In session N° 27-2026, held on June 15, 2026, Article XI, paid leave (permiso con goce de salario) was granted to Justice Vargas Vásquez for June 23 and 24, 2026, as well as authorization for Monday the 22nd of the current month, after the second hearing, for the outbound trip, and for Thursday the 25th of the current month for the return. The participation encompassed both the in-person session of the Ibero-American Commission on Environmental Justice of the Cumbre Judicial Iberoamericana, held in my capacity as Coordinator of said Commission, and the Regional Seminar for Judges and Justice Operators of Latin America and the Caribbean: "Justice, Biodiversity and Global Change: Building on the Legacy of the Amphictyonic Congress," held on June 23 and 24, 2026, in Panama City.

The activities were organized by the Ibero-American Commission on Environmental Justice of the Cumbre Judicial Iberoamericana, the International Union for Conservation of Nature (Unión Internacional para la Conservación de la Naturaleza, UICN), the Inter-American Institute for Justice and Sustainability (Instituto Interamericano de Justicia y Sostenibilidad, IIJS), the United Nations Environment Programme (Programa de las Naciones Unidas para el Medio Ambiente, PNUMA), the Supreme Court of Justice of Panama, and other international organizations specializing in environmental matters.

Both engagements are of particular institutional relevance, as they were carried out in my capacity as Coordinator of the Ibero-American Commission on Environmental Justice of the Cumbre Judicial Iberoamericana, Coordinator of the Specialized Environmental Working Group of the Central American and Caribbean Judicial Council, and Coordinator of the Institutional Environmental Management Commission of the Judiciary of Costa Rica, thereby strengthening the international presence of the Judiciary in high-level regional forums.

The seminar was held within the framework of the Bicentennial of the Amphictyonic Congress and the 56th Regular Session of the General Assembly of the Organization of American States (OAS), with the purpose of strengthening the capacities of female and male judges and justice operators of Latin America and the Caribbean in the areas of biodiversity, climate change, human rights, and environmental justice, in fulfillment of recommendation 64 of the United Nations Special Rapporteur on Climate Change (A/78/255, 2023). At that event, I participated as a speaker at the Second High-Level Panel entitled "Climate Change, Human Rights and Justice. Advisory Opinions (opiniones consultivas) and Emerging Judicial Standards," sharing the experience of the Judiciary of Costa Rica in the field of environmental justice and jurisprudential dialogue.

• 3)Development of the Agenda:

The Ibero-American Commission on Environmental Justice of the Cumbre Judicial Iberoamericana brought together the members of the Commission with the purpose of strengthening cooperation among the Ibero-American judiciaries in the areas of environmental justice, biodiversity, climate change, and human rights.

The Regional Seminar opened with an inaugural ceremony led by authorities from the Judicial Branch of Panama (Órgano Judicial de Panamá), the International Union for Conservation of Nature (IUCN), the United Nations Environment Programme (UNEP), the European Union, the Government of Sweden, and the Ministry of Environment of Panama, who underscored the importance of strengthening regional cooperation to address the challenges arising from climate change and the loss of biodiversity.

This was followed by the First High-Level Panel: "Global Change and Biodiversity: Threats, Solutions, and Opportunities for Justice," in which female and male justices and judges from Panama, Colombia, Brazil, and the Dominican Republic exchanged experiences on the challenges faced by judicial systems in responding to the environmental crisis through justice grounded in scientific evidence, ecosystem protection, and the guarantee of human rights.

During the first day, academic sessions were held aimed at strengthening the conceptual foundations of environmental justice, addressing topics related to the human rights approach, the role of science in judicial decision-making, the ethical and legal principles applicable to climate change and the loss of biodiversity, the sources of international environmental law, and strategic litigation.

The agenda also included a technical visit to the Panama Canal, used as a case study to analyze the relationship between strategic infrastructure, water resources, biodiversity, and sustainable development from a judicial perspective.

