027891-26. ENVIRONMENT. PUBLIC SERVICES. THE CLOSURE OF HAND-DUG WELLS AND THE FAILURE TO SUPPLY WATER IN PLAYA REAL DE CABO VELAS ARE CHALLENGED. DISMISSED BECAUSE NO ARBITRARY ACTION BY MINAE WAS ESTABLISHED AND THE INABILITY OF THE ASADA TO PROVIDE THE SERVICE IS DUE TO TECHNICAL AND WATER RESOURCE LIMITATIONS. VCG08/2026 "(…) III.- On the specific case. The petitioner (recurrente) claims that MINAE officials ordered the closure of a hand-dug well (pozo artesanal) located in Playa Real de Cabo Velas, Santa Cruz, prohibiting the water use (aprovechamiento) that, as she argues, constitutes the only source of supply for several families in the community. She alleges that this action was carried out in an arbitrary manner, without observing due process (debido proceso), thereby affecting the inhabitants' access to water.
Regarding the grievance raised against MINAE, this Chamber finds that the present matter must be resolved in the same manner as was decided in judgment no. 2026-021173, issued at 9:30 a.m. on June 12, 2026, handed down within case file (expediente) 26-011125-0007-CO. On that occasion, this Tribunal heard a writ of amparo (recurso de amparo) filed in connection with the same administrative action taken by that authority with respect to the water use derived from the hand-dug wells located in Playa Real de Cabo Velas, Santa Cruz, and therefore proceeds to reiterate the position adopted therein. In that judgment, the following was decided:
"I.- SUBJECT MATTER. The petitioner alleged that the protected party (amparada) is an elderly person (persona adulta mayor) and is the owner of a hand-dug well located in Playa Real de Cabo Velas de Santa Cruz, Guanacaste. He accuses the respondent authority (autoridad recurrida) of illegally closing that well with padlocks, without guaranteeing due process, leaving the family without water.
(…)
IV.Specific case. In accordance with the sworn reports, with the legal and even criminal consequences set forth in Article 44 of the Law governing this Jurisdiction, it is established that the protected party, María Rosa Bustos Duarte, national identity card number (cédula) 502320252, does not hold any real property registered in her name. The well that was closed for illegal use is not located on any property owned by the protected party. According to the Registro Nacional de Concesiones maintained by MINAE's Dirección de Agua, there is a pending water-use concession (concesión de aprovechamiento) application for two hand-dug wells under case file 27324-P, in the name of Mr. Fidencio Bustos Bustos. The concession is being processed in order to use the water from the wells for agricultural purposes. Prior to resolving the case file, an on-site inspection was conducted on March 27, 2026, in order to verify the condition of the wells and determine whether they are in fact hand-dug (artesanal) or drilled wells.
Upon arriving at the site, the official from MINAE's Dirección de Agua, specifically from the Unidad Hidrológica Tempisque-Pacífico Norte, confirmed that two hand-dug wells do indeed exist on the property. As indicated in technical report DA-UHTPNOL-0514-2026 of April 22, 2026, both wells are located in concrete well houses (casetas) secured with chains and padlocks. At the property, the official was received by Mr. Juan María Bustos Caravaca, who informed her that he does not have the keys to the well house for well No. 1, but that the keys are at Hotel Bahía de Los Piratas, as they are the ones who use the water. At the hotel, Mr. Jaime Enrique García Velásquez, who identified himself as the Hotel Manager, stated that he holds a water-use concession application for both wells. Well No. 1 is administered by the hotel. The condition of the well was verified on-site and the corresponding warning was served on Mr.
