Res. 28901-2026 Sala Constitucional · Sala Constitucional · 30/07/2026
OutcomeResultado
The justice maintained that, although environmental matters involving administrative intervention ordinarily belong in the administrative-litigation jurisdiction, this case warranted merits review because of the concurrent rights alleged; the note does not state the majority’s decision.
SummaryResumen
Justice Salazar Alvarado’s note states his view that, in environmental matters where the Public Administration has already intervened, the administrative-litigation jurisdiction should hear and resolve the case. He identifies an exception when the rights of people affected are also at stake, including health, quality of life, and the constitutional right to a healthy environment free from pollution. In this matter, the applicant alleged that the Municipality of Desamparados had not acted on a complaint filed in July 2024 concerning the use of land he owned as an open-air dump and for the consumption of illicit substances. Because those concurrent rights were implicated, the justice considered that the Chamber should examine the merits to verify or dismiss the allegations. The note states the justice’s view and does not itself report the majority’s operative disposition.

In environmental matters, it is my view that, if the Public Administration has already intervened, the matter falls within the jurisdiction of the administrative-litigation jurisdiction for consideration and resolution. Nevertheless, I do consider the merits when other rights of the people affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy environment free from contamination (Article 50 of the Political Constitution), as in this case. Here, the applicant alleges that the Municipalidad de Desamparados has not acted on the complaint he filed in July 2024, in which he informed the respondent entity that a parcel of land he owns, located in that canton, is being used as an open-air dump and for the consumption of illicit substances, and for that reason he brings this matter before this Chamber. The situation described is an exception to my general position on this subject. I therefore consider it necessary for this Constitutional Court to examine the merits of the matter in order to verify or dismiss the applicant’s allegations.
