025642-26. ENVIRONMENT. MUNICIPALITY. THE LACK OF A COMPREHENSIVE SOLUTION TO THE FLOODING AFFECTING THE COMMUNITIES OF LA FUENTE, ARRABARÁ, AND EL YAS DE PARAÍSO IS CHALLENGED. IT IS FOUND THAT THE MUNICIPALITIES OF OREAMUNO AND PARAÍSO FAILED IN THEIR DUTY OF COORDINATION AND RISK MANAGEMENT. THE PETITION IS PARTIALLY GRANTED AND BOTH MUNICIPALITIES ARE ORDERED TO PREPARE AND IMPLEMENT A JOINT ACTION PLAN WITHIN THREE MONTHS. VCG08/2026 "(…) IX.- SPECIFIC CASE REGARDING THE COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS. From the body of proven facts it follows that CNE's conduct has complied with the framework of authority conferred upon it by Ley N.° 8488. Indeed, CNE timely issued technical report CNE-UIAR-INF-1213-2021, through which it alerted the Municipality of Oreamuno to the existing risk assessment in the community of La Fuente, and subsequently provided concrete support to the Municipality of Paraíso by contracting heavy machinery under the modality of an undeclared emergency, thereby achieving the clearing and channeling of the watercourse (cauce) in the Calle Arrabará sector.

It must be borne in mind that, as explained in Considerando VII, CNE's authority is limited to declared emergency situations or the so-called first impacts, and it is not responsible for assuming comprehensive technical oversight of a structural and permanent hydraulic problem such as the one affecting the petitioning communities, which, as was established, is not covered by any currently effective emergency decree or General Emergency Plan. Consequently, this Commission cannot be required to take any action beyond that already undertaken, as doing so would constitute an improper extension of its jurisdictional scope. For the foregoing reasons, no omission attributable to CNE is established, and therefore, with respect to this authority, the petition is dismissed.

X. SPECIFIC CASE REGARDING THE MUNICIPALITY OF OREAMUNO

The situation of the Municipality of Oreamuno is different. It must be recalled that it was precisely this municipal body that was the direct recipient of the order set forth in judgment N.° 2014-020505, in which it was instructed to adopt, immediately, the measures necessary to provide a comprehensive and definitive solution to the flooding problem reported, under warning of incurring the criminal offense of contempt of court (desobediencia). Despite more than a decade having elapsed since notification of that ruling, the proven facts do not show that the Municipality of Oreamuno has implemented a comprehensive and definitive solution; rather, its participation has been limited to an unfulfilled commitment documented in official communication AM-1557-2011, an isolated notice directed at a private property owner, and its participation in inter-institutional coordination working groups (mesas de coordinación interinstitucional) that did not result in concrete works within its cantonal jurisdiction.

Added to this is the fact that the President of the Municipal Council (Concejo Municipal) of Oreamuno failed to submit the report requested by this Chamber, which, pursuant to article 45 of the Ley de la Jurisdicción Constitucional, requires that the facts alleged by the petitioning party with respect to this authority be deemed true. As set forth in Considerando VIII, it is the responsibility of municipalities to ensure efficient stormwater drainage (evacuación de aguas) services and adequate sewerage and drainage systems (alcantarillado) within their territory, with their responsibility in matters of land-use planning (ordenamiento territorial) and cantonal drainage being absolute and exclusive. The sustained inaction for more than twelve years, despite the existence of an express judicial order and technical studies documenting the problem, constitutes a clear omission that has kept the inhabitants of the affected communities in a state of anxiety and insecurity, exposing them to an imminent risk to their lives, physical integrity, and property. Accordingly, the petition is granted with respect to the Municipality of Oreamuno.

XI. SPECIFIC CASE REGARDING THE MUNICIPALITY OF PARAÍSO

With respect to this municipal body, although the proven facts reveal a more active participation than that of the Municipality of Oreamuno—having convened and chaired inter-institutional working groups, requested technical opinions on bodies of water, arranged the contracting of machinery for watercourse clearing, and promoted the preparation of a technical intervention plan through official communication MUPA-ALC-CAEN-219-2026—the fact remains that said plan, documented only as of April 22, 2026, is in an embryonic stage of formulation, with no indication that the structural works that the Municipality itself acknowledges as necessary have been commenced, such as the replacement of critical infrastructure and the construction of sediment traps (cajas sedimentadoras) and energy dissipators (disipadores de energía). It must likewise be considered that the Head of the Engineering Department of that Municipality failed to submit the report required by this Chamber, which also leads to the conclusion that the facts alleged by the petitioning party with respect to this authority must be deemed true, pursuant to article 45 of the Ley de la Jurisdicción Constitucional.