Jaime García Velásquez in his capacity as described above. At the time of the inspection of the aforementioned well, Ms. Linsey García Chavarría appeared and stated that she is the owner of the property where the hotel using the water from hand-dug well No. 1 is located. The corresponding notification of unauthorized water use was served on both Ms. García Chavarría and Mr. García Velásquez, as the use constituted an illegal extraction due to the absence of any concession. Mr. Bustos Caravaca proceeded to padlock well No. 1 in order to avoid problems. A record was made noting "that the action taken by Mr. Juan María Bustos Caravaca, regarding the placement of a padlock on the well house of hand-dug well 01, was carried out of his own free will, without the intervention of the undersigned" MINAE official. Subsequently, on April 9, 2026, a second on-site inspection was conducted, jointly with officials from the Municipalidad de Santa Cruz, the ASADA de Matapalo, and the Ministerio de Salud, as well as the Policía Turística de Flamingo and an official from the Regional Office of AyA.
Also present at the meeting were Mr. Juan María Bustos Caravaca, Jaime García Velásquez, Sabino Quintanilla Medina, José Andrés García Chavarría, Linsey García Chavarría, and [Name 001], the last-named allegedly as legal representative of the properties comprising Hotel Bahía de los Piratas. Ms. [Name 001] provided documentation of bank transfer payments for water service, as well as a letter signed by the petitioner authorizing use of the well. During an inspection of the hotel conducted with Ms. Chavarría's authorization, it was confirmed that the water use is for tourism purposes. On the property there is another hand-dug well, No. 02, which is used for domestic human consumption in dwellings that are not located on the property where it is situated, a circumstance that constitutes an irregular condition in the use of the resource. Likewise, Mr. Juan María Bustos Caravaca was notified that he may not carry out any water use from hand-dug well No. 02, given that said well is located on a property different from the one where the use is being carried out.
From the foregoing, it is concluded that there is no basis for upholding the writ. In the first place, there is no evidentiary basis upon which it could be considered established that the closure of well No. 1 left the protected party without access to water. On the contrary, the report is very clear in stating that the water use is by a hotel. Furthermore, the report is also very clear in stating that the person who received the MINAE official at the inspection placed a padlock: "At that point, Mr. Bustos Caravaca proceeded to padlock well No. 1 in order to avoid problems," which was duly recorded. Moreover, the report also explains that there is no concession in place, even though the water is being used on a property (where the hotel is located) different from the property on which the well is situated. In sum, for the reasons set out above, the writ must be dismissed." Having conducted a comprehensive review of the case file, this Chamber finds no reason whatsoever to depart from the position adopted in the precedent quoted above.
Indeed, the facts underlying the grievance raised against MINAE substantially coincide with those that were analyzed in the cited judgment. Likewise, the sworn reports and the evidence incorporated into the case file allow for verification of the same factual circumstances that supported that decision, including the inspections conducted by MINAE officials, the conditions under which the water resource was being used, the notifications served on the persons involved, the absence of a concession authorizing that use, and the circumstances relating to the placement of the padlock on the hand-dug well house.
In view of the foregoing, this Tribunal finds no new factual or legal elements that would justify modifying the previously adopted position. Rather, the evidence incorporated into these proceedings confirms the conclusions reached in judgment no. 2026-021173, such that the reasons that supported that decision remain fully applicable to resolving the grievance now raised.
Consequently, for the same reasons set forth in the cited precedent, which are hereby reiterated, no arbitrary action on the part of MINAE has been established, nor has any violation of fundamental rights attributable to that authority been shown. Accordingly, with respect to this aspect, the writ must be dismissed.
IV.Regarding the ASADA de Matapalo, Santa Cruz. With respect to the grievance raised against the ASADA de Matapalo de Santa Cruz, the petitioner accuses that entity of having failed to provide potable water supply service to the community of Bahía de los Piratas, Playa Real de Cabo Velas, notwithstanding the applications that, as she asserts, the residents have submitted over several years seeking connection to the distribution system. She contends that this omission has forced them to rely on a hand-dug well for their water supply, the use of which was subsequently restricted by MINAE, a situation that, in her view, violates their fundamental rights.
