The Court resolved to inform the Legislative Assembly that Bill N°25.491 does affect the organization and operation of the Judicial Branch because it expands duties involving mining offenses, investigations, seizures, and forfeitures without providing the indispensable budget.

SummaryResumen

The Supreme Court of Justice adopted its report on Bill N°25.491, “Reform Law to Strengthen the Sanctions Regime of the Mining Code,” and concluded that the proposal does affect the organization and operation of the Judicial Branch. Although the reform does not formally alter judicial powers or conflict with judicial independence, the expansion of mining offenses, penalties, punishable circumstances, and seizure and forfeiture measures would increase the work of the Ministerio Público, the Organismo de Investigación Judicial (Judicial Investigation Agency), and the Defensa Pública (Public Defense Office). The Court emphasized the need for personnel, training, forensic examinations, laboratories, equipment, infrastructure, transportation, and safe storage of hazardous substances. Without adequate budgetary provision, workloads, delays, limitation-period risks, and internal-control risks could worsen. The report also made technical observations concerning criminal legality, proportionality, overlapping provisions, and the need for a written legal source identifying which chemical substances qualify as hazardous.

Key excerptExtracto clave

In conclusion, from the standpoint of criminal law, there are several significant amendments that are viable but whose adoption warrants full awareness of their implications. At the same time, they entail an increase in the duties that the Judicial Branch must perform, which cannot be met unless the indispensable budgetary provision is granted for that purpose. This is where the criminal-law reforms intersect with the institution’s budgetary possibilities and capacities, because without the latter, those reforms are destined to be purely declarative. For these reasons, for purposes of Articles 167 of the Political Constitution and 59 subsection 1° of the Organic Law of the Judicial Branch, it is appropriate to conclude that Bill N°25.491, entitled “REFORM LAW TO STRENGTHEN THE SANCTIONS REGIME OF THE MINING CODE (LAW Nº6797 OF 1982 AND ITS AMENDMENTS),” transmitted through official letter AL-CPAAGRO-1560-2026 dated 18 August 2026, demonstrably affects the organization and operation of the Judicial Branch. The reform is not limited to introducing new criminal offenses or increasing the penalties applicable to certain mining-related conduct; rather, because of the breadth of the conduct criminalized and the measures associated with investigation, seizure, and forfeiture of property, it expands the obligations and spheres of action of the Ministerio Público, Organismo de Investigación Judicial, and Defensa Pública. Justices Rueda, Salazar Alvarado, Araya, Garro, and Hess abstained from voting. The resolution was declared final.

ARTICLE XII Documents N°9208-2026, 9522-2026 and 9958-2026 In official letter N°AL-CPAAGRO-1560-2026 of 18 August 2026, Lic. Cinthya Díaz Briceño, Area Head of the Ordinary Standing Committee on Agricultural Affairs of the Legislative Assembly (Asamblea Legislativa), requested this Court’s opinion on the bill entitled “Law Reform to Strengthen the Sanctioning Regime of the Mining Code (Ley N°6797 de 1982 y sus reformas),” file Nº25.491.

This Court’s deadline for submitting the requested report expires on 10 September 2026.

The consultation was referred for study to Justice Rafael Segura Bonilla, who submitted the required report by official letter 11-700-2026 of 3 September 2026.

President Justice Aguirre states: “Article XII concerns a legislative consultation on the bill entitled ‘Law Reform to Strengthen the Sanctioning Regime of the Mining Code (Ley N°6797 de 1982 y sus reformas),’ legislative file Nº25.491.

We will give the floor to Justice Segura so that he may present that report to us.

Yes, we already have it here; it has already been noted.” Justice Segura states: “Thank you, good morning. You can hear me, correct? Thank you.

Good morning to my colleagues and to those who, in one way or another, are watching or listening to us.

JUSTICE CHACÓN ENTERS.

The report is actually SI-69-2026 and concerns legislative file N°25.491, entitled: ‘Law Reform to Strengthen the Sanctioning Regime of the Mining Code.’ I prepared the report in, let us say, two parts, and I will state at the outset that it does affect the structure and organization of the Judiciary (Poder Judicial).

JUSTICE OLASO DISCONNECTS FROM THE VIDEOCONFERENCE SYSTEM.

JUSTICE VARELA ENTERS.

