022326-26. MUNICIPALITY. ENVIRONMENT. THE DECLARATION OF A PUBLIC ROAD THAT COULD AFFECT A SPRING AND ITS PROTECTION ZONE IN THE CANTON OF PÉREZ ZELEDÓN IS CHALLENGED. IT IS HELD THAT THE MUNICIPALITY FAILED TO APPLY THE PRECAUTIONARY AND PREVENTIVE PRINCIPLES WHEN SEEKING TO INTERVENE IN AN ENVIRONMENTALLY SENSITIVE AREA WITHOUT HAVING TECHNICAL CERTAINTY ABOUT ITS EFFECTS. PARTIALLY GRANTED; IMMEDIATE SUSPENSION OF THE ROAD INTERVENTION IS ORDERED UNTIL THE NECESSARY ENVIRONMENTAL STUDIES ARE CARRIED OUT; AND THE ALLEGED VIOLATION OF THE RIGHT OF ACCESS TO INFORMATION IS DISMISSED BECAUSE THE REQUEST HAD ALREADY BEEN ADDRESSED. VCG07/2026 "(…) IV.- On the specific case. To resolve the specific case, it is useful to recall what this Constitutional Court established regarding the constitutional principles in environmental matters, in judgment no. 2021-024807 of 09:20 hours on November 5, 2021:

"In this regard, specialized legal doctrine has noted that the preventive principle (principio preventivo) requires that, when there is certainty of possible harm to the environment, the harmful activity must be prohibited, restricted, or made conditional on compliance with certain requirements. In general, this principle applies when risks are clearly defined and identified as at least probable; likewise, this principle is useful when there are no technical reports or administrative permits guaranteeing the sustainability of an activity, but there are sufficient elements to foresee potential negative impacts. On the other hand, the precautionary principle (principio precautorio) states that, when there is a risk of serious and irreversible harm, the lack of absolute scientific certainty must not be used as a reason to delay the adoption of cost-effective measures to prevent environmental degradation.

From the foregoing, it is evident that this principle is grounded in reasonable scientific uncertainty coupled with the threat of serious and irreversible environmental harm. In general terms, a key difference between the preventive principle and the precautionary principle lies in the level of knowledge and certainty regarding the risks posed by an activity or project. Whereas in the former there is such certainty, in the latter what is present is a state of doubt arising from scientific information or technical studies." In light of the foregoing, the precautionary principle establishes that the lack of absolute scientific certainty must not be used to delay the adoption of appropriate measures; rather, it demands that preventive measures be adopted to prevent environmental degradation, even when the risk of serious or irreversible harm has not been fully established. That is to say, there must be some type of threat—one that plausibly involves a serious danger—and, furthermore, the measure must make efficient and effective use of the resources employed.

Thus, when confronted with a situation that requires the application of the precautionary principle, public entities and bodies must refrain from authorizing, approving, or permitting any new or modification request that reasonably entails a serious risk; moreover, they are obligated to suspend any activities already underway. At the same time, they must efficiently and effectively adopt all measures required for the preservation of a healthy and ecologically balanced environment (see in this regard judgment no. 2025-017901 of 09:20 hours on June 13, 2025).

Having clarified the foregoing, the evidentiary record leads to the conclusion that the authorities of the Municipalidad de Pérez Zeledón are fully aware that the challenged public road partially encompasses the protection zone (área de protección) of a spring (naciente). In this regard, through official communication no. OFI-0132-26-PTE dated April 24, 2026, Luis Alonso Granados Montero, acting in his capacity as surveying engineer for Territorial Planning at the Municipalidad de Pérez Zeledón, stated:

"It is clarified that the inclusion of this road in the cantonal road inventory (inventario vial cantonal) does not stem from a request to open new public thoroughfares, but rather from the recognition of a pre-existing road, which has existed since at least 1973, as reflected in the Map of Cadastral Zone No. 090, Proyecto San Isidro (…) [A]lthough the spring exists and its protection zone partially overlaps with the road corridor, it must be noted that, as was extensively explained in the preceding point, this road has been publicly recorded and recognized since at least 1973—that is, many years before the spring was officially declared as such, which did not occur until 2021. Consequently, at the time the road was established and the cartographic and documentary records evidencing its status as a public thoroughfare were created, there was no official registry or declaration identifying the presence of said spring; therefore, the road's alignment was established prior to that environmental designation." As is evident, the municipality attempts to justify its reasons for wishing to proceed with the project related to the opening of the road in question, arguing that at the time the road was established, there was no official registry or declaration of the spring.