It should be clarified to the petitioning party (parte accionante) that, although this Chamber has repeatedly recognized that access to potable water constitutes an indispensable fundamental right for the enjoyment of a dignified life, it has also held that this right is not absolute in character, such that the entities responsible for providing the service may deny a request or may find themselves unable to supply it when there are objective technical, material, or legal reasons that justify such a position. In that regard, this Tribunal has stated the following:
"IV.- On the specific case. In the sub lite, the petitioner considers her fundamental right of access to potable water to have been violated. She indicates that she is the co-owner, together with her husband, of the property registered under folio real [of San José, cadastral plan N° SJ-1843630-2015. She indicates that through an application submitted by her husband to the Instituto Costarricense de Acueductos y Alcantarillados, water availability (disponibilidad) for the referenced parcel was requested; however, by means of official communication N° UNDGAM-0583-2018-1803 of February 21, 2018, the respondent institute denied the request, on the grounds that availability does not exist (…) In the area indicated by the petitioner, the existing potable water infrastructure located in front of the property does not have sufficient capacity to supply the property. The potable water production that currently exists and supplies the infrastructure located in front of the property does not have sufficient capacity to supply the property.
The population in the area has been increasing, which has generated significant demand, causing the system that currently supplies the sector to be insufficient. The situation is compounded by the topographical elevation of the area, the limited intake sources in the sector, and the lack of cadastral control in the area by the competent municipality. In these circumstances, the appropriate course of action is to dismiss the writ of amparo. This Constitutional Tribunal has stated in repeated judgments on the matter that the supply of potable water is considered within the Costa Rican legal system to be a public service, and that as such, every public service provider—whether a public entity or a private entity—is obligated to provide the service on a continuous, efficient, and equal basis, and must adapt to technological changes (see Judgment N° 2001-09676 and N° 2004-08161). It is therefore clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the state entities responsible for the provision of the public potable water service, is also obligated to provide this service in a continuous, adaptable, efficient, and equal manner to all inhabitants.
However, the jurisprudence of this Tribunal has also indicated that, in the face of a legal impossibility (which is the failure to meet requirements established in the applicable regulations) or a formal impossibility (which is the absence of a water distribution network), it is reasonable not to process service requests or to require the interested party to assume installation costs when no potable water distribution network exists and infrastructure construction is required. Thus, in these cases it has been understood that this does not constitute a denial of access to the potable water service, but rather an impossibility of providing it, or the necessary participation of the interested party in overcoming a technical obstacle, namely the lack of infrastructure. In other words, as long as the failure to provide the potable water service is not a capricious, arbitrary, or unfounded act, but is instead justified by a legal or material impossibility, we are not facing a violation of fundamental rights.
In the present case, the respondent authority is clear in stating that the petitioner must comply with the requirements of the Ley de Planificación Urbana and the Plan Regulador. Furthermore, the protected party was informed that there is no water availability associated with the subdivision (fraccionamiento) of the parent parcel from which the property under analysis was generated, nor is there sufficient supply capacity in the sector. Finally, the respondent states that in the area indicated by the petitioner, the existing potable water infrastructure located in front of the property does not have sufficient capacity to supply the property. Accordingly, both a legal and a formal or technical impossibility exist, since the subdivision of the land was carried out without water availability having been previously obtained and, additionally, because the sector in which the property is located does not have sufficient capacity to provide the public service.
In consequence of the foregoing, the Chamber finds that the writ of amparo must be dismissed, since, in accordance with the line of jurisprudence invoked by this Tribunal in similar cases, it is permissible to deny the supply of potable water when a legal and/or formal-technical impossibility is found to exist, as is the case here, such that the fundamental rights of the petitioning party would not be infringed. If the petitioner's objection is to the denial itself and the grounds supporting it, this is a matter of legality that cannot be litigated in these proceedings. Furthermore, the Chamber notes that the protected party was expressly informed of the reasons why authorization of the service could not be granted, and therefore her fundamental rights were not violated in that respect either" (emphasis not in the original).
