THE MINISTERIO DE SALUD'S FAILURE TO PROVIDE TIMELY ATTENTION IN RESPONSE TO A COMPLAINT ABOUT WASTEWATER SEEPAGE (FILTRACIONES DE AGUAS RESIDUALES) AND FOUL ODORS IN A RESIDENCE LOCATED IN COYOL DE ALAJUELA IS CHALLENGED, THE SANITARY INSPECTION HAVING BEEN SCHEDULED FOR FOUR MONTHS LATER DESPITE THE RISK OF CONTAMINATION AND PROLIFERATION OF DISEASE VECTORS (VECTORES). THE WRIT IS GRANTED ON THE GROUNDS THAT THE TIME PERIOD SET BY THE ADMINISTRATION IS UNREASONABLE, AND THE ADMINISTRATION IS ORDERED TO COMPLETE THE TECHNICAL INVESTIGATION AND ISSUE THE CORRESPONDING SANITARY MEASURES (MEDIDAS SANITARIAS) WITHIN ONE MONTH. The State is obligated to organize its offices in such a way that sanitary-risk inspections are addressed within a reasonable and prioritized timeframe.
V.On the Interruption of Administrative Delay (mora administrativa) Through Judicial Proceedings: The Environmental Officer (Gestora Ambiental) of the respondent authority argues that the institution has not been inactive, given that they proceeded to carry out the inspection on 13 April 2026. However, it is evident to this Court that such action was not the result of the Administration's ordinary planning, but was rather carried out reactively and hastily following notification of the present writ of amparo (recurso de amparo). Although it is highly useful that the authority is moving forward with chemical tracer tests (pruebas de trazadores químicos), the forced advancement of the inspection does not erase the constitutional injury suffered by the petitioner, who was compelled to resort to judicial proceedings in order to receive attention that should have been provided promptly from the outset.
VI.Conclusion: A violation of the petitioner's rights to prompt resolution (pronta resolución) and health is established, given that an unreasonable four-month period was set to address a complaint of residential water contamination. Given that the technical investigation is currently ongoing and the source of the seepage is still pending definitive confirmation through dye-reading results (lecturas de coloración), the writ must be granted for the sole purpose of ensuring that the Ministerio de Salud completes the studies expeditiously and issues the definitive corrective measures (medidas correctoras).
