015340-26. ENVIRONMENT. MUNICIPALITY. PUBLIC SERVICES. SATURATION AND DISORDER OF OVERHEAD CABLING IN SAN RAMÓN, GENERATING VISUAL POLLUTION AND URBAN RISK. THE APPEAL IS PARTIALLY GRANTED AND THE MUNICIPALITY AND ICE ARE ORDERED TO IMPLEMENT PERMANENT ORGANIZING AND OVERSIGHT MEASURES. VCG05/2026 “(…) In this regard, it is worth noting that this Chamber, by means of judgment no. 2026008044, at 9:25 a.m. on March 6, 2026, heard and resolved a matter substantially similar to the present one, concerning four other points in the canton of San Ramón, on which occasion the amparo appeal filed against the respondent authorities was partially granted, based on the considerations transcribed below:
“(…) VI.- On the Responsibility of Local Governments. Article 169 of the Political Constitution establishes the duty of the country's municipalities to look after the interests of the inhabitants of their jurisdiction; hence, in repeated pronouncements, this Court has indicated that such corporations are obligated to eliminate any type of threat that puts at risk the rights to health and to a healthy and ecologically balanced environment of the people living in their canton (see Judgment No. 2008-11739 at 12:12 p.m. on July 25, 2008, reiterated in No. 2020-014753, at 9:15 a.m. on August 7, 2020).
Although the technical regulation of the telecommunications sector corresponds to specialized bodies of the Executive Branch and sectoral regulatory entities, the fact is that municipalities, pursuant to Articles 169 and 170 of the Political Constitution and the municipal autonomy regime, hold competence in matters of territorial planning, public space management, and safeguarding the local interest. In turn, in accordance with the Municipal Code, municipalities are responsible for urban planning and the protection of the environmental surroundings within their jurisdiction.
In the present case, the Mayor acknowledges that, on September 18, 2025, the appellants filed a complaint regarding the situation raised here, and as a result of the inspection carried out, it was verified that there is a "serious problem of visual pollution" and a "disorderly accumulation of cables and equipment" that negatively impacts the urban space, for which reason the creation of an institutional commission and outreach to ARESEP and ICE was recommended to address the situation comprehensively. Thus, on October 31, 2025, the Mayor's Office sent the complainants the response to each of the concerns raised in their complaint and explained to them that the Municipality is not the entity in charge of granting cable installation authorizations to the companies providing telecommunications services; rather, this corresponds to the Instituto Costarricense de Electricidad, which is responsible for granting the corresponding permits, as well as agreements with public and private institutions, for which reason it urged them to file the complaint with the competent public institutions.
Although, within a reasonable period and prior to the filing of this appeal, the Mayor resolved the complaint filed and notified the petitioners of its outcome, thereby not violating the right to swift and completed justice, the fact remains that the mere creation of a commission or the acknowledgment of the problem is insufficient if it does not translate into concrete material actions of oversight and ordering that cease the violation of the public space.
Municipal autonomy is not reduced to formal tax or administrative powers, but entails a correlative duty of effective guardianship of the cantonal environment. In that sense, even when the respondent Municipality is not the competent body to directly impose on telecommunications operators the removal or reordering of cabling, it does have the obligation to:
Therefore, absolute inactivity or the omission of inter-institutional management in the face of a notorious and prolonged situation of structural disorder in the cabling constitutes an indirect violation of the right to a healthy environment and the duty of protection incumbent upon all public authorities.
The problem denounced demonstrates that the actions, in exercise of the power of control or surveillance deployed in protection of health and the environment by the Municipality of San Ramon within the framework of its competencies, have been clearly insufficient, thereby incurring liability for omission in the exercise of those powers which, in turn, injures the citizens' constitutional right to receive efficient and effective public services.
By virtue of the foregoing, the respondent Municipality is responsible for the harm to the fundamental rights of the protected persons, due to the omission to promptly and effectively ensure the health of the population, and the environment.
Consequently, with regard to the Municipality of San Ramón, the appeal is granted, and it is warned that, henceforth, it must actively exercise its competencies regarding protection of the urban landscape, citizen security, and public space management, under warning of incurring liability for omission. Therefore, it is appropriate to order it to effectively put into operation the institutional commission mentioned in official document MSR-AM-GM-DDU-SMA-197-2025, and it must define a permanent work schedule to prevent the problem of infrastructure saturation from recurring in other sectors of the canton through coordinated work with the Instituto Costarricense de Electricidad.
VII.On the Duty of Oversight of SUTEL and the ICE. As governing bodies and administrators of passive infrastructure, including posts and networks, SUTEL and ICE have the obligation to ensure that private operators comply with the technical installation standards.
Articles 77 of the Public Services Regulatory Authority Law and 77 of the Regulation of the General Telecommunications Law state that SUTEL is responsible for guaranteeing the right to the joint or shared use of infrastructure, conduits, ducts, posts, towers, stations, and other installations required for the installation and operation of public telecommunications networks, as well as for the provision of services available to the public and the collocation of equipment.
For its part, ICE, in this case, as the owner of the infrastructure that supports public telecommunications networks, is obligated to grant rights of way, shared use, and colocation of equipment, to apply the regulations in force and the guidelines issued by the Superintendencia de Telecomunicaciones. Likewise, it is its duty to guarantee and provide the necessary maintenance of its scarce resource to ensure adequate operation and the continuity of shared use (Article 08 of the Regulation on the shared use of infrastructure for public telecommunications networks, GCO-NRE-REG-00469-2016).
Precisely, the Regulation on the shared use of infrastructure to support public telecommunications networks, in Article 13, also establishes that:

On the efficient use of network elements in telecommunications infrastructure by infrastructure owners. | | | When infrastructure owners that support public telecommunications networks become aware of underutilization or inefficient use of network elements in the space assigned to a telecommunications operator and/or provider, they must notify them so that the uninstallation and removal of these types of network elements is carried out, unless there is a valid justification for keeping them on the infrastructure. For this, a maximum period of 2 months shall be granted. | | | SUTEL, acting ex officio or at the request of a party, shall have the power to request the telecommunications operator and/or provider to remove these idle, unused, or improperly planned elements.” | | Consequently, according to the foregoing, once the request for intervention is received or acting ex officio, SUTEL is competent to require operators and/or telecommunications service providers to remove those elements that are idle, not being used, or whose existence does not respond to a duly substantiated technical plan. This regulatory power is particularly relevant in the management and ordering of the infrastructure, as it seeks to prevent saturation, inefficient use, or the permanence of installations lacking operational justification.