Based on this jurisprudential criterion, this Chamber finds no merit in upholding the present writ with respect to the grievance directed against the ASADA. Indeed, the sworn reports reveal that the community of Bahía de los Piratas lacks potable water supply service due to the absence of distribution infrastructure in the sector and the lack of sufficient water resource capacity (capacidad hídrica) to grant new service availabilities. It was likewise indicated that the Instituto Costarricense de Acueductos y Alcantarillados has recommended against authorizing new connections, in view of the negative water balance (balance hídrico negativo) of the Huacas-Tamarindo aquifer (acuífero), circumstances that, as reported, technically preclude the provision of the service under the conditions sought by the petitioner.
In view of the foregoing, this Tribunal finds that the situation set forth in the record is attributable to technical and material limitations that were duly explained by the respondent authority and that do not stem from a capricious, arbitrary, or unfounded act. On the contrary, the alleged impossibility is grounded in technical criteria relating to the capacity of the supply system, the absence of distribution infrastructure in the sector, and the existing water resource constraints, circumstances that, pursuant to the constitutional jurisprudence of this Chamber, constitute objective reasons justifying the impossibility of providing the requested service.
Consequently, it has not been established that the ASADA has violated the fundamental rights of the petitioner. Rather, the refusal to supply potable water service responds to technical circumstances that, according to the evidence incorporated into the case file, currently prevent its provision. Accordingly, with respect to this aspect as well, the writ must be dismissed. (…)"
027891-26. AMBIENTE. SERVICIOS PÚBLICOS. SE CUESTIONA EL CIERRE DE POZOS ARTESANALES Y LA FALTA DE SUMINISTRO DE AGUA EN PLAYA REAL DE CABO VELAS. SE DECLARA SIN LUGAR PORQUE NO SE ACREDITÓ ACTUACIÓN ARBITRARIA DEL MINAE Y LA IMPOSIBILIDAD DE BRINDAR EL SERVICIO POR PARTE DE LA ASADA OBEDECE A LIMITACIONES TÉCNICAS Y HÍDRICAS. VCG08/2026 “(…) III.- Sobre el caso concreto. La recurrente reclama que funcionarios del MINAE ordenaron el cierre de un pozo artesanal ubicado en Playa Real de Cabo Velas, Santa Cruz, prohibiendo el aprovechamiento del agua que, según sostiene, constituye la única fuente de abastecimiento para varias familias de la comunidad. Alega que esa actuación se llevó a cabo de manera arbitraria, sin observar el debido proceso, afectando el acceso al agua de los habitantes del lugar.
En lo concerniente al agravio planteado contra el MINAE, esta Sala estima que el presente asunto debe resolverse en el mismo sentido que lo decidido en la sentencia nro. 2026-021173 de las 9:30 horas del 12 de junio de 2026, dictada dentro del expediente 26-011125-0007-CO. En esa oportunidad, este Tribunal conoció un recurso de amparo promovido con ocasión de la misma actuación administrativa desplegada por esa autoridad respecto del aprovechamiento del agua proveniente de los pozos artesanales ubicados en Playa Real de Cabo Velas, Santa Cruz, por lo que procede reiterar el criterio allí sostenido. En dicha sentencia, se resolvió lo siguiente:
“I.- OBJETO. El recurrente alegó que la amparada es una persona adulta mayor y es dueña de un pozo artesanal ubicado en Playa Real de Cabo Velas de Santa Cruz, Guanacaste. Acusa que la autoridad recurrida cerró ilegalmente ese pozo, con candados, sin garantizar el debido proceso quedando la familia sin agua.