Although the Municipality of Paraíso has demonstrated a greater willingness to coordinate than Oreamuno, the mere existence of studies, assessments, and technical working groups, without their being translated into concrete and timely solutions, is not sufficient to satisfy the constitutional duty incumbent upon it, given that the harm reported by the petitioners persists. The responsibility for organizing the territory under its jurisdiction, controlling land use (uso del suelo), and ensuring an adequate cantonal drainage system falls exclusively upon this municipal body, as explained in Considerando VIII, and the involvement of other institutions does not exempt it from executing, within the scope of its own competences, the works necessary to bring the problem to an end. For the foregoing reasons, the petition is also granted with respect to the Municipality of Paraíso, without prejudice to recognizing the measures already initiated.

XII. SPECIFIC CASE REGARDING THE CONSEJO NACIONAL DE VIALIDAD

Finally, with respect to CONAVI, this Chamber notes that this institution was not a party to the proceedings that concluded with judgment N.° 2014-020505, nor was it the recipient of the orders issued therein, having been incorporated into this case file solely by virtue of the joinder of parties agreed upon by the resolution of eleven forty-five a.m. on May 19, 2026. The proven facts show that CONAVI has maintained an active and diligent participation strictly within the framework of its legal authority, which, pursuant to Ley N.° 7798, is limited to the National Road Network (Red Vial Nacional). In that regard, this institution participated in the inter-institutional meetings of November and December 2024, contributed technical information on the stormwater drainage structures of the national routes involved, timely warned, through official communication CARTA-CONAVI-DRC-08-2025-1230 of August 12, 2025, of the need for a comprehensive hydrological and hydraulic study of the micro-watershed (microcuenca), and submitted the corresponding technical input for the handling of the present constitutional protection petition (amparo).

There is no evidence that the harms reported originate in construction deficiencies or maintenance omissions attributable to the national road infrastructure under its administration; on the contrary, the available technical elements indicate that the problem stems from a comprehensive hydraulic dynamic of the micro-watershed, in which factors beyond this Council's authority converge, such as cantonal infrastructure, private properties, and natural watercourses. Consequently, no omission attributable to CONAVI is established, and therefore, with respect to this authority, the petition is likewise dismissed.

XIII. CONCLUSION

For the foregoing reasons, and in accordance with the reiterated case law of this Chamber regarding municipal authority and the obligation of inter-institutional coordination, it is clear that the Municipality of Oreamuno and the Municipality of Paraíso, in their role as guarantors of local interests and services, have failed in their duty to act and coordinate in a timely manner with each other and with the other competent institutions in order to protect the fundamental rights of the inhabitants of the communities of La Fuente (La Puente), Arrabará, and El Yas de Paraíso de Cartago. It must be recalled that this Chamber, in Judgment N.° 2011-012886 of 12:44 p.m. on September 23, 2011, already cited, has held that municipalities possess functional autonomy for the administration of local interests and services, autonomy that must be exercised efficiently and in cooperation with other public bodies, especially when it concerns the protection of rights such as the environment, life, and community safety.

Likewise, this Tribunal has reiterated that, although the scope of municipal functions is broad and autonomous, this does not authorize local bodies to hollow out their obligations to the detriment of the rights of their inhabitants, particularly when an express judicial order is in effect, as is the case with the Municipality of Oreamuno, or when there is full technical awareness of the problem, as is the case with the Municipality of Paraíso. Furthermore, in accordance with article 50 of the Constitución Política, the protection of the environment and of the lives and physical integrity of persons constitutes an objective obligation of the State, the prolonged non-observance of which by municipal authorities, in the face of a hydraulic risk documented for more than a decade through technical reports from CNE and from the Gerencia de Conservación de Vías y Puentes of CONAVI, constitutes a violation of the fundamental rights invoked by the petitioning party.

Pursuant to article 169 of the Constitución Política, the Municipality of Oreamuno and the Municipality of Paraíso not only have the authority to act on the problems affecting their territorial jurisdiction, but also the obligation to coordinate with each other and with the other competent institutions for the comprehensive management of the identified risk. Such cooperation cannot be left to the mere convening of technical working groups without concrete results, but rather requires the effective execution of the works and measures that, within the scope of each municipality's authority, are necessary to provide a definitive solution to the problem. By contrast, the same degree of responsibility cannot be demanded of CNE or of CONAVI, insofar as both institutions have acted strictly within the framework of their legal authority, providing the technical and material support within their respective mandates, and there is no factual or legal basis for attributing to them the omission sanctioned herein.