However, the respondent municipality is bound to fulfill its constitutional and legal responsibilities regarding the protection of water resource areas (zonas hídricas) and environmental protection zones, in particular, the provisions of Article 33 of the Ley Forestal:

"ARTICLE 33.- Protection zones. The following are declared to be protection zones:

  • a)Areas surrounding permanent springs, defined within a radius of one hundred meters measured horizontally.
  • b)A strip of fifteen meters in rural areas and ten meters in urban areas, measured horizontally on both banks of rivers, streams (quebradas), or creeks (arroyos), when the terrain is flat, and fifty horizontal meters when the terrain is rugged.
  • c)A zone of fifty meters measured horizontally along the banks of natural lakes and reservoirs (embalses) and along artificial lakes or reservoirs built by the State and its institutions. Private artificial lakes and reservoirs are excluded.
  • d)Recharge areas and aquifers (acuíferos) of springs (manantiales), whose boundaries shall be determined by the competent bodies established in the regulations of this law." From this standpoint, the position taken by the authorities of the Municipalidad de Pérez Zeledón constitutes a violation of Article 50 of the Constitución Política, which imposes on the State—and on all its institutions—the duty not only to refrain from harming the environment, but also to actively protect it, restore it, and prevent its deterioration. The right to a healthy environment, as the Sala Constitucional has noted, is not merely a programmatic clause; rather, it carries full normative force, is directly and immediately enforceable through the amparo action (recurso de amparo), and its observance imposes positive obligations on authorities, who must act in a timely, preventive, and effective manner. It should be noted that, although the evidence submitted has not yet revealed any direct harm to the spring, it has been duly established that construction of the road will affect the protection zone. Note that in official communication no. DA-UHTPSOZ-0590-2026 dated June 1, 2026, staff of the Dirección de Agua concluded:

"During the site inspection, this road was found not to be located over the watercourse (cauce) of any public-domain body of water; however, according to the National Registry of Concessions, Opinions, and Works in Watercourses of the Dirección de Agua of MINAE, an unnamed public-domain intermittent spring, classified as such by official communication DA-UHTPSOZ-0730-2021, is located approximately 4 meters from the road. Ostensibly, no harm to this unnamed spring itself is apparent, but the road is encroaching upon the protection zone of that body of water, in accordance with Art. 149 of the Ley de Aguas N°276, and the opinion of the Procuraduría General de la República C-318-2017 dated December 19, 2017 (Fig. 1 and 3)" (emphasis not in the original).

In light of the foregoing, the respondent municipality must be advised that the argument that the road in question was established prior to the official declaration of the spring is without merit, since the spring, by express statutory provision, enjoys legal protection against any intervention within it—whether by filling, construction, deforestation, earthworks (movimientos de tierra), or installation of tourist or recreational infrastructure—and therefore requires specific permits and the corresponding environmental technical opinion. Therefore, in accordance with the precautionary principle, the preventive principle, and the principle of environmental non-regression (no regresión ambiental), a resolute, effective, and coordinated course of action is required from the competent authorities, and any failure to act constitutes a violation of the right to a healthy and ecologically balanced environment.

In these circumstances, it is concluded that the authorities of the respondent municipality have failed to act in the face of a concrete environmental harm. Accordingly, this ground of the appeal must be granted, with the consequences set forth in the operative part (parte dispositiva) of this judgment.

V.Finally, it is confirmed that on March 11, 2026, the appellant filed a request for information, in the terms transcribed in established fact (hecho probado) b.

Regarding the request filed by the appellant, the list of established facts (elenco de hechos probados) shows that through official communication no. OFI-0112-26-PTE dated April 7, 2026, the request—transcribed in established fact d—was duly addressed, and this was properly communicated and sent to the appellant via the email address through which the request was made—see evidence in the electronic case file.

In these circumstances, the Sala observes that, prior to service of notice of this appeal—which took place on April 22, 2026—the respondent authority replied to and formally notified the petitioner (amparado) of the response to the request at issue. Accordingly, no violation of the petitioner's fundamental rights is found.

Consequently, this ground of the appeal must be dismissed, and it is so ordered. (…)"