Although it is true that some provisions of the Mining Code are amended, I could divide it into two parts. One involves a change to the work performed by the Judicial Investigation Agency (Organismo de Investigación Judicial), the Public Prosecution Service (Ministerio Público), and the Public Defense Office (Defensa Pública), as those bodies themselves indicated when their opinions were requested and as the Legal Directorate likewise notes.

The second part, which you have before you and which I believe was sent on Thursday or Friday, consists of proposed corrections concerning these provisions, or each of the articles proposed for amendment.

JUSTICE ALFARO ENTERS.

Accordingly, with respect to the relevant issue, principally the substance of the matter, which is the amendment, I wish to adopt the observations made specifically by the acting deputy director of the Organismo de Investigación Judicial concerning the changes to their work.

JUSTICE OLASO ENTERS.

I place this in the context of the budget cuts made day after day in relation to the work that we perform as the Judiciary, without losing sight of the fact that the auxiliary bodies—the Organismo de Investigación Judicial, Ministerio Público, and Defensa Pública—are part of the Judiciary and its budget.

JUSTICE SOLANO DISCONNECTS FROM THE VIDEOCONFERENCE SYSTEM.

I quote: ‘Regarding the operational impact, the bill affects the procedures, workloads, and operational or human resources of the office consulted. I am referring to the Organismo de Investigación Judicial, and the following is stated: the reform is not limited to introducing new criminal offenses or increasing the penalties applicable to certain conduct connected with mining activity.

Rather, because of the breadth of the conduct defined as criminal and the measures associated with the investigation, charging, and forfeiture of property, it expands the obligations and scope of action of the Organismo de Investigación Judicial in investigating mining offenses.

JUSTICE SOLANO ENTERS.

In addition to investigating the criminal conduct addressed by the reform, the foregoing entails the need to carry out actions related to the identification, documentation, seizure, and possible forfeiture of machinery, equipment, vehicles, chemical substances, minerals, and other property connected with the unlawful activity.

This could create new operational, technical, and interinstitutional coordination needs for the Organismo de Investigación Judicial.

Regarding the budgetary impact, from the forensic technical perspective of the Department of Forensic Sciences, the possible implementation of new expert examinations would have a significant budgetary impact. This could include the acquisition of additional analytical instruments; modification of electrical and air-conditioning systems; adaptation of physical spaces; purchase of reagents, reference materials, and consumables; and assessment of existing forensic capacity to determine whether it is sufficient to meet the new demand.

From the technical investigative perspective, the Department of Criminal Investigations would have a substantial impact on the institution. Implementation would require the creation and/or strengthening of working groups.

This would encompass personnel in investigative positions, investigative supervisors with the corresponding training, administrative staff, forensic science professionals, police, administrative, technological, and laboratory equipment, technology licenses, physical infrastructure, and the creation and/or expansion of spaces—meaning laboratories, offices, and storage facilities—as resources additional to those already available.

Even at present, shortcomings and deficiencies exist in each of these areas and have not been remedied. On the contrary, temporary solutions that had been contemplated have had to be discontinued, while others are being considered for termination, including the termination of appointments of administrative staff, investigative supervisors, experts, and operational advisers.

It should be noted that the bill’s own statement of reasons quotes former Minister of Public Security Mario Zamora as stating that the presence of Fuerza Pública personnel in the area represented a monthly cost of nearly one million dollars.

If we were to use this estimate as a reference, we must point out that this amount did not include analysis of the evidence or specialized equipment for protecting or storing the materials. We could therefore estimate that the Organismo de Investigación Judicial’s operating expenses could be much higher because they would have to be sustained over time.

Nevertheless, the bill allocates no specific budget line to the Organismo de Investigación Judicial, making it impossible to meet its requirements.

Merely by way of illustration, destroying one fifty-kilogram barrel of cyanide currently costs three million colones, and there are records of approximately thirty barrels being seized in a single operation. Destruction alone could therefore amount to ninety million colones, without considering the expenses that may be incurred for transportation—three hundred fifty thousand colones per truck for an approximate distance of thirty kilometers within the Greater Metropolitan Area—which would be multiplied if the seizure occurred in a rural area, where most investigations take place, or storage costs of thirty-five thousand colones per day for that quantity.

Presented in this manner, this single operation could consume twenty percent of the monthly expenditure estimated by former Minister of Public Security Mario Zamora.

It is not sufficient to provide that this cost will later be charged to the convicted persons, because these are operational needs that must be addressed immediately, while judgments may be issued months or years after the seizure.

Moreover, such collection would depend on the investigated persons’ ability to pay, and it is highly common for them to claim that they lack sufficient financial resources.

