SummaryResumen
In a separate note, Justice Garro Vargas explains that although she has referred technically complex matters to the ordinary route in other cases, she considers a ruling on the merits appropriate here because she found a clear breach of the principle of administrative coordination that impaired wetland protection and violated the fundamental right under Article 50 of the Constitution. The supplied excerpt does not include the judgment’s operative disposition, so it does not establish the majority’s result.

Nevertheless, this particular case warrants my ruling on the merits because a clear breach of the principle of administrative coordination has been found, to the detriment of the protection of the wetlands at issue in this proceeding, resulting in a violation of the fundamental right protected by Article 50 of the Political Constitution.

I must point out that, although I have issued decisions in which—because of the technical and evidentiary complexity involved in analyzing an amparo application—I have dissented and referred the matter to the ordinary courts (see, for example, judgments numbered 2023-011233 and 2025-024842), the specific case warrants my ruling on the merits because a clear violation of the principle of administrative coordination has been established, to the detriment of the protection of the wetlands at issue in this proceeding. This, in turn, infringes the fundamental right protected by Article 50 of the Political Constitution.
