ALLEGED DEFICIENT PROVISION OF THE SOLID WASTE COLLECTION SERVICE (servicio de recolección de residuos sólidos), FAILURE TO ADDRESS A STREAM (riachuelo) POSING ENVIRONMENTAL HAZARDS, AND DELAY IN RESPONDING TO ADMINISTRATIVE REQUESTS (gestiones administrativas). THE COURT FINDS THAT THE MUNICIPALITY MUST GUARANTEE THE CONTINUITY AND EFFICIENCY OF THE PUBLIC SERVICE, PROTECT THE RIGHT TO A HEALTHY ENVIRONMENT, AND RESOLVE ADMINISTRATIVE REQUESTS WITHIN A REASONABLE TIME. Accordingly, in Judgment No. 2019-5623 issued at 09:45 hours on 29 de marzo de 2019, in a similar matter involving the failure to provide garbage collection service by a district municipal council (concejo municipal de distrito), this jurisdiction ruled:
"V.- On the garbage collection service. On repeated occasions, this Constitutional Court has addressed the constitutional principles governing the provision of public services and the fundamental right to their efficient delivery — a right which entails, regardless of the type of service, that they must be provided to the highest quality standards, carrying with it the correlative obligation of public administrations to deliver them on a continuous, regular, timely, effective, and efficient basis (see, in that regard, judgments Nos. 2003-11382 issued at 15:11 hours on 07 de octubre de 2003 and 2011-003043 issued at 16:03 hours on 08 de marzo de 2011). Likewise, Article 169 of the Constitución Política establishes the duty of the country's municipalities to safeguard the interests of residents within their jurisdiction; accordingly, in repeated rulings, this Court has held that those bodies are obligated to eliminate any threat that endangers the rights to health and to a healthy and ecologically balanced environment of the persons living in their canton (see, in that regard, judgments 2008-11739 issued at 12:12 hours on 25 de julio de 2008 and 2011-003043 issued at 16:03 hours on 08 de marzo de 2011).
In the present case (sub lite), based on the sworn report and the evidence submitted to the case file, this Court verified that garbage collection is currently not being carried out in the locality of Santa Fe de Cóbano, establishing a violation of the petitioner's fundamental rights. This is so because it was confirmed that the petitioner must travel up to 4 kilometers to find a waste collection point in order to dispose of his/her waste. On the other hand, according to the information provided by the respondent authority, the necessary information is being gathered to determine the most appropriate way to provide the service in that community beginning in the last quarter. While the respondent authority attempts to justify the absence of garbage collection in that locality on the grounds that, since June, the Ministerio de Salud ordered the closure of the Municipal Landfill (Vertedero Municipal), making it necessary to transport solid waste to the community of Montes de Oro in Miramar de Puntarenas, the fact remains that this situation does not exempt it from its obligation to provide garbage collection service to users of its communities; on the contrary, it should have taken measures to resolve that situation, particularly since it has been aware of it since June 2017. This Court has repeatedly held that users of services should not have to bear the Administration's deficiencies. Under these circumstances, this Court found that the garbage collection service in the locality of Santa Fe de Cóbano is not stable, and it is therefore appropriate to grant the action with respect to this point, as will be set forth in the operative part (parte dispositiva) of this judgment" (sic).
IV.On the Merits. In accordance with Article 169 of the Constitución Política and the Código Municipal, local governments are responsible for administering the interests and local services of each canton. The service of collection, transportation, and final disposal of solid waste is an exclusive and essential municipal competency, closely linked to public health and environmental preservation (Articles 21 and 50 of the Constitution).
This Court has consistently held that public services must be provided in accordance with the principles of continuity, regularity, adaptation to any legal or social change in need, and equal treatment of recipients.
In the present case, the municipal authority itself acknowledges in official communication MP-GAM-OF-087-05-2026 that there were severe inconsistencies and irregularities in the frequency of service in Barrio Caribe, with collection reduced at times to once every 15 days, justified by mechanical breakdowns in the fleet (flotilla). While the municipality reports that in 2026 it acquired new units and plans to restore service to a once-per-week frequency, the prolonged and unjustified disruption of service during 2025 and part of 2026 constituted a flagrant violation of the inhabitants' right to receive an efficient and continuous public service, placing them in a situation of health vulnerability. The Administration's budgetary or technical difficulties cannot be passed on as a burden to the member of the public (administrado), least of all when the full corresponding fees (tasas) continue to be charged.