On the second day, I participated as a speaker at the Second High-Level Panel: "Climate Change, Human Rights and Justice. Advisory Opinions and Emerging Judicial Standards," alongside representatives of the Colombian Institute of Environmental Law, the Inter-American Juridical Committee, and specialists in international environmental law.

During my presentation, I set forth the experience of the Judiciary of Costa Rica in the development of environmental justice, the importance of international advisory opinions as tools for the interpretation and protection of human rights and the environment, and the strengthening of dialogue between national and international jurisdictions in addressing the challenges arising from climate change.

This was followed by a specialized session on Mitigation and Adaptation, in which regulatory strategies, climate finance, ecosystem-based adaptation, nature-based solutions, and legal liability arising from climate change were analyzed.

Finally, the Third High-Level Panel was held, dedicated to the challenges of global change, integration, and regional legal and judicial cooperation, as well as practical working sessions through case studies on the incorporation of international standards and advisory opinions in the resolution of environmental disputes, concluding with the identification of best practices to strengthen the administration of environmental justice in the region.

• 4)Conclusions and Recommendations:

Conclusions

The in-person meeting of the Ibero-American Commission on Environmental Justice strengthened regional coordination, enabled follow-up on adopted agreements, and defined strategic actions to continue advancing Ibero-American judicial cooperation in the field of environmental justice.

Environmental justice increasingly demands greater integration of scientific knowledge, human rights, and the judicial function in order to provide effective responses to the challenges of climate change and the loss of biodiversity.

Advisory opinions and international jurisprudence constitute fundamental tools for strengthening the judicial response to contemporary environmental challenges and for promoting a harmonized interpretation of human rights.

Cooperation among the judiciaries of Latin America and the Caribbean fosters the exchange of best practices, capacity development, and the construction of common criteria in the field of environmental justice.

The Judiciary of Costa Rica continues to consolidate its regional leadership through the coordination of the Ibero-American Commission on Environmental Justice and its active participation in high-level international initiatives.

The case studies and technical sessions conducted during the seminar demonstrated the importance of incorporating scientific evidence and interdisciplinary approaches in the resolution of environmental disputes.

Recommendations Follow up on the decisions taken by the Ibero-American Commission on Environmental Justice and promote their implementation through cooperative actions among the judiciaries of the region.

Continue strengthening specialized training processes directed at female and male judges and judicial staff in the areas of environmental justice, biodiversity, climate change, and human rights.

Promote the incorporation of international standards, advisory opinions, and comparative jurisprudence as supporting tools for the judicial function.

Strengthen regional exchange of best practices and experiences through the Ibero-American Commission on Environmental Justice and other international cooperation mechanisms.

Continue advancing the development of the Institutional Environmental Policy and the initiatives led by the Institutional Environmental Management Commission of the Judiciary.

Maintain the active participation of the Judiciary of Costa Rica in international spaces for cooperation and in preparation for the IUCN 2027 World Congress on Protected and Conserved Areas, with the aim of continuing to position the national experience in the field of environmental justice.

En sesión N° 27-2026 celebrada el 15 de junio del 2026, artículo XI, se concedió permiso con goce de salario a la magistrada Vargas Vásquez, para el 23 y 24 de junio del 2026, así como autorización por el lunes 22 de los corrientes después de la segunda audiencia para la ida y por el jueves 25 del presente mes para el regreso. Comisión Iberoamericana de Justicia Medioambiental de la Cumbre Judicial Iberoamericana en Panamá y actividad paralela: Seminario Regional para Jueces y Operadores de Justicia de América Latina y el Caribe: “Justicia, Biodiversidad y Cambio Global: Construyendo sobre el legado del Congreso Anfictiónico”.

• 2)Contextualización:

La participación comprendió tanto la sesión presencial de la Comisión Iberoamericana de Justicia Medioambiental de la Cumbre Judicial Iberoamericana, realizada en mi condición de Coordinadora de dicha Comisión, como el Seminario Regional para Jueces y Operadores de Justicia de América Latina y el Caribe: "Justicia, Biodiversidad y Cambio Global: Construyendo sobre el legado del Congreso Anfictiónico", efectuados los días 23 y 24 de junio de 2026 en la ciudad de Panamá.

