028901-26. ENVIRONMENT. HEALTHY ENVIRONMENT AND EDUCATION. IT IS ALLEGED THAT THE STATE OF ABANDONMENT OF A PROPERTY OWNED BY THE INSTITUTO MIXTO DE AYUDA SOCIAL, USED AS AN OPEN-AIR DUMP AND A SITE FOR ILLICIT ACTIVITIES, GENERATES ENVIRONMENTAL AND SAFETY PROBLEMS AFFECTING NEIGHBORING RESIDENTS AND THE SCHOOL COMMUNITY OF THE CENTRO EDUCATIVO SAN JERÓNIMO DE DESAMPARADOS. THE COURT CONSIDERS THAT IMAS, AS OWNER OF THE PROPERTY, HAS A DUTY TO ADOPT THE NECESSARY MEASURES TO ELIMINATE THE CONDITIONS COMPROMISING THE RIGHT TO A HEALTHY ENVIRONMENT AND THE HEALTH AND SAFETY OF THE POPULATION, AND THAT ADMINISTRATIVE OR REGISTRY PROCEEDINGS DO NOT JUSTIFY THE CONTINUATION OF THE REPORTED SITUATION. It was established that the Instituto Nacional de Vivienda y Urbanismo is the registered owner (propietario registral) of the property parcel (finca) in the San José registry, roll number 1-212856, which is land designated for social-project development, located in the canton (cantón) of Desamparados. As explained, the Unidad Local de Desarrollo Social Desamparados is not only aware of the regular presence of homeless individuals (habitantes de calle) on that same property, but also that third parties use it as a clandestine dump (botadero clandestino) and for other unauthorized activities—such as drug consumption—given that complaints have been filed by neighboring residents and by the principal of the Centro Educativo San Jerónimo regarding the reported problems. As the executive president of that Institute explains, despite the fact that periodic cleanups of the land were carried out during 2023, 2024, 2025, and 2026, unidentified individuals almost immediately resume depositing waste on the site.
That being said, and viewed from that perspective, even though IMAS has carried out—as reported—multiple administrative, technical, and inter-institutional efforts aimed at addressing the existing problem, pursuing a definitive solution, and ensuring proper management of the real property, the fact remains that the problem persists; as reported, the situation presents extraordinary social, legal, technical, registry, operational, and budgetary complexity, since it involves not merely a problem associated with the irregular deposit of waste by third parties, but rather a situation that encompasses the management of a large-scale property, the existence of longstanding occupations, pending titling (titulación) processes, public-domain encumbrances (afectaciones demaniales), registry limitations, potential transfers to the Municipalidad de Desamparados, specialized cadastral surveys, and the need to allocate significant public resources for the implementation of physical control and protective measures.
Furthermore, the information provided by the mayor of Desamparados only confirms that no definitive solution to the reported problem has been achieved. For these reasons, with respect to the respondent Institute, the writ (recurso) must be granted, as set forth below.