V.On Administrative Delay and the Violation of Article 41 of the Constitución Política. The case law of this Court has precisely established that when a member of the public files a formal complaint, grievance, or claim with the Administration with the purpose of activating its oversight or sanctioning powers, or of correcting a malfunction in public services, the matter must not be analyzed through the lens of the pure right of petition (derecho de petición) (Article 27 of the Constitución Política), but rather under the concept of the right to prompt and complete administrative justice, enshrined in Article 41 of the Constitution.
This fundamental right establishes that the Administration must not incur in undue delays or fall into a state of administrative delay (mora administrativa). In this regard, the legislature has set a temporal benchmark of proportionality and reasonableness in Article 261, paragraph 1), of the Ley General de la Administración Pública de Costa Rica, establishing that every administrative procedure or proceeding requiring a decision by the authority must be resolved and notified within the non-extendable period of two months, counted from the date of submission or the commencement of the proceeding. In the specific case at hand, a flagrant violation of Article 41 of the Constitution by the Municipalidad de Puntarenas is established. The claimant filed a complaint regarding the failures in the collection service and the risk posed by the stream on January 31, 2025. The local government had the legal obligation to process the complaint, order the necessary inspections, and provide a definitive response to the affected party no later than March of that same year.
Far from complying with the legal framework (bloque de legalidad), the municipality remained silent for one year and four months, issuing a formal response only on June 1, 2026, prompted solely by the filing of this amparo action. The Administration's extremely belated response does not erase the harm to the fundamental right to prompt justice; the administrative delay is manifest and the action must be granted on this point.
VI.On the Complaint Filed with the Ministerio de Salud. With respect to the intervention regarding the drainage channel (pajilla) or stream that causes flooding and erosion on properties in Barrio Caribe, the record shows that the Ministerio de Salud (Área Rectora de Barranca) responded to the complaint filed by the claimant in a timely and diligent manner. Within less than two months of the filing of the health complaint, it conducted an on-site inspection, issued the corresponding technical opinion (dictamen técnico), notified the interested party, and coordinated the transfer of competency to the Municipalidad de Puntarenas on August 6, 2025, requesting its intervention on the grounds that the matter involved land stabilization, property boundary demarcation, and local storm-drainage channeling.
Consequently, having established that the Ministerio de Salud acted with utmost diligence within the limits of its enforcement powers and the principle of legality (Article 11 of the Constitution), the action must be dismissed as to that authority. By contrast, the Municipalidad de Puntarenas, having received that technical and formal alert from the Ministerio de Salud since August 2025, merely indicated in May 2026 that "the inspection will be arranged," revealing a troubling neglect of a socio-environmental risk factor during the rainy season — which further reinforces the ruling against it.
Finally, regarding the petitioner's request that this Court order a proportional adjustment in the rate (tarifa) charged for the garbage collection service, that claim is inadmissible in this venue. The determination, setting, indexing, or reduction of municipal rates and fees for the provision of local services entails a technical, financial, and accounting analysis that must be addressed before the Municipal Administration itself or, failing that, before the ordinary contentious-administrative courts (jurisdicción de lo Contencioso-Administrativo), thereby falling outside the scope of protection of the amparo action. For the foregoing reasons, the action must be dismissed on this point. (…)"
