Res. 25783-2026 Sala Constitucional · Sala Constitucional · 10/07/2026
OutcomeResultado
The excerpt states that the Chamber reviews whether environmental authorities acted responsibly and promptly, while legality disputes and complex evidence fall outside summary amparo proceedings; it does not provide the case’s operative disposition.
SummaryResumen
The Constitutional Chamber (Sala Constitucional) reiterates that Article 50 of the Constitution entrusts the State, through its administrative agencies, with protecting the environment and overseeing environmental activity. In environmental matters, the Chamber’s role is to verify whether the competent authorities acted responsibly and promptly, not to review their technical criteria. Amparo requires proof of a disturbance or threat to a fundamental right and, given its summary nature, is unsuitable for slow or complex evidence or for first resolving disputes concerning rights below constitutional rank. Those disputes must be resolved within the sphere of legality before the Chamber can rule on a possible violation of fundamental rights. The supplied excerpt states this criterion but does not include the case facts or operative disposition, so it does not establish whether the amparo was granted or denied.

V.- REGARDING CONSTITUTIONAL JURISDICTION IN ENVIRONMENTAL MATTERS. As this Chamber has repeatedly held, constitutional jurisdiction in environmental matters cannot be extended to the point of becoming a reviewer of the technical criteria set out in regulations or expressed by administrative authorities in environmental matters. It is limited to determining whether the competent state agencies have fulfilled the obligation imposed on them by Article 50 of the Political Constitution to act responsibly and promptly to protect the environment. It has also been held that an amparo application may proceed only if a disturbance or threat to one or more rights or guarantees established in the Constitution or in the international human rights instruments signed by the country is shown. This underscores the distinctly summary nature of amparo proceedings, which are not suited to slow and complex evidentiary steps or to first examining, by way of a declaratory determination, whether rights below constitutional rank cited by the parties as part of the factual account in the amparo application or the required report actually exist. That is plainly a matter outside this Chamber’s jurisdiction. In this situation, it is not appropriate for the Chamber to rule either for or against the claim, because any dispute about whether fundamental rights have been violated must first be resolved within the sphere of legality. (…) ARTICLE 50 OF THE POLITICAL CONSTITUTION “(…) IV.— ON THE FUNDAMENTAL RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT. On numerous occasions, this Court has developed the content of this right, set out in Article 50 of the Political Constitution. Protecting the environment is an appropriate means of safeguarding and improving everyone’s quality of life, making it necessary for the Public Powers to intervene in relation to factors that may alter its balance and hinder a person’s development and well-being in a healthy environment. The State is the guarantor of the protection and safeguarding of the environment and natural resources. Accordingly, oversight and monitoring of environmental matters and activities constitute an essential function of the State. Thus, in matters of environmental protection, the State, through its various administrative agencies, is responsible for leadership, oversight, and monitoring of environmental matters.
As this Chamber has repeatedly held in its case law, constitutional jurisdiction in environmental matters cannot be extended to the point of making it a verifier of the technical criteria set out in environmental rules or applied by administrative authorities. Rather, it is limited to determining whether the competent state agencies have fulfilled the obligation imposed on them by Article 50 of the Political Constitution to act responsibly and in a timely manner to protect the environment. It has also been held that an amparo application may proceed only if the existence of a disturbance or threat to one or more of the rights or guarantees set out in the Political Charter or in the international human rights instruments signed by the country is established. This latter circumstance highlights the distinctly summary nature of the amparo proceeding, which is not suited to slow and complex evidentiary proceedings, or to the need first to examine, by way of a declaratory determination, whether rights below constitutional rank that the parties cite as part of the factual account in the amparo application or the statutory report, as the case may be, actually exist.
It is evident that this Chamber lacks jurisdiction to do so. In these circumstances, it is not appropriate for the Chamber to issue any ruling (whether positive or negative) in these cases, because, to determine whether fundamental rights have been infringed, that dispute must first be resolved at the level of legality.
(…)” VCG08/2026