As a basic exercise, we set out only some of the minimum resources needed in this area that are currently unavailable.

One, personal protection for investigative personnel: suits, gloves, masks, gowns, goggles, and helmets, all specialized for this field, as well as decontamination of personnel, equipment, and work areas due to the handling of hazardous materials.

Two, transportation: vehicles and specific equipment for the safe transport of seized property.

Three, storage: equipped spaces for the safe custody of hazardous materials and substances.

Four, investigation: personnel, training, drones, air transport, four-wheel-drive vehicles, a budget for operating expenses, controlled purchases, payments to collaborators, and travel allowances.

According to the information cited, approximately three thousand two hundred persons may be engaged in illegal gold extraction in at least three areas of the country.

The activity is spread broadly across the territory, covering approximately eighty square kilometers, making it difficult to assess and contain. Investigating it requires extensive human resources to identify individuals and their functions within the criminal structure, which has evolved from ordinary criminal activity into organized criminal activity.

This includes involvement in other related unlawful activities, such as human trafficking, sexual offenses, trafficking in drugs, weapons, and explosives, as well as environmental offenses such as illegal logging, hunting and trafficking in wildlife, diversion of rivers, and construction in watercourses. All of these offenses and methods complicate the investigation of the criminal activity occurring in an area with difficult access and adverse circumstances involving the local resident population itself.

Furthermore, because this is a technical and scientific investigation, the investment required for evidence analysis must be considered, including laboratories, technical professionals, and specialized equipment.

Regarding internal control, from the forensic technical perspective, implementation of this legislation could create internal-control risks if the law is enacted without a prior assessment of the needs described above.

The foregoing could result not only in an increase in the number of requests for expert examinations, with the resulting demand for human, technical, and financial resources, but also in a greater diversity of specialized analyses, whose implementation must be guaranteed under standards of scientific validity and technical quality.

And b, from the operational investigative perspective, implementation is not feasible without an infusion of resources in all areas. Otherwise, risks would be assumed that undoubtedly undermine efficiency and also complicate the effectiveness of supervision by management, with the consequences this could have for the proper use of resources and efficiency, as well as the risk of corruption.

It is estimated that the bill creates risks for current control mechanisms. What can be established is that, as the offenses to be investigated by the Organismo de Investigación Judicial are expanded, that agency may expand or extend its internal controls over both investigative matters and seizure or forfeiture.

Regarding institutional powers, the reform does not assign new powers to the Organismo de Investigación Judicial, because investigating crimes is among its fundamental functions. However, broadening the objective elements of mining offenses and the corresponding rules on forfeiture implies an increase in the handling of environmental cases, affecting operational and forensic matters through an increase in requests for expert opinions.

It is important to mention that, if the necessary resources are unavailable, responsibility for enforcement falls heavily upon the Organismo de Investigación Judicial, creating a risk of inefficiency and procedural jeopardy.

This would indirectly affect independence, but the Organismo de Investigación Judicial states that it is not the technical body competent to provide a definitive opinion on that subject.

It concludes by stating that the proposed reform does have an operational impact on the Organismo de Investigación Judicial.

Regarding the Ministerio Público and the Defensa Pública, both similarly state that there is a risk to internal control and judicial independence because, without an identified operational budget for the Judiciary, the bill directly affects its structure and operation.

I repeat that, in addition, observations are made concerning each of Articles one hundred thirty-nine, one hundred forty-one, forty-two, forty-three, forty-four, forty-five, and forty-six that are proposed for amendment, but these are merely technical matters.

You may refer to those observations so that the presentation of the report does not become too tedious. Ultimately, its conclusion is that, from the standpoint of the Judiciary’s structure and operation, there is a clear impact.

I repeat, I am well aware that some colleagues—and on some occasions I myself—have taken the position, when amendments to criminal offenses are involved, that there is no substantial impact. But in the Judiciary’s current circumstances, and given the proposal to amend these articles of the Mining Code, the structure and operation of the Judiciary are indeed affected. That is my opinion, and the requested report is presented accordingly.

Thank you very much, and have a good day.” President Justice Aguirre states: “The report is open for discussion.

If there are no observations, we will approve the proposed report, adopt that opinion as the Court’s own, and declare the decision final so that it may be communicated to the Asamblea Legislativa.