025735-26. AMBIENTE. MUNICIPALIDAD. SE ALEGA LA PRESTACIÓN DEFICIENTE DEL SERVICIO DE RECOLECCIÓN DE RESIDUOS SÓLIDOS, LA FALTA DE ATENCIÓN DE UN RIACHUELO QUE GENERA RIESGOS AMBIENTALES Y LA MORA EN LA RESPUESTA A GESTIONES ADMINISTRATIVAS. SE CONSIDERA QUE LA MUNICIPALIDAD DEBE GARANTIZAR LA CONTINUIDAD Y EFICIENCIA DEL SERVICIO PÚBLICO, PROTEGER EL DERECHO A UN AMBIENTE SANO Y RESOLVER LAS GESTIONES DENTRO DE UN PLAZO RAZONABLE. SE DECLARA PARCIALMENTE CON LUGAR EL RECURSO ÚNICAMENTE CONTRA LA MUNICIPALIDAD DE PUNTARENAS Y SIN LUGAR RESPECTO DEL MINISTERIO DE SALUD. SE ORDENA, EN EL PLAZO DE QUINCE DÍAS, REALIZAR LA INSPECCIÓN TÉCNICA DEL RIACHUELO E INICIAR LAS MEDIDAS NECESARIAS PARA SU ATENCIÓN, ASÍ COMO GARANTIZAR LA PRESTACIÓN CONTINUA Y EFICIENTE DEL SERVICIO DE RECOLECCIÓN DE RESIDUOS. VCG08/2026 “(…) III.- SOBRE EL SERVICIO DE RECOLECCIÓN DE BASURA. Esta Sala ha indicado reiteradamente que los usuarios de los servicios no tienen por qué soportar las deficiencias de la Administración. Por lo expuesto, mediante Sentencia N° 2019-5623 de las 09:45 horas de 29 de marzo de 2019, en un asunto similar relacionado con la falta de prestación del servicio de recolección de basura por parte de un concejo municipal de distrito, esta jurisdicción resolvió:
“V.- Sobre el servicio de recolección de basura. En reiteradas ocasiones, este Tribunal Constitucional se ha referido a los principios constitucionales que rigen la prestación de servicios públicos y el derecho fundamental a la prestación eficiente de éstos, que implica que independientemente del tipo de servicio, deben ser prestados con elevados estándares de calidad, el cual tiene como correlato necesario la obligación de las administraciones públicas de prestarlos de forma continua, regular, célere, eficaz y eficiente (véanse en ese sentido las sentencias números 2003-11382 de las 15:11 horas del 07 de octubre de 2003 y 2011-003043 de las 16:03 horas del 08 de marzo de 2011). Asimismo, el artículo 169, de la Constitución Política, dispone el deber de las Municipalidades del país de velar por los intereses de los habitantes de su jurisdicción, de ahí que, en reiterados pronunciamientos, este Tribunal ha señalado que dichas corporaciones se encuentran en la obligación de eliminar cualquier tipo de amenaza que ponga en riesgo los derechos a la salud y a un medio ambiente sano y ecológicamente equilibrado de las personas que viven en su cantón (véanse en ese sentido las sentencias 2008-11739 de las 12:12 horas del 25 de julio de 2008 y 2011-003043 de las 16:03 horas del 08 de marzo de 2011).
En el sub lite, del informe rendido bajo juramento y de la prueba aportada al expediente, esta Sala comprobó que actualmente en la localidad de Santa Fe de Cóbano no se realiza recolección de basura, con lo cual se acredita una afectación a los derechos fundamentales del recurrente. Lo anterior por cuanto, pudo verificarse que el recurrente debe trasladarse hasta 4 kilómetros para poder encontrar un punto en el que se recolecte basura, para poder dejar sus desechos. Por otro lado, según lo informado por la autoridad recurrida se está recabando la información necesaria para determinar la manera más adecuada de prestar el servicio en dicha comunidad a partir del último trimestre. Si bien la autoridad recurrida, intenta justificar la falta de recolección de basura en esa localidad, debido a que desde junio del Ministerio de Salud ordenó el cierre del Vertedero Municipal, teniendo que transportarse los desechos sólidos hasta la comunidad de Montes de Oro en Miramar de Puntarenas, lo cierto es que dicha situación no los exime de su obligación de brindar el servicio de recolección de basura a los usuarios de sus comunidades, y por el contrario, deberían tomar las medidas para solucionar dicha situación, máxime que desde junio de 2017, tienen conocimiento de ello. Esta Sala ha indicado reiteradamente que los usuarios de los servicios no tienen porque soportar las deficiencias de la Administración. Así las cosas, la Sala pudo comprobar que el servicio de recolección de basura en la localidad de Santa Fe de Cóbano no es estable, con lo cual, lo procedente es declarar con lugar el recurso, en cuanto a este extremo y según se dirá en la parte dispositiva de esta sentencia” (sic).
IV.Sobre el fondo. De conformidad con el artículo 169, de la Constitución Política y el Código Municipal, los gobiernos locales tienen a su cargo la administración de los intereses y servicios locales de cada cantón. El servicio de recolección, transporte y disposición final de residuos sólidos es una competencia municipal exclusiva y esencial, ligada estrechamente a la salud pública y a la preservación ambiental (artículos 21 y 50, de la Carta Magna).
Esta Sala ha sostenido de forma invariable que los servicios públicos deben prestarse bajo los principios de continuidad, regularidad, adaptación a todo cambio legal o de necesidad social, e igualdad en el trato de los destinatarios.