022326-26. MUNICIPALIDAD. AMBIENTE. SE IMPUGNA LA DECLARATORIA DE UN CAMINO PÚBLICO QUE PODRÍA AFECTAR UNA NACIENTE Y SU ÁREA DE PROTECCIÓN EN EL CANTÓN DE PÉREZ ZELEDÓN. SE CONSIDERA QUE LA MUNICIPALIDAD OMITIÓ APLICAR LOS PRINCIPIOS PRECAUTORIO Y PREVENTIVO AL PRETENDER INTERVENIR UNA ZONA AMBIENTALMENTE SENSIBLE SIN CONTAR CON CERTEZA TÉCNICA SOBRE SUS EFECTOS. SE DECLARA PARCIALMENTE CON LUGAR, SE ORDENA SUSPENDER DE FORMA INMEDIATA LA INTERVENCIÓN DEL CAMINO HASTA QUE SE REALICEN LOS ESTUDIOS AMBIENTALES NECESARIOS Y SE DESCARTA LA LESIÓN AL DERECHO DE ACCESO A LA INFORMACIÓN POR HABERSE ATENDIDO LA SOLICITUD PLANTEADA. VCG07/2026 “(…) IV.- Sobre el caso concreto. Para la resolución del caso concreto conviene traer a colación lo dispuesto por este Tribunal Constitucional respecto a los principios constitucionales en materia ambiental, en la sentencia nro. 2021-024807 de las 09:20 horas del 5 de noviembre de 2021:

“En este orden de ideas, la doctrina especializada ha señalado que el principio preventivo demanda que, cuando haya certeza de posibles daños al ambiente, la actividad afectante deba ser prohibida, limitada, o condicionada al cumplimiento de ciertos requerimientos. En general, este principio aplica cuando existen riesgos claramente definidos e identificados al menos como probables; asimismo, tal principio resulta útil cuando no existen informes técnicos o permisos administrativos que garanticen la sostenibilidad de una actividad, pero hay elementos suficientes para prever eventuales impactos negativos. Por otra parte, el principio precautorio señala que, cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente.

De lo anterior, se advierte que el principio parte de una incertidumbre científica razonable en conjunto con la amenaza de un daño ambiental grave e irreversible. En términos generales, una diferencia relevante entre el principio preventivo y el precautorio radica en el nivel de conocimiento y certeza de los riesgos que una actividad u obra provoque. Mientras que en el primero existe tal certeza, en el segundo lo que se advierte es un estado de duda resultado de informaciones científicas o estudios técnicos”.

En virtud de lo expuesto, el principio precautorio establece que la falta de certeza científica absoluta no deberá utilizarse para postergar la adopción de medidas correspondientes, sino más bien exige la adopción de medidas preventivas para impedir la degradación del medio ambiente, aunque el peligro de un daño grave o irreversible no esté del todo asegurado. Es decir, debe de estar de por medio cualquier tipo de amenaza -plausiblemente debe involucrar un peligro serio- y, por otro, que la medida demanda un uso eficaz y eficiente de los recursos empleados. Así, cuando se está ante una situación que exige la aplicación del principio precautorio, los entes y órganos públicos deben abstenerse de autorizar, aprobar o permitir toda solicitud nueva o de modificación que razonablemente conlleve un riesgo grave; incluso, se encuentran obligados a suspender las actividades que se estén desarrollando. Paralelamente tienen que adoptar con eficiencia y efectividad todas las medidas requeridas para la preservación de un ambiente sano y ecológicamente equilibrado (ver en ese sentido la sentencia nro. 2025-017901 de las 09:20 horas del 13 de junio de 2025).

Una vez aclarado lo anterior, de los elementos probatorios que constan en los autos se concluye que las autoridades de la Municipalidad de Pérez Zeledón tienen pleno conocimiento que el camino público cuestionado abarca parcialmente el área de protección de una naciente. En ese sentido, por medio del oficio nro. OFI-0132-26-PTE del 24 de abril de 2026, Luis Alonso Granados Montero, en su condición de ingeniero topógrafo de Planificación Territorial de la Municipalidad de Pérez Zeledón consignó:

“Se aclara que la incorporación de este camino dentro del inventario vial cantonal no obedece a una solicitud de apertura de nuevas vías públicas, sino al reconocimiento de un camino preexistente, el cual ha existido al menos desde el año 1973, según se refleja en el Mapa de la Zona Catastral N.° 090, Proyecto San Isidro (…) [S]i bien la naciente existe y su área de protección abarca parcialmente el área correspondiente al camino, debe señalarse que, conforme se esta vía constan al menos desde el año 1973, es decir, muchos años antes de la declaratoria de la naciente, la cual se produjo hasta el año 2021. En consecuencia, al momento en que se consolidó el camino y se generaron los antecedentes cartográficos y documentales que acreditan su condición de vía pública, no existía un registro ni declaratoria oficial que identificara la presencia de dicha naciente, por lo que el trazado del camino se configuró con anterioridad a dicha condición ambiental”.