Accordingly, the present constitutional protection petition (recurso de amparo) must be partially granted, solely with respect to the Municipality of Oreamuno and the Municipality of Paraíso, to the effect that both municipal bodies, within the scope of their respective competences and in effective and ongoing coordination with the other institutions involved—CNE, CONAVI, the Ministerio de Ambiente y Energía, and the Ministerio de Salud—shall establish and implement a joint action plan to execute the stormwater infrastructure works and other mitigation measures necessary to safeguard the life, physical integrity, property, and healthy environment of the inhabitants of the communities of La Fuente (La Puente), Arrabará, and El Yas de Paraíso de Cartago, with the petition being dismissed with respect to CNE and with respect to CONAVI, all in accordance with what is set forth in the operative part (parte dispositiva) of this judgment. (…)"

025642-26. AMBIENTE. MUNICIPALIDAD. SE CUESTIONA LA FALTA DE UNA SOLUCIÓN INTEGRAL A LAS INUNDACIONES QUE AFECTAN LAS COMUNIDADES DE LA FUENTE, ARRABARÁ Y EL YAS DE PARAÍSO. SE ESTIMA QUE LAS MUNICIPALIDADES DE OREAMUNO Y PARAÍSO INCUMPLIERON SU DEBER DE COORDINACIÓN Y GESTIÓN DEL RIESGO. SE DECLARA PARCIALMENTE CON LUGAR Y SE ORDENA ELABORAR Y EJECUTAR UN PLAN DE ACCIÓN CONJUNTO EN EL PLAZO DE TRES MESES. VCG08/2026 “(…) IX.- CASO CONCRETO EN RELACIÓN CON LA COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS. Del elenco de hechos probados se desprende que la actuación de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias se ha ajustado al marco de competencias que le confiere la Ley N.° 8488. En efecto, dicha Comisión emitió oportunamente el informe técnico CNE-UIAR-INF-1213-2021, mediante el cual advirtió a la Municipalidad de Oreamuno sobre la valoración de riesgo existente en la comunidad de La Fuente, y posteriormente brindó apoyo concreto a la Municipalidad de Paraíso a través de la contratación de maquinaria pesada bajo la modalidad de emergencia no declarada, logrando la limpieza y canalización del cauce en el sector de Calle Arrabará.

Debe tenerse presente que, conforme se explicó en el Considerando VII, la competencia de la Comisión se circunscribe a las situaciones de emergencia declarada o a los denominados primeros impactos, sin que le corresponda asumir la rectoría técnica integral de una problemática hidráulica de carácter estructural y permanente como la que aqueja a las comunidades recurrentes, la cual, según fue acreditado, no se encuentra amparada a ningún decreto de emergencia vigente ni a un Plan General de Emergencia. Por consiguiente, no puede exigirse a esta Comisión una actuación distinta de la ya desplegada, pues ello implicaría una extensión indebida de su ámbito competencial. En razón de lo expuesto, no se acredita omisión alguna atribuible a la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, por lo que, en cuanto a esta autoridad, el recurso resulta improcedente.

X. SOBRE EL CASO CONCRETO EN RELACIÓN CON LA MUNICIPALIDAD DE OREAMUNO

Distinta es la situación de la Municipalidad de Oreamuno. Debe recordarse que fue precisamente esta corporación municipal la destinataria directa de la orden dispuesta mediante la sentencia N.° 2014-020505, en la cual se le instruyó adoptar, de forma inmediata, las medidas necesarias para dar una solución integral y definitiva al problema de inundaciones denunciado, bajo apercibimiento de incurrir en el delito de desobediencia. No obstante haber transcurrido más de una década desde la notificación de dicho fallo, de los hechos probados no se desprende que la Municipalidad de Oreamuno haya ejecutado una solución integral y definitiva, sino que su participación se ha limitado a un compromiso incumplido documentado en el oficio AM-1557-2011, a una prevención aislada dirigida a un propietario particular y a su participación en mesas de coordinación interinstitucional que no derivaron en obras concretas dentro de su jurisdicción cantonal.