In the case under study, it was verified that on September 17, 2025, the appellant filed a complaint before the Superintendencia de Telecomunicaciones (SUTEL) for the chaotic accumulation of cabling and visual pollution in the central core of San Ramón, and within a reasonable period, the complaint was forwarded to ICE, which was asked to coordinate with the owners of telecommunications networks that use the passive infrastructure (posts) to adopt the necessary verification and correction measures and to report on actions taken.
By virtue of this, once SUTEL became aware of the actions taken by ICE and by the operators and/or providers offering telecommunications services, on October 17, 2025, it proceeded to inform the complainants of the actions taken. Thus, in that sense, the right to swift and completed justice was not violated, since the procedure was resolved within a reasonable time and before the filing of this appeal. Therefore, regarding this aspect, the appeal is dismissed.
On the other hand, it is not considered that SUTEL violated the right to health and the environment of those protected, since as the sectoral regulatory body, its role is to establish the legal, technical, and economic conditions under which said infrastructure can be used in a shared manner by operators and/or providers of telecommunications services available to the public. Note that it was through the complaint filed by the appellants that it became aware of the problem, and in order to provide a solution, it requested ICE, as the owner of the posts in that locality, to coordinate with the owners of telecommunications networks that use the passive infrastructure the adoption of the necessary verification and correction measures, and also asked said body to implement practices in surveillance and auditing in order to guarantee the ordering and proper management of telecommunications networks.
For compliance with this, it required ICE to report on the actions taken, and on October 6, 2025, it was informed that, as of that date, the removal of disused networks had been 50% completed, and that a two-month period had been granted to operators to conclude the corrective actions. Ultimately, constitutional review cannot become a mechanism to attribute automatic liability for every dysfunctional material situation when no arbitrary inactivity or deliberate neglect by the regulatory body is proven. Thus, SUTEL issued the acts necessary to provide a solution to the problem raised by the appellants.
It is noted that, without prejudice to criminal or civil liability, it will be up to SUTEL to intervene if the parties do not reach an agreement on the shared use of the scarce resource or a conflict exists, and to sanction the administrative infractions incurred by operators or providers, as well as those who exploit telecommunications networks or provide telecommunications services illegitimately (Article 65 of the General Telecommunications Law No. 8642 and 55 of the Regulation on the shared use of infrastructure for public telecommunications networks).
Notwithstanding the foregoing, this Chamber deems it pertinent to remind SUTEL of its permanent duty of oversight and supervision of compliance with technical obligations by operators, especially when these have an impact on the urban environment and may have environmental repercussions.
As a corollary to the foregoing, it is not proven, in the specific case, that the Superintendencia de Telecomunicaciones incurred in arbitrary or illegitimate action or omission that violates the fundamental right to a healthy environment, and it is appropriate to dismiss the appeal against this administrative body.
Take note. Although the present amparo appeal must be dismissed regarding SUTEL, follow-up must be given to the administrative proceedings initiated that are the subject of this amparo, within the framework of its legal competencies, in order to verify compliance with the technical obligations of the operating companies and to adopt, where appropriate, the corresponding measures.
VIII.Regarding the Instituto Costarricense de Electricidad (ICE). As for this entity, like the previous ones, it received the complaint from the administered parties and proceeded to execute the corresponding administrative acts and verified that there were disused service connections; double network (coaxial and fiber); double post installations; poorly detailed reserve loops; lack of space optimization on posts, and proceeded to notify the operators; Liberty, Telecable, Tigo, Claro, and Ufinet to carry out the relocation work of the disused networks, which was reiterated on several occasions and granted each operator a two-month period, with the purpose of guaranteeing compliance with the conditions stipulated in the corresponding service contracts, which expired on December 13, 2025, that is, after the date this appeal was filed. It is noted that, by November 2025, some of the operators had already executed the ordered actions, and during the week of December 15 to 19, 2025, an inspection was scheduled by personnel from the Shared Infrastructure Use Area to verify the current state of the denounced post installations; however, the Chamber does not know the result thereof.
Even though the telecommunications operating companies are the owners of the installed cabling, the fact is that the Instituto Costarricense de Electricidad, in its capacity as owner and administrator of the post installations, holds a legal position of guarantor regarding the adequate and safe use of that infrastructure. In that capacity, it cannot ignore the deterioration of the public space derived from the negligent use of the posts under its administration, as this would imply tolerating practices contrary to urban planning norms and technical regulations on electrical safety and telecommunications.
In the case at hand, an administrative omission is verified in the exercise of the police, control, and supervision powers that correspond to ICE over its own infrastructure, which has caused an impact on the fundamental right to a healthy and balanced environment, as well as a certain threat to the health and physical integrity of the appellants and the community.
The disorderly accumulation of cabling, the so-called “tangling” of lines, and the permanence of disused overhead lines constitute a form of visual pollution that degrades the urban landscape and undermines the right of the inhabitants to a safe and aesthetically harmonious environment.
In this sense, the passivity of the respondent entity does not constitute a mere aesthetic deficiency, but an omission with constitutional relevance, as it compromises the health and physical safety of persons as well as regularity in the management of the public domain. Inaction in the face of the technical non-compliance of the operators makes the administrator of the post installations co-responsible for the caused harm to health and the environment, since the administration of public infrastructure cannot be exercised outside the principles of legality, efficiency, and protection of the general interest.
It is evident, then, that the lack of effective oversight has produced harm to the right to the environment and a latent threat to the health and integrity of persons, given the risk of detachment or electrical accidents. Consequently, the omission by ICE in the exercise of its control competencies transgresses the constitutional mandates of administrative efficiency and environmental protection.
On the other hand, it is not recorded that, by the date this appeal was filed, the authorities of the corresponding branch had communicated to the appellants the concrete result of the actions undertaken, which also constitutes a violation of the right to swift and completed justice. This right is not satisfied by the mere issuance of concrete acts but requires a substantive and effective response that addresses the problem raised in a real and timely manner.