Como se observa, intenta justificar los motivos por los cuales desean continuar con el proyecto relacionado con la apertura del camino en cuestión, bajo los argumentos de que para la fecha en que se consolidó dicho camino no existía ningún registro o declaración de la naciente. Sin embargo, corresponde al municipio accionado el cumplimiento de sus competencias constitucionales y legales en materia de protección de zonas hídricas y área de protección ambiental, en particular, lo dispuesto en el artículo 33 de la Ley de Forestal:

“ARTICULO 33.- Áreas de protección Se declaran áreas de protección las siguientes:

  • a)Las áreas que bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal.
  • b)Una franja de quince metros en zona rural y de diez metros en zona urbana, medidas horizontalmente a ambos lados, en las riberas de los ríos, quebradas o arroyos, si el terreno es plano, y de cincuenta metros horizontales, si el terreno es quebrado.
  • c)Una zona de cincuenta metros medida horizontalmente en las riberas de los lagos y embalses naturales y en los lagos o embalses artificiales construidos por el Estado y sus instituciones. Se exceptúan los lagos y embalses artificiales privados.
  • d)Las áreas de recarga y los acuíferos de los manantiales, cuyos límites serán determinados por los órganos competentes establecidos en el reglamento de esta ley”.

Desde este plano, la posición de las autoridades de la Municipalidad de Pérez Zeledón configura una violación del artículo 50 de la Constitución Política que impone al Estado —y a todas sus instituciones— el deber no solo de no dañar el ambiente, sino de protegerlo activamente, restaurarlo y prevenir su deterioro. El derecho al ambiente sano, tal como lo ha señalado la Sala Constitucional no es simplemente una cláusula programática, sino que tiene fuerza normativa plena, goza de protección directa e inmediata mediante el recurso de amparo y su respeto impone obligaciones positivas a las autoridades, las cuales deben actuar de manera oportuna, preventiva y eficaz. Conviene señalar que aún cuando en los elementos aportados no se encontró a la fecha una afectación directa a la naciente, lo cierto del caso es que ha sido debidamente acreditado que con la construcción del camino se verá afectada la zona de protección. Nótese el oficio nro. DA-UHTPSOZ-0590-2026 del 1 de junio de 2026, el personal de la Dirección de Agua concluyó:

“Durante el recorrido, este camino no se ubica sobre el cauce de algún cuerpo de agua del dominio público, sin embargo, de acuerdo con el Registro Nacional de Concesiones, Dictámenes y Obras en Cauce de la Dirección de Agua del MINAE, a 4 metros aproximadamente del camino, se ubica una naciente sin nombre del dominio público y de carácter intermitente dictaminada así mediante oficio DA-UHTPSOZ-0730-2021. En apariencia, no se evidencia daño propiamente sobre esta naciente sin nombre, pero este camino está invadiendo el área de protección de dicho cuerpo de agua según lo establecido en el Art. 149 de la Ley de Aguas N°276, pronunciamiento de la Procuraduría General de la República C-318-2017 de fecha 19 de diciembre de 2017 (Fig. 1 y 3)” (el destacado no pertenece al original).

En virtud de lo expuesto, se le debe advertir al municipio accionado que el argumento de que el camino en cuestión se consolidó previo a la declaratoria de la naciente no resulta de recibo, toda vez que la naciente por disposición normativa expresa goza de protección jurídica ante cualquier intervención dentro de ella —sea por relleno, construcción, deforestación, movimiento de tierra, instalación de infraestructura turística o recreativa—, motivo por el cual requiere de permisos específicos y del dictamen técnico ambiental correspondiente. De ahí que, conforme al principio precautorio, de prevención y al de no regresión ambiental, impone una actuación decidida, eficaz y articulada por parte de las autoridades competentes y su omisión constituye una violación al derecho a un ambiente sano y ecológicamente equilibrado.

Así las cosas, se concluye que por parte de las autoridades del municipio accionado ha existido una omisión frente a una afectación ambiental concreta. En consecuencia, se impone declarar con lugar el recurso este extremo del recurso, con las consecuencias que se especifican en la parte dispositiva de esta sentencia.

V.Finalmente, se verifica que efectivamente el 11 de marzo de 2026 el recurrente realizó una solicitud de información, en los términos transcritos en el hecho probado b.

En atención a la solicitud formulada por el recurrente del elenco de hechos probados consta que por medio del oficio nro. OFI-0112-26-PTE del 7 de abril de 2026 se le procedió atender la gestión -transcrita en el hecho probado d-, lo cual le fue debidamente comunicado y remitido a través del correo electrónico en el que hizo la solicitud -ver pruebas aportadas al expediente electrónico-.

Así las cosas, la Sala observa que, previo a la notificación de este recurso -realizada el 22 de abril de 2026-, la autoridad recurrida le contestó y notificó formalmente al amparado la respuesta respectiva a la gestión reclamada. De ahí que se descarta la lesión a sus derechos fundamentales.

En consecuencia, lo procedente es desestimar este extremo del recurso, como en efecto se ordena. (…)”
