Al respecto, la Sala tiene por demostrado que en efecto la recurrente ha presentado sendas denuncias a las cuales la municipalidad ha dado respuestas desde 2022, incluyendo explicación técnica de la problemática, justificación de la saturación del sistema y detalle de las obras posibles. 016960-26. MUNICIPALITY. THE APPELLANT ALLEGES THAT THE MUNICIPALITY OF MONTES DE OCA HAS NOT RESOLVED THE CONSTANT FLOODING ON CALLE SEGURA CAUSED BY THE SATURATION OF THE STORMWATER SYSTEM AND THE CLOSING OF SEWERS, AFFECTING HER HOME AND THE WELL-BEING OF AN ELDERLY ADULT WITH A DISABILITY. THE APPEAL IS GRANTED AS IT IS PROVEN THAT, DESPITE THE TECHNICAL STUDIES AND PALLIATIVE MEASURES ADOPTED, THE PROPOSED SOLUTION HAD NOT BEEN EXECUTED AND THE RISK TO RESIDENTS PERSISTED, ORDERING THE EXPANSION OF THE STORMWATER COLLECTOR WITHIN TWELVE MONTHS. VCG06/2026 “(…) III.- ON THE MERITS. In the case under study, the appellant alleges that since 2017, she has filed complaints with the respondent municipality regarding the problem on Calle Segura, which suffers constant flooding due to the closing of several sewers that officials of the respondent municipality closed without any technical study or consulting the residents; however, the problem continues to date.
In this regard, the Court has established that the appellant has indeed filed numerous complaints, to which the municipality has responded since 2022, including a technical explanation of the problem, justification for the system saturation, and details of possible works. Regarding the problem reported here, the respondent authority notes that according to Official Letter IP-181-2022, the interventions carried out on Calle Segura were due to the construction of slabs in manholes, curb and gutter repairs, and corrective maintenance, which responded strictly to technical criteria to ensure the safety and minimum operability of the system. The area where the appellant resides belongs to the Quebrada Los Negritos watershed, with an extension of approximately 35 hectares and complex topography, characterized by variable slopes and natural accumulation of runoff in flat areas, and according to Report IP-153-2023, the system saturation events do not originate from an isolated municipal action, but from the insufficiency of the historical stormwater system, designed for hydrological conditions that have varied significantly, there being no direct causal link between the municipal maintenance work, the reported flooding, and the extraordinary climatic events, added to the limited capacity of the collector, are the determining factors of the effects.
By virtue of the foregoing, the following has been carried out: 1. Specialized studies. Within the framework of contract 2022LA-000020-0003400001, a comprehensive hydrological study was executed that culminated in the June 2023 Report, which diagnosed the real capacity of the system, modeled the hydraulic behavior of the watershed, and designed a comprehensive structural solution. 2. Comprehensive solution designed. The study determined the need to install HDPE detention tanks, completely replace the sewer system, and improve the hydraulic capacity of the system. The solution was valued at ₡1,207,182,695.00, and while the major work is made viable, the respondent municipality has a specific solution with immediate impact, which according to official letter DGSIP-IP-011-2026, was integrated into the 2026 Work Plan, which would be the expansion of the stormwater collector on Calle Segura, by installing new piping parallel to the existing one, in order to increase conveyance capacity and reduce overflows.
The project is currently in the final design phase, prior to its elevation to the Mayor's Office for the assignment of the corresponding budget allocation. Indeed, the Court recognizes that the respondent municipality has taken some palliative measures to address the flooding problem whenever it arises; however, as the respondent mayor himself explains, the problem requires comprehensive and broader attention than the palliative measures that have been executed. From the record, it is clear that a project exists that is currently in the final design phase, prior to its elevation to the Mayor's Office for the assignment of the corresponding budget allocation, pending budget approval, which seeks to efficiently remedy the flooding problem. However, said budget approval and final design are pending processing. In this case, even though the Court notes that the respondent has carried out some steps to resolve the situation, this latter solution proposed in 2026, which could be more viable at the moment to reduce the impact in question, has similarly been adopted much later and has not yet been implemented, which justifies granting the appeal. ALEGA LA RECURRENTE QUE LA MUNICIPALIDAD DE MONTES DE OCA NO HA SOLUCIONADO LAS INUNDACIONES CONSTANTES EN CALLE SEGURA PROVOCADAS POR LA SATURACIÓN DEL SISTEMA PLUVIAL Y EL CIERRE DE ALCANTARILLAS, AFECTANDO SU VIVIENDA Y LA INTEGRIDAD DE UN ADULTO MAYOR CON DISCAPACIDAD. SE DECLARA CON LUGAR AL ACREDITARSE QUE, PESE A LOS ESTUDIOS TÉCNICOS Y MEDIDAS PALIATIVAS ADOPTADAS, LA SOLUCIÓN PROPUESTA NO HABÍA SIDO EJECUTADA Y PERSISTÍA EL RIESGO PARA LOS VECINOS, ORDENÁNDOSE EN DOCE MESES LA AMPLIACIÓN DEL COLECTOR PLUVIAL. Respecto a la problemática aquí denunciada, acota la autoridad recurrida que según Oficio IP-181-2022, las intervenciones realizadas en la Calle Segura, se debieron a la construcción de losas en pozos, reparaciones de cordón y caño y mantenimiento correctivo, las cuales respondieron estrictamente a criterios técnicos para garantizar la seguridad y operatividad mínima del sistema. La zona donde reside la recurrente pertenece a la cuenca de la Quebrada Los Negritos, con una extensión de aproximadamente 35 hectáreas y una topografía compleja, caracterizada por pendientes variables y acumulación natural de escorrentía en áreas planas y según el Informe IP-153-2023, los eventos de saturación del sistema no se originan en una acción municipal aislada, sino en la insuficiencia del sistema pluvial histórico, diseñado para condiciones hidrológicas que han variado significativamente, no existiendo un nexo causal directo entre las labores de mantenimiento municipal, las inundaciones reportadas, y los eventos climáticos extraordinarios, sumados a la capacidad limitada del colector, son los factores determinantes de las afectaciones, en virtud de lo anterior, se ha realizado: 1.
Estudios especializados. En el marco de la contratación 2022LA-000020-0003400001, se ejecutó un estudio hidrológico integral que culminó en el Informe de junio 2023, el cual diagnosticó la capacidad real del sistema, modeló el comportamiento hidráulico de la cuenca, y se diseñó una solución estructural integral. 2. Solución integral diseñada. El estudio determinó la necesidad de instalar tanques de retardo en HDPE, sustituir por completo el alcantarillado, y mejorar la capacidad hidráulica del sistema. La solución fue valorada en ¢1.207.182.695,00, y mientras se viabiliza la obra mayor, la municipalidad recurrida cuenta con una solución puntual de impacto inmediato, que según el oficio DGSIP-IP-011-2026, se integró al Plan de Trabajo 2026, el cual sería la ampliación del colector pluvial en Calle Segura, mediante la instalación de una tubería nueva paralela a la existente, con el fin de aumentar la capacidad de conducción y reducir desbordamientos.
El proyecto se encuentra actualmente en fase de diseño final, previo a su elevación a la Alcaldía para la asignación del contenido presupuestario correspondiente. En efecto, la Sala reconoce que el municipio accionado ha tomado algunas medidas paliativas para atender el problema de inundaciones cada vez que se presenta; sin embargo, como lo explica el propio alcalde accionado, el problema requiere una atención integral y más amplia que las medidas paliativas que se han podido ejecutar.