In the specific case, an administrative inoperativeness is observed, because, despite approximately two months having passed since the filing of the complaints and there being express acknowledgment of the poor condition of the cabling by the authorities, by the date of filing this appeal, the urban landscape of San Ramón had not undergone substantial changes, keeping the administered parties in a situation of risk and uncertainty. The persistence of the problem reveals that the oversight has been neglectful or ineffective. Public institutions cannot limit their action to mere forwarding of correspondence; they are obliged to guarantee the effective removal of cabling that is disused or installed in contravention of the applicable technical regulations.
IX.Conclusion. It is evident that both the Municipality of San Ramón and the ICE Branch in the canton of San Ramón have failed in their duty of inter-institutional coordination to resolve a fully identified problem of visual pollution. The lack of execution and the persistence of technical disorder in the four reported points justify the intervention of this Chamber to order the restoration of the visual balance and safety of the central core of San Ramón (…)
Therefore:
The appeal is granted. [Name 008] and [Name 009], in their respective capacities as Mayor and Head of the Municipal Environmental Services Unit, both of the Municipality of San Ramón, or whoever holds those positions, are ordered, within a period of FIFTEEN BUSINESS DAYS from the notification of this judgment, to effectively put into operation the institutional commission mentioned in official document MSR-AM-GM-DDU-SMA-197-2025, and must define a permanent work schedule to prevent the problem of saturation of telecommunications cables on the infrastructure from recurring in other sectors of the canton. Furthermore, they must coordinate with the INSTITUTO COSTARRICENSE DE ELECTRICIDAD, jointly and effectively, within their respective spheres of competence, so that within a period of ONE MONTH, counted from the notification of this resolution, the process of cleaning, organizing, and removing all telecommunications cabling that is disused, installed irregularly, or generating a chaotic accumulation in the four specific points denounced by the appellants is completed.
In turn, Alex Rodríguez Cambronero, in his capacity as Coordinator of the Integrated Agency of San Ramón of the Instituto Costarricense de Electricidad, or whoever holds that position, is ordered to arrange the administrative and technical actions necessary so that: a) Within a period of SIX MONTHS, counted from the notification of this judgment, he coordinates with the telecommunications operators the ordering and removal in their entirety of the disused cabling in the affected area; b) He executes, together with the telecommunications operators, an organizing and tensioning plan for the remaining cables to eliminate the negative visual impact and guarantee safety; c) He establishes a permanent oversight protocol to prevent the situation of visual chaos from recurring in the future; and d) He resolves and notifies the resolution of the complaint filed by the appellant on September 17, 2025.
The foregoing, under the warning that based on the provisions of Article 71 of the Constitutional Jurisdiction Law, imprisonment of three months to two years, or a fine of twenty to sixty days, shall be imposed on anyone who receives an order that must be complied with or enforced, issued in an amparo proceeding, and does not comply with it or does not enforce it, provided the crime is not more severely penalized. The Municipality of San Ramón and the Instituto Costarricense de Electricidad are ordered to pay the costs, damages, and losses caused by the facts that serve as the basis for this declaration, which shall be liquidated in the enforcement of judgment in the contentious-administrative proceeding. Regarding the Superintendencia de Telecomunicaciones, the appeal is dismissed, although it must take note of what is indicated in the final paragraph of Considerando VII of this judgment.
Judge Castillo Víquez records a note. Judge Salazar Alvarado partially dissents and declares the appeal dismissed regarding the alleged violation of the right to a healthy and ecologically balanced environment, since this aspect of the appeal corresponds to be resolved in the ordinary jurisdiction (…)”.
In this regard, it is clarified that this amparo appeal denounces the excess of cabling on the posts located at: “a) Avenida 0, 24 meters east of the Club de Amigos, in front of the Washington Apartments, b) Avenida 05, 200 meters north and 25 east from the front of the San Ramón Parish, next to the Librería Católica de San Ramón, in front of Boutique Mova, and c) Avenida 5, 25 meters from ASEMBIS, in front of PRO PLAN Concentrados, alongside D´Feria Centro de Carnes”. Likewise, the cited precedent questions the cabling placed on the electrical posts located at: “four points in the city, on Avenida Segunda of San Ramón, on sidewalks and in front of various commercial premises (Pizza Grace, Librería Eureka, The Corner Pub, and Sala de Juegos Mora)”. On the other hand, as in the cited precedent, the Municipality of San Ramón mentions official document MSR-AM GM-DDU-SMA-197-2025, dated October 1, 2025, which establishes that it carried out an inspection at the indicated location and issued that document with conclusions and recommendations (the formation of the institutional commission is recommended). Furthermore, in the present matter, the appellants allege the lack of attention to several complaints presented in this regard to the Municipality of San Ramón, the Superintendencia de Telecomunicaciones, and the Instituto Costarricense de Electricidad.
That is, it is considered proven that these are complaints about visual pollution in common areas of said canton, so this Court relies on that precedent for the resolution of this new amparo appeal.
VI.From the comprehensive review of the case file, the reports rendered under oath -with the consequences provided for in Article 44 of the Law of this Jurisdiction-, and the incorporated evidentiary record, this Court deems it accredited that the appellants denounced, on September 9, 17, and 18, 2025, a persistent situation of visual pollution, structural disorder, and accumulation of disused electrical and telecommunications cabling, particularly in various urban sectors of the canton of San Ramón de Alajuela, which generated a negative impact on the urban landscape and risks to citizen security.
As is evident from the proven facts, said complaints were filed before the Instituto Costarricense de Electricidad (ICE), the Municipality of San Ramón, and the Superintendencia de Telecomunicaciones (SUTEL), with each of these entities deploying actions within their respective scope of competence. However, the constitutional analysis requires determining whether such actions were timely, sufficient, and effective in guaranteeing the invoked fundamental rights.
With respect to the Instituto Costarricense de Electricidad, it is recorded that, in its capacity as owner and administrator of the passive infrastructure (post installations), it received the respective complaints and, after these were also forwarded by SUTEL, executed various administrative procedures, such as field inspections, notifications, and warnings to the telecommunications operators using said infrastructure -Liberty, Telecable, Tigo, Claro, Ufinet, and Kölbi-, granting them deadlines for the relocation of networks, the removal of disused overhead lines, and the correction of multiple detected irregularities, including idle service connections, double network, double post installations, poorly arranged reserve loops, and unfinished work.