(…)
IV.Caso concreto. De conformidad con los informes bajo fe de juramento con las consecuencias legales, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción, se comprueba que, la amparada María Rosa Bustos Duarte, cédula 502320252, no posee bienes inmuebles inscritos a su nombre. El pozo que se clausuró por uso ilegal no se encuentra en algún inmueble propiedad de la amparada. Conforme el Registro Nacional de Concesiones que lleva la Dirección de Agua del MINAE, se tiene solicitud de concesión de aprovechamiento de dos pozos artesanales bajo el expediente 27324-P, a nombre del señor Fidencio Bustos Bustos. La concesión se tramita para aprovechar el agua de los pozos en uso agropecuario. Previo a resolver el
de verificar la condición de los pozos y comprobar si efectivamente los mismos son excavados (artesanales) o si se trata de pozos perforados. Al llegar al sitio, la funcionaria de la Unidad Hidrológica Tempisque- Pacífico Norte de la Dirección de Agua, comprueba que en la propiedad efectivamente existen dos pozos artesanales. Que tal y como se indica en el informe técnico DA-UHTPNOL-0514-2026 del 22 de abril del 2026, ambos pozos se ubican en casetas de concreto protegidas con cadenas y candados. En la propiedad la funcionaria es atendida por el señor Juan María Bustos Caravaca, quien le indica que no cuenta con las llaves de la caseta del pozo N°1, pero que en el hotel Bahía de Los Piratas, se encuentran las llaves pues son ellos quienes utilizan el agua. En el hotel, el señor Jaime Enrique García Velásquez quien se identificó como Administrador del Hotel, informó que posee una solicitud de concesión de aprovechamiento de agua de ambos pozos.
El pozo N°1 es administrado por el hotel. Se verifica en el sitio la condición del pozo y se procede a notificar la prevención respectiva al señor Jaime García Velásquez en la condición antes señalada. Al momento de la inspección del pozo citado supra se presenta la señora Linsey García Chavarría, quien manifiesta ser propietaria del inmueble donde se ubica el hotel que aprovecha el agua del pozo artesanal N°1. Se procede a realizar la notificación correspondiente del no uso del agua tanto a la señora García Chavarría como al señor García Velásquez, por tratarse de un aprovechamiento ilegal al no contar con concesión alguna. El señor Bustos Caravaca procedió a poner candado al pozo N°1 a fin de evitarse problemas. Se dejó constancia de “que la actuación realizada por el señor Juan María Bustos Caravaca, respecto a la colocación de un candado en la caseta del pozo artesanal 01, ha sido efectuado por su propia voluntad, sin intervención de la suscrita”, funcionaria del MINAE.
Posteriormente con fecha 9 de abril del 2026, se realiza una segunda inspección al sitio, conjuntamente con funcionarios de la Municipalidad de Santa Cruz, de la Asada de Matapalo y del Ministerio de Salud así como de la Policía Turística de Flamingo y un funcionario de la Oficina Regional del AyA. En la reunión estuvo presente además el señor Juan María Bustos Caravaca, Jaime García Velásquez, Sabino Quintanilla medina, José Andrés García Chavarría, Linsey García Chavarría y [Nombre 001], ésta última supuestamente como representante legal de los inmuebles que conforman el Hotel Bahía de los Piratas. La señora [Nombre 001], aporta documentación de pago de transferencias bancarias por concepto de pago del agua, así como una carta suscrita por la recurrente autorizando el uso del pozo. En inspección al hotel con autorización de la señora Chavarría, se constató que el uso del agua es turístico.
En la propiedad se encuentra otro pozo artesanal 02 que es utilizado para consumo humano tipo doméstico en viviendas que no se ubican dentro de la propiedad donde este se localiza, lo cual constituye una condición irregular en el uso del recurso. Asimismo, se notificó al señor Juan María Bustos Caravaca que no puede realizar ningún tipo de aprovechamiento del agua del pozo artesanal 02, debido a que dicho pozo se localiza en una propiedad distinta a aquella donde se realiza el aprovechamiento.
Del panorama expuesto se concluye que no hay razón para estimar el recurso. En primer término no hay ningún elemento de juicio conforme al cual se pueda tener por demostrado que el cierre del pozo 1 hubiera dejado a la amparada si acceso al agua. Al contrario, el informe es muy claro en cuanto a que el uso es por parte de un hotel. Por otra parte, el informe es también muy claro en cuanto a que quien atendió a la funcionario del MINAE en la inspección un candado: “En ese acto el señor Bustos Caravaca procedió a poner candado al pozo N°1 a fin de evitarse problemas”, de lo que se dejó constancia. Por otra parte, en el informe también se explica que no hay ninguna concesión, pese a que el agua se utiliza en una propiedad (donde está el hotel) distinta a la propiedad donde está el pozo. En suma, de conformidad con las razones Del examen integral del expediente, esta Sala no encuentra motivo alguno para apartarse del criterio sostenido en el precedente transcrito.