All of this is subject to the abstention of the justices of the Constitutional Chamber (Sala Constitucional), as we had already noted here.” With no objection from the justices present, it was decided: To adopt Justice Segura’s report and bring it to the attention of the Ordinary Standing Committee on Agricultural Affairs of the Asamblea Legislativa in response to the consultation submitted, expressly indicating that the bill under consultation does affect the organization and operation of the Judiciary. Justices Aguirre, Rivas, Vargas Vásquez, Leiva, Zamora, Sánchez, Varela, Olaso, Chacón, Solano, Alfaro, Vargas González, Segura, and Herrera López voted accordingly.

The report reads as follows:

“For your consideration, I refer to official letter SI-69-2026, in which I was asked to provide an opinion on the bill entitled ‘Law Reform to Strengthen the Sanctioning Regime of the Mining Code (Ley N°6797 de 1982 y sus reformas).’ I respectfully state that, in my view, the cited bill does not entail any modification of the Judiciary’s powers or of the constitutional principles governing it, principally its independence. To that extent, there is no objection to its possible enactment, which falls within the exercise of the powers enjoyed by our Asamblea Legislativa. However, insofar as it is not accompanied by an adequate budget to address the new duties conferred, it would affect the structure and organization of the Judiciary.

This is because, as noted by the representatives of the Ministerio Público, Defensa Pública, and Organismo de Investigación Judicial, the possible statutory amendment adds a series of powers and duties, which are detailed below:

  • 1)According to the representative of the Ministerio Público, although the bill under analysis does not entail the modification or elimination of powers conferred upon the Ministerio Público and does not directly or indirectly affect judicial independence, it does affect the Ministerio Público’s workloads and operational and human resources. This is because the reform seeks to introduce new operative verbs defining the prohibited conduct, which would increase the workload of prosecutorial staff, who already have limited capacity to handle pending cases; it would generate additional costs for the Ministerio Público because of the need for more prosecutorial and technical personnel to address the indicated increase in workloads and the specialized training that would be required; and, likewise, it would increase the probability of risks to the Ministerio Público’s internal control, including the expiration of limitation periods in cases, judicial delay, a continuing increase in the pending caseload, deterioration in human-talent management, and loss of human talent.

b- According to the Acting Deputy Director General of the Organismo de Investigación Judicial, although the bill does not assign new powers to the Organismo de Investigación Judicial because investigating crimes is among its fundamental functions, it has an operational and budgetary impact and would weaken the Organismo de Investigación Judicial’s internal control for the following reasons:

Regarding operational impact: Does the bill affect the procedures, workloads, or operational or human resources of the office consulted?

(…) the reform is not limited to introducing new criminal offenses or increasing the penalties applicable to certain conduct connected with mining activity. Rather, because of the breadth of the conduct defined as criminal and of the measures associated with the investigation, seizure, and forfeiture of property, it expands the obligations and scope of action of the Organismo de Investigación Judicial in investigating mining offenses.

[…]

Regarding the budgetary impact: Would implementation of the bill generate additional costs for the office consulted? (Including, but not limited to, expenses for technology, recruitment of personnel, adaptation of infrastructure, or training.)

From the forensic technical perspective of the Department of Forensic Sciences: the possible implementation of new expert examinations would have a significant budgetary impact. This could include the acquisition of additional analytical instruments; modification of electrical and air-conditioning systems; adaptation of physical spaces; purchase of reagents, reference materials, and consumables; and assessment of existing forensic capacity to determine whether it is sufficient to meet the new demand.

From the technical investigative perspective of the Department of Criminal Investigations:

It would have a substantial impact on the institution; its implementation would require the creation and/or strengthening of working groups, encompassing personnel in investigative positions, investigative supervisors with the corresponding training, administrative staff, forensic science professionals, police, administrative, technological, and laboratory equipment, technology licenses, and physical infrastructure (creation and/or expansion of spaces, meaning offices, laboratories, and storage facilities). These resources would be additional to those already available, even though shortcomings and deficiencies currently exist in each of these areas and have not been remedied. On the contrary, temporary solutions that had been contemplated have had to be discontinued, while others are being considered for termination (termination of appointments of administrative staff, investigative supervisors, experts, and an operational adviser).

