SummaryResumen

The Constitutional Chamber (Sala Constitucional) granted the amparo application concerning a reported sewage leak near Plaza Higuerones in San Rafael Abajo de Desamparados, which allegedly caused foul odors, insects, and health effects among residents. Although ICAA and the Municipality of Desamparados had conducted inspections and interventions, they disagreed on whether the overflow came from the municipal stormwater network or the sanitary sewer system, and the case file did not show a definitive solution. The Chamber did not replace the institutions’ technical judgment or determine the source of the overflow itself. It found that the lack of effective coordination, despite a possible threat to public health and the environment, violated the fundamental rights invoked. It ordered both institutions to coordinate a joint technical inspection within one month, identify the source of the overflow and the infrastructure involved, and take the appropriate measures.

Key excerptExtracto clave

The duty to protect health and the environment requires the respondent entities to coordinate effectively, conduct any necessary joint inspections, and determine, on a technical basis, the source of the overflow and the authority responsible for carrying out corrective measures. The absence of a definitive solution, in a situation brought to both institutions’ attention and involving potentially unhealthy conditions, constitutes a violation of the fundamental rights invoked. Accordingly, the application should be granted, ordering ICAA and the Municipality of Desamparados, in a coordinated manner and within their respective areas of responsibility, to conduct a joint technical inspection at the reported site, precisely determine the source of the overflow and the nature of the infrastructure involved, and take the appropriate measures to address the situation so that the community does not continue to bear the burden arising from the lack of interagency resolution.

024753-26. ALLEGES THAT THERE IS A SEWAGE LEAK IN THE VICINITY OF PLAZA HIGUERONES, IN SAN RAFAEL ABAJO DE DESAMPARADOS, CAUSING FOUL ODORS AND INSECTS AND AFFECTING THE HEALTH OF RESIDENTS. GRANTED, ORDERING THE MUNICIPALITY OF DESAMPARADOS AND ICAA TO COORDINATE AS NECESSARY AND ISSUE INSTRUCTIONS SO THAT, WITHIN ONE MONTH, A JOINT TECHNICAL INSPECTION IS CONDUCTED IN THE VICINITY OF PLAZA HIGUERONES TO DETERMINE, WITH TECHNICAL PRECISION, THE SOURCE OF THE REPORTED OVERFLOW AND THE NATURE OF THE INFRASTRUCTURE INVOLVED. RGS07-2026 Granted The petitioner alleges that there is a sewage leak in the vicinity of Plaza Higuerones, in San Rafael Abajo de Desamparados, causing foul odors, insect proliferation, and harm to the health of residents. Despite multiple complaints, ICAA and the Municipality of Desamparados have taken no effective measures to resolve the problem, each attributing responsibility for the matter to the other.

“(…) the respondent authorities have taken action related to the reported situation; however, the record also shows that they maintain opposing positions regarding the source of the overflow and the infrastructure to which it pertains. ICAA maintains that the problem originates in a stormwater well, which the municipality is responsible for addressing, while the municipality asserts, based on its intervention on 13 March 2026, that the problem does not originate in the municipal stormwater network, but in infrastructure associated with the sanitary sewer system. That technical discrepancy has not been resolved in the case file.

Furthermore, the reports submitted do not show that, as of today, the reported problem has been definitively resolved. On the contrary, the record shows that both institutions have conducted inspections or interventions and have attributed the source of the overflow to infrastructure that, according to each institution, is not under its administration. Consequently, there remains no conclusive institutional determination of the source of the problem or of the specific measures needed to address it.

This Chamber does not disregard that each institution must act within the framework of its legal and technical powers. Nor is it for this jurisdiction to replace the specialized judgment of the competent authorities and itself determine whether the well belongs to the stormwater network or the sanitary sewer system. Nevertheless, from a constitutional perspective, it is unacceptable for a situation reported months ago, known to the authorities involved at least since October 2025 and linked to possible harm to public health, to remain without an effective solution because of conflicting institutional positions.

The duty to protect health and the environment requires the respondent entities to coordinate effectively, conduct any necessary joint verifications, and determine, on a technical basis, the source of the overflow and the authority responsible for carrying out corrective measures. The absence of a definitive solution to a situation brought to the attention of both institutions and involving potentially unsanitary conditions constitutes a violation of the fundamental rights invoked.

Accordingly, the appropriate course is to grant the amparo application and order ICAA and the Municipality of Desamparados, in coordination and within the scope of their respective powers, to conduct a joint technical inspection at the reported site, determine precisely the source of the overflow and the nature of the infrastructure involved, and adopt the appropriate measures to address the situation, so that the community does not continue to bear the burden arising from the lack of interinstitutional determination. 024753-26.