Las actividades fueron organizadas por la Comisión Iberoamericana de Justicia Medioambiental de la Cumbre Judicial Iberoamericana, la Unión Internacional para la Conservación de la Naturaleza (UICN), el Instituto Interamericano de Justicia y Sostenibilidad (IIJS), el Programa de las Naciones Unidas para el Medio Ambiente (PNUMA), la Corte Suprema de Justicia de Panamá y otras organizaciones internacionales especializadas en materia ambiental.

Ambas intervenciones son de especial relevancia institucional por cuanto se realizaron en mi condición de Coordinadora de la Comisión Iberoamericana de Justicia Medioambiental de la Cumbre Judicial Iberoamericana, Coordinadora del Grupo Especializado de Trabajo Ambiental del Consejo Judicial Centroamericano y del Caribe y Coordinadora de la Comisión de Gestión Ambiental Institucional del Poder Judicial de Costa Rica, fortaleciendo la presencia internacional del Poder Judicial en espacios regionales de alto nivel.

El seminario se desarrolló en el marco del Bicentenario del Congreso Anfictiónico y del 56.º Período Ordinario de Sesiones de la Asamblea General de la Organización de los Estados Americanos (OEA), con el propósito de fortalecer las capacidades de juezas, jueces y operadores de justicia de América Latina y el Caribe en materia de biodiversidad, cambio climático, derechos humanos y justicia ambiental, dando cumplimiento a la recomendación 64 del Relator Especial de Naciones Unidas sobre Cambio Climático (A/78/255, 2023).En esa actividad, participé como ponente en el Segundo Conversatorio de Alto Nivel denominado "Cambio Climático, Derechos Humanos y Justicia. Opiniones Consultivas y Estándares Judiciales Emergentes", compartiendo la experiencia del Poder Judicial de Costa Rica en materia de justicia ambiental y diálogo jurisprudencial.

• 3)Desarrollo de la Agenda:

La Comisión Iberoamericana de Justicia Medioambiental de la Cumbre Judicial Iberoamericana, reunió a las y los integrantes de la Comisión con el propósito de fortalecer la cooperación entre los Poderes Judiciales iberoamericanos en materia de justicia ambiental, biodiversidad, cambio climático y derechos humanos.

El Seminario Regional con una ceremonia inaugural encabezada por autoridades del Órgano Judicial de Panamá, la Unión Internacional para la Conservación de la Naturaleza (UICN), el Programa de las Naciones Unidas para el Medio Ambiente (PNUMA), la Unión Europea, el Gobierno de Suecia y el Ministerio de Ambiente de Panamá, quienes destacaron la importancia de fortalecer la cooperación regional para enfrentar los desafíos derivados del cambio climático y la pérdida de biodiversidad.

Seguidamente se desarrolló el Primer Conversatorio de Alto Nivel: "Cambio Global y Biodiversidad: amenazas, soluciones y oportunidades para la justicia", en el que magistradas, magistrados y jueces de Panamá, Colombia, Brasil y República Dominicana intercambiaron experiencias sobre los retos que enfrentan los sistemas judiciales para responder a la crisis ambiental mediante una justicia basada en evidencia científica, protección de ecosistemas y garantía de los derechos humanos.

Durante la primera jornada se llevaron a cabo sesiones académicas dirigidas a fortalecer las bases conceptuales de la justicia ambiental, abordándose temas relacionados con el enfoque de derechos humanos, el papel de la ciencia en la toma de decisiones judiciales, los principios éticos y jurídicos aplicables al cambio climático y la pérdida de biodiversidad, las fuentes del derecho ambiental internacional y el litigio estratégico.

La agenda incluyó además una visita técnica al Canal de Panamá, utilizada como estudio de caso para analizar la relación entre infraestructura estratégica, recursos hídricos, biodiversidad y desarrollo sostenible desde la perspectiva judicial.