On the other hand, with regard to the Municipalidad de Desamparados, the record shows that on unspecified dates—the most recent being June 15, 2026—the Green Areas Administration (Administración de Zonas Verdes) of that local authority carried out periodic brush-clearing (chapea) and cleanup work at the site with the aim of preventing the location from becoming an open-air dump. In addition, that same unit coordinated actions with the Municipal Police (Policía Municipal) to ensure safe access for operational staff and the execution of maintenance work, thereby guaranteeing the security of the area in view of the high incidence of public-safety problems, the frequent presence of homeless individuals and users of psychoactive substances; several inspections were also conducted at the site, which confirmed the existence of multiple occupations and encroachments across various sections of the property, all in response to the request for cooperation submitted by residents neighboring the IMAS property. Under these circumstances, the Court finds that no grievance (agravio) exists in this regard. Accordingly, the writ must be dismissed with respect to this party, as is hereby ordered. (…)"
028901-26. AMBIENTE. AMBIENTE SANO Y EDUCACIÓN. SE ALEGA QUE EL ESTADO DE ABANDONO DE UN INMUEBLE PROPIEDAD DEL INSTITUTO MIXTO DE AYUDA SOCIAL, UTILIZADO COMO BASURERO A CIELO ABIERTO Y SITIO DE ACTIVIDADES ILÍCITAS, GENERA PROBLEMAS AMBIENTALES Y DE SEGURIDAD QUE AFECTAN A LOS VECINOS Y A LA COMUNIDAD EDUCATIVA DEL CENTRO EDUCATIVO SAN JERÓNIMO DE DESAMPARADOS. LA SALA CONSIDERA QUE EL IMAS, COMO PROPIETARIO DEL BIEN, TIENE EL DEBER DE ADOPTAR LAS MEDIDAS NECESARIAS PARA ELIMINAR LAS CONDICIONES QUE COMPROMETEN EL DERECHO A UN AMBIENTE SANO, LA SALUD Y LA SEGURIDAD DE LA POBLACIÓN, SIN QUE LOS TRÁMITES ADMINISTRATIVOS O REGISTRALES JUSTIFIQUEN LA PERMANENCIA DE LA SITUACIÓN DENUNCIADA. Se comprobó que el Instituto Nacional de Vivienda y Urbanismo es el propietario registral de la finca del partido de San José matrícula 1-212856, que es terreno para desarrollo de proyecto social, que se ubica en el cantón de Desamparados. Según se explica, la Unidad Local de Desarrollo Social Desamparados no solo conoce de la presencia regular de habitantes de calle en esa misma propiedad, sino que terceras personas la utilizan como botadero clandestino y para otras actividades no autorizadas -como consumo de drogas-, pues, existen denuncias de vecinos del lugar y de la directora del Centro Educativo San Jerónimo, sobre la problemática acusada. Según explica la presidenta ejecutiva de ese Instituto, pese a que, durante los años 2023, 2024, 2025 y 2026, se ha realizado limpiezas periódicas del terreno, de manera casi inmediata personas no identificadas vuelven a depositar desechos en el sitio.
Ahora bien, desde esa perspectiva, aunque el Instituto Mixto de Ayuda Social haya realizado -según se informa- múltiples gestiones administrativas, técnicas e interinstitucionales dirigidas a atender la problemática existente, procurar su solución definitiva y garantizar una adecuada administración del bien inmueble, lo cierto es que el problema persiste, pues, según se informa, la situación planteada reviste una extraordinaria complejidad social, jurídica, técnica, registral, operativa y presupuestaria, dado que no se trata únicamente de un problema asociado al depósito irregular de residuos por parte de terceros, sino de una situación que involucra la administración de un inmueble de grandes dimensiones, la existencia de ocupaciones históricas, procesos de titulación pendientes, afectaciones demaniales, limitaciones registrales, eventuales traspasos a la Municipalidad de Desamparados, estudios catastrales especializados y la necesidad de destinar recursos públicos significativos para la implementación de medidas físicas de control y protección.
Incluso, lo informado por parte de la alcaldesa de Desamparados, no hace más que confirmar que no ha existido una solución definitiva al problema acusado. De ahí que en lo que respecta al instituto recurrido, se impone acoger el recurso, conforme se dirá.
De otra parte, en lo que concierne a la Municipalidad de Desamparados, consta que en fechas indeterminadas, la última el 15 de junio de 2026, la Administración de Zonas Verdes de ese ente local realizó labores periódicas de chapea y limpieza en el sitio con la intención de evitar que el lugar se convierta en un basurero a cielo abierto. Además, esa misma dependencia coordinó acciones con la Policía Municipal, para garantizar el ingreso seguro del personal operativo y la ejecución de los trabajos de mantenimiento y así garantizar la seguridad de la zona, en vista de la una alta incidencia de problemáticas de seguridad ciudadana, presencia frecuente de personas habitantes de calle y consumidores de sustancias psicoactivas y se realizaron algunas inspecciones en el lugar, constatado la existencia de múltiples ocupaciones e invasiones en diversos sectores del terreno, todo en atención a la solicitud de colaboración que plantearon vecinos del inmueble propiedad del IMAS. Así las cosas, en este punto, descarta la Sala que exista agravio alguno. Bajo esta inteligencia, se impone desestimar el recurso, como en efecto se dispone. (…)”
