalización, evaluación, normalización, planificación sectorial de los servicios de agua potable y saneamiento de aguas residuales y dirección de la gestión que realizan las ASADAS, ya que la gestión del sistema corresponde a la ASADA por delegación del AyA.
La relación entre el AyA y las ASADAS estará basada en los principios de participación social, colaboración, cooperación, adaptabilidad o mutabilidad de los servicios, eficiencia y eficacia, fiscalización, control, evaluación, normalización, planificación sectorial de los servicios de agua potable y saneamiento de aguas residuales y dirección de la gestión que realizan las ASADAS”.
Por su parte, de conformidad con lo preceptuado en el reglamento citado, las ASADAS tienen como únicos y específicos fines la prestación de los servicios de abastecimiento de agua potable y saneamiento de aguas residuales, contribuir en la gestión integrada del recurso hídrico y brindar el servicio de hidrantes por ley especial. Entonces, de conformidad con la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, la competencia privativa en materia de suministro de agua potable, así como la construcción de los sistemas de acueducto con ese propósito, le corresponde a esa institución.
De manera, que el ICAA y la ASADA recurrida han quebrantado el principio del buen funcionamiento de los servicios públicos y el derecho al servicio de agua potable, al no efectuar de manera célere las acciones conjuntas para garantizar la prestación del agua potable a la comunidad en los términos de idoneidad que la misma normativa dispone. Lo anterior porque es obligación de ambas partes, velar por la continuidad, la cantidad y la oportunidad del servicio, afirmando el derecho a la salud y el derecho humano de acceso al agua potable.
Por lo demás, en cuanto a las gestiones posteriores presentadas por la recurrente, se le advierte que a esta Sala no le corresponde determinar si se le debe otorgar la certificación de disponibilidad de agua, pues constituye un extremo de legalidad ordinaria, ya que es la ASADA la que debe determinar si es posible o no su otorgamiento con sustento en aspectos técnicos ajenos a esta jurisdicción constitucional.
V.Conclusión. Por consiguiente, se impone declarar con lugar el recurso por infracción del derecho al agua potable y ordenarles a las partes recurridas que ejecuten las acciones correspondientes, en sus respectivos ámbitos de competencia, para que se realicen las mejoras al acueducto, según las recomendaciones supra mencionadas.