We could therefore estimate that the OIJ’s operating expenses could be much higher because they would have to be sustained over time. Nevertheless, the bill allocates no specific budget line to the OIJ, making it impossible to meet its requirements. Merely by way of illustration, destroying one barrel (50 k) of cyanide currently costs three million colones (₵3.000.000), and there are records of approximately 30 barrels being seized in a single operation. Destruction alone could therefore amount to 90 million colones (₵90.000.000), without considering the expenses that may be incurred for transportation (₵350.000 colones per truck for an approximate distance of 30km within the GAM, which would be multiplied if the seizure occurred in a rural area, where most investigations take place) and storage (₵35.000 colones per day for that quantity). Presented in this manner, this single operation could consume 20% of the monthly expenditure estimated by former Minister of Public Security Mario Zamora.

As a very basic exercise, we set out only some of the minimum resources needed in this area that are currently unavailable:

• Personal protection for investigative personnel: suits, gloves, masks, boots, goggles, and helmets, all specialized for this field. Decontamination of personnel, equipment, and work areas due to the handling of hazardous materials.

• Transportation: vehicles and specific equipment for the safe transport of seized property.

• Storage: equipped spaces for the safe custody of hazardous materials and substances.

• Investigation: personnel, training, drones, air transport, four-wheel-drive vehicles, a budget for operating expenses, ‘controlled purchases,’ payments to collaborators, and travel allowances.

According to the information cited, approximately 3200 persons may be engaged in illegal gold extraction in at least three areas of the country, with the activity spread broadly across the territory (approximately eighty square kilometers), making it difficult to assess and contain. Investigating it requires extensive human resources to identify individuals and their functions within the criminal structure, which has evolved from ordinary criminal activity into organized criminal activity involving other related unlawful activities, such as human trafficking, sexual offenses, trafficking in drugs and weapons, and explosives, as well as environmental offenses such as illegal logging, hunting and trafficking in wildlife, diversion of rivers, and construction in watercourses.

Regarding the risk to internal control: Could the bill weaken or expand current control mechanisms? Would it create additional risks to the internal control of the office consulted?

a. Forensic technical aspect: Implementation of this legislation could create internal-control risks if the law is enacted without a prior assessment of the needs described above. The foregoing could result not only in an increase in the number of requests for expert examinations, with the resulting demand for human, technical, and financial resources, but also in a greater diversity of specialized analyses, whose implementation must be guaranteed under standards of scientific validity and technical quality.

b. Operational investigative aspect: Implementation is not feasible without an infusion of resources in all areas.

Regarding institutional powers: Does the bill entail the creation, modification, or elimination of powers conferred upon the body consulted?

The reform does not assign new powers to the Organismo de Investigación Judicial because investigating crimes is among its fundamental functions. However, broadening the objective elements of mining offenses and the corresponding rules on forfeiture implies an increase in the handling of environmental cases, affecting operational and forensic matters through an increase in requests for expert opinions.

Regarding judicial independence: Would enactment of the bill directly or indirectly affect judicial independence, as assessed from the perspective of the powers of the body consulted?

It is important to mention that, if the necessary resources are unavailable, responsibility for enforcement falls heavily upon the Organismo de Investigación Judicial, creating a risk of inefficiency and procedural jeopardy and indirectly affecting independence. However, this body is not the competent technical entity for issuing a definitive opinion on that subject.

It concludes by stating that the proposed reform does have an impact on the Organismo de Investigación Judicial in terms of operational matters, forensic technical matters, and the investigation of new offenses and forfeitures; a budgetary impact on existing forensic capacity, new purchases, and demand for new expert examinations, as well as on the handling of the offenses covered by the bill; and a weakening of internal control through the creation of new risks.” c- According to Mr. Juan Carlos Pérez Murillo, Director of the Defensa Pública, the proposed reform does not indicate a risk to internal control or judicial independence in the bill. However, the disproportionate increase in the ranges of penalties for criminal offenses, which does not allow the penalty to be tailored to the particular circumstances of the possible conduct, together with the creation of aggravating circumstances and new punishable situations, means that actions previously outside the scope of criminal investigation must now be investigated.

This affects the Judiciary’s budget and operations because more resources must be allocated to prosecuting conduct that was not previously criminal, increasing the workload, which also affects response times and the maintenance of materials used, including possible expert examinations. For this reason, he considers that the provisions of the legislative bill would have a budgetary impact on the Judiciary.

Furthermore, in my capacity as a justice specializing in criminal matters, I will identify the criminal-law issues that must be carefully weighed.