En el sub-lite, la propia autoridad municipal reconoce en el oficio MP-GAM-OF-087-05-2026 que existieron severas inconsistencias e irregularidades en la frecuencia del servicio en Barrio Caribe, reduciéndose en ocasiones a visitas cada 15 días, bajo la justificación de desperfectos mecánicos en la flotilla. Si bien la municipalidad informa que en el año 2026 adquirió nuevas unidades y planifica restablecer el servicio a una frecuencia de una vez por semana, la prolongada e injustificada alteración del servicio durante los años 2025 y parte de 2026 constituyó una flagrante violación al derecho de los habitantes de recibir un servicio público eficiente y continuo, colocándolos en una situación de vulnerabilidad sanitaria. Las dificultades presupuestarias o técnicas de la Administración no pueden ser trasladadas como una carga al administrado, menos cuando se mantiene el cobro íntegro de las tasas correspondientes.
V.Sobre la Mora Administrativa y la infracción al artículo 41 de la Constitución Política. La jurisprudencia de esta Sala ha delimitado con precisión que cuando un administrado interpone una denuncia, queja o reclamo formal ante la Administración con el fin de activar sus potestades de fiscalización o sanción, o para corregir una disfuncionalidad en los servicios públicos, el asunto no debe analizarse bajo el tamiz del derecho de petición puro (artículo 27 de la Constitución Política), sino bajo el concepto de derecho a una justicia administrativa pronta y cumplida, consagrado en el artículo 41 constitucional.
Este derecho fundamental establece que la Administración no debe incurrir en dilaciones indebidas o en un estado de mora administrativa. En este sentido, el legislador ha fijado un parámetro temporal de proporcionalidad y razonabilidad en el artículo 261, inciso 1), de la Ley General de la Administración Pública de Costa Rica, determinando que todo procedimiento administrativo o gestión que implique una decisión de la autoridad deberá resolverse y notificarse dentro del plazo improrrogable de dos meses, contado a partir de su presentación o del inicio del trámite. En el caso concreto, se constata una flagrante vulneración al numeral 41, de la Carta Magna, por parte de la Municipalidad de Puntarenas. La actora acudió a denunciar las fallas del servicio de recolección y el riesgo del riachuelo el 31 de enero de 2025. El gobierno local tenía la obligación legal de tramitar la denuncia, ordenar las inspecciones e informar de forma resolutiva a la afectada a más tardar en el mes de marzo de ese mismo año.
Lejos de cumplir con el bloque de legalidad, la municipalidad guardó silencio durante un año y cuatro meses, emitiendo una respuesta formal hasta el 1 de junio de 2026, espoleada únicamente por la interposición de este recurso de amparo. VI.Sobre la denuncia ante el Ministerio de Salud. Respecto a la intervención de la pajilla o riachuelo que provoca inundaciones y erosión en las propiedades de Barrio Caribe, consta que el Ministerio de Salud (Área Rectora de Barranca) atendió de forma oportuna y diligente la denuncia interpuesta por la actora. En un plazo menor a dos meses desde la interposición del reclamo sanitario, realizó la inspección ocular, emitió el correspondiente dictamen técnico, lo notificó a la interesada y coordinó el traslado de competencias a la Municipalidad de Puntarenas el 6 de agosto de 2025, solicitando su intervención por tratarse de un asunto de estabilización de terrenos, linderos y canalización pluvial de resorte local.
Consecuentemente, al comprobarse que el Ministerio de Salud actuó con diligencia extrema dentro del límite de sus potestades de imperio y el principio de legalidad (artículo 11, Constitucional), el recurso debe ser desestimado en cuanto a esta autoridad. Por el contrario, la Municipalidad de Puntarenas, habiendo recibido dicha alerta técnica y formal del Ministerio de Salud desde agosto de 2025, se limitó a indicar en mayo de 2026 que "se procederá a gestionar la inspección", evidenciando una preocupante desatención a un factor de riesgo socioambiental en época lluviosa, lo que refuerza la estimatoria en su contra.
Finalmente, en cuanto a la solicitud de la recurrente tendiente a que esta Sala ordene un ajuste proporcional en el cobro de la tarifa por el servicio de recolección de basura, dicho extremo resulta improcedente en esta vía. La determinación, fijación, indexación o rebaja de tarifas y tasas municipales por la prestación de servicios locales comporta un análisis técnico, financiero y contable que corresponde ventilarse ante la propia Administración Municipal o, en su defecto, ante la jurisdicción ordinaria de lo Contencioso-Administrativo, excediendo el objeto de protección del recurso de amparo. Por lo expuesto, en cuanto a este aspecto, el recurso debe desestimarse. (…)”
