The Chamber summarily rejected the amparo and stated that approval and the order of consideration of the wildlife crossings bill must be pursued before the Legislative Assembly.
SummaryResumen
The Constitutional Chamber (Sala Constitucional) summarily rejected an amparo application alleging that the Legislative Assembly violated the right to a healthy environment by failing to submit for a second debate and approve a bill on wildlife crossings in infrastructure. The Chamber held that it cannot replace the Legislative Branch’s constitutional authority to decide which laws to enact, their content, or the order in which the Plenary discusses them, as those decisions fall within its legislative discretion. It stated that the applicant must pursue approval of the bill before the Legislative Assembly itself. The ruling does not decide whether the bill should pass or order its consideration.
Key excerptExtracto clave
It is not for this Chamber to replace the powers constitutionally assigned to the Legislative Branch in order to determine which laws should be enacted, their content, or their place on the Plenary’s agenda, since that task belongs to the Legislative Branch in exercising its legislative discretion. In these circumstances, if the applicant considers that the cited bill should be approved in a second debate, she must pursue that before the Legislative Assembly itself. Consequently, the amparo is inadmissible.

THE AMPARO APPLICATION IS REJECTED OUTRIGHT. VCG08/2026 “(…)
Having reviewed the claims and relief sought by the applicant, it must first be noted that this Chamber is not responsible for replacing the powers constitutionally assigned to the Legislative Branch to determine which laws should be enacted, their content, or their place on the agenda of the Legislative Plenary, since that task falls to the Legislative Branch in exercising its freedom to shape legislation. Under these circumstances, if the amparo applicant considers that the cited bill should be approved in a second debate, she must pursue that request before the Legislative Assembly itself.
