The Chamber denied the amparo as premature because less than a week had passed since the wastewater complaint was filed; it indicated that the authority should protect the physical safety of the applicant and nearby residents and respond without undue delay if it had not already done so.La Sala declaró sin lugar por prematuro el amparo sobre una denuncia por vertido de aguas residuales, pues había transcurrido menos de una semana desde su presentación; indicó que la autoridad debía proteger la integridad física de la recurrente y vecinos y responder sin dilaciones indebidas si aún no lo había hecho.

SummaryResumen

The Constitutional Chamber (Sala Constitucional) considered an amparo proceeding concerning the alleged routing of wastewater through ditches along the national road network toward a property in Puriscal and the Pital stream, and the alleged failure to address a complaint to the Ministry of Health promptly. It found that the complaint was filed on 18 March 2026 and the amparo application on 24 March, less than a week later; that period was not unreasonable or disproportionate so as to warrant the Chamber’s intervention. The Administration also reported that it had already conducted an inspection and issued technical recommendations. The Chamber therefore denied the amparo as premature, finding no constitutional injury requiring intervention at that time. It nevertheless directed the respondent authority to take the necessary steps to protect the physical safety of the applicant and nearby residents and, if it had not already done so, to provide the applicant with a clear and express final response to the complaint without undue delay.

Accordingly, it is established that the amparo applicant submitted the complaint to the Ministry of Health on 18 March 2026 and filed the amparo on the following 24 March—that is, less than a week later. Such a period is not long enough to support prima facie the conclusion that, when the applicant filed the claim, an unreasonable and disproportionate delay had occurred that warranted the Chamber’s intervention. Consequently, as the application was framed, no constitutional injury warranting the Chamber’s intervention at this time is found; the amparo is therefore denied as premature. Without prejudice to the foregoing, the respondent authority shall take note and carry out the necessary actions to ensure the physical safety of the applicant and the area’s residents and, if it has not already done so, shall clearly and expressly communicate a final response to the applicant concerning her complaint, without undue delay.

023547-26. ENVIRONMENT. EXECUTIVE BRANCH. THE FAILURE TO ADDRESS IN A TIMELY MANNER A COMPLAINT REGARDING THE DISCHARGE OF WASTEWATER INTO THE DITCHES OF THE NATIONAL ROAD NETWORK TOWARD A PROPERTY IN PURISCAL IS CHALLENGED. THE COURT CONSIDERS THAT THE AMPARO APPLICATION WAS FILED PREMATURELY, BECAUSE AN UNREASONABLE PERIOD HAD NOT ELAPSED SINCE THE COMPLAINT WAS FILED AND THE ADMINISTRATION HAD INITIATED THE CORRESPONDING ACTIONS. THE AMPARO APPLICATION IS DENIED. VCG07/2026 “(… )IV.- The specific case. In this case, the claimant alleges that they own real property located in San José, Puriscal, Mercedes Sur, Cerbatana, 350 meters southwest of the public school. They assert that, for several years, sewage and wastewater have been improperly diverted and conveyed through the ditches (cunetas) of the national road network toward the property, from where they continue flowing to the channel of quebrada Pital, causing direct and ongoing contamination of that watercourse.

They allege that these ditches, which are administered by Conavi, are being improperly used to convey wastewater and diverted toward the property, contrary to their exclusive purpose of managing stormwater, and without any authorization for such use. They state that they filed a formal complaint with the Ministerio de Salud; however, as of the date of this decision, no inspection has been carried out and no effective response has been provided. They request the Court’s intervention.

In this regard, it follows from the proven facts that on 18 March 2026, the claimant filed a complaint with the Ministerio de Salud, which was processed under reference number 287-2026, concerning the “Discharge of wastewater and stormwater diverted and conveyed through ditches of the national road network toward the property of the Castro Montoya family and [Nombre 002], ditches under the responsibility of CONAVI; the conveyance of this water causes environmental contamination manifested by the presence of wastewater and stormwater, the carrying of solid waste, soil erosion, and offensive odors.” It should also be noted that the claimant filed the amparo application on 24 March 2026.

Accordingly, it is established that the amparo applicant submitted the complaint to the Ministerio de Salud on 18 March 2026 and filed the amparo application on the following 24 March, that is, less than a week later. Such a period is not long enough to support, prima facie, the conclusion that, when the petitioner lodged the claim, an unreasonable and disproportionate delay had occurred that would warrant the Court’s intervention.

In any event, it follows from the report submitted under oath that the inspection and technical report have already been completed, and a series of recommendations were issued, as appears from document MS-DRRSCS-ARS-PT-2005-01-2026.

Consequently, on the terms in which the application was brought, no violation of constitutional stature warranting the Court’s intervention at this time has been established; therefore, the amparo application is dismissed as premature. Without prejudice to the foregoing, the respondent authority must take note and carry out the necessary actions to ensure the physical safety of the claimant and the residents of the area and, if it has not already done so, must provide the claimant with a clear and express final response regarding their complaint, without undue delay. 023547-26. AMBIENTE. PODER EJECUTIVO. SE CUESTIONA LA FALTA DE ATENCIÓN OPORTUNA DE UNA DENUNCIA POR EL VERTIDO DE AGUAS RESIDUALES EN LAS CUNETAS DE LA RED VIAL NACIONAL HACIA UNA PROPIEDAD EN PURISCAL. SE CONSIDERA QUE EL RECURSO FUE INTERPUESTO PREMATURAMENTE, AL NO HABER TRANSCURRIDO UN PLAZO IRRAZONABLE, DESDE LA PRESENTACIÓN DE LA DENUNCIA Y HABER INICIADO LA ADMINISTRACIÓN LAS ACTUACIONES CORRESPONDIENTES. SE DECLARA SIN LUGAR EL RECURSO. VCG07/2026 “(…