However, it was also demonstrated that, by the date this appeal was filed, relevant irregularities persisted in the denounced areas, and the total removal of disused cabling and the comprehensive correction of the problem had not been proven, despite the existence of such anomalies being expressly acknowledged. Likewise, it is not recorded that ICE had clearly and timely communicated to the appellants the concrete result of the actions taken, which negatively impacted their right to swift and completed justice.
As this Chamber has repeatedly held, even though the operating companies are the owners of the installed networks, ICE, as the administrator of the post installations, holds a legal position of guarantor regarding the adequate, safe, and orderly use of said infrastructure. Consequently, it cannot disregard the negative effects that the negligent use of the posts generates on the public space, as this compromises the constitutional right to a healthy and balanced environment, as well as the health and physical integrity of persons. The omission or ineffective oversight in the exercise of its control and supervision powers therefore constitutes an infraction with constitutional relevance.
For its part, regarding the Municipality of San Ramón, it is accredited that it received the complaint for visual pollution and that, through a technical inspection, it expressly acknowledged the veracity of the denounced facts, concluding that there was a serious problem of visual pollution derived from the disorder of cables and equipment on the urban posts. However, it is also verified that an excessive period - exceeding two months - elapsed without a formal response being provided to the complainants, which was only issued on the occasion of the processing of this amparo.
Additionally, although the municipality stated its intention to form an institutional commission and to coordinate with other competent entities, it is not recorded that such measures were effectively materialized or that they translated into concrete and verifiable actions of oversight, ordering, or mitigation of the denounced problem. As this Court has indicated, municipal autonomy entails not only formal powers but an active duty of guardianship of the urban environment and cantonal public space. Consequently, even if it is not responsible for directly imposing the removal of cabling on the operators, it is obligated to oversee, coordinate inter-institutionally, and adopt reasonable measures to prevent environmental and urban risks. Inactivity or merely declaratory management is insufficient and constitutes an omission that violates fundamental rights.
Finally, with regard to the Superintendencia de Telecomunicaciones (SUTEL), it was considered proven that said entity received multiple complaints of a similar nature and, within a reasonable period, proceeded to forward them to ICE as the owner of the passive infrastructure, issued clear directives for the verification and correction of the indicated irregularities, and requested detailed reports on the actions executed. Likewise, before the filing of this appeal, SUTEL communicated to the complainants the actions taken and the reports rendered by ICE, without any negligent, arbitrary, or illegitimate conduct on the part of the regulatory body being evident.
It must be remembered that SUTEL's function is limited to the regulation, supervision, and oversight of the technical and legal conditions of the shared use of the infrastructure, and it is not responsible for the direct material execution of the removal of cabling. Within this framework, this Court considers that SUTEL acted within its scope of competence and did not violate the fundamental rights of the appellants, without prejudice to its permanent duty of continuous supervision and eventual sanctioning power in the event of future non-compliance (see in a similar sense judgment no. 2026014326 at 9:20 a.m. on April 24, 2026).
VII.Conclusion. By virtue of the foregoing, the appropriate course is to declare the appeal partially with merit solely against the Instituto Costarricense de Electricidad and the Municipalidad de San Ramón on the grounds indicated. As to the Superintendencia de Telecomunicaciones, the appeal is declared without merit. Nevertheless, as stated in the cited precedent, that authority is reminded that it must follow up on the administrative proceedings initiated that are the subject of this amparo, within the framework of its legal powers, in order to verify compliance with the technical obligations of the operating companies and to adopt, as applicable, the corresponding measures. (…)
015340-26. AMBIENTE. MUNICIPALIDAD. SERVICIOS PÚBLICOS. SATURACIÓN Y DESORDEN DE CABLEADO AÉREO EN SAN RAMÓN, GENERA CONTAMINACIÓN VISUAL Y RIESGO URBANO. SE DECLARA PARCIALMENTE CON LUGAR Y SE ORDENA A LA MUNICIPALIDAD Y AL ICE IMPLEMENTAR MEDIDAS PERMANENTES DE ORDENAMIENTO Y FISCALIZACIÓN. VCG05/2026 “(…) Sobre el particular, conviene indicar que esta Sala, mediante sentencia no. 2026008044, de las 9:25 horas del 6 de marzo de 2026, conoció y resolvió un asunto sustancialmente similar al presente, referido a otros cuatro puntos del cantón de San Ramón, ocasión en la cual se declaró parcialmente con lugar el recurso de amparo interpuesto contra las autoridades accionadas, con base en las consideraciones que seguidamente se transcriben:
“(…) VI.- Sobre la Responsabilidad de los Gobiernos Locales. El artículo 169, de la Constitución Política, dispone el deber de las municipalidades del país de velar por los intereses de los habitantes de su jurisdicción, de ahí que, en reiterados pronunciamientos, este Tribunal ha señalado que, dichas corporaciones se encuentran en la obligación de eliminar cualquier tipo de amenaza que ponga en riesgo los derechos a la salud y a un medio ambiente sano y ecológicamente equilibrado de las personas que viven en su cantón (véase la Sentencia N° 2008-11739 de las 12:12 horas del 25 de julio de 2008, reiterada en la N° 2020-014753, de las 9:15 horas del 7 de agosto de 2020).
Si bien la regulación técnica del sector telecomunicaciones corresponde a órganos especializados del Poder Ejecutivo y entes reguladores sectoriales, lo cierto es que las municipalidades, conforme a los artículos 169 y 170, de la Constitución Política, y al régimen autonómico municipal, ostentan competencia en materia de ordenamiento territorial, gestión del espacio público y resguardo del interés local. A su vez, de conformidad con el Código Municipal, corresponde a las municipalidades la planificación urbana y la protección del entorno ambiental en su jurisdicción.
En el presente caso, la Alcaldesa reconoce que, el 18 de setiembre de 2025, los recurrentes interpusieron una denuncia por la situación aquí planteada y a raíz de la inspección realizada, se constató que existe un "grave problema de contaminación visual" y una "acumulación desordenada de cables y equipos" que impacta negativamente el espacio urbano, por lo que se recomendó la creación de una comisión institucional y el acercamiento con ARESEP e ICE para abordar la situación en forma integral. De manera que, el 31 de octubre de 2025, la Alcaldía remitió a los denunciantes la respuesta a cada una de las inquietudes formuladas en su queja y se les explicó que, la Municipalidad no es la encargada de otorgar las autorizaciones de instalación de cableado a las empresas prestadoras de servicios de telecomunicaciones, sino que le corresponde al Instituto Costarricense de Electricidad, el cual es el responsable de otorgar los permisos correspondientes, así como los convenios con las instituciones públicas y privadas, por lo que les instó a poner la denuncia ante las instituciones públicas competentes.