In that regard, I respectfully note the following:

  • 1)The proposed reform of Article 139 expands the criminal offense to encompass all extraction, exploration, and exploitation of metals or minerals in the subsoil and alluvial deposits, compared with the current provision, which covers only national parks, biological reserves, or wildlife conservation areas. Likewise, anyone who organizes, finances, or directs such activities will be deemed subject to that prohibition and will be given the same sentencing range as the direct perpetrators, even where there is no co-perpetration. This establishes a sui generis offense, insofar as commission of the principal act is not required for prosecution, which is accepted by criminal-law doctrine.
  • 2)Proposed Article 140 establishes a special element of subjective culpability, namely positive knowledge of the unlawful origin of the materials involved in the activities described therein (first paragraph), together with the additional element of specific intent to obtain profit for purposes of the aggravated penalty (final paragraph). From the standpoint of Criminal Law, there are no objections regarding those matters.
  • 3)Proposed Article 141 has characteristics that should be noted. First, it is an abstract-endangerment offense, because commission of the actions referred to therein is sufficient—regardless of the danger or harm they cause—for the offense to be deemed complete. Second, where “other hazardous chemical substances” are mentioned, account must be taken of the principle of legality in criminal matters established by Article 39 of the Political Constitution, which imposes the Lex Stricta rule. This means that determining what constitutes “a hazardous substance” cannot be left to interpretation or analogy. Accordingly, a mechanism referring to a written source of provisions—such as a regulation or executive decree—must be established to determine which substances are hazardous. Finally, it must be borne in mind that the criminal subtype in the final paragraph establishes an offense of anticipated completion with respect to the phrase “attempt to introduce,” because a mere attempt is sufficient for the defined conduct to be deemed committed.
  • 4)I have no observations regarding Article 142 of the reform.
  • 5)Regarding Article 143 of the proposed reform, the following should be observed. It refers to promoting, financing, and facilitating a series of objects or advantages for the conduct of illegal mining, and it is therefore unclear how this differs from the final paragraph of Article 143 of the bill, which also covers financing those unlawful activities. The issue is even more complex because the same penalty applies—four to eight years’ imprisonment—so the penalties are not proportionate as between the ordinary case and the special case, which is more serious. In other words, there is not only an issue of overlap between provisions, but also equal penalties for conduct that supposedly embodies different degrees of wrongdoing, because in the second case there is not merely financing but also the provision of material or organizational facilities, indicating greater complexity in the activity. The article also provides for punishment of a preparatory act, namely the “promotion” of the activity. This warrants careful examination because it advances criminal prosecution to conduct that is still far from threatening the legally protected interest. It should be added, however, that this is an accepted criminal-law mechanism when the interests threatened are difficult to restore, as in the present case. It should also be borne in mind that a sui generis offense is introduced here as well, by elevating to a principal act what would otherwise be accessory participation, namely facilitation—which otherwise would constitute complicity requiring a principal act by another person. Finally, the last paragraph, concerning organized crime cases, is unnecessary because it refers to legislation that itself establishes the situations and procedural consequences applicable to “organized crime” cases, without any need for the Mining Code to provide for its application.
  • 6)Regarding Articles 144, 145, and 146 of the bill, I have no observations.

In conclusion, from the standpoint of Criminal Law, there are several significant amendments that are viable but whose implementation must be undertaken with full awareness of what is being changed. At the same time, they entail an increase in the tasks that the Judiciary must perform, which cannot be met unless the indispensable budgetary funding is provided for that purpose. This is where the criminal-law reforms intersect with the institution’s budgetary possibilities and capacities, because without the latter, those reforms are destined to remain purely declaratory.

In view of the foregoing, I consider that, for purposes of Articles 167 of the Political Constitution and 59 subsection 1° of the Organic Law of the Judiciary (Ley Orgánica del Poder Judicial), it is appropriate to conclude that bill N°25.491, entitled ‘LAW REFORM TO STRENGTHEN THE SANCTIONING REGIME OF THE MINING CODE (LEY Nº6797 DE 1982 Y SUS REFORMAS),’ transmitted through official letter AL-CPAAGRO-1560-2026 of 18 August 2026, demonstrably affects the organization and operation of the Judiciary. This is because the reform is not limited to introducing new criminal offenses or increasing the penalties applicable to certain conduct connected with mining activity. Rather, because of the breadth of the conduct defined as criminal and of the measures associated with the investigation, seizure, and forfeiture of property, it expands the obligations and scope of action of the Ministerio Público, Organismo de Investigación Judicial, and Defensa Pública.” - 0 - Justices Rueda, Salazar Alvarado, Araya, Garro, and Hess abstained from voting. The decision is declared final.