El segundo día participé como ponente en el Segundo Conversatorio de Alto Nivel: "Cambio Climático, Derechos Humanos y Justicia. Opiniones Consultivas y Estándares Judiciales Emergentes", junto con representantes del Instituto Colombiano de Derecho Ambiental, el Comité Jurídico Interamericano y especialistas en derecho internacional ambiental.

Durante mi intervención expuse la experiencia del Poder Judicial de Costa Rica en el desarrollo de la justicia ambiental, la importancia de las opiniones consultivas internacionales como herramientas para la interpretación y protección de los derechos humanos y del ambiente, así como el fortalecimiento del diálogo entre jurisdicciones nacionales e internacionales para enfrentar los desafíos derivados del cambio climático.

Posteriormente se desarrolló la sesión especializada sobre Mitigación y Adaptación, en la que se analizaron estrategias regulatorias, financiamiento climático, adaptación basada en ecosistemas, soluciones basadas en la naturaleza y responsabilidad jurídica derivada del cambio climático.

Finalmente, se llevó a cabo el Tercer Conversatorio de Alto Nivel, dedicado a los desafíos del cambio global, la integración y la cooperación jurídica y judicial regional, así como sesiones prácticas de trabajo mediante estudios de caso sobre la incorporación de estándares internacionales y opiniones consultivas en la resolución de conflictos ambientales, concluyendo con la identificación de buenas prácticas para fortalecer la administración de justicia ambiental en la región.

• 4)Conclusiones y Recomendaciones:

Conclusiones

La reunión presencial de la Comisión Iberoamericana de Justicia Medioambiental permitió fortalecer la coordinación regional, dar seguimiento a los acuerdos adoptados y definir acciones estratégicas para continuar impulsando la cooperación judicial iberoamericana en materia de justicia ambiental.

La justicia ambiental demanda una integración cada vez mayor entre el conocimiento científico, los derechos humanos y la función jurisdiccional para ofrecer respuestas efectivas frente a los desafíos del cambio climático y la pérdida de biodiversidad.

Las opiniones consultivas y la jurisprudencia internacional constituyen herramientas fundamentales para fortalecer la respuesta judicial frente a los retos ambientales contemporáneos y promover una interpretación armonizada de los derechos humanos.

La cooperación entre los Poderes Judiciales de América Latina y el Caribe favorece el intercambio de buenas prácticas, el desarrollo de capacidades y la construcción de criterios comunes en materia de justicia ambiental.

El Poder Judicial de Costa Rica continúa consolidando su liderazgo regional mediante la coordinación de la Comisión Iberoamericana de Justicia Medioambiental y su participación activa en iniciativas internacionales de alto nivel.

Los estudios de caso y las sesiones técnicas desarrolladas durante el seminario evidenciaron la importancia de incorporar evidencia científica y enfoques interdisciplinarios en la resolución de conflictos ambientales.

Recomendaciones Dar seguimiento a las decisiones tomadas por la Comisión Iberoamericana de Justicia Medioambiental y promover su implementación mediante acciones de cooperación entre los Poderes Judiciales de la región.

Continuar fortaleciendo los procesos de capacitación especializada dirigidos a personas juzgadoras y personal judicial en materia de justicia ambiental, biodiversidad, cambio climático y derechos humanos.

Promover la incorporación de estándares internacionales, opiniones consultivas y jurisprudencia comparada como herramientas de apoyo para la función jurisdiccional.

Fortalecer el intercambio regional de buenas prácticas y experiencias mediante la Comisión Iberoamericana de Justicia Medioambiental y otros mecanismos de cooperación internacional.

Continuar impulsando el desarrollo de la Política Ambiental Institucional y las iniciativas lideradas por la Comisión de Gestión Ambiental Institucional del Poder Judicial.

Mantener la participación activa del Poder Judicial de Costa Rica en los espacios internacionales de cooperación y preparación hacia el Congreso Mundial de Áreas Protegidas y Conservadas de la UICN 2027, con el propósito de seguir posicionando la experiencia nacional en materia de justicia ambiental.