Si bien, dentro de un plazo prudencial y previo a la interposición del presente recurso, la Alcaldesa resolvió la denuncia planteada y les notificó a los gestionantes el resultado de la misma, con lo cual no se lesionó el derecho de una justicia pronta y cumplida, lo cierto es que la mera creación de una comisión o el reconocimiento del problema resulta insuficiente si no se traduce en acciones materiales concretas de fiscalización y ordenamiento que cesen la vulneración del espacio público.
La autonomía municipal no se reduce a potestades tributarias o administrativas formales, sino que comporta un deber correlativo de tutela efectiva del entorno cantonal. En ese sentido, aun cuando la Municipalidad recurrida no sea el órgano competente para imponer directamente a las operadoras de telecomunicaciones el retiro o reordenamiento del cableado, sí tiene la obligación de:
De modo, que la inactividad absoluta o la omisión de gestión interinstitucional frente a una situación notoria y prolongada de desorden estructural en el cableado constituye una vulneración indirecta del derecho a un ambiente sano y del deber de protección que incumbe a toda autoridad pública.
El problema denunciado demuestra que las acciones en ejercicio de la potestad de control o vigilancia desplegadas en tutela de la salud y del ambiente por parte Municipalidad de San Ramon dentro del marco de sus competencias, han sido claramente insuficientes, incurriendo así en responsabilidad por omisión en el ejercicio de esas potestades que, a su vez, lesiona el derecho constitucional de los ciudadanos a que les presten servicios públicos eficientes y eficaces.
En virtud de lo expuesto, la Municipalidad recurrida es responsable del daño a los derechos fundamentales de las personas amparadas, por la omisión en velar pronta y eficazmente por la salud de la población, y al ambiente.
En consecuencia, en cuanto a la Municipalidad de San Ramón se declara con lugar el recurso y se le previene que, en lo sucesivo, deberá ejercer activamente sus competencias en materia de protección del paisaje urbano, seguridad ciudadana y gestión del espacio público, bajo apercibimiento de incurrir en responsabilidad por omisión. Por ende, lo procedente es ordenarle poner en funcionamiento efectivo la comisión institucional mencionada en el oficio MSR-AM-GM-DDU-SMA-197-2025, debiendo definir un cronograma de trabajo permanente para evitar que la problemática de saturación de infraestructura se repita en otros sectores del cantón mediante un trabajo de coordinación con el Instituto Costarricense de Electricidad.
VII.Sobre el deber de Fiscalización de la SUTEL y el ICE. Como entes rectores y administradores de la infraestructura pasiva, entre ellos postes y redes, la SUTEL y el ICE tienen la obligación de garantizar que los operadores privados cumplan con las normas técnicas de instalación.
Los artículos 77, de la Ley de la Autoridad Reguladora de los Servicios Públicos, y 77, del Reglamento de la Ley General de Telecomunicaciones, señalan que le corresponde a la SUTEL, garantizar el derecho al uso conjunto o compartido de las infraestructuras, canalizaciones, ductos, postes, torres, estaciones y demás instalaciones requeridas para la instalación y operación de redes públicas de telecomunicaciones, así como para la provisión de los servicios disponibles al público y la coubicación de equipos.
Por su parte, el ICE, en este caso, como propietario de la infraestructura que soporta redes públicas de telecomunicaciones, se encuentra en la obligación de conceder derechos de paso, uso compartido y colocalización de equipos, aplicar la normativa vigente y los lineamientos emitidos por la Superintendencia de Telecomunicaciones. Asimismo es su deber garantizar y brindar el mantenimiento necesario a su recurso escaso para asegurar la operación adecuada y la continuidad del uso compartido (artículo 08, del Reglamento sobre el uso compartido de infraestructura para redes públicas de telecomunicaciones, GCO-NRE-REG-00469-2016).
Precisamente, el Reglamento sobre el uso compartido de infraestructura para el soporte de redes públicas de telecomunicaciones, en el artículo 13, también establece que:
“Artículo 13. Sobre el uso eficiente de los elementos de la red en la infraestructura de telecomunicaciones por parte de los propietarios de la infraestructura.
Cuando los propietarios de la infraestructura que soporten redes públicas de telecomunicaciones tengan conocimiento sobre subutilización o uso no eficiente de los elementos de red en el espacio asignado a un operador y/o proveedor de servicios de telecomunicaciones, deberán notificar a éstos, para que se realice la desinstalación y remoción de este tipo de elementos de red, salvo cuando exista una justificación válida para mantenerlos en la infraestructura. Para esto se deberá otorgar un plazo máximo de 2 meses.
La SUTEL de oficio o a solicitud de parte, tendrá la potestad de solicitarle al operador y/o proveedor de telecomunicaciones la remoción de estos elementos ociosos, no utilizados o que no tengan un uso debidamente planificado” De manera que, según lo expuesto una vez recibida la solicitud de intervención o de oficio la SUTEL es competente para requerir a los operadores y/o proveedores de servicios de telecomunicaciones, la remoción de aquellos elementos que se encuentren en condición de ociosidad, que no estén siendo utilizados o cuya existencia no responda a una planificación técnica debidamente sustentada. Esta atribución normativa reviste especial relevancia en la gestión y ordenamiento de la infraestructura, en tanto procura evitar la saturación, el uso ineficiente o la permanencia de instalaciones carentes de justificación operativa.
En el caso bajo estudio, se constató que el 17 de setiembre de 2025, la parte recurrente interpuso una denuncia ante la Superintendencia de Telecomunicaciones (SUTEL) por la acumulación caótica de cableado y contaminación visual en el casco central de San Ramón y dentro de un plazo prudencial, la queja fue trasladada al ICE y se le pidió coordinar con los propietarios de redes de telecomunicaciones que hacen uso de la infraestructura pasiva (postes) adoptar las medidas de verificación y corrección necesaria e informar de lo actuado.