En efecto, los hechos que sirven de fundamento al agravio formulado contra el MINAE coinciden sustancialmente con aquellos que fueron objeto de análisis en la sentencia citada. Asimismo, los informes rendidos bajo juramento y la prueba incorporada al expediente permiten constatar las mismas circunstancias fácticas que sustentaron aquella decisión, entre ellas, las inspecciones efectuadas por funcionarios del MINAE, las condiciones en que se realizaba el aprovechamiento del recurso hídrico, las notificaciones practicadas a las personas involucradas, la inexistencia de una concesión que autorizara ese aprovechamiento y las circunstancias relacionadas con la colocación del candado en la caseta del pozo artesanal.
Así las cosas, este Tribunal no advierte la existencia de elementos fácticos o jurídicos novedosos que justifiquen modificar el criterio previamente adoptado. Antes bien, la prueba incorporada a este proceso confirma los extremos considerados en la sentencia nro. 2026-021173, de manera que las razones que sustentaron aquella decisión mantienen plena vigencia para resolver el agravio ahora planteado.
En consecuencia, por las mismas razones expuestas en el precedente citado, las cuales se reiteran en esta oportunidad, no se acredita una actuación arbitraria por parte del MINAE ni una lesión a los derechos fundamentales atribuible a esa autoridad. Por ello, en cuanto a este extremo, el recurso debe declararse sin lugar.
IV.Respecto a la ASADA de Matapalo, Santa Cruz. En lo que respecta al agravio formulado contra la ASADA de Matapalo de Santa Cruz, la recurrente acusa que esa entidad ha omitido brindar el servicio de abastecimiento de agua potable a la comunidad de Bahía de los Piratas, Playa Real de Cabo Velas, pese a las gestiones que, según afirma, los vecinos han planteado durante varios años para obtener la conexión al sistema de distribución. Sostiene que esa omisión los ha obligado a abastecerse mediante un pozo artesanal, cuyo aprovechamiento fue posteriormente restringido por el MINAE, situación que, a su juicio, vulnera sus derechos fundamentales.
Ahora bien, se aclara a la parte accionante que, si bien esta Sala ha reconocido de manera reiterada que el acceso al agua potable constituye un derecho fundamental indispensable para el disfrute de una vida digna, también ha sostenido que ese derecho no reviste carácter absoluto, de manera que las entidades encargadas de la prestación del servicio pueden denegar una solicitud o encontrarse imposibilitadas para suministrarlo cuando existan razones técnicas, materiales o jurídicas objetivas que lo justifiquen. En ese sentido, este Tribunal ha señalado lo siguiente:
“ IV.- Sobre el caso concreto. En el sub lite, la recurrente estima lesionado su derecho fundamental de acceso al agua potable. Indica que es propietaria, junto con su esposo, del inmueble matrícula folio real [ de San José, plano catastrado N° SJ-1843630-2015. Señala que mediante gestión realizada por su esposo ante el Instituto Costarricense de Acueductos y Alcantarillados, se solicitó la disponibilidad de agua para el terreno citado; empero, por medio del oficio N° UNDGAM-0583-2018-1803 del 21 de febrero de 2018, el instituto recurrido denegó la petición, bajo el argumento que no existe disponibilidad (…) En el sector indicado por la recurrente, la infraestructura de agua potable existente frente a la propiedad no tiene capacidad suficiente para abastecer el inmueble. La producción de agua potable que existe actualmente y abastece la infraestructura que se ubica frente a la propiedad no tiene capacidad suficiente para abastecer el inmueble.
