THE MINISTRY OF HEALTH IS ALLEGED TO HAVE FAILED TO TIMELY ADDRESS COMPLAINTS OF ENVIRONMENTAL CONTAMINATION CAUSED BY A CARPENTRY AND FURNITURE WORKSHOP THAT GENERATES EMISSIONS OF SAWDUST (aserrín), CHEMICAL ODORS, AND EXCESSIVE NOISE, ADVERSELY AFFECTING HEALTH AND THE RIGHT TO A HEALTHY ENVIRONMENT. THE STATE IS FOUND TO HAVE A DUTY TO ACT DILIGENTLY AND PROMPTLY IN ADDRESSING ENVIRONMENTAL COMPLAINTS IN ORDER TO PROTECT THE RIGHTS TO HEALTH, LIFE, AND A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT. From the reports submitted by the representatives of the respondent authorities (autoridades recurridas)—which are deemed to have been given under oath, with the consequences, including criminal consequences, set forth in article 44 of the Law governing this Jurisdiction—and from the evidence submitted for resolution of the matter, it has been duly established that the petitioner filed two formal complaints with the Regional Health Authority (Área Rectora de Salud) of Abangares, on January 20 and May 14, 2026, in which she reported on the health effects suffered by herself and her family as a result of the operation of an adjacent carpentry and furniture workshop, which continuously generates emissions of sawdust, chemical odors, and excessive industrial noise.
Notwithstanding the foregoing, as of the date of resolution of this petition, the respondent authority has not provided an effective response to those complaints. While the Área Rectora de Salud of Abangares claims to have handled five confidential complaints against the establishments [Nombre 002] and [Nombre 003], and to have served sanitary orders (órdenes sanitarias) on both establishments, the fact remains that follow-up on those orders is still pending. Likewise, noise measurements have not been carried out, on the grounds that the equipment required for that purpose needs calibration—a process that was only requested from LACOMET on June 5, 2026, that is, after the filing of this amparo petition (recurso de amparo).
The justification offered by the respondent authority regarding its inability to link the petitioner's complaints to those processed in administrative proceedings (sede administrativa), due to the confidential nature of those proceedings and the absence of an exact address in the filing, is not constitutionally acceptable. It should be noted that the case file contains all the necessary evidence, on the basis of which the respondent authority was fully capable of preparing the report requested by this Constitutional Tribunal.
In this regard, as this Tribunal has held in judgment No. 2008-18443, the State has an objective obligation to act diligently in protecting the rights to life and physical integrity of its inhabitants, which includes addressing in a timely and effective manner any environmental complaints that may compromise the health of individuals. The intervention of constitutional jurisdiction is precisely warranted where the State's proven inaction fails to attend to the demands made by residents of the country in the exercise of their rights.
In the present case, the situation reported directly and continuously affects the right of the petitioner and her family to a healthy and ecologically balanced environment, protected by article 50 of the Constitución Política, as well as their rights to health and to life. For the foregoing reasons, the appropriate course of action is to grant the present amparo proceeding, as set forth in the operative section (parte dispositiva) of this judgment. (…)"

SE ALEGA LA OMISIÓN DEL MINISTERIO DE SALUD DE ATENDER OPORTUNAMENTE DENUNCIAS POR CONTAMINACIÓN AMBIENTAL PROVOCADA POR UN TALLER DE CARPINTERÍA Y MUEBLERÍA, QUE GENERA EMISIONES DE ASERRÍN, OLORES QUÍMICOS Y RUIDO EXCESIVO, CON AFECTACIÓN A LA SALUD Y AL AMBIENTE SANO. SE CONSIDERA QUE EL ESTADO TIENE EL DEBER DE ACTUAR DE MANERA DILIGENTE Y OPORTUNA EN LA ATENCIÓN DE DENUNCIAS AMBIENTALES PARA PROTEGER LOS DERECHOS A LA SALUD, A LA VIDA Y A UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO.