En virtud de ello, una vez que la SUTEL tuvo conocimiento de lo actuado por parte del ICE y de los operadores y/o proveedores que brinden servicios de telecomunicaciones, el 17 de octubre de 2025, procedió a informar a los quejosos de lo actuado. De modo, que en ese sentido no se lesionó el derecho a una justicia pronta y cumplida, ya que la gestión fue resuelta en un plazo razonable y antes de la interposición del presente recurso. Por ende, en cuanto este extremo se declara sin lugar el recurso.
Por otra parte, no se estima que la SUTEL haya lesionado el derecho a la salud y al ambiente de los tutelados, ya que como ente regulador sectorial, lo que le corresponde es reglar las condiciones jurídicas, técnicas y económicas a partir de las cuales, dicha infraestructura puede ser utilizada de manera compartida por los operadores y/o proveedores de servicios de telecomunicaciones disponibles al público. Nótese que, fue a partir de la queja que presentaron los recurrentes, que tuvo conocimiento del problema y para brindar una solución, le solicitó al ICE, como propietario de los postes en dicha localidad, coordinar con los propietarios de redes de telecomunicaciones que hacen uso de la infraestructura pasiva la adopción de medidas de verificación y corrección necesarias, así como también le pidió a dicho órgano, disponer de prácticas en la vigilancia y auditoría con el fin de garantizar el ordenamiento y adecuada gestión de las redes de telecomunicaciones.
Para el cumplimiento de ello, le requirió al ICE informar de las acciones realizadas y el 06 de octubre de 2025, se le comunicó que, a esa fecha, ya se había ejecutado el retiro de redes en desuso en un 50%, y que se le había otorgado un plazo de dos meses a los operadores para concluir las acciones correctivas. En definitiva, el control constitucional no puede convertirse en un mecanismo para atribuir responsabilidad automática ante toda situación material disfuncional, cuando no se acredita inactividad arbitraria o desatención deliberada por parte del ente regulador. De modo, que la SUTEL dictó los actos necesarios para brindar una solución al problema planteado por los recurrentes.
Se advierte, que sin perjuicio de la responsabilidad penal o civil, será a la SUTEL que le corresponderá intervenir en caso de las partes no lleguen a un acuerdo sobre el uso compartido del recurso escaso o exista conflicto y proceder a sancionar las infracciones administrativas en que incurran los operadores o proveedores y también los que exploten redes de telecomunicaciones o presten servicios de telecomunicaciones de manera ilegítima. (artículo 65, de la Ley General de Telecomunicaciones, Nº 8642 y 55 del Reglamento sobre el uso compartido de infraestructura para redes públicas de telecomunicaciones) Sin perjuicio de lo anterior, esta Sala estima pertinente recordar a la SUTEL su deber permanente de fiscalización y supervisión del cumplimiento de las obligaciones técnicas por parte de los operadores, especialmente cuando estas incidan en el entorno urbano y puedan tener repercusiones ambientales.
Corolario de lo anterior, no se acredita, en el caso concreto, que la Superintendencia de Telecomunicaciones haya incurrido en una acción u omisión arbitraria o ilegítima que vulnere el derecho fundamental a un ambiente sano y lo que procede es declarar sin lugar el recurso en contra este órgano administrativo.
Tome nota. A pesar de que, el presente recurso de amparo debe ser declarado sin lugar en cuanto a la SUTEL, se deberá dar seguimiento a las gestiones administrativas iniciadas objeto de este amparo, dentro del marco de sus competencias legales, a efectos de verificar el cumplimiento de las obligaciones técnicas de las empresas operadoras y adoptar, en su caso, las medidas que correspondan.
VIII.En relación con el Instituto Costarricense de Electricidad (ICE). En cuanto a este ente, al igual que los anteriores, recibió la queja de los administrados y procedió a ejecutar los actos administrativos correspondientes y constató que, existían acometidas en desuso; doble red (coaxial y fibra); doble postería; rollos de reserva mal detallados; falta de optimización del espacio en postes y procedió a avisar a los operadores; Liberty, Telecable, Tigo, Claro y Ufinet para que efectuaran los trabajos de relocalización de las redes en desuso, lo cual fue reiterado en varias ocasiones y otorgó a cada operador el plazo de dos meses, con el propósito de garantizar el cumplimiento de las condiciones estipuladas en los contratos de servicio correspondientes, lo cual vencía el 13 de diciembre de 2025, es decir posterior a la fecha de interposición del presente recurso. Se advierte que, para el mes de noviembre de 2025, algunos de los operadores ya habían ejecutado las acciones ordenadas, siendo que de la semana del 15 al 19 de diciembre de 2025, se programó una inspección por parte del personal del Área de Uso Compartido de Infraestructura, para verificar el estado actual de la postería denunciada; no obstante, la Sala desconoce el resultado del mismo.
Aun cuando las empresas operadoras de telecomunicaciones sean propietarias del cableado instalado, lo cierto es que el Instituto Costarricense de Electricidad, en su condición de titular y administrador de la postería, ostenta una posición jurídica de garante respecto del uso adecuado y seguro de esa infraestructura. En tal carácter, no puede desentenderse del deterioro del espacio público derivado de la utilización negligente de los postes bajo su administración, pues ello implicaría tolerar prácticas contrarias a las normas de ordenamiento urbano y a los reglamentos técnicos en materia de seguridad eléctrica y telecomunicaciones.
En el sub lite se verifica una omisión administrativa en el ejercicio de las potestades de policía, control y supervisión que corresponden al ICE sobre su propia infraestructura, lo cual ha generado una afectación al derecho fundamental a un ambiente sano y equilibrado, así como una amenaza cierta a la salud e integridad física de los recurrentes y de la colectividad.
La acumulación desordenada de cableado, el denominado “marañamiento” de líneas y la permanencia de tendidos en desuso configuran una forma de contaminación visual que degrada el paisaje urbano y menoscaba el derecho de los habitantes a un entorno seguro y estéticamente armónico.
En tal sentido, la pasividad del ente recurrido no constituye una mera deficiencia estética, sino una omisión con relevancia constitucional, en tanto compromete la salud y la seguridad física de las personas así como la regularidad en la gestión del dominio público. La inacción frente al incumplimiento técnico de las operadoras convierte al administrador de la postería en corresponsable de la lesión a la salud y ambiental ocasionada, pues la administración de infraestructura pública no puede ejercerse al margen de los principios de legalidad, eficacia y tutela del interés general.