La población en la zona ha ido aumentando y ello ha generado mucha demanda que ha provocado que, en la actualidad, el sistema que abastece el sector sea insuficiente. La situación se ve agravada por la elevación topográfica de la zona, las limitadas fuentes de captación en el sector y la falta de control catastral en la zona por parte de la municipalidad competente. Así las cosas, lo correspondiente es declarar sin lugar el recurso de amparo. Este Tribunal Constitucional ha indicado en reiteradas sentencias sobre el tema que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos -sea sujeto público o sujeto privado- está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase Sentencia N° 2001-09676 y N° 2004-08161).
Resulta claro entonces concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargados de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes. Ahora bien, también la jurisprudencia de este Tribunal ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una red de distribución de aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura.
En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales. En la especie, la autoridad recurrida es clara en indicar que la recurrente debe cumplir con lo estipulado en la Ley de Planificación Urbana y Plan Regulador. Además, a la amparada se le explicó que no existe disponibilidad asociada para el fraccionamiento de la propiedad madre de la que se generó la propiedad en análisis ni tampoco existe capacidad de abastecimiento en el sector. Por último, el recurrido señala que en el sector indicado por la recurrente, la infraestructura de agua potable existente frente a la propiedad no tiene capacidad suficiente para abastecer el inmueble. De manera tal, que existe una imposibilidad tanto jurídica como formal o técnica, ya que el fraccionamiento del terreno se realizó sin que previamente se haya obtenido la disponibilidad y, además, porque en el sector donde se encuentra la propiedad no existe capacidad suficiente para brindar el servicio públicos.
Corolario de lo expuesto, la Sala considera que se debe desestimar el recurso de amparo, ya que de conformidad con la línea jurisprudencial esgrimida por este Tribunal en casos similares, es posible denegar el suministro de agua potable cuando se determina la existente de una imposibilidad jurídica y/o formal técnica, como ocurre en la especie, de modo que no se estarían infringiendo los derechos fundamentales de la parte promovente. Si la recurrente lo que se encuentra es disconforme con la negatoria en sí, y con los motivos que la sustentan, ello corresponde a un extremo de legalidad que no puede ser ventilado en esta vía . Además, la Sala constata que a la amparada sí se le indicaron expresamente los motivos por los cuales no procedía la autorización del servicio, de ahí que tampoco en ese aspecto se hayan conculcado sus derechos fundamentales” (el resaltado no es del original).
A partir de ese criterio jurisprudencial, esta Sala no encuentra mérito para estimar el presente recurso en cuanto al agravio dirigido contra la ASADA. En efecto, de los informes rendidos bajo juramento se desprende que la comunidad de Bahía de los Piratas no cuenta con servicio de abastecimiento de agua potable debido a la inexistencia de infraestructura de distribución en el sector y a la ausencia de capacidad hídrica suficiente para otorgar nuevas disponibilidades de servicio. Asimismo, se indicó que el Instituto Costarricense de Acueductos y Alcantarillados ha recomendado no autorizar nuevas conexiones, en atención al balance hídrico negativo que presenta el acuífero Huacas-Tamarindo, circunstancias que, según se informó, impiden técnicamente la prestación del servicio en las condiciones pretendidas por la parte recurrente.
Así las cosas, este Tribunal estima que la situación fueron debidamente explicadas por la autoridad recurrida y que no obedecen a una actuación antojadiza, arbitraria o carente de fundamento. Por el contrario, la imposibilidad alegada encuentra sustento en criterios técnicos relacionados con la capacidad del sistema de abastecimiento, la inexistencia de infraestructura de distribución en el sector y las restricciones hídricas existentes, circunstancias que, conforme a la jurisprudencia constitucional de esta Sala, constituyen razones objetivas que justifican la imposibilidad de brindar el servicio solicitado.
En consecuencia, no se acredita que la ASADA haya incurrido en una lesión a los derechos fundamentales de la recurrente. Antes bien, la negativa para suministrar el servicio de agua potable responde a circunstancias técnicas que, según la prueba incorporada al expediente, actualmente impiden su prestación. Por ello, en cuanto a este extremo, el recurso también debe declararse sin lugar. (…)”