A ello se suma que el Presidente del Concejo Municipal de Oreamuno omitió rendir el informe que le fue solicitado por esta Sala, lo cual, conforme al artículo 45 de la Ley de la Jurisdicción Constitucional, obliga a tener por ciertos los hechos denunciados por la parte recurrente en cuanto a esta autoridad. Conforme fue expuesto en el Considerando VIII, corresponde a las municipalidades garantizar servicios eficientes de evacuación de aguas y adecuados sistemas de alcantarillado dentro de su territorio, siendo su responsabilidad en materia de ordenamiento territorial y drenaje cantonal absoluta y exclusiva. La inacción sostenida por más de doce años, pese a existir una orden judicial expresa y estudios técnicos que documentan la problemática, constituye una omisión clara que ha mantenido en zozobra e inseguridad a los habitantes de las comunidades afectadas, exponiéndolos a un riesgo inminente contra su vida, integridad física y patrimonio. En consecuencia, procede declarar con lugar el recurso en cuanto a la Municipalidad de Oreamuno.

XI. SOBRE EL CASO CONCRETO EN RELACIÓN CON LA MUNICIPALIDAD DE PARAÍSO

En cuanto a esta corporación municipal, si bien de los hechos probados se desprende una participación más activa que la de la Municipalidad de Oreamuno, al haber convocado y presidido mesas de trabajo interinstitucional, solicitado dictámenes técnicos sobre cuerpos de agua, gestionado la contratación de maquinaria para la limpieza de cauces y promovido la elaboración de un plan técnico de intervención mediante el oficio MUPA-ALC-CAEN-219-2026, lo cierto es que dicho plan, acreditado apenas el 22 de abril de 2026, se encuentra en una etapa embrionaria de formulación, sin que conste que se hayan iniciado las obras estructurales que la propia Municipalidad reconoce como necesarias, tales como la sustitución de infraestructura crítica y la construcción de cajas sedimentadoras y disipadores de energía. Asimismo, debe valorarse que el Jefe del Departamento de Ingeniería de esa Municipalidad omitió rendir el informe requerido por esta Sala, lo que también conduce a tener por ciertos, en lo que a esta autoridad respecta, los hechos alegados por la parte recurrente conforme al artículo 45 de la Ley de la Jurisdicción Constitucional.

Aunque la Municipalidad de Paraíso ha mostrado una disposición de coordinación superior a la de Oreamuno, la mera existencia de estudios, diagnósticos y mesas técnicas, sin que se traduzcan en acciones concretas y oportunas de solución, no resulta suficiente para tener por satisfecho el deber constitucional que le asiste, en tanto persiste la afectación denunciada por los recurrentes. La responsabilidad de ordenar el territorio bajo su jurisdicción, controlar el uso del suelo y garantizar un sistema de drenaje cantonal adecuado recae de forma exclusiva sobre esta corporación municipal, según fue explicado en el Considerando VIII, sin que la concurrencia de otras instituciones la exima de ejecutar, dentro del ámbito de sus competencias, las obras que resulten necesarias para poner fin a la problemática. Por lo anterior, procede declarar con lugar el recurso también en cuanto a la Municipalidad de Paraíso, sin perjuicio de reconocerse las gestiones ya iniciadas.

XII. SOBRE EL CASO CONCRETO EN RELACIÓN CON EL CONSEJO NACIONAL DE VIALIDAD

Finalmente, en lo que respecta al Consejo Nacional de Vialidad, esta Sala advierte que dicha institución no fue parte del proceso que culminó con la sentencia N.° 2014-020505, ni fue destinataria de las órdenes ahí dispuestas, habiendo sido incorporada a este expediente únicamente en virtud de la ampliación de partes acordada mediante la resolución de las once horas cuarenta y cinco minutos del 19 de mayo de 2026. De los hechos probados se desprende que el CONAVI ha mantenido una participación activa y diligente dentro del estricto marco de sus competencias legales, las cuales, conforme a la Ley N.° 7798, se circunscriben a la Red Vial Nacional. En tal sentido, dicha institución participó en las reuniones interinstitucionales de noviembre y diciembre de 2024, aportó información técnica sobre las estructuras de drenaje de las rutas nacionales involucradas, advirtió oportunamente, mediante el oficio CARTA-CONAVI-DRC-08-2025-1230 de 12 de agosto de 2025, de la necesidad de un estudio hidrológico e hidráulico integral de la microcuenca, y remitió el insumo técnico correspondiente para la atención del presente amparo.