Se evidencia, entonces, que la falta de fiscalización efectiva ha producido una lesión al derecho al ambiente y una amenaza latente a la salud y a la integridad de las personas, ante el riesgo de desprendimientos o accidentes eléctricos. En consecuencia, la omisión del ICE en el ejercicio de sus competencias de control transgrede los mandatos constitucionales de eficiencia administrativa y protección del entorno.
Por otra parte, no consta que, a la fecha de interposición del presente recurso, las autoridades de la sucursal correspondiente hayan comunicado a los recurrentes el resultado concreto de las gestiones emprendidas, lo que también comporta una lesión al derecho a una justicia pronta y cumplida. Este derecho no se satisface con la mera emisión de actos concretos, sino que exige una respuesta sustantiva y eficaz que atienda de manera real y oportuna la problemática planteada.
En el caso concreto se advierte una inoperancia administrativa, pues, pese a haber transcurrido aproximadamente dos meses desde la interposición de las denuncias y a existir reconocimiento expreso del mal estado del tendido por parte de las autoridades, a la fecha de interposición del presente recursos el paisaje urbano de San Ramón no ha experimentado cambios sustanciales, manteniendo a los administrados en una situación de riesgo e incertidumbre. La persistencia del problema revela que la fiscalización ha sido omisa o ineficaz. Las instituciones públicas no pueden limitar su actuación a meros traslados de correspondencia; están obligadas a garantizar el retiro efectivo del cableado en desuso o instalado en contravención de la normativa técnica aplicable.
IX.Conclusión. Resulta evidente que tanto la Municipalidad de San Ramón, como la Sucursal del ICE en el cantón de San Ramón, han fallado en su deber de coordinación interinstitucional para resolver un problema de contaminación visual plenamente identificado. La falta de ejecución y la persistencia del desorden técnico en los cuatro puntos denunciados justifican la intervención de esta Sala para ordenar la restauración del equilibrio visual y la seguridad del casco central de San Ramón (…)
Por tanto:
Se declara con lugar el recurso. Se ordena a [Nombre 008] y a [Nombre 009], en su condición respectiva de Alcaldesa y Jefe de la Unidad de Servicios Ambientales Municipales, ambos de la Municipalidad de San Ramón, o a quienes ocupen dichos cargos, que dentro del plazo de QUINCE DIAS HÁBILES, a partir de la notificación de la presente sentencia, deben poner en funcionamiento efectivo la comisión institucional mencionada en el oficio MSR-AM-GM-DDU-SMA-197-2025, debiendo definir un cronograma de trabajo permanente para evitar que la problemática de saturación de cables de telecomunicaciones en la infraestructura se repita en otros sectores del cantón. Además, deberán coordinar con el INSTITUTO COSTARRICENSE DE ELECTRICIDAD, de manera conjunta y efectiva, dentro de sus respectivas esferas de competencia, para que dentro del plazo de UN MES, contado a partir de la notificación de esta resolución, se finalice el proceso de limpieza, ordenamiento y retiro de todo cableado de telecomunicaciones que se encuentre en desuso, instalado de manera irregular o que genere una acumulación caótica en los cuatro puntos específicos denunciados por los recurrentes.
A su vez, se ordena a Alex Rodríguez Cambronero, en su condición de Coordinador de la Agencia Integrada de San Ramón del Instituto Costarricense de Electricidad, o a quien ocupe dicho puesto que disponga las acciones administrativas y técnicas necesarias para que: a) Dentro del plazo de SEIS MES, contado a partir de la notificación de esta sentencia, coordine con las operadoras de telecomunicaciones, el orden y retiro en su totalidad del cableado en desuso en la zona afectada; b) Ejecutar, junto con las operadoras de telecomunicaciones un plan de ordenamiento y tensado de los cables remanentes para eliminar el impacto visual negativo y garantizar la seguridad; c) Establecer un protocolo de fiscalización permanente para evitar que la situación de caos visual se repita en el futuro y; d) Resolver y notificar la resolución de la denuncia interpuesta por la parte recurrente el día 17 de setiembre de 2025.
Lo anterior, bajo el apercibimiento que con base en lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de San Ramón y al Instituto Costarricense de Electricidad al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto a la Superintendencia de Telecomunicaciones se declara sin lugar el recurso, aunque debe tomar nota de lo indicado en el párrafo final del considerando VII, de esta sentencia. El magistrado Castillo Víquez consigna nota.
El magistrado Salazar Alvarado salva el voto en forma parcial y declara sin lugar el recurso, en cuanto a la acusada violación del derecho a un ambiente sano y ecológicamente equilibrado, ya que este extremo del recurso corresponde ser dirimido en la vía de legalidad (…)”.
Al respecto, se aclara que en este recurso de amparo se denuncia el exceso de cableado en los postes ubicados en: “a) Avenida 0, 24 metros al este del Club de Amigos, frente a los Departamentos Washington, b) Avenida 05, 200 metros norte y 25 este del frente de la Parroquia de San Ramón, a un lado de la Librería Católica de San Ramón, frente la Boutique Mova, y c) Avenida 5, 25 metros de ASEMBIS, frente a PRO PLAN Concentrados, a un costado de D´Feria Centro de Carnes”. Asimismo, en el precedente citado se cuestiona el cableado colocado en los postes eléctrico ubicado en: “cuatro puntos de la ciudad, en la Avenida Segunda de San Ramón, sobre aceras y frente a diversos locales comerciales (Pizza Grace, Librería Eureka, The Corner Pub y Sala de Juegos Mora)”. Por otra parte, al igual que en el precedente citado, la Municipalidad de San Ramón hace mención del oficio MSR-AM GM-DDU-SMA-197-2025, fechado 01 de octubre de 2025, en donde se establece que realizó una inspección en el lugar señalado y emitió ese documento con conclusiones y recomendaciones (se recomienda la conformación de la comisión institucional). Por otra parte, en el presente asunto, los recurrentes alegan la falta de atención de varias denuncias al respecto presentadas ante la Municipalidad de San Ramón, Superintendencia de Telecomunicaciones e Instituto Costarricense de Electricidad.
