SummaryResumen
Circular No. 95-2026 informs the Regional Administrations of the Poder Judicial of criteria for intervening on trees on institutional land. It limits pruning or felling to technical grounds such as risks to people, impacts on infrastructure or services, security, and maintenance. It distinguishes pruning, which leaves the tree alive and standing, from complete felling, which under the stated criterion is allowed only when it is the sole suitable option. Before intervening, the Administration must obtain an appropriate, independent technical opinion from a qualified professional registered with their professional association, assessing the tree’s health, ecological and environmental value, stability, and actual risk. If felling is proposed, the opinion must explain why pruning is insufficient and identify environmental compensation. The circular also instructs staff to check Forestry Law No. 7575, the restrictions it attributes to Decree No. 25700-MINAE, and the protection areas in Articles 33 and 34; it lists external permits and specifies validation requirements for security cameras, infrastructure, and trees on national roads.

The Regional Administration is responsible for seeking an appropriate and independent technical opinion that technically justifies the need for pruning or, ultimately, felling, while ensuring compliance with the applicable legal procedures. If the tree must be felled, the document must technically justify why pruning is insufficient and why felling is the only suitable measure to mitigate the risk (e.g., progressive death of the root system, pathogens, or imminent danger of falling onto people or critical infrastructure).

TO: Regional Administrators SUBJECT: Guidelines for carrying out tree pruning or felling on Poder Judicial property DATE: 28 August 2026 For the purpose of promoting people’s safety, protecting the environment, and complying with Costa Rican legislation, the following guidelines are issued to govern any intervention involving trees on institutional property, in accordance with the opinion issued by Eugenio Solís Rodríguez, Environmental Manager of Poder Judicial:
1. Grounds for intervention Tree pruning or felling may be undertaken exclusively on the following technical grounds:
Imminent risk: Trees that pose a danger to staff or members of the public because of falling dry or diseased branches, or structural instability.
Impact on infrastructure: Risk of potential damage to buildings, sidewalks, equipment, or vehicles.
Safety and surveillance: Obstruction of the visibility of security cameras where relocating them is not possible.
Impact on public services: Interference with power lines or the water supply.
Institutional infrastructure: In the event of an impact on critical infrastructure, a technical opinion must be requested from General Services before any intervention.
Maintenance: Preventive work and landscaping at the facilities.
2. Pruning vs. felling Pruning: The removal of one or more branches or other parts of a tree that remains alive and standing, carried out in accordance with technical judgment to address one or more of the grounds indicated in section 1.
Felling (Tala): The complete removal of a standing tree by cutting its trunk when, according to technical judgment, this is the only option for addressing one or more of the grounds indicated in section 1.
In addition to the above, it is essential to consider:
The Regional Administration is responsible for obtaining an appropriate and independent technical opinion that technically justifies the need for pruning or, as a last resort, felling, while ensuring compliance with the applicable legal procedures.
To ensure that the opinion is valid and sufficient, it must address the following:
The opinion must be issued by an expert (a forestry engineer or related professional with technical expertise in trees, duly registered with the relevant professional association, who evaluates the tree’s phytosanitary condition, ecological and environmental value, structural stability, and the actual risk it poses).
If the tree must be felled, the document must technically explain why pruning is insufficient and why felling is the only appropriate measure to mitigate the risk (e.g., progressive death of the root system, pathogens, imminent danger of falling onto people or critical infrastructure). It must also establish environmental compensation measures (e.g., planting new trees of native species).
This opinion will serve as the necessary technical support for any subsequent procedure, including dealings with the relevant environmental authorities (such as SINAC or the municipalities, as applicable).
If the tree obstructs the visibility of security cameras, the opinion must be validated or supplemented by the Security Department, which must certify that there is no technical possibility of relocating the devices.
If institutional infrastructure is affected, the General Services Department must be consulted so that it can confirm that the structure is compromised and support the need for intervention.
If the tree is located on a national highway, CONAVI is the authority that must authorize the intervention, and it has its own forestry engineering corps to conduct the technical assessment. Outside national highways, the institution itself is responsible for obtaining this independent technical opinion before proceeding.
3. Legal and environmental restrictions For every intervention, compliance with Ley Forestal N° 7575 and the restrictions in Decreto N° 25700 MINAE must be verified; that decree prohibits the felling of the following protected species:
| Common name | Scientific name |
|---|---|
| Ajo Negro | Anthodiscus chocoensis |
| Bálsamo | Myroxylon balsamum |
| Camíbar | Copaifera camibar |
| Caoba | Swietenia macrophylla |
| Cedro | Cedrela salvadorensis |
| Cedro real | Cedrela fissilis |
| Cipresillo | Podocarpus costaricensis |
| Cola de pavo | Hymenolobium mesoamericanum |
| Copo | Couratari scottrnorii |
| Cristóbal | Platymiscium pinnatum |
| Guayacán real | Guaiacum sanctum |
| Laurel negro | Cordia gerascanthus |
| Pinillo | Podocarpus guatemalensis |
| Quira | Caryotaphnopsis burgeri |
| Sandrillo | Paramachaerium gruberi |
| Tamarindón | Parkia pendula |
| Tostado | Tachigali costarricense |
Protection areas: The regulations in force for aquifer recharge areas, riverbanks, and protected zones must be observed. In this regard, Ley Forestal N°7575 provides as follows:
“ARTICLE 33.—Protection areas.—The following are declared protection areas:
ARTICLE 34.—Prohibition on felling in protected areas. The felling or removal of trees is prohibited in the protection areas described in the preceding article, except in projects declared by the Executive Branch to be of national interest (…).” External permits:
Municipality in the area: For trees on roads or municipal property.
CONAVI: For trees on national highways.
Electricity provider: When the tree affects power lines.
SINAC: Pruning does not require a permit, provided that it does not affect the tree’s health and at least 50% of the crown is retained.
If the intervention concerns a tree under environmental protection, the Administration must obtain special permits from the competent authorities.