No consta que las afectaciones denunciadas se originen en deficiencias constructivas u omisiones de mantenimiento imputables a la infraestructura vial nacional bajo su administración, sino que, por el contrario, los elementos técnicos disponibles apuntan a que la problemática obedece a una dinámica hidráulica integral de microcuenca, en la que confluyen factores ajenos a la competencia de este Consejo, tales como infraestructura cantonal, propiedades privadas y cauces naturales. En consecuencia, no se acredita omisión alguna atribuible al Consejo Nacional de Vialidad, por lo que, en cuanto a esta autoridad, el recurso también resulta improcedente.

XIII. CONCLUSIÓN

En razón de lo anteriormente la competencia municipal y la obligación de coordinación interinstitucional, resulta claro que la Municipalidad de Oreamuno y la Municipalidad de Paraíso, en su rol de garantes de los intereses y servicios locales, han incumplido con su deber de actuar y coordinar oportunamente entre sí y con las demás instituciones competentes para proteger los derechos fundamentales de los habitantes de las comunidades de La Fuente (La Puente), Arrabará y El Yas de Paraíso de Cartago. Debe recordarse que esta Sala, en la Sentencia N.° 2011-012886 de las 12:44 horas del 23 de setiembre de 2011, ya citada, ha señalado que las municipalidades poseen una autonomía funcional para la administración de los intereses y servicios locales, autonomía que debe ejercerse de forma eficiente y en cooperación con otros entes públicos, especialmente cuando se trata de la protección de derechos como el ambiente, la vida y la seguridad de la comunidad.

De igual forma, este Tribunal ha reiterado que, aunque el ámbito de las funciones municipales es amplio y autónomo, ello no autoriza a las corporaciones locales a vaciar de contenido sus obligaciones en detrimento de los derechos de sus habitantes, particularmente cuando media una orden judicial existe pleno conocimiento técnico de la problemática, como ocurre respecto de la Municipalidad de Paraíso. Asimismo, en concordancia con el artículo 50 de la Constitución Política, la protección del ambiente y de la vida e integridad física de las personas constituye una obligación objetiva del Estado, cuya inobservancia prolongada por parte de las autoridades municipales, ante un riesgo hidráulico documentado desde hace más de una década mediante informes técnicos de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias y de la propia Gerencia de Conservación de Vías y Puentes del Consejo Nacional de Vialidad, constituye una vulneración a los derechos fundamentales invocados por la parte recurrente.

Conforme al artículo 169 de la Constitución Política, la Municipalidad de Oreamuno y la Municipalidad de Paraíso no solo tienen la competencia para actuar sobre los problemas que afectan su circunscripción territorial, sino también la obligación de coordinar entre sí y con las demás instituciones competentes para la atención integral del riesgo identificado. Dicha cooperación no puede quedar librada a la mera convocatoria de mesas técnicas de trabajo sin resultados concretos, sino que exige la ejecución efectiva de las obras y medidas que, dentro del ámbito de cada competencia municipal, resulten necesarias para dar una solución definitiva a la problemática. En contraste, no puede exigirse ese mismo grado de responsabilidad a la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias ni al Consejo Nacional de Vialidad, en tanto ambas instituciones han actuado dentro del estricto marco de sus competencias legales, brindando el apoyo técnico y material que les correspondía, sin que exista sustento fáctico ni jurídico para atribuirles la omisión que aquí se sanciona.

Consecuentemente, procede declarar parcialmente con lugar el presente recurso de amparo, únicamente en cuanto a la Municipalidad de Oreamuno y la Municipalidad de Paraíso, a efecto de que ambas corporaciones municipales, dentro del ámbito de sus respectivas competencias y en coordinación efectiva y continua con las demás instituciones involucradas, la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, el Consejo Nacional de Vialidad, el Ministerio de Ambiente y Energía y el Ministerio de Salud, establezcan e implementen, un plan de acción conjunto que permita ejecutar las obras de infraestructura pluvial y las demás medidas de mitigación necesarias para salvaguardar la vida, la integridad física, la propiedad y el ambiente sano de los habitantes de las comunidades de La Fuente (La Puente), Arrabará y El Yas de Paraíso de Cartago, debiendo declararse sin lugar el recurso en cuanto a la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias y en cuanto al Consejo Nacional de Vialidad, lo anterior de conformidad con lo indicado en la parte dispositiva de esta sentencia.