Es decir, se tiene por probado que se trata de denuncias sobre contaminación visual en zonas comunes de dicho cantón, por lo que este Tribunal se fundamenta en ese precedente para la resolución de este nuevo recurso de amparo.
VI.De la revisión integral del expediente, de los informes rendidos bajo juramento -con las consecuencias previstas en el artículo 44 de la Ley de esta Jurisdicción- y del acervo probatorio incorporado, este Tribunal tiene por acreditado que los recurrentes denunciaron, el 9, 17 y 18 de setiembre de 2025, una situación persistente de contaminación visual, desorden estructural y acumulación de cableado eléctrico y de telecomunicaciones en desuso, particularmente en diversos sectores urbanos del cantón de San Ramón de Alajuela, lo cual generaba un impacto negativo en el paisaje urbano y riesgos para la seguridad ciudadana.
Conforme se desprende de los hechos demostrados, dichas denuncias fueron planteadas ante el Instituto Costarricense de Electricidad (ICE), la Municipalidad de San Ramón y la Superintendencia de Telecomunicaciones (SUTEL), siendo que cada una de estas entidades desplegó actuaciones dentro de su respectivo ámbito competencial. No obstante, el análisis constitucional exige determinar si tales actuaciones fueron oportunas, suficientes y eficaces para garantizar los derechos fundamentales invocados.
En lo que respecta al Instituto Costarricense de Electricidad, consta que, en su condición de propietario y administrador de la infraestructura pasiva (postería), recibió las denuncias respectivas y, trasladadas estas también por la SUTEL, ejecutó diversas gestiones administrativas, tales como inspecciones de campo, notificaciones y apercibimientos a los operadores de telecomunicaciones que utilizan dicha infraestructura -Liberty, Telecable, Tigo, Claro, Ufinet y Kölbi-, otorgándoles plazos para la relocalización de redes, el retiro de tendidos en desuso y la corrección de múltiples irregularidades detectadas, entre ellas acometidas ociosas, doble red, doble postería, rollos de reserva mal dispuestos y trabajos inconclusos.
Sin embargo, también quedó demostrado que, a la fecha de interposición del presente recurso, persistían irregularidades relevantes en las zonas denunciadas y no se había acreditado el retiro total del cableado en desuso ni la corrección integral del problema, pese a haberse reconocido hubiera comunicado de manera clara y oportuna a los recurrentes el resultado concreto de las gestiones realizadas, lo cual incidió negativamente en su derecho a una justicia pronta y cumplida.
Tal como ha sostenido reiteradamente esta Sala, aun cuando las empresas operadoras sean propietarias de las redes instaladas, el ICE, como administrador de la postería, ostenta una posición jurídica de garante respecto del uso adecuado, seguro y ordenado de dicha infraestructura. En consecuencia, no puede desentenderse de los efectos negativos que el uso negligente de los postes genera sobre el espacio público, pues ello compromete el derecho constitucional a un ambiente sano y equilibrado, así como la salud y la integridad física de las personas. La omisión o fiscalización ineficaz en el ejercicio de sus potestades de control y supervisión configura, por ende, una infracción con relevancia constitucional.
Por su parte, en cuanto a la Municipalidad de San Ramón, se encuentra acreditado que esta recibió la denuncia por contaminación visual y que, mediante inspección técnica, reconoció expresamente la veracidad de los hechos denunciados, concluyendo que existía un grave problema de contaminación visual derivado del desorden de cables y equipos en la postería urbana. No obstante, también se constata que transcurrió un plazo excesivo -superior a dos meses- sin que se brindara una respuesta formal a los denunciantes, la cual únicamente se produjo con ocasión de la tramitación del presente amparo.
Adicionalmente, aunque la municipalidad manifestó su intención de conformar una comisión institucional y de coordinar con otras entidades competentes, no consta que tales medidas se hayan materializado efectivamente ni que se hayan traducido en acciones concretas y verificables de fiscalización, ordenamiento o mitigación del problema denunciado. Como ha señalado este Tribunal, la autonomía municipal comporta no solo potestades formales, sino un deber activo de tutela del entorno urbano y del espacio público cantonal. En consecuencia, aun cuando no le corresponda imponer directamente a los operadores el retiro del cableado, sí está obligada a fiscalizar, coordinar interinstitucionalmente y adoptar medidas razonables para prevenir riesgos ambientales y urbanos. La inactividad o gestión meramente declarativa resulta insuficiente y configura una omisión lesiva de derechos fundamentales.
Finalmente, en lo atinente a la Superintendencia de Telecomunicaciones (SUTEL), se tuvo por demostrado que dicha entidad recibió múltiples denuncias de similar naturaleza y, dentro de un plazo razonable, procedió a trasladarlas al ICE como propietario de la infraestructura pasiva, emitió directrices claras para la verificación y corrección de las irregularidades señaladas y requirió informes detallados sobre las acciones ejecutadas. Asimismo, antes de la interposición del presente recurso, la SUTEL comunicó a los denunciantes las gestiones efectuadas y los informes rendidos por el ICE, sin que se evidencie una conducta omisiva, arbitraria o ilegítima por parte del ente regulador.
Debe recordarse que la función de la SUTEL se circunscribe a la regulación, supervisión y fiscalización de las condiciones técnicas y jurídicas del uso compartido de la infraestructura, sin que le corresponda la ejecución material directa del retiro del cableado. En ese marco, este Tribunal estima que la SUTEL actuó dentro de su ámbito competencial y no lesionó los derechos fundamentales de los recurrentes, sin perjuicio de su deber permanente de supervisión continua y eventual potestad sancionatoria ante incumplimientos futuros (ver en similar sentido la sentencia no. 2026014326 de las 9:20 horas del 24 de abril de 2026).
VII.Conclusión. En virtud de lo expuesto, lo que procedente es declarar parcialmente con lugar el recurso únicamente en contra del Instituto Costarricense de Electricidad y la Municipalidad de San Ramón por los puntos indicados. En cuanto a la Superintendencia de Telecomunicaciones, se declarar sin lugar el recurso. No obstante, tal y como se indicó en el precedente citado, se le recuerda a dicha autoridad que deberá dar seguimiento a las gestiones administrativas iniciadas objeto de este amparo, dentro del marco de sus competencias legales, a efectos de verificar el cumplimiento de las obligaciones técnicas de las empresas operadoras y adoptar, en su caso, las medidas que correspondan.
